"국가를 당사자로 하는 계약에 관한 법률" 시행령 제9조 1항 제3호 및 같은 법 시행규칙 제5조 제2항에 근거 전기공사의 예정가격의 결정기준은 (1)거래실례가격 (2)표준품셈 (3)표준시장단가 (4)견적가격 등 4가지 방법을 사용하고 있다. 특히 표준시장단가제도는 이미 수행한 공사의 계약단가만을 고려하여 발표하는 "실적공사비"제도를 계약단가, 입찰단가, 시공단가 등을 고려한 "표준시장단가"제도로 2015년 3월 1일부로 개정되었다. 제도는 시행되었으나 표준시장단가의 산정기준, 절차 및 방법 등 세부적인 제도가 미흡한 상황이다. 따라서 과거 실적공사비 산정방식을 검토하되, 계약단가, 입찰단가, 시공단가 등을 고려한 합리적인 표준시장단가의 산정방식을 제시함으로써, 예정가격결정시 적정공사비를 확보하고, 원 하도급간의 거래가격 투명성 및 객관성을 통해 전기공사의 품질 및 안정성이 확보될 것으로 사료된다.

Existing specifications of road pavement require contractors to meet only materials and construction conditions regardless of pavement life. There are limitation of developing road pavement technology and possibility causing dispute between ordering organization and contractor with this type of specification. Research efforts to introduce performance warranty contracting are in progress in the field of road pavement to improve the problems. The performance warranty contracting gives the contractors opportunity to select materials and construction methods as they like. But they should satisfy a certain level of performance during a given period. The performance indicator and threshold value of pavement which are main elements of the warranty specification should be defined first to introduce the performance warranty contracting successfully. In this study, the performance indicator, threshold value, and warranty duration of asphalt pavement were investigated by reviewing literatures on performance warranty contracting of some states of the US. Major distresses influencing the performance of the asphalt pavement were investigated at 24 national expressway lines and national highway lines in 16 regions, and the data were analyzed to be compared to the cases of the US. Development of rational performance warranty specification for domestic asphalt pavement is expected based on the research results.

The Purpose of this paper is to compare workfare system in UK with in Australia from the view point of social contract theory. There are two kinds of social contract theory - Hobbesian and Kantian theory. In view of these two types, this paper makes a comparative study of New Deal in UK and Mutual Obligation in Australia. The results of analysis can be summarized as follows. Firstly, in this respect of compulsive program formation background, Mutual Obligation and New Deal is all similar with Hobbesian social contract theory. Secondly, With regard to concern for the disadvantaged, Mutual Obligation is among Hobbesian social contract but New Deal is among Kantian social contract. Lastly, concerning orientation of compulsion, Mutual Obligation is close to Hobbesian social contract but New Deal is close to Kantian social contract.

현행 생명보험업계는 중복가입계약에 대한 정보교환제도를 시행함으로써 잠재적 위험에 대한 위험평가를 하고는 있으나 실제 언더라이팅 과정에서는 효율적인 활용을 못하고 있다. 따라서 언더라이팅 실무 입장에서 현행 정보교환제도의 문제점을 파악하고 각 보험회사가 취할 수 있는 효율적인 대응방안을 제시할 필요성이 대두되고 있다. 현행 정보교환제도의 문제점을 크게 몇가지로 나눌 수 있다. - 교환기준에 미달하는 다수의 계약건을 가입한 경우 위험평가 불가 - 위험평가상 고지의무에 충실한 계약자의 상대적 불리 - 정해진 기준과 다른 임의적 기준적용 등 선별적 자료교환으로 위험선택에서 배제된 잠재적 위험들의 계속적인 계약 및 지급 등 역선택 방조기능 - 실시간 반영된 정보부재 및 교환된 자료만으로 one-stop 위험평가를 할 수 없는 어려움 내재 - 정보교환에 대한 전체적 참여노력 부족 및 자기정보에 대한 방어와 자체 활용 이런 문제점들을 인식하고 이에 대한 효율적 대응방안을 제시해 본다. - 언더라이팅 측면에서 판매채널 다변화, 업무겸업화 둥 대외 환경변화에 따른 위험분석 및 평가, 위험분산을 위한 multi-player로서의 언더라이터 양성 필요 - 지급, 조사건의 분석 및 통계화 등 feed back 기능 강화통한 언더라이팅 활용 - 방문진단 통한 적부기능 활용 또는 모집자 사정평점제 등 언더라이팅 과정에서 활용할 수 있는 위험평가 자료축적 - 영업환경적 측면에서 고보장 상품의 경쟁적인 개발제한 - 정보교환제도 측면에서 정보교환 기준 변경 및 교환내용 추가 및 공동의 계약인수 guideline 필요 - 진단거절체, 표준미달체, 사절체 등 새로운 정보교환의 추진 필요 - 종합적인 피보험자의 정보를 획득할 수 있는 피보험자 종합정보의 데이터 구축 및 활용 효율적인 위험관리 외에도 각 보험회사별로 역선택 위험에 대한 심각성을 인식하고 업계간 정보교환에 적극적인 참여와 노력이 필요하며 잠재적 위험평가를 하는데 있어 계약자에게는 객관적 근거없이 불편을 갖지 않도록 언더라이팅 서비스하는 것 또한 중요하다. 지속적인 피보험자의 위험통계축적으로 잠재위험에 대한 보다 객관화된 위험평가를 할 수 있는 언더라이팅 기법을 체득함으로써 언더라이팅 경쟁력을 갖을 수 있다.

기획재정부가 모든 공사에 하도급지급확인제 실시 등 국가계약 회계예규를 개정하고 지난 9월 8일부터 시행에 들어갔다. 개정된 회계예규의 주요 내용은 $\Delta$하도급대금 지급 확인제도 도입 $\Delta$최저가낙찰제공사 PQ시 지역업체 참여도 반영 $\Delta$국가계약법 시행령 시행규칙 개정에 따른 후속 조치 등이다. 대한설비건설협회는 회원사의 원활한 하도급 공사대금의 확보와 부당한 공사대금의 수령을 막기 위해 그동안 관련 제도 마련을 관계기관에 지속적으로 건의한 결과, 기획재정부가 회계예규를 개정하여 국가기관이 발주하는 모든 공공공사에서 원도급자의 하도급대금 지급내역 및 하도급자의 하도급 대금 수령내역을 발주기관 및 공사감독관이 직접 대조·확인토록 하는 하도급대금지급 확인제도를 도입한 것이다. 이 제도의 도입으로 앞으로 발주기관이 원도급자의 하도급공사대금의 공정한 지급여부를 직접 확인함으로써 하도급자의 공사대금 적기수령에 도움이 될 것으로 기대된다.

This study aims to analyze the influence relationship between the level of fringe benefits and relational contract among social workers in the non-profit organization. Under this relationship, we explored the dual mediating effect of perceived superior's support and perceived organizational support. A total of 371 self-administered questionnaires were distributed to social workers in Gwangju, South Korea, and 271 questionnaires (73.0%) were used for study analysis after excluding incomplete and unreliable responses. This study performed structural equation modeling, the results are as follows. Perceived superior's support and perceived organizational support both have a positive (+) influence on relational contract. Furthermore, perceived superior's support and perceived organizational support were found to mediate effect between fringe benefits and relational contract. Therefore, these results contribute to provide academic meaning that the range of future studies by identifying the dual mediated effect of the fringe benefits and social worker 's relational contract.

재정경제부는 지난 4월 28일 정부계약제도 개선안을 확정하고 29일부터 1천억원 이상 대형공사를 제외한 공공공사의 낙찰 하한율을 동전보다 2.8$\~$10$\%$ 상향조정토록 한 적격심사기준을 개정했다. 또 10억원 미만 소규모 시설공사는 시공실적을 평가하는 한편 기존업체와의 역차별을 해소하기 위해 시공실적에 가산점을 부여하게 된다.

정부가 공공 건설공사의 하도급계약 체결 자료를 일반에 공개하는 내용의 제도 개선을 추진한다. 불법 하도급을 통해 비자금을 조성하지 못하도록 하기 위한 것으로 발주기관에 거짓 하도급계약 자료를 제출하면 입찰참가자격이 제한된다. 국민권익위원회는 지난해 11월 28일 이런 내용을 담은 '공공 건설공사 불공정 하도급계약 개선 방안'을 마련해 기획재정부 등 8개 정부부처와 지방자치단체에 권고했다.

최저가낙찰제 확대, 연대보증인제도 폐지 및 계약보증금율 인하, 지역의무공동도급 대상금액 상향 등을 주요 내용으로 하는 국가계약법 시행령 시행규칙이 지난 7월 22일 개정되었다. 국가계약법 시행령 시행규칙은 오는 10월 22일부터 시행된다.
