건축물 용도변경제도와 허가절차 개선 방향

  • 건축법이 올 정기국회에서 개정될 예정이다. 이를 위해 건설교통부는 지난 7월 10일 입법예고 하고 법제처 및 관계부처 협의를 진행중인 것으로 알려졌다. 입법예고 내용중 상업지역 공동주택에 대한 일조기준 폐지 및 건축물의 일조기준을 남쪽기준으로 변경, 허가기준 고시, 피난 및 내화 등의 건축기준을 설계기준으로 고시, 사전승인대상(21층이상 10㎡이상)을 시도에서 직접 허가가능토록 하는 등 절차와 기준에 대한 대폭적인 변경이 예상되고 있다. 그러나 무엇보다도 일반인의 관심을 끌었던 것은 일간신문에서 중점보도한 "용도변경이 자유로워져 건축물을 마음대로 사용할 수 있다"와 "건축인허가시 건축사확인으로 허가 가능한 대상이 확대된다"는 것이었다. 따라서 용도변경제도와 허가제도의 개정 내용과 이를 시행시 발생하는 문제점과 함께 개선방안, 선결되어야 할 문제와 관련, 병행해서 개정되어야 할 과제 등을 살펴보고 바람직한 제도개선 방향에 대해서도 제안해 본다.

  • This study is a basic research on looking onto bringing performance warranty contract into the country, to consider the usage in architecture which it is usually used on road pavement in developed countries. The study will also apply performance warranty contracts on public private partnerships through examination and analysis of various matters which will lead to globalization of the korean architecture industry, the increase of quality of result, better convenience for the orderer, the decrease of cost, and the acceleration on research for technical development.

Operation Direction of Regional Architectural Safety Center through Analysis of Japanese Building Confirmation System (일본의 건축확인제도 분석을 통한 지역건축안전센터의 운영 방향 설정)

  • To prevent illegal building work in advance, regional building safety centers were introduced to perform technical investigations and management. The purpose of this study is to propose the detailed operational directions of the regional building safety center through the analysis on the current status of parameters, such as the operation of designated confirmation and inspection bodies in Japan. We consider the role, building administrative process and establishment criteria of regional building safety centers through the analysis the introduction background and the designation criteria of designated confirmation and inspection bodies. In establishing the center's professional manpower qualifications, we refer to the criteria for the professional qualifications of the designated confirmation and inspection bodies. In addition, the calculation method of required manpower of verification inspectors in Japan was used as a reference in setting the scale of regional professional manpower. Finally, we propose the detailed operational directions of the regional building safety center such as (1)roles of the center, (2)establishing management plan of the center, (3)work scope (4)scale of the professional manpower, (5)qualification of the professional manpower, and (6)funds.

  • 본지에서는 최근 논란이 되고있는 대형건설업체의 설계용역업허용요구와 관련해 건축설계업과 건설시공간의 상호관계 및 역할분담 등에 관한 선진외국의 사례들을 모아 조사ㆍ확인함으로써 건설업체의 이같은 주장에 대한 부당성을 지적하고 이를 통해 우리 현실에 맞는 제도로 발전시켜 나가고자 한다. 또한 이번 조사내용은 국내건축문화 발전의 건전한 풍토조성과 국제경쟁력 강화를 위한 방안을 모색하는데 귀중한 자료로 삼고자 한다.

  • In recent decades, unpredictable earthquakes around the world have caused massive damage. The incidence of earthquakes in Korea that are larger than M5.0 has increased the social demand for earthquake policies. As the seismic performance of buildings has been proven to be the most effective damage mitigation responsibility from past earthquake damage cases, the US and Japan are implementing a seismic retrofitting support system. In Korea, this is being implemented through tax benefits, but it is being neglected by the owners of private buildings. As a solution to this problem, this paper reviews, compares, and analyzes the domestic and overseas seismic retrofitting support systems, and suggests ways to improve the policy and support system for revitalizing the seismic retrofitting of private buildings based on the results.

법령과 규칙 - 온돌 및 난방설비 설치 확인서 개정

  • 건축물에 설치하는 온돌 및 난방설비는 국토해양부령으로 정하는 기준에 따라 안전 및 방화에 지장이 없도록 하는 내용으로 건축법 제63조가 개정(법률 제8662호, 2007. 10. 17. 공포, 2008. 1. 18. 시행)됨에 따라 온돌 및 난방설비의 구체적인 설치기준을 정하는 한편, 그 밖에 현행 제도의 운영상 나타난 일부 미비점을 개선 보완하기 위해 건축물의 설비기준 등에 관한 규칙 제4조가 지난 2008. 7. 10일 신설(관련 별표1, 별지제2호서식 신설)되었다. 본지는 이 내용에 대한 회원사의 문의가 많기에 건축물의 설비기준 등에 관한 규칙개정 주요 내용 및 단서사항 등을 게재하니 회원사들의 참고 바란다.

  • As buildings are changing variously from the side of use, efficiency and size, the construction qualities are more importantly recognized. Supervision system was enacted in the Residential Building Law in 1990 and responsibility supervision system in the Construction Engineering Management Law in 1994, respectively. However, recently revised supervision system in 2003 has some limitations: the present problems of appointing supervisor, disposing the supervisors, supervisor's works. Therefore, the aim of this study is to improve the present supervision system for mix-use residential building. By implementing the proposed revised supervision system, it will be able to expect quality improvement, confidence of the owner and the user, development of construction technology, and increase international competitiveness of supervision company.

A Study on Legal and Institutional Improvements for the Digital Transformation of Construction Supervision (건축공사 감리업무의 디지털 전환을 위한 법·제도 개선안 연구)

  • This study reviewed the existing legal framework governing construction supervision practices and conducted a survey of expert groups to identify and propose strategies for facilitating the digital transformation of construction supervision processes, with the goal of enhancing the quality and safety of construction projects. The research underscored the necessity for digital transformation to improve quality, safety, and efficiency of construction supervision. Additionally, it highlighted the need for greater consistency and clarity in terminology related to construction supervision. The study also presented recommendations for improvement, which included: establishing a structured supervision checklist to ensure safety and compliance, establishing a specialized construction supervision corporations subject to qualification screening, and introducing evaluation criteria to encourage the adoption of digital transformation technologies in construction supervision. The findings of this study are intended to serve as the foundation for future policy and regulatory frameworks aimed at promoting the digital transformation of construction supervision practices.
