A Study on the Judgment Criteria for the Trademark Dilution of Famous Marks

  • The trademark dilution of famous marks as a kind of unfair competition practice is defined and regulated in Article 2 (1) (c) of the Unfair Competition Prevention and Trade Secret Protection Act (hereinafter referred to as the Unfair Competition Prevention Act), which was newly established according to the amendment of the Act on February 3, 2001. Famous trademarks are universally protected in all around the world, which are likewise protected in the Republic of Korea by the Unfair Competition Prevention Actin line with such international trends. In order to establish the trademark dilution of famous marks, it is necessary to have the following characteristics: (1) high reputation of the original mark, (2) use of identical or similar markscompared to the original mark, (3) occurrence of blurring of discrimination or tarnishment of reputation; in particular, with respect to the degree of proof of 'blurring of discrimination or tarnishment of reputation', which is a constituent requirement of the trademark dilution of famous marks, it is reasonable to interpret the trademark dilution as concrete endangerment offense, neither harm-based offense nor abstract endangerment offense, and thus it should be considered that the crime is established if a specific realistic risk of blurring of discrimination or tarnishment of reputation occurs. Furthermore, in relation to the specific criteria of 'blurring of discrimination or tarnishment of reputation', it is necessary to comprehensively judge the degree of individual behavior in specific matters as a normative factor as well as the psychosocial viewpoint of the general public.

The Influence of Relationship Marketing in Design Companies on the Trust and Intent of Relationship Maintenance (디자인기업에서의 관계마케팅이 신뢰와 관계지속의도에 미치는 영향)

  • This study aims to analyze the effect on the adherence intention of enterprise image, trust, and relationship maintenance by the relation marketing in companies, especially in design companies, to examine the relationship establishment in the operation and communication between customers (users) on using the company's service and the member working for the company, and to suggest its substantiation of the mutual satisfaction effect. The research method was, first, analyzed based on the data collected after examining the published domestic and foreign papers, academic journals, publications, books, and internet in order to conduct the theoretic consideration. Also, for objective validity and empirical proof, the empirical analysis was conducted on the survey conducted and collected over two months for the employees of design companies living in Seoul and Gyeonggi-do, and the results are as follows. First, the result of verifying the relationship between relationship marketing and trust showed that the company's expertise does not significantly affect its trust while the company's communication and reputation affect significantly on trust. Second, the relationship between relationship marketing and sustainability has been verified that all variables, such as expertise, communication and reputation does not significantly effect the relationship maintenance. Third, the company's trust has significant effect on relationship maintenance. In addition, the implication and limitation of the study related to this were suggested in the conclusion.

The Analysis of the 6th Grade Students' Mathematical Thinking on the Application of Lakatos' Methodology (Lakatos 방법론을 통한 초등학교 6학년 학생들의 수학적 사고)

  • In this study, We analyzed the mathematical thinking of sixth grade students showed mathematics lessons through the application of Lakatos' methodology and search for the role of their teachers in this lessons. We supposed to find the solution to the way of teaching-learning regarding the Lakatos' methodology for the elementary school level. According to the stages of presenting a problem situation, suggesting an initial conjecture, examining the conjecture, and improving the conjecture, we had lessons 8 times that are applied to Lakato's methodology. We gathered and analyzed data from lessons and interviews recording videotapes, documents for this study. The participants showed a lot of mathematical thinking. They understood the problem situation with the skill of fundamental thinking and suggested the initial conjecture by the skill of developmental thinking and they found a counter-example to be able to rebut the initial conjecture by critical thinking. Correcting the conjecture not to have counter-example, they drew developmental thinking and made their thinking generalize.

The Value Relevance of Accounting Numbers in the New CEO's Early Years of Service (최고경영자 취임 초기 회계수치의 가치관련성)

  • In this research, The new CEO is expected to increase a reporting income through earning management for individual benefit such as a good reputation, high compensation and CEO' s contract extension in the early years of service, of which may influence value relevance of the accounting numbers. We investigate the change of value relevance from 2004 to 2014, compare firms with a change of CEO and firms with non-change of CEO and analysis the value relevance in the early years and in the late years of the new CEO. The results of research are as follows. First, value relevance of EPS of firms with change of CEO are decreased, whereas value relevance of BPS are increased in the regression of all sample. Second, value relevance of EPS are decreased, whereas value relevance of BPS are increased in the early years of the new CEO. This research makes a contribution to provide the first proof about influence of value relevance by the earning management in the early years of the new CEO in Korea.
