인터넷 개인방송 플랫폼상 미성년자 후원행위에 대한 법적 고찰 및 입법론적 개선방안 - 미성년자의 상대방 보호 필요성을 중심으로 - (Legal Study and Legislative Suggestions about Donation by Minors on Live Streaming Platforms - Focusing on protection of the counterparty -)

  • 최근 쌍방향성 통신 기술의 발달로 인해 인터넷 개인방송 플랫폼에 대한 수요가 증가하고 있다. 인터넷 개인방송은 시청자의 자율적인 후원금으로 수익을 창출하는데, 현재 후원행위에 관한 법률이 미비하다. 특히 미성년자가 후원을 하는 경우, 취소권을 행사할 수 있기 때문에 취소 과정에서 분쟁이 빈번하게 발생한다. 이때, 급부를 요구하는 후원행위의 경우, 일방적인 후원과 법적 성질 및 결과가 달라져 문제가 된다. 미성년자가 취소권을 행사하면 방송진행자는 급부 제공에 대한 보상은 받지 못한 채 후원금을 반환해야 하는 것이다. 본 연구는 통상적으로 증여로 인식되는 인터넷 개인방송 후원행위에서 쌍무계약성을 발견하고, 이로 인해 발생할 수 있는 방송진행자의 피해를 지적하며, 미성년자의 취소권이 배제되는 경우인 미성년자의 사술에 주목하여 관련 판례와 후원 절차를 검토하고, 미성년자의 취소권을 침해하지 않는 선에서 진행자를 보호하는 법리를 제시한다. 모호한 법리적 상황을 학문적으로 규명하고, 분쟁예방 절차를 제시하여 해당 산업에 긍정적인 영향을 가져올 수 있다.

Morphological redescriptions of three Cyrtohymena ciliates (Ciliophora: Sporadotrichida: Oxytrichidae) new to Korea

  • Three ciliate species of genus Cyrtohymena, C. australis Foissner, 1995, C. citrina (Berger & Foissner, 1987) and C. muscorum (Kahl, 1932) new to Korea, were collected from semi-terrestrial habitats. The description was based on the observation of live and silver stained specimens. Diagnostic characteristics of these species are as follows. C. autralis: size about $275{\times}100{\mu}m$ in live specimens. Cortical granules yellowish. 18-31 right and 31-40 left marginal cirri in number. Dorsal kineties eight rows. C. citrina: size about $180{\times}50{\mu}m$ in live specimens. Cortical granules yellowish. 26-32 right and 23-27 left marginal cirri in number. Dorsal kineties five to six rows. C. muscorum: size about $180{\times}60{\mu}m$ in live specimens. Cortical granules reddish. 31-34 right and 33-36 left marginal cirri in number. Dorsal kineties six rows. Three species of Cyrtohymena have been added to Korean ciliate fauna from this study. Including previous one species of C. quadrinucleata, four species of this genus in total have been recorded so far in this country.

한빈우(韓牝牛)의 생체중(生體重)과 장기중량(臟器重量)에 관한 연구(硏究) (Study on the Weight of Visceral Organs and Live Weight of Korean Native Cattle)

  • This study was conducted to determine the interrelationship between the weight of various visceral organs and the live weight of Korean native cattle with particular regard to female ones. One hundred and eighty-five of 2 to 6 years and one hundred and fifty-six Korean native cow of over 7 years of age were examined at the Busan slaughter house during the lest quarter of 1979. The results obtained are summarized as follows: 1. The average live weight of 72 years old cows examined was 297.09kg, while these weight of visceral organs such as liver, lung, heart, left kidney, right kidney and spleen being 4301.09, 2165.22, 1355.43, 346.74, 350 and 991.30g, respectively. The length, width and thickness of the spleen were 49.0, 12.92 and 2.95cm, respectively. 2. The average live weight of 3 years old cows examined was 306.56kg, while these weight of visceral organs such as liver, lung, heart, left kidney, right kidney and spleen being 4099.07, 2144.44, 1383.33, 326.85, 325.93 and 964.82g, respectively. The length, width and thickness of the spleen were 43.3, 12.37 and 2.80cm, respectively. 3. The average live weight of 4 years old cows examined was 314.67kg, while these weight of visceral organs such as liver, lung, heart, left kidney, right kidney and spleen being 4186.67, 2292.50, 1392.50, 346.67, 343.33 and 932.50g, respectively. The length, width and thickness of the spleen were 47.01, 12.55 and 3.08cm, respectively. 4. The average live weight of 5 years old cows examined was 328.90kg, while these weight of visceral organs such as liver, lung, hearts left kidney, right kidney and spleen being 4465.32, 2394.35, 1493.55, 370.16, 335.97 and 997.58g, respectively, The length, width and thickness of the spleen were 49.17, 12.76 and 3.16cm, respectively. 5. The average live weight of 6 years old cows examined was 334.97kg, while these weight of visceral organs such as liver, lung, heart, left kidney, right kidney and spleen being 4585.29, 2552.79, 1555.89, 364.70, 373.24 and 985.29g, respectively. The length, width and thickness of the spleen were 48.27, 12.66 and 2.78cm, respectively. 6. The average live weight of 156 cows (over 7 years of age) examined was 344.91kg, while these weight of visceral organs such as liver, lung, heart, left kidney, right kidney and spleen being 4730.77, 2651.44, 1554.39, 407.37, 409.42 and 1101.06g, respectively. The length, width and thickness of the spleen were 51.04, 13.21 and 3.08cm, respectively. 7. Total average live weight of 341 cows (from 2 to 6 and over 7 years of age) examined was 332.44kg, while these weight of visceral organs being 4550.95, 2497.13, 1500.76, 380.18, 382.27 and 1047.98g, respectively. The length, width and thickness of the spleen were 52.01, 12.96 and 3.02cm, respectively. 8. The correlation coefficients between the live weight of 341 cows and their visceral organs were found to be highly significant (P<0.01), except fort for the length of spleen

활어 컨테이너 장거리 수송시스템 운용 설계 (Operation design for long-distance live fish container transport system)

  • Fish exportation using airplanes incurs sizable logistics costs (12,000KRW/kg), according for more than 45% out of the total export cost. Thus, it is unreasonable to quantitatively expand fish exportation by means of air transport. In addition, cases of failing to deliver fish at the right time to the right place occurs frequently due to the limited cargo capacity and insufficient cargo space of airplanes, especially during the peak season. Therefor, a technology that not only minimizes the logistics costs but also transports fish freshly and safely, in the case of long distance exportation to countries such as the United States and Taiwan, should be developed. In this study, a live fish container control system for long distance transportation was designed and implemented. Live flatfish (2,000kg) were selected as the target fish, were transported to the United States to analyze and verify the performance of the a live fish container control ystem and transportation ability.

한약투여 및 의료용 거머리 요법을 병행 시술 후 관절 경직 및 부종이 호전된 국소 류마티즘 환자 증례 1례 (A Case of Live Leech(Hirudo Medicinalis) Therapy with Herbal Medication on Regional Rheumatoid Arthritis)

  • Objectives : The purpose of this study is to report the effect of live leech(hirudo medicinalis) therapy with oriental medication on the patient with regional rheumatoid arthritis. The patient had resistant to DMARDs so she was in the debilitating condition and suffered from edema, pain, stiffness of joint and purpura before live leech(hirudo medicinalis) therapy. Methods : The regional rheumatoid arthritis patient had edema, pain, stiffness of joint and purpura on right foot. We treated the patient with live leech(hirudo medicinalis) therapy and oriental medicine. Results : The symptoms of regional rheumatoid arthritis was improved through live leech(hirudo medicinalis) therapy and oriental medicine. The patient maintains her condition with oriental medicine treatment after stopped all DMARDs such as MTX(methotrexate) and NSAIDs. After this treatment the patient's walking difficulty has been improved. Conclusions : This study shows that live leech(hirudo medicinalis) therapy and oriental medicine can elevate the regional rheumatoid arthritis patient's quality of life with continuous health care and treatment for major problem. For more accurate studies, further studies would be needed with more cases.

  • Medical demand has been increased explosively since health insurance was introduced in 1977. Person has taken a growing interest in increase of medical service supply while that period. We must understand the legal aspects of medical quality management. There have been many legislative efforts for securing the right of patient. Patient's legal right is secured through the declaration of patient's right and all hospital person deal with patients according to the standard and criterion of the declaration of patient's right. The patient's right is set up on a basis of the right to live and the expectation right of patient. It is important to prevent medical accidents because the right of patient's health is violated by medical accident. We must manage well the medical quality to prevent the medical accident. The effort to escalate the medical quality is the best method to decrease the medical dispute. Nowadays a person take a growing interest medical quality. Our government make an effort to secure the medical quality through the legal system to be contained health organization evaluation system.

국제인권법 및 인권규범의 주거권 규정에 대한 연구 (A Study on the Right to Housing in International Human Rights Laws and Instruments)

  • 오늘날 인권은 국제법 체계에서 가장 복잡하면서도 두드러진 쟁점이며, 주거권도 세계인권선언을 비롯하여 국제인권규범에서 기본인권으로 인정되고 있다. 본 연구는 85개 국제인권법 및 인권규범을 대상으로 인권으로서 주거권 규정을 종합적으로 검토한다. 주거권 일반, 노동자의 주거권, 사회적 취약집단의 주거권, 국제지역기구의 주거권으로 나누어 국제규범에 나타난 주거권의 내용과 특징을 분석한다. 주거권은 보편성, 불가분성, 상호의존성이라는 인권일반의 성격을 마찬가지로 가지고 있으며, 적절한 주거권이란 단순한 물리적 공간의 보장이라는 의미를 넘어 점유의 법적 안정성, 생활편익시설의 이용가능성, 비용의 적정성, 입지의 적합성 등 총체적인 의미로 해석하고 있다. 다양한 규범에 나타난 주거권에 대한 접근은 발전권적 관점, 양성평등의 관점, 차별금지의 원칙, 참여권적 관점 등을 종합적으로 반영하고 있으며, 인간존엄 및 안정과 평화 속에서 주거생활을 향유하는 것을 지향하고 있다.

Assessment of deformations and internal forces in the suspension bridge under eccentric live loads: Analytical algorithm

  • Suspension bridges bear large eccentric live loads in rush hours when most vehicles travel in one direction on the left or right side of the bridge. With the increasing number and weight of vehicles and the girder widening, the eccentric live load effect on the bridge behavior, including bending and distortion of the main girder, gets more pronounced, even jeopardizing bridge safety. This study proposes an analytical algorithm based on multi-catenary theory for predicting the suspension bridge responses to eccentric live load via the nonlinear generalized reduced gradient method. A set of governing equations is derived to solve the following unknown values: the girder rigid-body displacement in the longitudinal direction; the horizontal projection lengths of main cable's segments; the parameters of catenary equations and horizontal forces of the side span cable segments and the leftmost segments of middle span cables; the suspender tensions and the bearing reactions. Then girder's responses, including rigid-body displacement in the longitudinal direction, deflections, and torsion angles; suspenders' responses, including the suspender tensions and the hanging point displacements; main cables' responses, including the horizontal forces of each segment; and the longitudinal displacement of the pylons' tower top under eccentric load can be calculated. The response of an exemplar suspension bridge with three spans of 168, 548, and 168 m is calculated by the proposed analytical method and the finite element method in two eccentric live load cases, and their results prove the former's feasibility. The nonuniform distribution of the live load in the lateral direction is shown to impose a greater threat to suspension bridge safety than that in the longitudinal direction, while some other specific features revealed by the proposed method are discussed in detail.

  • 라이브 시네마 연극(Live cinema theatre)은 연극과 영상 매체가 결합된 공연 형태로서 하나의 극영화를 만드는 과정이 라이브 이벤트로서 무대화 된 것이다. 여기서 배우는 카메라를 보며 연기하며 모든 시청각적 효과는 라이브로 조합된다. 무대는 실시간으로 장면이 구성 편집되고 있는 프로덕션 상황으로서 제시되며 연극은 카메라를 매개로 스크린을 통해 관객 앞에 생중계된다. 영국 연출가 케이티 미첼(Katie Mitchell)은 이야기 전달 및 공유 과정을 효율화한다는 목적의식 아래, '라이브 시네마 연극'이란 특정용어로 작업 형태를 구별 지칭하며 이를 장르문법으로 이끌어내고 있다. 여기서 '시네마'와 '연극'은 사이성의 실험을 넘어 동기화(synchronization)를 통해 수평적 관계를 맺음으로써 각자의 위상을 유지한다. 이는 서로 다른 영역에서 독립적으로 존재하는 연극 영화의 결합을 통해 기술매체 시대에 총체의 의미를 재규정하려는 시도를 보여준다. 여기서 카메라는 무대 안팎에 현존하고 몸은 이러한 상황 안에 실존하면서, 카메라-몸-무대는 서로 불가분한 관계를 구축한다. 무대 배우들은 기술적이고 심리적인 상태를 넘나들며 카메라의 현존을 체화하고, 스텝들은 몸에서 내면성을 분리하여 외현화하며, 연출은 이를 프레임 단위로 조직함으로써 무대 위 존재양식은 뉴미디어와의 관계 안에서 재구성되고 있다.

백신 전달기술 개발 동향과 과제 (Development of Vaccine Delivery System and Challenges)

  • Vaccine is a protective clinical measure capable of persuading immune system against infectious agents. Vaccine can be categorized as live attenuated and inactivated. Live attenuated vaccines activate immunity similar to natural infection by replicating living organisms whereas inactivated vaccines are either whole cell vaccines, eliciting immune response by killed organisms,or subunit vaccines, stimulating immunity by non-replicating sub cellular parts. The components of vaccine play a critical role in deciding the immune response mediated by the vaccine. The innate immune responds against the antigen component. Adjuvants represent an importantcomponent of vaccine for enhancing the immunogenicity of the antigens. Subunit vaccines with isolated fractions of killed and recombinant antigens are mostly co-administered with adjuvants. The delivery system of the vaccine is another essential component to ensurethat vaccine is delivered to the right target with right dosage form. Furthermore, vaccine delivery system ensures that the desired immune response is achieved by manipulating the optimal interaction of vaccine and adjuvantwith the immune cell. The aforementioned components along with routes of administration of vaccine are the key elements of a successful vaccination procedure. Vaccines can be administered either orally or by parenteral routes. Many groups had made remarkable efforts for the development of new vaccine and delivery system. The emergence of new vaccine delivery system may lead to pursue the immunization goals with better clinical practices.
