해상보험계약에서는 실무상 영국법 준거약관을 포함하고 있는 영국의 해상보험증권 및 협회약관을 사용하고 있으며, 이에 따라 관련문제가 발생하면 영국법 및 우리나라 법이 적용되게 된다. 이 경우 영국법은 외국법법률설에 따라 영국법도 법률이므로 법원은 직권으로 영국법을 조사하여 적용하여야 한다. 영국법이 적용되는 경우 영국법상 법률개념을 어떻게 이해하고 확정하여야 할 것인지가 문제가 되며, 따라서 그러한 법률개념은 영국에서 이루어졌던 논의 및 영국법 질서 전체와 관련하여 해석하고 확정되어야 한다.

The purpose of this study is to verify the applicability of concept mapping in the process of planning of network outcomes in social welfare. Planning and evaluation of network outcomes involve many stakeholders. Recognizing the value and range of individuals' perspectives in the creation of a common framework is one of the biggest methodological challenges for planning of network outcomes. Concept mapping is a kind of methodology that creates a stakeholder-authored visual geography of ideas from a group. It uses both a quantitative and qualitative approach, including brainstorming, structuring the statement, specific analysis and data interpretation methods to produce maps that can then be used to guide planning and evaluation efforts on the issues that matter to the group. 13 network managers who work in the social welfare centers in Busan are core participants. The 50 statements on network outcomes from brainstorming session fell into six distinct clusters. After the interpretation session these clusters were rated according to the seven rating scales. This paper explores applicability of concept mapping in the process of planning of network outcomes in social welfare. Concept mapping helps stakeholders with different value and ideas about network outcomes to consensus on common conceptual framework. In addition, a multidimensional conceptualization of network outcomes was made. It will assist in designing future outcomes evaluation and guide the evaluators through a selection of key activities and outcomes.

The purpose of this study was to analyze hierarchy for high school students' concepts about genetics. The assessment of genetics related concept was conducted for 10th and 11th grade students and a hierarchy map was schematized based on the evaluation result using Knowledge State Analysis Method. Some differences were found when comparing the result of whole students' hierarchy with hierarchy on 7th national science education curriculum. In analyzing hierarchy by grade, concepts of highest and lowest level turned out same but some concepts of middle level changed. In case of analysis of hierarchy for concepts about genetics by score, as score was higher, the number of concept in lower level became larger and the relationship among concepts became more structurized. Following studies are required to develop specific teaching strategies for having effective genetics concept and conduct case study of applying the concept hierarchy through this method to class in the field.

1999년 7 월부터 시행된 "전자거래기본법"은 전자문서와 전자거래의 효력을 법적으로 인정하고 있다. 그러나 본 법률이 제정될 당시 UNCITRAL의 전자상거래 모델법(1996)을 그대로 답습하여 영미 법계와 달리 대륙법계인 우리 나라의 실정에는 맞지 않는 조항이 포함되고 법률의 체계도 기본법 체계라고 보기에는 어려운 법률제정체계 문제점도 등장하고 있다. 이에 따라 본 연구에서는 전자문서의 개념과 데이터, 기록물 등의 다른 개념과의 관계 재정립을 통한 전자문서의 정의재조명과 동법에서의 "전자거래" 개념의 해석을 통한 전자거래 개념의 발전방향을 살펴본 후 현재 동법과 전자서명법과의 관계해석을 통해 법제정 추진체계 및 방향에 대하여 검토하였다. 전자문서와 관련해서는 기존의 문서개념과 기능을 생각하건대 현재 각종 법률에서 언급되고 있는 전자문서의 개념은 제한적으로 해석되어야 한다. 문서라는 개념을 넘어서는 새로운 개념도입이 필요하다면, 디지털컨텐츠의 포함한 전자적 기록 내지 전자적 매시지라는 개념도입이 불가피하다. 그러나 이러한 방식은 재산권을 표상하는 정보(컨텐츠, 화폐가치의 정보 등)와 기존의 문서와 서면을 대신하는 정보를 혼합시켜 이해하게 만들어 오히려 해석상 혼란을 가중시킬 수 있다. 따라서 기존의 문서나 서면을 대체하는 '전자문서'라는 개념은 그대로 사용하되, 기타 정책목적상 필요하다고 판단되는 디지털 컨텐츠, 화폐가치를 표상한 정보(전자화폐, 전자자금 정보 등) 등은 개별법률에서 이에 관한 정의를 하고 규율을 하는 것이 바람직할 것이다. 전자거래와 관련해서는 본 개념을 전자문서와 관련시켜 파악해서는 안된다는 것을 전제로 강학적 의미로 전자거래의 해석부분은 이해를 하되, 특정한 법률에는 그 법률제정목적에 맞는 전자거래의 개념정의를 통해 법률제정 내지 개정목적을 달성하면 될 것이다. 전자거래를 포괄하는 법률은 가능하지도 않고 이것이 가능하다 하더라도 결국 포함되어야 하는 전자거래 관련 규정을 선별하는 것도 쉽지 않을 것이다.

This study aims to present a conceptual model for technology valuation based on market approach. We first propose a transition model in which technology itself is endowed with its intrinsic value based on its technology- and market-specific features, which subsequently goes through a transition to the market perceived value. We also discuss the model's logical validity. Based upon the transition model, we develop market approach based technology valuation models by identifying factors comprising each component of the transition model for each case of fixed royalty and running royalty. We also show that the proposed model can be used to describe the relationship between cost, income and market approaches for technology valuation.

Caregiving supports have been provided to decrease caregiving burdens of families of children with disabilities, but there are needs for improving caregiving services. The purpose of this study was to conceptualize content items and domains of caregiving supports from the perspectives of parents and service providers in order to help families of children with disabilities to decrease their caregiving burdens. This study used concept mapping that was useful for service-needs identification and program development. First, focus group interviews with two parent groups and one service provider group were conducted to generate a total of 31 items. Also, they sorted the items in terms of conceptual similarity and rated the items in terms of their needs. Next, the sorting data were analyzed using multidimensional scaling and cluster analysis and the rating data were calculated for mean. The results provided 31 content items in four domains: regular caregiving, activity-based caregiving, parent empowerment for caregving, and strengthening family relationships. All the domains were rated as important to decrease caregiving burdens. This study has practical implications for improving caregiving services and the related policies.

The purpose of this study is to develop program that take a genuine interest in science and motivate students to keep up their study for science gifted children of start period. In this study, we develop and apply the program about sinking and floating for elementary science gifted students, and analyse degree of conceptual change. Students' prior knowledge is analysed for developing the program, and each step is settled about concept of density and buoyancy. Conceptests are arranged into step by step, and we apply the program to 26 science gifted students of 6th grade elementary school. We compare a percentage of correct answers of pre-test and post-test and evaluate Hake gain for analysis of degree of conceptual change. As a result, science gifted students' concepts are changed effectively into scientific concepts by program based on peer instruction for gifted students of start period. And they evaluate the program is novel and useful, also they can be motivated by the program.

The aim of this essay is to identify elements of methodologies to investigate the development of Newtonian dynamics. This methodology involves the transformation and synthesis of preceding theories. My essay attempts to confirm my assertion by analyzing historical case of Newton's discovery of his dynamics. While discovering his mechanistic theory, Newton reconstructed theoretical concepts and structures of intellectual predecessors, such as Aristotle, Descartes, Galileo, and Kepler. Newton's synthesis was possible only after carefully reconstructing the appropriate and useful ideas of previous natural philosophers' ideas. As a result, Newtonian dynamics are completed with these modified and integrated concepts incorporated into Newton's law of motion and space-time concepts. This study consists of two parts. First, Lakatos' research program has been applied in order to analyze the structure of Newtonian dynamics. Second, the aforementioned methodologies of discovery are distilled from the case study.

The culpability of a person, as determined by due process of law, for any of his actions that are defined as criminal. Determination of such responsibility is a legal function, not a psychiatric one, although a psychiatrist may be called upon to present evidence to the court in order to aid the judge or jury in reaching a decision as to responsibility. Determination of responsibility varies with the laws of the state in which the accused is being tried, but in general all states base their laws on three famous judicial decisions concerning criminal responsibility. 1. the M'Naghten(McNaughton) rule(a. to establish such a defense the accused, at the time the act was committed, must be shown to have been laboring under such defect of reason as not to know the nature and quality of the act he was doing, b. if he did know it, he did or know that what he was doing was wrong). 2. the irresistible impulse test. 3. the Durham decision. Under the Durham test, however, the psychiatrist may give any relevant testmony concerning the mental illness at issue. The psychological and behavioral appearance of a person, in clinical psychiatry this term is commonly used to refer to the results of the mental examination of a patient. The purpose of this study is to develop and apply materials to teach about reflection of light by peer instruction. These which consist of both hands-on experiments and ConcepTests based on students' preconceptions found in previous researches are inducing active interaction between peers during instruction. Data from 29 university students were rate of correct answer of pre and post tests, results of conceptests before and after peer discussion, homework for strengthening their conceptual changes, and RTOP result for analysis of learners' perception about this method. Learners' preconceptions on reflection of light and position of image are changed effectively into scientific concepts. And they evaluate this teaching method helps conceptual understanding and interaction of an instructor and learners.
