해상보험증권의 해석상 작성자 불이익의 원칙의 적용에 관한 연구 (A study on the Application of the Contra Proferentem Rule in the Interpretation of Marine Insurance Policies)

  • In the absence of any guidance under statutory law, such as the Rules for Construction of Policy, MIA 1906, judges should follow the general principles of interpretation that apply to all contracts. In simple terms, Contra Proferentem Rule means that if the contents of the terms and conditions are ambiguous, they are interpreted against the writer of the terms and conditions. In the Anglo-American Contract Law, the 'default rule' is an important judicial tool that can supplement defects in contract norms and reinforce the principle of private autonomy through gap-filling techniques related to the interpretation of contracts. In Korea, it is sometimes mentioned in case of precedent, and it has been established as a clear rule. This study analyzes the interpretation of terms and conditions is not in the form that the interpretation of other general contracts and other interpretation principles are valid, but contracts based on terms and conditions are also contracts, and as a general rule, the interpretation of terms and conditions is explained like the general contract interpretation.

  • This paper presents an implementation of a gramar of Dynamic Syntax for Japanese. Dynamic Syntax is a grammar formalism which enables a parser to process a sentence in an incremental fashion, establishing the semantic representation. Currently the application of lexical rules and transition rules in Dynamic Syntax is carried out arbitrarily and this leads to inefficient parsing. This paper provides an algorithm of rule application and partitioned parsing state for efficient parsing with special reference to processing Japanese, which is one of head-final languages. At the present stage the parser is still small but can parse scrambled sentences, relative clause constructions, and embedded clauses. The parser is written in Prolog and this paper shows that the parser can process null arguments in a complex sentence in Japanese.

설계오류 자동 검증을 위한 안전 설계 Rule Checking 체계에 관한 연구 (A Study on the Safety Design Rule Checking System for Automatic Verification of Design Errors)

  • 연구목적: 화학물질 취급, 사용 등의 플랜트 및 사업장 설계 시 국내 안전관리 관련 법령을 준수하여 설계가 이루어졌는지 자동으로 판단할 수 있는 체계를 마련하여 검토 시간의 단축과 정확성을 높이고자 한다. 연구방법: 화학물질 취급, 사용 사업장에 대한 안전 설계 기준을 조사하고, 조문을 의미단위로 구분하여 자동으로 설계오류를 판단할 수 있는 유형과 체계를 도출하였다. 연구결과: 건물 설계 시 수행하던 자동 설계 검토 방법을 화학물질 취급 사업장을 설계 시 요구되는 안전설계 사항을 Rule Checker 개발을 통해 검토할 수 있는 체계를 제안하였다. 법 적용 대상 여부의 확인 후 전처리를 통해 의미단위로 안전설계 Rule을 구분한다. 구분된 결과는 4가지 유형으로 분류할 수 있고, 특정 장치 및 설비에 대한 사양, 공간, 조건, 상황에 대한 부분과 안전성을 강화하기위한 특정 장치 및 설비에 대한 사항이 대표적인 유형으로 분석되었다. 각각의 안전설계 Rule에 대한 Diagram을 작성하고, 이를 Rule checker 프로그램을 통해 검토할 수 있도록 하는 체계를 제안한다.

  • 교통안전특정해역은 선박사고의 위험성이 특히 높아 정부가 채택한 연안해역을 의미하나 정작 이 곳에서 적용되는 항법에 대하여는 여전히 논란이 있는 게 사실이며 여수VTS 관제구역에 있는 광양만 출입항로에 있어서는 그 적용이 더 난해한 부분이 있다. 따라서 본 연구에 대한 대책으로서 적극적 관제를 위한 교통안전특정해역에서의 항법적용에 대한 통일된 해석과 적용 방침을 마련하고, 나아가서 해사안전법에서의 특별항법 부분을 별도로 분리 입법하는 방법으로 선박교통안전을 향상하고, 선박교통관제사가 적극적인 업무자세로 집중관제의 토대를 마련하는데 조금이나마 기여하고자 한다.

  • 한자가 유입된 당시 한자의 원음도 함께 들어와서 현재 많은 한자들이 중국과 같은 한자에 같은 발음으로 사용하고 있으나 한국과 중국은 한자에 대한 발음이 서로 독립적으로 보존 및 변천되어 오늘날은 그 발음을 표기하는 방식이 서로 다르다. 본 연구는 중국 한자의 발음인 한어병음과 한국 한자발음을 구성하는 초성, 중성, 종성의 변화를 시스템으로 분석하여 중국어 발음과 대응되는 변환규칙을 생성함으로써 쉽게 중국어 발음을 학습할 수 있는 중국어규칙변환 교육시스템으로 설계 및 구현하였다. 본 연구는 중국어규칙변환 교육시스템을 웹으로 구현하였고, 앱등의 다양한 어플리케이션을 통하여 중국어를 학습하는데 도움이 되도록 하였다.

공간적응절차를 통한 웨이퍼 가공 공정의 로버스트한 작업배정규칙 결정 (A Spatial Adaptation Procedure for Determining Robust Dispatching Rule in Wafer Fabrication)

  • In traditional approaches to scheduling problems, a single dispatching rule was used by all machines in a system. However, since the situation of each machine generally differs from those of other machines, it is reasonable to apply a different dispatching rule to each machine responding to its given situation. In this regard, we introduce the concept of spatial adaptation and examine its effectiveness by simulation. In the spatial adaptation, each machine in a system selects an appropriate dispatching rule in order to improve productivity while it strives to be in harmony with other machines. This study proposes an adaptive procedure which produces a reliable dispatching rule for each machine beginning with the bottleneck machine. The dispatching rule is composed of several criteria of which priorities are adaptively weighted. The weights are learned for each machine through systematic simulations. The simulations are conducted according to a Taguchi experimental design in order to find appropriate sets of criteria weights in an efficient and robust way in the context of environmental variations. The proposed method was evaluated in an application to a semiconductor wafer fabrication system. The method achieved reliable performance compared to traditional dispatching rules, and the performance quickly approached the peak after learning for only a few bottleneck machines.

Implementing Rule-based Healthcare Edits

  • Automated medical claims processing and billing is a popular application domain of information technology. Managing medical related data is a tedious job for healthcare professionals, which distracts them from their main job of healthcare. The technology used in data management has a sound impact on the quality of healthcare data. Most of Information Technology (IT) organizations use conventional software development technology for the implementation of healthcare systems. The objective of this experimental study is to devise a mechanism for use of rule-based expert systems in medical related edits and compare it with the conventional software development technology. A sample of 100 medical edits is selected as a dataset to be tested for implementation using both technologies. Besides empirical analysis, paired t-test is also used to validate the statistical significance of the difference between the two techniques. The conventional software development technology took 254.5 working hours, while rule-based technology took 81 hours to process these edits. Rule-based technology outperformed the conventional systems by increasing the confidence value to 95% and reliability measure to 0.462 (which is < 0.5) which is three times more efficient than conventional software development technology.

  • Dispatching rule plays an important role in a hybrid flow shop. Finding the appropriate dispatching rule becomes more challenging when there are multiple criteria, uncertain demands, and dynamic manufacturing environment. Using a single dispatching rule for the whole shop or a set of rules based on a single criterion is not sufficient. Therefore, a multi-criteria decision making technique using 'the order preference by similarity to ideal solution' (TOPSIS) and 'analytic hierarchy process' (AHP) is presented. The proposed technique is aimed to find the most suitable set of dispatching rules under different manufacturing scenarios. A simulation based case study on a PCB manufacturing process is presented to illustrate the procedure and effectiveness of the proposed methodology.

  • Legal sources of fraud rule in documentary letter of credit, which have their origin in Sztejn Case can be traced to various rules or laws of international or domestic level ; URCG, URDG and ISP98 as ICC Rules, and UNCITRAL Convention as an international uniform law, and UCC as a domestic law and U.K. cases. Among them the combination of "material fraud" in UCC ${\S}5-109$ and the detailed list of the types of misconduct in UNCITRAL Convention may provide the best solution or standard in real application of the fraud rule in letter of credit transaction.

  • The traditional approaches of association rule mining have relied on high support condition to find interesting rules. However, in some application such as analyzing the web page link and discovering some unusual combinations of some factors that have always caused some disease, we are interested in rules with high confidence that have very low support or need not have high support. In these cases, the traditional algorithms are not suitable since it relies on first satisfying high support. In this paper, we propose a new model, CP(Confidence Pattern)-Tree, to identify high confidence rule between 2-items without support constraint. constraint. In addition, we discuss confidence association rule between two more items without support constraint.
