소득이전의 빈곤완화 및 빈곤이행 효과에 관한 연구 (The Effect of Income Transfer on Poverty Rate)

  • The primary purpose of this study is to analyze the decreasing effect of public and private income transfers on poverty rate. Two year data of Korean Labor and Income Panel Study (KLIPS, 1998, 1999) are used for the analysis, and 1/2 of median income and 1/3 of mean income are adopted to measure poverty rate. Although private income transfer contributes more to reduce the rate than the public transfer, the main effect for decreasing poverty rate is forced by the wage. Statistically significant variables that affect to the exit of poverty based on the logistic regression analysis are number of family members(-), wage(+), property income(+), social insurance benefit(+), and the transfer income(+). Therefore, the future policy should be more related with the active labor market policy for developing better human resources among the poor family.

  • In many parts of the world, low cost housing used to be built and maintained by the governments, based on designs and detail specifications prepared by the public sector with construction carried out by contractors. Results vary due to differences in design standards, workmanship and property management, depending also on the neighbourhood's care of the estates and their pattern of usage. In the UK, where Private Finance Initiative (PFI) has been used for infrastructure projects, there have been successful cases of city estate being transformed by PFI. These PFI housing schemes involve new-build, refurbishment as well as facility management. Unlike traditional construction, which is based on prescriptive specifications, PFI housing is based on output specifications. A study has been undertaken to compare the two specification approaches as they are applied to housing estate. Results are enlightening and serve as good reference to cities such as Hong Kong SAR and Singapore, where public housing provisions have been a major concern of their citizens as the building stock gets older.

점유이탈 예술품의 국제거래에 관한 법적 연구 - 문화재를 중심으로 - (A Legal Study on the International Trade of stolen/lost artworks: Focused on Illegal trafficking of cultural property)

  • 예술품의 국제거래상 준거법 채택의 문제는 실제로 소송의 결과와 밀접한 관계가 있는데, 최근 들어 국제예술품시장의 허브인 뉴욕을 중심으로 점차 현대적 혼합법을 채택하고 있다. 예술품 국제거래의 준거법 지정은 해당 국가의 사법규정만으로는 결정되기 곤란하며, 해당 국가의 이익 및 공익과 관련된 경우 공법규정도 함께 고려되어야 한다. 섭외적 사안에 대해서 우리 국제사법은 공공질서이론을 수용하고 있으며, 국제사법 제7조에 따라 입법목적상 해당 사안에 적용 되어야 하는 우리 강행규정은 준거법 지정여부와는 무관하게 적용된다. 여기서 말하는 강행규정이란 당사자 합의로 그 적용배제가 불가능 하고 외국법이 준거법인 경우에도 적용이 배제되지 않는 '국제적 강행법규'를 의미하며, 특정 법률이 국제적 강행법규에 해당하는 지는 법규의 의미와 목적상 적용의지를 가지는가를 면밀히 분석 후 판단해야 한다. 거래목적물이 문화재라면 관련 공법규범 역시 검토가 필요한데, 예술품의 국제거래 대상이 문화재의 범주에 속하는 경우, 당해 법원은 법정지의 강행법규까지 고려해야 한다. 우리 민법은 문화재 보호법이 적용되지 않는 경우에는 원칙적으로 문화재에 대한 선의취득을 인정하는데, 점유이탈 예술품 역시 선의취득의 대상이지만 도난 혹은 분실물인 경우 원소유자는 민법 제250조에 의해 도난, 분실 후 2년 내에 그 작품의 반환을 요구할 권리가 있고 매수인은 원소유자에게 반환하여야 한다. 나아가, 매수인이 전문 경매회사나 화랑, 갤러리 등 전문 업자에게 구입한 경우 원소유자에게 구입대금의 배상을 요구할 수 있고, 사적 거래로 구입한 경우에는 원소유자에게 구입가를 배상받지 못하고 작품을 반환해야 하는데, 이 경우 매수인은 매도인에 대하여 민법 제570조에 기한 책임을 물을 수 있다. 유니드로와(Unidroit) 협약 발효 이전에 도난 및 반출된 문화재에 대한 소급효의 부정과 미국의 조항 유보행사와 관련해서는 외교적 논의가 필요하며, 현재로서는 미국 연방도품법 활용 등 우회적 노력이 차선책이다.

  • Modern architecture after enlightenment period of Korea has been defamed indifferently before preparing devices for preservation. Many modern architecture has been underestimated by the feeling of being cultural victimized for Japan and economic logic. Other advanced countries make laws for their historic heritage with a concept for past-present-future. Also they re-create their cultural heritage to help their local economic. As the Registration System is established at july 2001, we have to find organic, positive interior space utilization methods about modern architecture. Modern architecture is private property in real using but it has historic trace. Therefore, modern architecture can be affirmative social property because it is a base of historic, cultural circumstances for local identity. The purpose of this study is to construct preservation and utilization methods of interior space for modern architecture.

  • Traditional housing must be conserved simultaneously with not only the building itself, but the circumstances of the surroundings. Hence, traditional housing should be developed as a product of a culture environment. However, most cultural properties have recently been treated as only a piece of property by irresponsible maintenance practices and damage placed on private traditional housing. Apparently, it has not always been a result of dweller's negligence. Thus, various policies must be needed to effectively preserve traditional housing. To do so, this study will indicate a new direction for the circumstance of preservation through cultural employment of traditional high-class housing as well as reduce maintenance and damage for dweller's convenience. Furthermore, this study will propose a renovation for popularization of Korean cultural assets through the gradual implementation of both economic value and public worth.

정보통신 국책개발 기술의 상용화과정 특성에 관한 연구 (The Characteristics of commercialization process in government-sponsored information technology: Korean Case)

  • Korean government has been putting efforts to promote development of technologies by government sponsored labs and to transfer, diffuse, and commercialize these technologies in private sector since mid 1980s. In spite of these efforts, utilization of government-sponsored technology remains in the very low level. According to the survey conducted by Korea Intellectual and Patent Office (1999), the ratio of unused industrial property rights including patents was above 70% of total industrial property rights. Survey on the information and telecommunication industry done by the Institute of Information Technology Assessment (IITA) in 1999 shows that the utilization ratio of government-sponsored technologies is about 55.8%. This is especially true where government is not the primary or end-user of technologies. The purposes of this paper are to (1) identify a process model of technology commercialization, (2) develop the related variables of each step in the six-step continuous process model of government-sponsored technology commercialization, (3) empirically investigate the data gathered through questionnaire survey, and (4) suggest policy alternatives for promoting technology commercialization in Information and Telecommunication industries.

  • In recent years, NASA, FAA and the aerospace industry, through MIL-HDBK-17 and the NASA-conceived AGATE(Advanced General Aviation Transport Experiments) program, have worked together to reduce the qualification burden imposed on individual aircraft manufacturers. AGATE is one of the most successful public/private cost-haring partnerships ever conceived, bringing together academia, the FAA, other government agencies and industry to develop affordable new technologies and accompanying industry standards and certification methods. In 2005, NASA established NCAMP(National Center for Advanced Materials Performance) with the purpose of refining and enhancing the AGATE process to a self-sustaining level to serve the entire aerospace industry in partnership with CMH-17, FAA, and SAE. In this paper, I will introduce briefly NCAMP process and explain its organization structure and core NCAMP documents. This paper can provide some help in establishing our certification system for composite materials where the NCAMP process is expected to be the most good model.

  • The article deals with the problematic issues of defining information as an object of private relations. Definitions that they are intangible and non-consumable by nature, are inextricably linked to a specific material carrier are/or secured by the subject that transmits them, messages, and information that have quantitative and qualitative characteristics, and are capable of having a freight or another value, and in case of its illegal usage causing damage and moral harm.

  • 지리정보DB는 구축하는데 많은 비용과 노력이 수반됨에도 불구하고 비교적 간편하게 복제하여 활용할 수 있기 때문에 유통관리에 있어 법적 보호체계가 마련되어야 한다. 그러나 우리나라의 저작권법은 보호기준을 소재의 선택 또는 배열에 창작성으로 규정하고 있어 소재의 선택 또는 배열에 창작성이 낮거나 없는 데이터베이스는 보호받을 수 없는 실정이다. 본 연구는 이러한 현실적인 법 체계하에서 데이터베이스 제작에 따른 자료수집과 구성에 대한 노력 그리고 유통 및 활용에 따른 관련집단간의 이해갈등을 조정하기 위한 보호방안을 마련하기 위해 시도되었다.

  • The saying likely as "In the rapidly-changing outside management environment, the light-weighted body only able to survive" means the 'lightness' in working space, reducing expenditure for immovable property and unnecessary facility, and also means the flexibility of facility which is ready to cope promptly with the approaching situation. For such reason, as many enterprises do not support an individual workstation for each person but by introduction of sharing system, also reducing the area for working space, they have made the immovable property expense per person curtailed. Though the reduction of the immovable property expense that subsequently gained by merely decreasing of working space brings a remarkable effect of retrenchment, there is also a worrying opinion that because of the narrowed working space than before, or by disappearing of private space, a possible non-productive effect which let working enthusiasm falls down might be brought. By practicing such investigating method, at the first stage survey, the Satisfaction of non-territorial and territorial office user and the order of required improvement are figured out, also arranged the appraisal items as 6 factors in total, and all of the factors were being influenced to the entire satisfaction in statistically meaningful level.
