The social welfare law concerning the children, the elderly and the disabled has been sufficiently in the center of the discussion in the academic as well as practical arena. One can find however rarely academic proposals about the way of understanding, spheres affiliated with this legal system, and systematic characteristics. So these problems stay now vague. This article aims to approach to these points of issue. First, it tries to reveal the physical, psychological and psychic characteristics of these group of people. These situation are not to be effectively protected by norms and measures provided by other instruments of social security, i.e. social insurances and social assistances. Second, based upon these functional limits inherent to these instruments of social security the own system of the social welfare law is explored in this article. The discussing points are as follows; 1. the concept of social welfare law, 2. as core principles; realization of the personality and freedom based upon self-determination right, universalism and equality. 3. rearrangements of the legal provisions to bring harmony with the legal purpose and function of social welfare law. Finally, it is pointed that the evaluation of the relevant legislation is essential, since in this area the difference between the norm purpose and the reality could be immense.
By analyzing informed consent and the refusal of emergency medical treatment (called patient dumping) under the current Emergency Medical Service Act, this study suggests that an emergency medical professional is only liable for patient dumping if their duty to protect the patient's life takes precedence over the patient's right to self-determination. In emergency medical situations, as in general medical situations, medical treatment should be performed after the emergency medical professional informs the patient about the medical treatment, including its necessity and methods, and obtains consent from the patient. Refusing or evading the performance of emergency medical services on the excuse of the informed consent not considering a waiver or alteration of informed consent requirements without reasonable reasons violates the Emergency Medical Service Act and thus makes an emergency medical professional liable to administrative disposition or criminal penalty. In other words, depending on the existence of a waiver of alteration of the informed consent, patient dumping may be established. If the patient is a minor or has no decision-making ability, and their legal representative makes a decision against the patient's medical interests, the opinion of the legal representative is not unconditionally respected. A minor also has the right to decide over their body, and the decisions of their legal representatives should be in the patient's best interests. If the patient refuses treatment, in principle, the obligation of life protection of emergency medical professionals is the top priority. However, making these decisions in the aforementioned situations in the emergency medical field is difficult because of the absence of explicit regulations regarding these exceptional problems. This study aims to organize the following precedents of the Supreme Court of Korea. The court states that, when balancing the conflicting interests between the duty to provide emergency medical service and the duty to inform is unavoidable for emergency medical professionals, they should put the duty to protect the patient's life ahead of the duty to inform if the patient's life matters. Exceptionally, when a patient has seriously considered whether they should receive treatment before the emergency medical situation, their right to self-determination can be considered equal to the obligation of emergency medical professionals to provide emergency medical treatment. This research also suggests that an amendment of the Emergency Medical Service Act should include the following. First, the criteria for determining the decision-making ability of emergency patients should consist of medical content. Second, additional consent from a medical professional is unnecessary for first-aid treatment. Finally, new provisions for emergency medical obligations for minors, new provisions for the decision standard when there are conflicting opinions about the treatment of a patient, and new penalty provisions for professionals who suspend emergency medical examinations and treatments need to be established.

In the present study, to determine walking imbalance using the walking analysis method, where limitations in the existing walking analysis have been minimized, we propose a new walking analysis method that adopts the following: self-developed equipment to measure the angles of left-right hip joints and knee joints; a determination system using symmetry index (SI); and dynamic time warping (DTW) similarity analysis algorithm to analyze individual walking styles. Normal and imbalanced walking tests were conducted for 12 subjects without walking disorder. From the SI calculation to determine imbalanced walking, both the normal and imbalanced walking styles can be determined using the angle measurements of the left-right hip joints and knee joints. In the analysis of the individual walking styles, the similarities at the center of the lower back, left-right thighs, and dorsum of the feet of the 12 subjects in both normal and imbalanced walking cases were compared. From the similarity analysis of the measured values during the normal and imbalanced walking tests, I determined that the walking pattern does not maintain the same stance when the body parts move during walking.

If one were to say that war is political in its nature, then war could be one of the several ways of achieving political goals. Thus, the aspect of wars will, in certainty, be altered by the changes in political environment. Wars in the past broke out mainly due to ideological differences that ran to extremes and were of high intensity. However, wars today show such restraints as controlling them beforehand or during the war in anticipation of the post-war situation. The trend of ideas to actualize such wars in the effective operation of airpower is on the rise. Airpower normally possesses speed and operative flexibility as well as capability of destruction, so it is possible to destroy the politically declared targets clearly. Previous airpower was merely employed as means of helping to vertically detouring the spatial obstacle that the ground forces encountered. Over the years, due to the speedy improvement of aviation technology and of ideas concerning wars in space, more advanced application has been developed. but they also were nothing more than an auxiliary role to facilotate the ground forces, that needed a longer effective range of firepower and did not become forces with the right of self-determination, that is, the fact of decisive war that makes its outcome. However, under transitional strategic environment like that of the present, Airpower possesses not only the capability to operate as a decisive means of war but also as theories to support it. The advancement in air technology has enabled supremacy over targets in depth, and the development of electronic technology has empowered the improvement of degree of destruction but also triumphant war by means of an overwhelming supremacy in a relatively short period. Thus, the method of systematic destruction that accomplishes the stated goals while rejecting the damage of accumulative destruction has been realized. The progress of such a concept has also proved that the counter-force strategy that has been developed in nuclear strategy is useful in conventional warfare as well. Therefore, it can be said that the under today's strategic environment airpower is an outstanding means of military strategy that can deeply affect to achieve the national objectives.
As modern society advances, women's self-consciousness and attitudes toward beautiful appearances have changed. Amid this trend, the young and slim body of adolescent girls expressed in contemporary fashion incites fantasy on continuing youth among women. In modern society, women's youth is frequently regarded as a subject of consumption and a sex product in the mass media. In this regard, the study is focused on examining desire and psychology of worshipping women's youth and beauty in connection with flapper fashion in the 1920s. In the process, the study took a look at the social and cultural background of flapper fashion and conducted an analysis on formative characteristics and aesthetic sense of flapper fashion as follows: First, the formative characteristics include a short skirt that expresses straight lined shape and the beauty of exposure, lighter clothing, thick make-up, short hair style and black or vivid colors, and they lead to exceptional and innovative aesthetic sense in flapper fashion. Flapper fashion style is focused on completely denying outdated fashion worn by women in the age right before. Second, pursuit of mature, graceful and classical beauty that had continued in previous ages has gone through complete changes in the flapper era in the name of pursuit of youth, and the flapper fashion expresses sensual image through the exposure of slim arms and legs of a young girl. In the formative characteristics, aesthetic sense of youth and sensuality inherent in the flapper fashion was generated. Third, women's free-spirited lifestyle at that time and 'aesthetic sense of freedom and amusement that reflected the speed of machine civilization could be found in the flapper fashion. Material and decoration of the flapper fashion pertained to clothing that enabled a free expression through rapid movements. Aesthetic sense of the flapper fashion generated in the process could be defined as women's internal determination to express individual and free-spirited ideas through the use of fashion when tradition and order of the old age were torn down. And this aesthetic sense is continuously affecting modern fashion design.
The purpose of this study is to explore the experiences and challenges of public guardianship services project for the mental disabled as a system of supporting the decision-making and the rights advocacy. For this purpose, interviews with 11 social workers who act as public guardians were conducted and a model of practice was suggested through analysis using the grounded theory of Strauss and Corbin(1998). As a results, the possibility of rights advocacy through public guardian services for the mentally disabled, the positive change of attitude of the facilities and the establishment of direction for the restoration of rights for the mentally disabled were derived. Public guardians experienced excessive empowerment of their guardians or difficulties in the process of their duties, but were also able to defend the rights of the mental disabled and support self-determination right. Through this study, expansion of budgets and expansion of beneficiaries for public guardianship services, establishment of infrastructure for integration in the community, set-up a support organization for public guardian services and Raising awareness of the mental disabled and public guardian services were suggested.
In January 2020, the National Assembly passed the revisions of three bills which ease regulations on the use of personal information. The revised laws include the launch of an independent supervisory body, the arrangement of redundant regulations, and regulations for the development of the data economy. This paper analyzes the content and meaning of each law of the Three Revised Bills that Ease Regulations on the Use of Personal Information. And the future challenges outline three aspects: the establishment of a system to ensure the right to informational self-determination of privacy concerns, the establishment of a certification system and the presentation of reasonable guidelines, and the expectation of professional performance by the Personal Information Protection Commission.
Purpose: This study aimed to distinguish and describe the types of perceptions of do not resuscitate (DNR) proxy decisions among families of elderly patients in a long-term care facility. Methods: This exploratory study applied Q-methodology, which focuses on individual subjectivity. Thirty-four Q-statements were selected from 130 Q-populations formed based on the results of in-depth interviews and literature reviews. The P-samples were 34 families of elderly patients in a long-term care hospital in Busan, Korea. They categorized the Q-statements using a 9-point scale. Using the PC-QUANL program, factor analysis was performed with the P-samples along an axis. Results: The families' perceptions of the DNR proxy decision were categorized into three types. Type I, rational acceptance, valued consensus among family members based on comprehensive support from medical staff. Type II, psychological burden, involved hesitance in making a DNR proxy decision because of negative emotions and psychological conflict. Type III, discreet decisions, valued the patients' right to self-determination and desire for a legitimate proxy decision. Type I included 18 participants, which was the most common type, and types II and III each included eight participants. Conclusion: Families' perceptions of DNR proxy decisions vary, requiring tailored care and intervention. We suggest developing and providing interventions that may psychologically support families.
This study aims to analyse major changes of Mental Health Promotion and Welfare Service Support Act(MHPWSSA) and critically discuss these changes based on the major discourses on Mental Health Act revision. For this purposes this study reviewed literatures and government reports to understand human rights discourses, welfare discourses, and prevention discourses. Secondly, the major changes of MHPWSSA were analysed and discussed based on those discourses. This study found that MHPWSSA defined the concept of people with mental disorders narrowly, tightened the involuntary admission procedures, introduced welfare service support provisions and mental health promotion provisions. But this study shows that the new legislation may well be criticised due to neglect of the concept of disability and people with psychiatric disability, involuntary admission without mental capacity assessment, neglect of the basic values and principles of self determination and independent living common in welfare of the persons with disability. And the new legislation may be criticised due to overuse of the concept of mental health promotion as encompassing promotion, prevention, treatment and rehabilitation.
The Personal Information Protection Act enacted in March 2011 stated that the application target of this law includes all personal information processors in the public and private sector, and established the protection standard by phase such as collection, use and provision of personal information. There was an introduction of the Privacy Impact Assessment system that enables personal information processors to perform impact assessment autonomously if there are great concerns over the fact that making and expanding personal information files will influence the protection of personal information, while also making impact assessment compulsory for public institutions in specific reasons with great concerns for violating the rights of the subjects of information. This Act still has the problem that it is generally difficult to understand. This paper deals with the Korean legal practices about the personal information protection with regard to ambiguity and promotional system.
