An Investigation of the Factors that Influence the Compliance to Information Security Policy: From Risk Compensation Theory (정보보안 정책 준수에 영향을 미치는 요인: 위험보상이론 관점에서)

  • Information security has been a major concern in organizations. The longstanding question of how to improve employees security behaviors and reduce human errors remains unanswered and requires further exploration in the information security domain. To do this, we propose a risk compensation theory-based model and examine the model. Research results shows that the relationships between information security countermeasures and information security compliance intention of employees are moderated by system vulnerability. However, the finding is contrary to the previously held risk compensation assumption and deserve further study. In addition, system quality does not play a moderator role in the relationship. Conclusions and implications are discussed.

  • Medical practice is characterized by various physiological response and uncapacity of prediction, therefore when medical accident occur it's hard to prove medical professionals' mistake. Though medical accident by medical professionals' mistake will be compensated anyhow, about irresistible medical accidents, no one should be not bound to compensate, victims get into very difficult situation. So, the nation don't negligent irresistible medical accidents but compensate anyway. As in the past, to the legal principle's constitution of irresistible medical accidents, theory of liability without fault was adapted, and it was said this theory was illogical in theory of liability with fault. But the subject of compensation to irresistible medical accidents is nation, nation don't participate in medical treatment therefore there is no room to occur mistake. And it is not reasonable to regard medical agency as a truster of public service, to cast to it responsibility of medical accidents. The problem of compensation to irresistible medical accidents is understood under the theory of social compensation. Social compensation is consisted of compensation to sacrifice and contribution to nation and society and compensation to sacrifice revealed under danger, the compensation to irresistible medical accidents belongs to the latter. This is near to concept of relief, is applied to national compensation system supplementarily, and compensation have no option but to compensate minimum. And there are not relation between national compensation system of irresistible medical accidents and proof liability transposition and theory of liability with out fault, merely in side of sharing responsibility burden between medical treater and victim, it is reasonable to discuss transportation of proof liability and compulsive liability insurance together.

Ship collision in Chinese Maritime Law: Legislation and Judicial Practice

  • A report released by the Chinese Maritime Court found that the natural environment and other objective factors have greatly reduced the risk of ship collision accidents with the advancement of technologies. However, collisions between merchant ships and fishing boats occur frequently along the coast during fishing seasons, which should be highly valued. International conventions and domestic legislation in China comprise detailed laws with respect to ship collisions, but the theory of ship collision infringement needs to be improved, enriched, and developed. Meanwhile, the development of the tort liability law provides theoretical support for ship collision infringement. As far as China's ship tort legal system is concerned, the research on ship collision tort damage compensation is relatively extensive, and the constitutive elements and causality of ship collision tort liability have also been studied in depth. The purpose of this paper is to explore the domestic legislation applicable to disputes related to ship collisions in China. As these laws are unclear on the resolution of disputes resulting from ship collisions, significant attention has been focused on the final judgments by the Supreme Court of China (SPC), as well as the judicial judgments set by the Maritime Court of China.

The Effect of Audit Quality on Crash Risk: Focusing on Distribution & Service Companies (감사품질이 주가급락 위험에 미치는 영향: 유통, 서비스 기업을 중심으로)

  • Purpose - According to agency theory, managers have incentives to adjust firm revenues to meet earnings expectations or delay bad news disclosure because of performance-based compensation and their reputation in the market. When the bad news accumulates, stock prices fail to reflect all available information. Thus, market prices of stocks are higher than their intrinsic value. After all, bad news crosses the tipping point, it comes out all at once. That results in stock crashes. Auditors can decrease stock crash risk by reducing agency costs through their informational role. Especially, stock price crash risk is expected to be lower for firms adopting high-quality audits. We focus on distribution and service industry to examine the relation between audit quality and stock price crash risk. Industry specialization and auditor size are used as proxies for auditor quality. Research design, data and methodology - Our sample contains distribution and service industry firms listed in KOSPI and KOSDAQ during a period of 2004-2011. We use a logistic regression to test whether auditor quality influences crash risk. Auditor quality was measured by industry specialist auditor and Big4 / non-Big4 dichotomy. Following the approach in prior researches, we use firm-specific weekly returns to measure crash risk. Firms experiencing at least one stock price crash in a specific week during year are classified as the high risk group. Results - The result of analyzing 429 companies in distribution and service industry is summarized as follows: Above all, it is shown that higher audit quality has a significant negative(-) effect on the crash risk. Crash risk is alleviated for firms audited by industry specialist auditors and Big 4 audit firms. Therefore, our results show that hypotheses are supported. Conclusions - This study is very meaningful as the first study which investigated the effects of high audit quality on stock price crash risk. We provide evidence that high-quality auditors reduce stock price crash risk. Our finding implies that the risk of extreme losses can be reduced through screening of high-quality auditors. Therefore investors and regulators may utilize our findings in their investment and rule making decisions.

  • The ultimate intention of this research is to identify the factors that have a significant effect on the perceived importance of information security as the antecedent of intention to information security policy compliance. We found that the effectiveness of information security training program did not have statistically significant effect on the perceived cost of policy compliance. Second, the effectiveness of information security policy has significant influence on the perceived cost of policy compliance. Third, perceived vulnerability has a significant effect on the perceived cost of policy compliance. Fourth, perceived cost of policy compliance has a significant effect on perceived importance of information security. Fifth, supervisor's attitude toward information security silence has a significant effect on employee silent behavior towards information security. Sixth, communication opportunities towards information security has a significant influence on employee silent behavior towards information security. Finally, it was shown that employee silent behavior towards information security had a significant influence on the perceived importance of information security.
