Electronic commerce and the Internet offer unprecedented opportunities. The explosive expansion of the use of the Internet makes it possible for businesses to expand their markets and render services. Global transaction costs are easy to cut off using Internet and transaction speed is faster than before. Where cyberspace is not free from claims, Offline transaction can lead to problems and disputes the same is for cyberspace transactions. However ADR is not meet for the online transaction for speed, cost and open network system, ODR methods to resolve electronic commerce conflicts is crucial for building confidence and permitting access to justice in an online business environment. The use of the Internet and the network in dispute resolution has an impact on the types of communication implied in the relevant processes such as automated negotiation, online mediation and online arbitration and involves new technological issues such as the integrity and confidentiality of data and communication used to transmit and store data. Among the ODR systems Online Arbitration is currently binding both parties disputed and can achieve the aim of dispute award the same as the traditional arbitration. Arbitration is based on the New York Convention 1958, Arbitration Model law 1985 and national Arbitration Act that are founded on territorial area and rested on arbitration agreement, constitution of the arbitral tribunal, due process, final and binding award and enforcement of the arbitration award. To compare with this issues Online arbitration has unnecessarily legal unstability and risk. ODR is the burgeoning field and has created a new issues. All such issues which have been debated in the ADR are composed with ODR. But these are not limited Some of issues are further complicated by the nature of the online environment such as confidentiality and principle of parties. It is true that online arbitration should comply with legal provisions, but which is impossible to adhere of the law. The letter of credit is quintessentially international. In the absence of international legal system, a private system based on banking practices has evolved, commanding the adherence of the international letter of credit community and providing the foundation of th reputation of this instrument. To maintain this international system, it is vital that international standard banking practice should not be subject to local interpretations that misconstrue or distort it. The UCP is a formulation of international standard banking practice. It is neither positive law nor a "contract term" in any traditional sense and its interpretation must be consonant with its character as a living repositary of international understanding in this field. As a result, the interpretation and application of specific articles of the UCP must be consistent with its evolving character and history and with the principles upon which sound letter of credit practice is predicated. This study, especially, focuses on article 13 and article 14 of the UCP500. Article 13(b) of UCP500 stipulates that banks will have a reasonable time, not to exceed seven days, to examine documents to determine whether they comply facially with the terms of the credit. The seven-day provision is not designed as a safe harbor, because the rule requires the issuer to act within a reasonable time. But, by virtue of the deletion of the preclusion rule in the document examination article in UCP500, however, seven days may evolve as something of a safe harbor, especially for banks that engage in strategic behavior. True, under UCP500 banks are supposed to examine documents within a reasonable time, but there are no consequences in UCP500 for a bank's violation of that duty. It is only in the next provision. Courts might read the preclusion more broadly than the literal reading mentioned here or might fashion a common-law preclusion rule that does not require a showing of detriment. Absent that kind of development, the change in the preclusion rule could have adverse effects on the beneficiary. The penalty, strict estoppel or strict preclusion, under UCP500 and 95UCC differs from the classic estoppel. The classic estoppel rule requires a beneficiary to show three elements. 1. conduct on the part of the issuer that leads the beneficiary to believe that nonconforming documents do conform; 2. reasonable reliance by the beneficiary; and 3. detriment from that reliance. But stict preclusion rule needs not detrimental reliance. This strict estoppel rule is quite strict, and some see it as a fitting pro-beneficiary rule to counterbalance the usually pro-issuer rule of strict compliance.
This study is focused on the problems and the suggestions of proper ideas for solving them which are arisen from appling CIF, Incoterms 1990 into the contract of sale after reviewing of the contents of traditional CIF contract and the main changes of CIF, Incoterms 1990. This study summerized as follows: First, when the seller provide the buyer with non-negotiable sea waybill or inland waterway document instead of negotiable bill of lading, it is my feeling that the essence of symbolic delivery in traditional CIF contract is fading. And if the buyer has paid for the goods in advance, or a bank wishes to use the goods as security for a loan extended to the buyer, it is not sufficient that the buyer or the bank be named as consignee in a non-negotiable document. This is true because the seller by new instractions to the carrier could replace the named consignee with someone else. To protect the buyer or the bank it is therefore necessary that the original instructions from the seller to the carrier to deliver the goods to the named consignee be irrevocable. Second, CIF term can only be used for sea and inland waterway transport. When the ship's rail serves no practical purposes such as in the case of roll-on/roll-off or container traffic, CIP term instead of CIF term is more appropriate to use. Third, the EDI method still contains many legal and technical problems to be solved in order to be used thoroughly' in the international sale of goods. Therefore, the parties wishing to replace the traditional paper-based trade documents by electronic messages must exchange the agreement on EDI each other in order to prevent and sol ye unexpected problems. Forth, it may be that the goods are to be carried in bulk without such marking or naming of consignee as would amount to appropriation. Then the risk will not pass until effective appropriation has been made. Therefore, the seller needs to appropriate by issuing of separate bills of lading or delivery orders for parts of the bulk cargo. And in case the goods are bought while they are carried at sea, some problems on the passing of risk would arise. One possibility is that the buyer might have to assume risks which have already occured at the time when the contract of sale is entered into force. The other possibility would be to let the pissing of the risk concide with the time when the contract of sale is concluded. The parties are advised to ascertain the applicable law and any solution which might follow there form. Finally, Incoterms are restricted to deal with the main principles for the division of functions, costs and risks between the parties and the rest is left to their individual contract as supplemented by the custom of the trade, the individual terms of the contract of sale and the applicable law. This study was initiated out of necessity to inquire into the trend of costume regulation between the mid-15th century and mid-17th century, and what influence the change of dress and its ornaments had on the people at the time. As for the resources this study was based on, the True Record of Joseon Dynasty, which was the historical record of official compilation, was used as basic material, and the excavated relics at the time were referred to. The forbidden dress and ornaments mentioned in the records from the time of King Seonjong to the time of King Hyeonjong were classified into textiles, clothes, ornaments and dresses, according to the objects. It was designed to identify the laws and ordinances or regulations enacted by the state and the contents of discussions, which were caused by the extensive consumption of silk gauze and fabrics and the luxury in dress and ornaments, and the phenomenon induced by the consumption desire of the social class with economic power, and to help understand the cause. So to speak, the law and ordinance or regulations were established to solve the social problems caused by the failure in controlling dress and ornaments wearing based on social position, during the process in which the king and court officials were making effort to intensify their political power in each regime.
본 연구는 '우주폐기물'(space debris)을 포한한 우주의 환경보호를 위한 국제우주법을 살펴보고자 하는 것인데, 1967년 우주조약을 포함한 1968년 구조협정, 1972년 책임협약, 1975년 등록협약, 1979년 달협정이 국제법상 우주에서의 환경문제를 다루는 조약이지만 이에 관하여 비교적 매우 적게 다루고 있다. 그 이유는 이 협약들이 제정될 당시 국가들은 우주활동의 기본규칙제정에 주로 관심을 쏟았지 우주활동과정에서 파생되는 환경훼손이나 위험요소에 관한 문제는 그리 심각한 문제가 아니었기 때문이다. 특히 1967년 우주조약은 '유해한 오염'(harmful contamination)이나 '유해한 방해'(harmful interference), '환경의 불리한 변화'(adverse changes in the environment)이라는 용어만 사용할 뿐 이것들에 대한 정의가 없으며, 1979년 달협정 역시 우주조약과 마찬가지로 '유해한 오염', '불리한 변화', '환경의 방해'(disruption of the environment), '유해한 영향'(harmfully affecting) 등과 같은 중요한 개념에 대한 정의를 내리지 못하고 있다. 이 두 협약은 구조협정과 등록협약과 함께 모두 '우주폐기물'(space debris)에 관하여 언급 하지 않고 있다. 또한 1972년 책임협약이 배상문제를 다루고 있지만 동 협약에서 규정하고 있는 우주물체(space objects)의 개념에 우주폐기물이 포함되는지의 여부도 Cosmos 954 사건의 선례에도 불구하고 아직 불분명하다. H. A. Baker도 우주환경에 대한 손해(damage to the outer space environment)는 책임협약의 범위를 넘는 것이며 결론적으로 책임협약이 우주폐기물을 다루는 협약인지는 불분명하다고 한 바 있다. 이러한 면에서 우주폐기물을 포함한 환경보호문제를 위하여 기존협약들을 수정 보완하는 별도의 추가의정서를 채택하거나 또는 별도의 조약을 제정하자는 필요성이 제기되는 것이다. 한편 COPUOS의 우주폐기물 경감에 관한 가이드라인이나 NPS원칙과 같은 UN 결의나 ILA 협약초안과 같은 협약의 초안들은 엄밀하게 말해서 법적 구속력은 없다. 다시 말해서 이것들은 국가들을 구속하는 법문서는 아니다. 현존하는 우주법에 관한 조약들의 관점에서 볼 때는 일종의 권고의 형태로써 우주관련조약들의 보충적 역할을 할 수 있을 뿐이다. 그럼에도 불구하고 많은 학자들이 이러한 결의 속에 나타난 몇 개의 원칙들은 국제관습법을 표명하고 있다고 주장하기도 한다. 예를 들어 우주에서의 NPS의 통지나 사용, 책임에 관한 규칙들은 법의 일반적 성격에 대한 기초를 형성하는 것으로 간주되는 '근본적으로 규범설적 성격'(a fundamentally norm-creating character)을 지닌 것으로 볼 수 있는데, 국가관행이 이를 더욱 증명해주고 있다. 이러한 결의들을 연성법(soft law)이라고 하는데 연성법은 경성법(hard law)인 조약의 부족한 부분을 보충해주고 있으며, 조약으로 발전하기도 한다. 또한 연성법은 국가들이 점차 수용할 때 그것은 국제관습법이 될 수 있으며 국제관습법은 모든 국가를 구속한다는 점에서 그 의의를 찾을 수 있다.
진단서는 의사등이 진찰결과에 관한 판단을 표시하여 작성하는 문서로서 민 형사소송 등에서 증거로 쓰인다. 특히 상해의 증명에서 그 기능이 현저하다. 법은 허위진단서작성을 형사처벌하는 등으로 그 증명기능을 보호하기 위하여 힘쓰고 있다. 그러나 몇 가지 이유에서 진단서가 진실과 부합하지 아니하는 경우가 생긴다. 첫째, 의사등의 제1차적 관심은 환자의 효과적인 진단과 치료인데, 그에 필요한 정보수집 및 판단의 방법이 법정 등에서 진실을 찾는 것과 다를 수 있다. 둘째, 의사등은 종종 환자의 진술 등에서도 판단에 필요한 정보를 얻는데, 환자와의 치료적 대화 관계 등의 유지를 위하여 그 진술 등의 신빙성을 의심하는 것이 부적절한 경우가 있을 수 있다. 이는 결국 의사등이 증명이 아닌 다른 목적으로 수집한 정보로부터 내린 판단을 증명에 전용(轉用)하여 생긴 문제이고, 비용이 낮은 진단서 제도를 버릴 수 없는 한 불가피한 한계에 해당한다. 진단서에 의한 증명에 표현증명의 효력을 부여하여야 하는 경우와 그 증명력을 자유심증주의에 터 잡아 개별적으로 심사하여야 하는 경우를 나누어 후자에 대하여는 전면적인 증명력 심사를 가하고, 진단서 서식 자체를 개선하여 법원이나 수사기관 등이 위 둘 중 어느 경우에 해당하는지를 가리는 데 필요한 정보가 이미 진단서 자체에 드러나게 하는 개선이 필요하다.
최근에 이동국(MS)위치에 대한 정확한 위치 추정이 많이 요구되고 있다. 하지만, 기존 방법을 사용한 위치 추정 방법에는 많은 문제를 가지고 있다. 기지국(BS)은 이동국(MS)에서 전파한 전파를 수신하여 시간 지연에 따른 거리를 측정하고, 이동국(MS)에 근접한 기지국(BS)들을 선택하여 기존의 삼각측정법을 사용하여 위치를 추정한다. 이 방법은 참 위치와 추정된 위치가 많은 오차를 보이고 있다. 본 논문은 이동국(MS)의 위치를 추정하기 위해서 주변 기지국(BS)들을 선택하는 방법과 코사인 제 2법칙을 사용하여 각도를 추정하여 이동국(MS)의 위치를 추정하는 방법을 제안한다. 시뮬레이션을 통해서 기존 방법과 제안한 방법의 비교 검토하여 제안한 방법의 우수성을 증명한다.
To ensure the effective operation of a curriculum, facilities and equipments should be properly supported. Therefore, changes are required for educational facilities in accordance with the curriculum, revised 10 times in total from 1945 to 2011, but it's true that the facility and equipment laws, which are the standards of facility and equipment changes, did not adapt to the changes. After 'the Act on Standards of School Facilities' was repealed, 'the Act on Establishment and Operation of the Schools,' the corresponding law for the purpose of spatial configuration for teaching and learning methods, was enacted in Sept. 1997. This law has been active for 14 years and revised 11 times thereafter. It has also been decided to often revise the curriculum, so the 7th National curriculum has undergone 6 times of minor revisions. Among them, the most recently revised 2009 curriculum is to be applied for elementary school 1st and 2nd grade, middle school 1st grade, and high school 1st grade from the beginning of this year of 2011. Hereupon, the purpose of this study is to research on the revisions of the school facility and equipment standards which can support the curriculum revised in 2009 and thereafter by examining classrooms and facilities as the learning space that can respond to the changes of school functions and systems with curriculum transition, of teaching and learning systems, and of subjects.
본 연구는 국내에서 발표된 다문화 가정 관련 간호연구 동향을 살펴보고 향후 간호연구 방향을 제시하기 위해 시행되었다. 다문화 가정의 여성, 남편, 자녀와 시어머니를 대상으로 한 2008년부터 2016년까지의 간호연구를 분석 하였다. 다문화 가정 관련 간호연구는 2011년 이후 꾸준히 증가되고 있었으며, 학술지 게재가 많았으나, 학위논문의 학술지 게재률은 낮았다. 순수 실험연구는 2014년 이후 시작 되었으며 실험연구의 대부분이 유사 실험연구이었다. 연구대상자는 결혼이주여성이 중심이었고 자녀, 남편, 시어머니, 부부에 대한 연구가 매우 부족하였다. 결혼이주여성의 출신국가에 따라 연구도구가 번역되어 사용되었으나, 타당도와 신뢰도 검증이 미흡하였으며, 통역사의 도움 없이 진행된 논문의 비율이 높았다. 이러한 연구결과를 바탕으로 향후 실험연구의 확대와 결혼이주여성의 모국어로 번역된 연구도구의 개발과 통역사의 활용이 필요함을 제언한다.
고령화 사회의 도래와 함께 폭발적으로 증가하는 사회복지시설에서의 화재안전은 매우 중요한 사회문제로 대두되고 있다. 근래에 발생했던 노인요양원의 화재를 계기로 사회복지시설에 대한 소방관련법과 기준을 분석하고, 사회복지시설 현장을 방문하여 현장실태조사 및 소방기술인, 교수, 시설운영자, 이용자들을 대상으로 설문조사를 실시한 결과를 분석하여 화재안전관리방안으로 법 개정을 통한 맞춤형 소방시설설치, 소방시설유지관리강화, 소방안전관리 및 관련시설 평가를 통한 소방안전관리방안을 제시하였다.
