Purpose: This study was done to develop a web-based diagnostic evaluation program for nurses to prevent malpractice liability. Methods: A comprehensive review of the literature and 9 specialist interviews were used to search for learning goals and content for protection for nurses from malpractice. Data on needs for learning goals were collected from 56 hospital nurses who agreed to complete a self-report questionnaire. The diagnostic program was evaluated between September 2008 and August 2009 by 35 new hospital nurses using an application of the web-based program evaluation tools by Chung (2000). Results: A comprehensive review of the literature and interviews were used to search for learning goals and content. The evaluation program was composed of the 73 questions for diagnostic evaluation under 23 learning goals and 6 grand learning goals which included the principles of law, patient's rights, legal responsibility, patient's safety, regulation on nursing practice and patient's rights protection. Evaluation of the program showed that the mean for program evaluation was 3.43 (SD=.37). Conclusion: This diagnostic evaluation program could be an efficient method for teachers and learners to improve nurses' behavior in protecting the patient's rights and preventing malpractice claims.

The authors in this paper aim to identify the growth of literature on Intellectual Property Rights (IPRs). The research publications on IPRs were downloaded from the Scopus online citation database and the authors found that there were 1,513,138 records contributed globally over a period of 10 years from 2005 to 2014. The distribution of publications based on the year, country, and document type were studied. Relative growth rate (RGR) of the publications and doubling time (T_d) were calculated. Most productive organizations, source titles, and the productive authors on IPR research were studied. Most cited articles in the study area were identified. The results show that a number of publications under the subjects Medicine and Engineering were produced. The developed countries are very active in IPR research and producing publications. It is found that one institution which holds the sixth place among the top 10 most productive institutions belongs to Brazil, a developing country. Two developing countries such as China and India hold second and tenth positions respectively in the top 10 countries contributing literature on IPRs.

장기요양보험제도 시행의 정착에 따른 노인요양서비스 이용 노인 규모가 점차 확대되고 보편화됨에 따라 장기요양서비스 질 제고를 위한 제도적 기반이 마련되는 과정에서 기존의 욕구에 기반을 둔 서비스(need based service) 제공의 원칙으로부터 인권에 기반을 둔 서비스(human rights based service) 제공으로 패러다임 전환이 요구되고 있다. 노인장기요양기관 요양보호사들은 요양시설 인권실천의 최전방에 있는 주체로 이들의 인권옹호행동이 질 높은 서비스 전달의 중요한 요인이 된다는 점에서 주목을 받고 있다. 본 연구에서는 노인장기요양기관 요양보호사들의 인권의식이 인권옹호행동에 어떠한 영향을 미치는지, 또한 그 과정에서 환경요인인 조직의 효과는 이들의 관계를 어떻게 조절하는지 검증하고자 하였다. 연구대상 기관은 2014년 7월 현재 등록된 전국 장기요양기관(정원 30인 이상) 3,983개소 중 사회복지법인 등 비영리법인이 운영하는 782개 시설을 대상으로 하였다. 노인장기요양기관에서 노인요양보호사들을 대상으로 개인수준에 해당하는 인권의식과 조직의 서비스 환경으로 조직수준의 서비스 지향성이 인권옹호행동에 미치는 효과를 검증하고, 인권의식(개인)과 인권환경(조직)의 상호작용 효과를 통합적으로 검증하였다. 개인수준과 조직수준 효과 검증을 위해 분석방법은 다층모형(multi-level model)을 적용하여 분석하였다. 분석 결과, 개인수준의 인권의식이 인권옹호행동에 정적으로 유의한 영향을 미치고, 조직수준의 서비스 환경에 해당하는 서비스지향성(리더십/태도/인적자원관리/시스템)은 세부 요소에 따라 영향은 다르지만, 인권옹호행동에 유의한 영향을 미치는 것으로 나타났다. 개인의 인권의식과 조직의 서비스 지향성 상호작용 효과를 살펴본 결과 인권옹호행동에 유의한 영향을 미치는 것으로 나타나는데, 특히 서비스 지향성구성요소 중 '인적자원관리'는 인권의식과 상호작용을 통해 인권옹호행동에 정(+)적으로 유의한 영향을 미치는 것으로 나타났다. 이러한 분석을 통해 본 연구에서는 인권옹호행동에 영향을 미치는 개인 요인과 조직 요인에 대한 이해를 제고하고, 노인장기요양기관 인권 증진을 위해 요양보호사와 장기요양보호기관에 어떤 정책적, 실천적 개입을 할 수 있을지에 대한 함의를 도출하였다.

Objectives : The purpose of this study is to set the explanatory duty on traditional Korean medical(TKM) treatment by analyzing the judicial precedents. Methods : The study was performed by analyzing nine cases of lawsuits related to Korean medicine doctor and explanatory duty among the medical dispute cases in Korea from 1968 through 2012. Results : Nine closed claims occurred regarding the violation of explanatory duties in the field of TKM practice. Two claims were decided by supreme court, three were decided by high court, and four were decided by district court. The causes of lawsuits were categorized as follows : bee venom pharmacopuncture, herb treatment, and an explanation for safety. Conclusions : To perform an explanatory duty has important legal implications for the protection of patients' rights and Korean Medicine doctors' autonomy on TKM treatment.

보건복지부가 실시한 2017년 장애인 실태조사에 의하면 여성장애인이 가장 많이 이용하는 서비스 기관이 장애인복지관으로 조사되었다. 이는 여성장애인의 모성권 보장을 위한 장애인복지관의 역할이 중요함을 의미한다. 그러나 장애인복지실천 현장에서 모성권 보장을 위한 프로그램은 미비한 수준이며, 실태조사 역시 파악되지 않고 있는 실정이다. 따라서 본 연구는 장애인복지관이 제공해야 할 모성권 관련 프로그램 필요성의 근거를 제시하기 위해 첫째, 보건복지부의 2017년 장애인실태조사 결과를 바탕으로, 문헌자료를 추가하여 여성장애인의 모성권 관련 애로사항과 필요한 서비스를 분석하고 둘째, 모성권을 보장해야 하는 법적 근거와 법적근거에 기반한 현존하는 프로그램 현황을 파악하고자 하였다. 연구결과 법적인 근거에 기반한 모성권 관련 프로그램은 존재하고 있으나 여성장애인이 경험하는 모성권 관련 애로사항과 이를 해결 할 수 있는 실질적 지원서비스는 미비한 수준으로 파악되었다. 따라서 지역거점의 장애인 복지관은 성인지적 관점을 바탕으로 여성장애인의 모성권 확립을 위한 중심적 역할로서 임신, 출산, 양육에 대한 기초상식 정보제공을 위한 매뉴얼 개발, 출산관련 상담서비스 지원, 자조모임 활성화 추진, 가족을 위한 개별화된 프로그램, 의료기관 연계, 사례관리 지원 등의 구체적인 서비스 지원을 제공해야 할 것이다.

본 연구의 목적은 LGBTQ의 인권을 기저로 LGBTQ Friendly Library 정책의 방향을 제시하는 것이다. 이 목적을 달성하기 위하여, 이 글에서는 세계인권선언서(UDHR)와 미국도서관협회(ALA) 및 국제도서관연맹(IFLA)의 활동과 기존의 학술기사를 귀납적으로 분석하여, 그 결과로 우리나라 도서관의 LGBTQ 서비스 정책 수립에 필요한 7가지의 방향을 다음과 같이 제시하였다: 1) LGBTQ의 인권 향상과 도서관의 의무 선언, 2) 도서관인의 교육 강화, 3) 다양한 정보요구의 수집과 장서의 확대, 4) 정보검색 및 접근 도구의 개발, 5) 도서관 환경의 안전성과 시설사용의 평등성의 보장, 6) NGO와의 협력 네트워크의 구축, 마지막으로 7) LGBTQ 어린이 및 청소년의 지원.

한국사회복지는 최근 급증하고 있는 국내 체류 외국인근로자를 위한 서비스 전달정책과 실천에 그 관심의 폭을 확대하고 있다. 사회복지실천은 외국인 근로자들을 지원하는 현장 실천가들의 문화적 역량강화에 역점을 두고 연구와 실천을 수행해왔다. '문화적 역량강화를 위한 실천론'은 외국인이주자들이 한국사회에 순응하고 적응을 돕는 실천론으로서의 강점이 있다. 그러나 문화 역량강화는 그들이 당하는 차별과 그들을 억압하는 한국문화와 제도 등의 문제점을 인식하고 이의 변화를 모색하기에는 한계가 있다. 본 연구는 영국에서 사회복지실천개혁의 배경으로 발전된 사회구조 변화를 통해서 사회정의와 인권 가치를 실현하는 반-억압실천론(anti-oppressive practice)의 한국 외국인근로자를 위한 적용가능성을 살펴보고자 한다. 외국인 근로자와 그들을 지원하는 사회복지실천가들의 인터뷰를 기초로 외국인근로자들이 경험하는 차별의 유형과 사회복지실천가들의 실천방법을 분석하고 반-억압실천론(anti-oppressive practice)이 외국인근로자에게 적용 가능한가에 대한 의견을 제안한다.

Respect for human life and respect for human rights are basic values which the organized nursing profession has urged its members to adhere to in their service to human beings. This study was designed and carried out to identify ways to reconcile often conflicting basic values in practice. This study focused on ethical dilema experienced by nurses who were caring for political offenders in prison. Concrete case study was presected to show solutions to the problems.

It is fair to say that there are many ethical issues concerning the publication of medical papers. To define the best practice in the ethics of scientific publishing and a proper understanding of appropriate reporting in medical papers, this review should be useful for authors dealing with ethical issues which involve the protection of human and animal rights, the protection of confidentiality and informed consent, fabrication, falsification, plagiarism, author and authorship, copy right transfer, duplicate publication, conflict of interest, and dealing with misconduct cases.

온라인 및 무선 통신은 콘텐츠 산업 시장을 획기적으로 변화시켰다. 유통 채널이 서점에서 스마트 플랫폼으로 이동함에 따라 거래가 즉각적으로 이루어져 제작자에게 새로운 크고 작은 기회가 제공되었다. 그러나 그러한 기회는 산업 생태계의 불균형을 초래한다. 창의적 중소기업의 성장이 중요한 콘텐츠 산업 특성상, 산업의 건전성과 다양성을 보장하기 위해서는 콘텐츠 저작권에 관한 공정거래 규칙이 필요하다. 하지만 산업의 몇몇 구조적 특성이 이러한 규칙의 시행을 어렵게 한다. 첫째, 콘텐츠 업계는 주요 출판사들처럼 다수의 중소 판매업자들로 이루어져 있다. 둘째, 구글과 같은 플랫폼 회사 등 최종 판매자들은 독점적 지위를 보유하고 있다. 셋째, 콘텐츠에 대한 경제적 가치 평가도 어렵다. 기업 인수의 측면에서 보면, 저작권 거래는 (1) 라이선스(권리위임) 모델, (2) 원시취득 모델, (3) 수요독점 모델로 분류가 가능하다. 이 연구는 출판업계에서의 주요 법령과 각 모델 별 적용 방식에 대해 알아본다. 한국과 미국의 법령, 판례분석, 공정거래위원회(FTC)의 심결들을 분석하여 저작권 거래의 공정성/불공정성 평가 기준을 제시한다. 나아가 이 연구는 콘텐츠 저작권의 공정한 거래를 제고하기 위하여 콘텐츠 산업의 일반적 관행을 개선하기 위한 가이드라인을 제시함으로써 출판산업 생태계가 발전하기를 기대하는 바이다.
