Case Study on the Legal Effects of Letters of Intent (양해사항확인장의 법적 효력에 관한 사례 연구)

  • The Pennzoil case and the SME case illustrate the difficulties which originate from inadequate drafting of letters of intent. In both cases the judges had to face the crucial question as to whether or not a given letter of intent had a binding nature; they had in other words to decide whether the wills expressed in such letters still belonged to the pre-contractual stage, or whether their incorporation into a pre-contractual document meant that negotiations were over and binding obligations had already arisen for the parties. In other words, some problems may occur when a party has documented a stage in the negotiations by letters of intent. The letters may well explicitly spell out if, and to what extent, the parties should be bound by what they have already agreed or to carry on negotiations in order to reach the final contract. But if the letters are silent, some problems would arise. Contracting parties are, therefore, well advised to spell out if, and to what extent, they should be bound by such preliminary agreements. Here again, it might be prudent to explicitly set forth that the parties should not be bound until there is a final written contract signed by authorized representatives of the parties but that they shall abstain from such measures which may defeat their stated objective to reach final agreement, e.g. by diminishing the value of performance under the contemplated contract.

Job Transition Process by Reasons of Job Separation and Its Determining Factors (이직사유별 일자리 이행경로 및 결정요인 분석)

  • This study examines job transition process and its lahor market performance by reasons of job separation, using the Employment Insurance DB(2000~07). The findings show that involuntary job changers lend to suffer greater loss in job spell and real wage than voluntary job changers, which seems to reflect their characteristics such as lower quality of job matching due to unsystematic job search, negative signaling effect in the labor market and decreasing availability of human capital in previous job. In addition, unemployment benefit eligible for involuntary job changers tends to prolong the period of unemployment, while increasing job spell in the following employment.

  • 본 연구에서는 한반도의 유역별 대표 기상관측 지점을 선정하여 기후변화로 인하여 미래에 나타날 수 있는 가뭄의 경향성을 분석하였다. 분석을 위한 자료는 실제 강수량 자료(1974~1999년)와 A2시나리오를 따르는 5개의 GCMs(General Circulation Model) 자료를 통계적 상세화한 강수량 자료(1974~2099년)를 이용하여 산정한 지속기간 6개월의 SPI(Standardized Precipitation Index)를 사용하였다. 분석을 위한 대표 기상관측 지점으로는 춘천, 서울, 대전, 대구, 전주, 광주, 부산 지점을 선정하였으며 GCM으로는 호주(CSIRO : MK3), 미국(GFDL : CM2_1), 독일/한국(CONS : ECHO-G), 일본(MRI : CGCM2_3_2), 영국(UKMO : HADGEM1)의 GCM을 선정하였다. 가뭄의 통계적 특성을 분석하기 위하여 Mann-Kendall 검정을 통한 경향성 분석과 Wavelet Transform 분석을 통한 주기성 분석을 하였으며 Drought Spell을 이용하여 가뭄심도별 발생빈도를 보았다. 그 결과, 경향성 분석에서는 각 GCMs의 차이를 볼 수 있었으며 CSIRO : MK3.0, GFDL : CM2_1, MIUB : ECHO-G 모델에서는 전체적으로 가뭄이 완화되고 MRI : CGCM2_3_2, UKMO : HADGEM1 모델에서는 가뭄이 심화되는 것으로 나타났다. 주기성 분석에서는 춘천, 서울에서는 낮은 주기를 대전, 대구, 전주, 광주, 부산지점에서는 다소 긴 주기를 보여주었다. Drought-spell에 의한 분석에서는 전 관측지점에서 SPI의 이론적인 확률밀도 함수값과 유사하게 나타나고 있었으며 이를 통해, 미래에는 극심한 가뭄의 빈도가 증가하고 있는 것을 예측할 수 있었다.

Unity and Consistency in the Romanization of Korean Personal Names. (한국인의 로마자 인명 표기의 통일성과 일관성: ≪영어영문학≫게재자를 중심으로)

  • The aim of this paper is two-fold. First, it examines the romanization of personal names of the teachers who teach English at a university and compares it with the romanization of the general public to see whether there is a unity between the two groups. Second, it explores whether the teachers romanize their personal names consistently and, if they don't, how differently they romanize their names. The data used in this study are the romanized names of the 313 authors who published their articles in The Journal of English Language and Literature from 1991 to 2000. The study shows that the English teachers and the general public differ in the order of the given name and surname as well as formatting. Most of the English teachers prefer to put their surnames last while the majority of the general public put their surnames first. The English teachers opt Gn-Gn and Gngn whereas the general public select Gn Gn for their given names. However, both groups, in general, spell the surname with the same Roman alphabets. The study also shows that the English teachers frequently reverse the order of the given name and surname, and change the formatting of their given names. They, however, spell their names rather consistently. This result indicates that Koreans may be lenient with the order of the given name and surname and formatting of their given names. However, they will unlikely change the spelling of their names even when a new policy on personal names is promulgated.

Where a Null C Fails to PF-merge

  • This paper discusses the distribution of a null complementizer C, as opposed to an overt counterpart 'that', presenting empirical support both for and against the PF-merge analysis of C proposed by Boscovic and Lasnik (2003, henceafter B&L) who in turn attribute to the proposal in Pesetsky (1992) and Halle & Marantz (1993). In Section I, as a background, I discuss B&L's proposal that a null complementizer C is a PF-affix which undergoes a PF-merger operation at the PF component. In Section 2, after a brief sketch of the distribution of a null C mostly in bare-relatives, I explore the possibility of extending B&L's analysis to accomodate the null C's in the bare-relative constructions. In Section 3, I argue that despite some empirical difficulties, B&L's analysis of a null C as a PF-affix can still be maintained, if Adverb Fronting is an operation to Spec-C position. Furthermore, I propose a rule - PF Spell-Out Constraint - to account for the C-trace (i.e. that-trace) effect in relative constructions. With the PF Spell-Out Constraint and B&L's PF-merge account, the distribution of a null C can better be analyzed.

Congenital Tracheomalacia Associated with Esophageal Atresia (선천성 식도폐쇄에서 발생한 선천성 기관연화)

  • This is a case of tracheomalacia associated with esophageal atresia. An 11-month-old- male boy presented with a life-threatening apneic spell after correction of esophageal atresia (Gross type C). After complete exclusion of the other possible causes of the apneic spell, the presumptive diagnosis of tracheomalacia was made with fluoroscopy and 3-dimensional chest CT. The final diagnosis was made with rigid bronchoscopy under spontaneous respiration. The aortopexy was performed with intraoperative bronchoscopic examination. The postoperative period was unremarkably uneventful. The patient was discharged 9 days after the aortopexy and has remained well to date (5 months after the aortopexy).

A Prototype Design for a Real-time VR Game with Hand Tracking Using Affordance Elements

  • In this paper, we propose applying interactive technology in virtual environments to enhance interaction and immersion by inducing more natural movements in the gesture recognition process through the concept of affordance. A technique is proposed to recognize gestures most similar to actual hand movements by applying a line segment recognition algorithm, incorporating sampling and normalization processes in the gesture recognition process. This line segment recognition was applied to the drawing of magic circles in the <VR Spell> game implemented in this paper. The experimental method verified the recognition rates for four line segment recognition actions. This paper aims to propose a VR game that pursues greater immersion and fun for the user through real-time hand tracking technology using affordance Elements, applied to immersive content in virtual environments such as VR games.

Poverty Dynamics in Korea: Poverty Duration and its Determinants (빈곤의 동태적 분석: 빈곤지속기간과 그 결정요인)

  • This study examines dynamics of poverty in Korea, focusing on poverty duration and its determinants. Data come from Korean Labor and Income Panel Study(KLIPS), 1998-2003. KLIPS is a longitudinal survey of 5,000 families and their members which are representative of urban residents in Korea. Respondents of KLIPS annually report detailed information on their income, economic activities, and other socio-economic characteristics. This study use poverty exit probabilities to generate distributions of spell lengths, following Bane and Ellwood(1986)'s methodology. This study finds a high level of poverty exit rates in Korea. About three quarters of those beginning a poverty spell exit from poverty within two years. Only 14.3 percent of all the poverty spells consist of long spells which persists five years or more. Yet, a different picture emerges when spells of the poor persons at a given time are analysed. Persistent poor occupy a considerable share of all the poor. Almost 50 percent of those who would be in poverty at a given time are in the midst of poverty spells lasting five years or more. When repeat spells of poverty are also included in the analyses, the proportion of long-term poor increases further. 63 percent of persons poor at a given time are long-termers. The majority of long-term poor are members of families headed by the aged. They show both a low level of poverty exit rates and a high level of reentry rates, and thus are most likely to experience long-term poverty. In the first place, they occupy a substantial share of all the poor. The second who are likely to be poor longer is members of families headed by non-aged women. Researchers have recentlty paid much attention to the working poor who have increased since the economic crisis in 1997. Yet, it is very likely that families headed by non-aged male who largely consist of the working poor temporarily experience poverty. Findings for this study suggest that further studies and policy proposals addressing persistent poverty are necessary.

  • A 12-yr-old patient was admitted due to severe hemoptysis and known cyanotic CHD. In chest P-A and echocardiogram, pulmonary aspergilloma in left upper lobe was associated with TOF. The cardiac catheterization couldnt be done because of frequent hypoxic spell and severe hemoptysis. Surgical management was performed. After left posterolateral thoractomy, modified Blalock-Taussig shunt operation and left upper lobe lobectomy were done at same time. Postoperative PaO2 was elevated and hemoptysis was disappeared.

Longitudinal Patterns of Financial Kin Support and Welfare to Single Mother Families

  • This study examines longitudinal patterns of financial kin support and welfare given to single mother families using life table techniques. Drawing on the 1985-1993 Panel Study of Income Dynamics(PSID), I followed 560 single mothers from the time they began a single motherhood spell. About 30 percent of these single mothers received financial support from relatives, and 40 to 50 percent received AFDC and Food Stamps, respectively. Results indicate that kin support is more likely to be given in a transitional period and tends to decrease over time. In comparison, receiving welfare appears positively time-dependent.
