A Study on the International Factoring Agreement for Improvement of Korean Civil Law (국제팩토링계약과 한국민법의 개선점에 대한 연구)

  • The trend of payment terms of an international trade has been changed from letter of credit to open account. In this regard factoring has come out to support SMEs in terms of financing on a without recourse basis. However, factoring is in Korea is not workable softly due mainly to legal system affecting smooth assignment of receivables. Therefore this study suggest the following solutions : Korean Civil Law shall be modified to protect factor's position as a right creditor to debtor and protect factor's position when perfection among several creditors are incurred. However, formal modification to this end would not be easy in short run and it is suggested that a special law be established in case a commercial receivable assignment both domestic and internationally happens between seller and factor.

  • Due to the construction technique (or the construction culture) growth in and out of Korea, newly-developed products have been continuously released. Furthermore, all legislation and regulation that the World follows are gradually becoming unified. (e.g. FTA(Free Trade Agreement) with the United States was contracted, and inevitable FTA contraction with EU and China ), For this reason, it is considered that Korean fire regulation on building interior materials needs to be reviewed and compared with that of international standard so that it becomes legitimate and reasonable one. Especially, this reference is going to make a description of building interior materials' Flame retardant performance standard.

Electret-based microgenerators under sinusoidal excitations: an analytical modeling

  • The fast-growing number of mobile and wearable applications has driven several innovations in small-scale electret-based energy harvesting due to the compatibility with standard microfabrication processes and the ability to generate electrical energy from ambient vibrations. However, the current modeling methods used to design these small scale transducers or microgenerators are applicable only for constant-speed rotations and small sinusoidal translations, while in practice, large amplitude sinusoidal vibrations can happen. Therefore, in this paper, we formulate an analytical model for electret-based microgenerators under general sinusoidal excitations. The proposed model is validated using finite element modeling combined with numerical simulation approaches presented in the literature. The new model demonstrates a good agreement in estimating both the output voltage and power of the microgenerator. This new model provides useful insights into the microgenerator operating mechanism and design trade-offs, and therefore, can be utilized in the design and performance optimization of these small structures.

  • 본 논문은 생산설비 PLC(Programmable logic Controller) 데이터의 실시간 공유 플랫폼을 설계한다. 이 플랫폼은 자동화 설비를 보유하고 운영 중인 수출집약 중소기업에서 FTA(Free Trade Agreement) 체결 수입 상대국의 원산지 증명을 위한 생산 시험성적서 제출에 활용할 수 있고, 생산설비의 OPC 서버가 갖는 실시간 데이터를 수집하는 라이브러리를 활용하여 MES(Manufacturing Execution System)에서 생성되는 다양한 실시간 데이터를 활용하여 그래프, 생산관리 모니터링 및 설비 관리를 가능케한다. 따라서 중소기업이 생산관리, 공정관리, PLC 데이터공유 등에 필요한 수준별 분야별로 실시간 제조운영관리 시스템의 확대 보급이 가능하고, 생산설비의 실시간 제어가 가능하도록 설계한다.

Fisheries Resources -A Brief Introduction of the Republic of Senegal

  • Fish is a major source of protein for the Senegalese population. Fishing plays a dominant role in the Government's policy towards generating employment. It currently generates about 100,000 direct jobs (fishermen) for nationals, of which more than 90% are in small-scale fishing. The fishing industry also contributes to Government revenue through different agreements. In addition to associated dues, fishing agreements imply a series of economic, trade and technical counterparts. Under the latest fishing agreement concluded by Senegal and the European Union (1997-2001), direct financial compensation amounts to about CFAF 32 billion. Despite its economic and social importance, the sector has to face serious disequilibria both in resource exploitation and market supply: the coastal demersal (deep lying fish) stocks with high market value (mostly exported) are fully and even over-exploited, with a serious risk of local market supply shortages looming ahead as the fishing effort shifts from locally consumed species to export-oriented ones.

  • 본 연구는 한미FTA 체결이 우리나라의 소프트웨어 산업에 미치는 영향에 대해서 논의하였다. 소프트웨어 산업의 현황을 패키지소프트웨어, IT서비스, 디지털콘텐츠 등으로 구분하여 경쟁력 및 대미 수출입을 중심으로 분석하고, 관련된 한미 FTA 협상 영역중에 통신 및 전자상거래, 서비스, 저작권, 그리고 정부조달 영역 등에 대해서 각각 소프트웨어 산업 부분에 파급되는 영향과 시사점을 도출하였다. 결론으로는 우리나라 소프트웨어산업의 자체 경쟁력을 제고하고 미국 관련 시장에 폭넓게 진출하기 위한 전략의 관점에서 소프트웨어 산업 관련 정책상의 제안이 제시되어 있다.

  • Virtualization technology opened a new era in the field of Data intensive, Grid and Cloud Computing. Today's Data centers are smarter than ever leveraging the Virtualization technology. In response to that, Dynamic consolidations of Virtual Machines (VMs) allow efficient resource management by live migration of VMs in the hosts. Moreover, each client typically has a service level agreement (SLA), leads to stipulation in dealing with energy-performance trade-off as aggressive consolidation may lead to performance degradation beyond the negotiation. In this paper we propose a Cloud Based CDN approach for allocation of VM that aims to maximize the client-level SLA. Our experiment result demonstrates significant enhancement of SLA at certain level.

  • FTA(Free Trade Agreement)는 체결국들의 자유로운 물자 이동을 기반으로 무역의 활성화와 외국자본의 직접투자를 통해 경제성장을 가져오는 중요한 협정이다. 그러나 FTA 협정의 체결조건에 따라 품목별 세율 등의 정보가 달라진다. 국제통일상품분류체계(Harmonized Commodity Description and Coding System)코드도 마찬가지로 국제 공동코드 영역인 6 자리까지 동일 하나, 7 ~ 10 자리까지는 각 국가에 의해 운영관리 되어, 국가별로 품목분류 방식이 달라진다. 또한, 품목분류코드가 갱신 될 때마다 연관 정보를 사용자에게 제공하고 있다. 그러나 우리나라와 FTA 체결국간 세부품목분류 방식이 달라 품목분류방식의 의미에 따라 담당자가 한 건씩 비교하고 맵핑하여, 많은 시간과 인력이 소모된다. 따라서, 의미를 갖는 품목분류코드를 맵핑하면서 발생하는 문제들이 있다. 이를 해결하기 위해, 이 논문에서는 품목분류코드 기반의 온톨로지 모델을 제안한다.

A Study on the Industrial Competitiveness of Ballast Water Management System in Compliance with the International Maritime Organization Ballast Water Management Convention in Korea (우리나라 선박평형수처리시스템(BWMS) 산업의 경쟁력 분석에 관한 연구)

  • In this study, we compared and analyzed the Revealed Comparative Advantage (RCA) and Trade Specialization Index (TSI) based on ballast water management systems (BWMS) trade data, which are related to the International Maritime Organization (IMO) Ballast Water Management Convention to suggest the current status of Korea's industrial competitiveness and suggest future development directions for the BWMS industry. As international interest in eco-friendly vessels is expanding, the IMO is engaged in dramatic discussions and agreement-making related to marine emissions of pollutants from ships. IMO member states that must implement this convention are striving to develop technology and secure industrial competitiveness as major industries in the eco-friendly shipping sector, with the BWMS industry experiencing a high market entry barrier and the possibility of the leading market entrants gaining leadership. The Republic of Korea accounts for 17 (approximately 38 %) of the 45 BWMS that received final approval as of October 2019. Based on trade data relating to product codes HS842219, HS84212, and HS89, the RCA index and TSI were calculated and compared. The findings revealed that the Republic of Korea has relative inferiority compared to countries such as Germany and Denmark. Despite this, Korea's favorable industrial environment, which includes several IMO-approved BWMS technologies and the possession of domestic certification institutions, is likely to strengthen its competitiveness in the BWMS market.

Methods to Introduce Criminal Remedies to Enahnce Effectiveness of Administrative Technology Misappropriation Investigation (기술침해 행정조사의 실효성제고를 위한 분쟁조정 방안 -형사적 구제방안을 중심으로-)

  • Small and medium-sized enterprises ("SMEs") are vulnerable to trade secret misappropriation. Korea's legislation for the protection of SMEs' trade secrets and provision of civil, criminal, and administrative remedies includes the SME Technology Protection Act, the Unfair Competition Prevention Act, the Industrial Technology Protection Act, the Mutually Beneficial Cooperation Act, and the Subcontracting Act. Among these acts, the revised SME Technology Protection Act of 2018 introduced the "administrative technology misappropriation investigation system" to facilitate a rapid resolution of SMEs' technology misappropriation disputes. On September 27, 2021, Korea's Ministry of SMEs announced that it had reached an agreement to resolve the dispute between Hyundai Heavy Industries and Samyeong Machinery through the administrative technology misappropriation investigation system. However, not until 3 years and a few months passed since the introduction of the system could it be used to resolve an SME's technology misappropriation dispute with a large corporation. So there arose a question on the usefulness of the system. Therefore, we conducted a comparative legal analysis of Korea's laws enacted to protect trade secrets of SMEs and to address technology misappropriation, focusing on their legislative purpose, protected subject matter, types of misappropriation, and legal remedies. Then we analyzed the administrative technology misappropriation investigation system and the cases where this system was applied. We developed a proposal to enhance the usefulness of the system. The expert interviews of 4 attorneys who are experienced in the management of the system to check the practical value of the proposal. Our analysis shows that the lack of compulsory investigation and criminal sanctions is the fundamental limitation of the system. We propose revising the SME Technology Protection Act to provide correction orders, criminal sanctions, and compulsory investigation. We also propose training professional workforces to conduct digital forensics, enabling terminated SMEs to utilize the system, and assuring independence and fairness of the mediation and arbitration of the technology misappropriation disputes.
