일본(日本) 의학醫學의 '절충파(折衷派)'에 관(關)한 연구(硏究) (A Study on the 'Zhe Zhong Pai'(折衷派) of the Traditional Medicine of Japan)

  • The outline and characteristics of the important doctors of the 'Zhe Zhong Pai'(折衷派) are as follows. Part 1. In the late Edo(江戶) period The 'Zhe Zhong Pai', which tried to take the theory and clinical treatment of the 'Hou Shi Pai (後世派)' and the 'Gu Fang Pai (古方派)' and get their strong points to make treatments perfect, appeared. Their point was 'The main part is the art of the ancients, The latter prescriptions are to be used'(以古法爲主, 後世方爲用) and the "Shang Han Lun(傷寒論)" was revered for its treatments but in actual use it was not kept at that. As mentioned above The 'Zhe Zhong Pai ' viewed treatments as the base, which was the view of most doctors in the Edo period, However, the reason the 'Zhe Zhong Pai' is not valued as much as the 'Gu Fang Pai' by medical history books in Japan is because the 'Zhe Zhong Pai' does not have the substantiation or uniqueness of the 'Gu Fang Pai', and also because the view of 'gather as well as store up' was the same as the 'Kao Zheng Pai', Moreover, the 'compromise'(折衷) point of view was from taking in both Chinese and western medical knowledge systems(漢蘭折衷), Generally the pioneer of the 'Zhe Zhong Pai' is seen as Mochizuki Rokumon(望月鹿門) and after that was Fukui Futei(福井楓亭), Wadato Kaku(和田東郭), Yamada Seichin(山田正珍) and Taki Motohiro(多紀元簡), Part 2. The lives of Wada Tokaku(和田東郭), Nakagame Kinkei(中神琴溪), Nei Teng Xi Zhe(內藤希哲), the important doctors of the 'Zhe Zhong Pai', are as follows First. Wada Tokaku(和田東郭, 1743-1803) was born when the 'Hou Shi Pai' was already declining and the 'Gu Fang Pai' was flourishing and learned medicine from a 'Hou Shi Pai' doctor, Hu Tian Xu Shan(戶田旭山) and a 'Gu Fang Pai' doctor, Yoshimasu Todo(吉益東洞). He was not hindered by 'the old ways(古方), and did not lean towards 'the new ways(後世方)' and formed a way of compromise that 'looked at hardness and softness as the same'(剛柔相摩) by setting 'the cure of the disease' as the base, and said that to cure diseases 'the old way' must be used, but 'the new way' was necessary to supplement its shortcomings. His works include "Dao Shui Suo Yan", "Jiao Chiang Fang Yi Je" and "Yi Xue Sho(醫學說)" Second. Nakagame Kinkei(中神琴溪, 1744-1833) was famous for leaving Yoshirnasu Todo(吉益東洞) and changing to the 'Zhe Zhong Pai', and in his early years used qing fen(輕粉) to cure geisha(妓女) of syphilis. His argument was "the "Shang Han Lun" must be revered but needs to be adapted", "Zhong jing can be made into a follower but I cannot become his follower", "the later medical texts such as "Ru Men Shi Qin(儒門事親)" should only be used for its prescriptions and not its theories". His works include "Shang Han Lun Yue Yan(傷寒論約言) Third. Nei Teng Xi Zhe(內藤希哲, 1701-1735) learned medicine from Qing Shui Xian Sheng(淸水先生) and went out to Edo. In his book "Yi Jing Jie Huo Lun(醫經解惑論)" he tells of how he went from 'learning'(學) to 'skepticism'(惑) and how skepticism made him learn in 'the six skepticisms'(六惑). In the latter years Xi Zhe(希哲) combines the "Shen Nong Ben Cao jing(神農本草經)", the main text for herbal medicine, "Ming Tang jing(明堂經)" of accupuncture, basic theory texts "Huang Dui Nei jing(黃帝內徑)" and "Nan jing(難經)" with the "Shang Han Za Bing Lun", a book that the 'Gu Fang Pai' saw as opposing to the rest, and became 'an expert of five scriptures'(五經一貫). Part 3. Asada Showhaku(淺田宗伯, 1815-1894) started medicine at Zhong Cun Zhong(中村中倧) and learned 'the old way'(古方) from Yoshirnasu Todo and got experience through Chuan Yue(川越) and Fu jing(福井) and received teachings in texts, history and Wang Yangmin's principles(陽明學) from famous teachers. Showhaku(宗伯) meets a medical official of the makufu(幕府), Ben Kang Zong Yuan(本康宗圓), and recieves help from the 3 great doctors of the Edo period, Taki Motokato(多紀元堅), Xiao Dao Xue GU(小島學古) and Xi Duo Cun Kao Chuang and further develops his arts. At 47 he diagnoses the general Jia Mao(家茂) with 'heart failure from beriberi'(脚氣衝心) and becomes a Zheng Shi(徵I), at 51 he cures a minister from France and received a present from Napoleon, at 65 he becomes the court physician and saves Ming Gong(明宮) jia Ren Qn Wang(嘉仁親王, later the 大正犬皇) from bodily convulsions and becomes 'the vassal of merit who saved the national polity(國體)' At the 7th year of the Meiji(明治) he becomes the 2nd owner of Wen Zhi She(溫知社) and takes part in the 'kampo continuation movement'. In his latter years he saw 14000 patients a year, so we can estimate the quality and quantity of his clinical skills Showhaku(宗伯) wrote over 80 books including the "Ju Chuang Shu Ying(橘窓書影)", "WU Wu Yao Shi Fang Han(勿誤藥室方函)", "Shang Han Biang Shu(傷寒辨術)", "jing Qi Shen Lun(精氣神論)", "Hunag Guo Ming Yi Chuan(皇國名醫傳)" and the "Xian Jhe Yi Hua(先哲醫話)". Especially in the "Ju Chuang Shu Ying(橘窓書影)" he says "the old theories are the main, and the new prescriptions are to be used"(以古法爲主, 後世方爲用), stating the 'Zhe Zhong Pai' way of thinking. In the first volume of "Shung Han Biang Shu(傷寒辨術) and "Za Bing Lun Shi(雜病論識)", 'Zong Ping'(總評), He discerns the parts that are not Zhang Zhong Jing's writings and emphasizes his theories and practical uses.

국내 명승 정책과 미국 국립공원 시스템의 지정 특성 비교 (A Comparison of the Designation Characteristics of Korean Scenic Sites Policies and National Park System in the United States)

  • 본 연구는 국내 명승과 미국 국립공원을 대상으로 정의 및 주요 가치, 지정 절차 및 유형, 지정추이를 살펴보고 두 자연유산의 지정 특성을 분석한 결과 다음과 같은 결론을 도출하였다. 첫째, 명승은 경관성을 기본 전제로 학술적, 역사적, 인문적 가치를 포함하는 복합유산으로서의 성격을 지니고 있다. 미국 국립공원은 공공성을 기반으로 하는 자연유산으로서 경관의 보호를 통해 국민의 자연유산 향유에 기여하고 생태적·역사적 가치를 동시에 만족하는 것을 목표로 삼고 있다. 둘째, 명승의 지정은 소유자나 관리자, 지자체의 요청이나 문화재청장의 직권으로 지정신청과 지정조사를 거쳐 문화재 위원회의 심의를 통해 지정여부를 결정한다. 지정조사는 기초자원조사와 유형별 자원조사로 구분되며, 1970년 명주 청학동 소금강의 최초 명승 지정 이후 2000년대까지 명승 지정은 저조했으나 2006년 이후 명승 활성화 정책에 힘입어 지정건수가 급격히 증가했고, 자연명승과 역사문화명승의 비중이 균형을 이루게 되었다. 미국 국립공원은 의회나 대통령에 의해 지정이 결정되며 국립공원청에서는 사전검사조사를 통한 잠정자원의 특별자원연구 수행 여부 결정, 특별자원연구 결과에 따른 국립공원 지정기준 만족 여부, 우선순위 결정이 순차적으로 이루어진다. 미국 국립공원은 의회뿐만 아니라 대통령의 국립기념지 지정 권한 부여를 통해 국립공원의 지정경로가 확대되었고, 국립공원청의 통합 운영으로 여러 부처에서 관할하던 유산들이 국립공원에 포함되어 지정건수가 증가하였다. 또한 사적지법의 제정으로 역사유적이 다수 지정되고, 여가공간 제공을 위한 레크리에이션 지역들을 지정하여 총 18개 유닛으로 분류·관리하고 있다. 셋째, 명승과 미국 국립공원의 지정 특성을 비교한 결과 복합적 가치를 지닌 자연유산의 지정, 상호보완적 지정체계와 자원특성에 따른 유형분류, 주무부처 신설 및 지정 정책에 따른 유산의 균형화가 특징으로 확인되었다. 두 유산은 경관성과 공공성을 바탕으로 생태적, 역사적, 학술적 가치를 동시에 충족하는 복합적 자연유산의 특징을 지니고 있었다. 또한 양국 모두 기초자원조사와 심화단계의 지정조사를 통해 순차적, 상호보완적 조사로 유산의 지정을 심의하는 체계가 확인되었으며 자원의 특성에 따라 각 유형을 분류하였다. 이외에 국내 명승 활성화 정책과 미국의 국립공원청 통합운영은 두 유산의 지정 양상에 영향을 미쳤으며, 자연유산과 역사문화유산의 균형을 이루었다. 넷째, 명승과 국립공원의 자원유형과 보존관리 방식은 상당부분 연관성을 지니고 있었다. 미국 국립공원의 자연지역은 국내 천연기념물의 유형들이 주요 자원으로 포함되며, 자연명승과 유사한 특성을 지닌다. 또한 역사유적은 경관성 측면에서 역사문화명승의 지정기준과 유사하며, 전쟁 및 유명인물 관련 유적이 주를 이루는 양상이 사적의 유형과 관련있었다. 보존관리 측면에서 미국 국립공원의 자연지역은 생태계 원상을 그대로 두는 방식을 지니고 있으나 점적 자원에 대한 중점관리는 국내 자연유산 보호체계가 유용할 것으로 보인다. 한편, 역사자원은 사적과 역사문화명승이 전통시대 생활상 전반을 포함하고 있으나, 미국 국립공원의 역사유적은 전쟁사, 유명인 관련 유적을 대상으로 현대까지 시간적 범위를 설정하였으며, 현존 자원을 토대로 적극적인 향유 프로그램 제공이 차이점으로 도출되었다.

항공기(航空機) 사고조사제도(事故調査制度)에 관한 연구(硏究) (A Study on the System of Aircraft Investigation)

  • The main purpose of the investigation of an accident caused by aircraft is to be prevented the sudden and casual accidents caused by wilful misconduct and fault from pilots, air traffic controllers, hijack, trouble of engine and machinery of aircraft, turbulence during the bad weather, collision between birds and aircraft, near miss flight by aircrafts etc. It is not the purpose of this activity to apportion blame or liability for offender of aircraft accidents. Accidents to aircraft, especially those involving the general public and their property, are a matter of great concern to the aviation community. The system of international regulation exists to improve safety and minimize, as far as possible, the risk of accidents but when they do occur there is a web of systems and procedures to investigate and respond to them. I would like to trace the general line of regulation from an international source in the Chicago Convention of 1944. Article 26 of the Convention lays down the basic principle for the investigation of the aircraft accident. Where there has been an accident to an aircraft of a contracting state which occurs in the territory of another contracting state and which involves death or serious injury or indicates serious technical defect in the aircraft or air navigation facilities, the state in which the accident occurs must institute an inquiry into the circumstances of the accident. That inquiry will be in accordance, in so far as its law permits, with the procedure which may be recommended from time to time by the International Civil Aviation Organization ICAO). There are very general provisions but they state two essential principles: first, in certain circumstances there must be an investigation, and second, who is to be responsible for undertaking that investigation. The latter is an important point to establish otherwise there could be at least two states claiming jurisdiction on the inquiry. The Chicago Convention also provides that the state where the aircraft is registered is to be given the opportunity to appoint observers to be present at the inquiry and the state holding the inquiry must communicate the report and findings in the matter to that other state. It is worth noting that the Chicago Convention (Article 25) also makes provision for assisting aircraft in distress. Each contracting state undertakes to provide such measures of assistance to aircraft in distress in its territory as it may find practicable and to permit (subject to control by its own authorities) the owner of the aircraft or authorities of the state in which the aircraft is registered, to provide such measures of assistance as may be necessitated by circumstances. Significantly, the undertaking can only be given by contracting state but the duty to provide assistance is not limited to aircraft registered in another contracting state, but presumably any aircraft in distress in the territory of the contracting state. Finally, the Convention envisages further regulations (normally to be produced under the auspices of ICAO). In this case the Convention provides that each contracting state, when undertaking a search for missing aircraft, will collaborate in co-ordinated measures which may be recommended from time to time pursuant to the Convention. Since 1944 further international regulations relating to safety and investigation of accidents have been made, both pursuant to Chicago Convention and, in particular, through the vehicle of the ICAO which has, for example, set up an accident and reporting system. By requiring the reporting of certain accidents and incidents it is building up an information service for the benefit of member states. However, Chicago Convention provides that each contracting state undertakes collaborate in securing the highest practicable degree of uniformity in regulations, standards, procedures and organization in relation to aircraft, personnel, airways and auxiliary services in all matters in which such uniformity will facilitate and improve air navigation. To this end, ICAO is to adopt and amend from time to time, as may be necessary, international standards and recommended practices and procedures dealing with, among other things, aircraft in distress and investigation of accidents. Standards and Recommended Practices for Aircraft Accident Injuries were first adopted by the ICAO Council on 11 April 1951 pursuant to Article 37 of the Chicago Convention on International Civil Aviation and were designated as Annex 13 to the Convention. The Standards Recommended Practices were based on Recommendations of the Accident Investigation Division at its first Session in February 1946 which were further developed at the Second Session of the Division in February 1947. The 2nd Edition (1966), 3rd Edition, (1973), 4th Edition (1976), 5th Edition (1979), 6th Edition (1981), 7th Edition (1988), 8th Edition (1992) of the Annex 13 (Aircraft Accident and Incident Investigation) of the Chicago Convention was amended eight times by the ICAO Council since 1966. Annex 13 sets out in detail the international standards and recommended practices to be adopted by contracting states in dealing with a serious accident to an aircraft of a contracting state occurring in the territory of another contracting state, known as the state of occurrence. It provides, principally, that the state in which the aircraft is registered is to be given the opportunity to appoint an accredited representative to be present at the inquiry conducted by the state in which the serious aircraft accident occurs. Article 26 of the Chicago Convention does not indicate what the accredited representative is to do but Annex 13 amplifies his rights and duties. In particular, the accredited representative participates in the inquiry by visiting the scene of the accident, examining the wreckage, questioning witnesses, having full access to all relevant evidence, receiving copies of all pertinent documents and making submissions in respect of the various elements of the inquiry. The main shortcomings of the present system for aircraft accident investigation are that some contracting sates are not applying Annex 13 within its express terms, although they are contracting states. Further, and much more important in practice, there are many countries which apply the letter of Annex 13 in such a way as to sterilise its spirit. This appears to be due to a number of causes often found in combination. Firstly, the requirements of the local law and of the local procedures are interpreted and applied so as preclude a more efficient investigation under Annex 13 in favour of a legalistic and sterile interpretation of its terms. Sometimes this results from a distrust of the motives of persons and bodies wishing to participate or from commercial or related to matters of liability and bodies. These may be political, commercial or related to matters of liability and insurance. Secondly, there is said to be a conscious desire to conduct the investigation in some contracting states in such a way as to absolve from any possibility of blame the authorities or nationals, whether manufacturers, operators or air traffic controllers, of the country in which the inquiry is held. The EEC has also had an input into accidents and investigations. In particular, a directive was issued in December 1980 encouraging the uniformity of standards within the EEC by means of joint co-operation of accident investigation. The sharing of and assisting with technical facilities and information was considered an important means of achieving these goals. It has since been proposed that a European accident investigation committee should be set up by the EEC (Council Directive 80/1266 of 1 December 1980). After I would like to introduce the summary of the legislation examples and system for aircraft accidents investigation of the United States, the United Kingdom, Canada, Germany, The Netherlands, Sweden, Swiss, New Zealand and Japan, and I am going to mention the present system, regulations and aviation act for the aircraft accident investigation in Korea. Furthermore I would like to point out the shortcomings of the present system and regulations and aviation act for the aircraft accident investigation and then I will suggest my personal opinion on the new and dramatic innovation on the system for aircraft accident investigation in Korea. I propose that it is necessary and desirable for us to make a new legislation or to revise the existing aviation act in order to establish the standing and independent Committee of Aircraft Accident Investigation under the Korean Government.

편액과 시문으로 본 요월정원림(邀月亭園林)의 입지 및 조영 해석 (The Location and Landscape Composition of Yowol-pavilion Garden Interpreted from Tablet & Poetry)

  • 본 연구는 편액과 시문이 과거 누정원림의 고유한 입지 및 조영 특성 추론의 중요한 준거(準據)가 된다는 전제 하에, 요월정원림(邀月亭園林)을 대상으로 과거 시점의 입지 및 조영 해석을 고구(考究)하기 위해 시도되었다. 요월정원림이 갖는 의미와 문화재적 위상과 가치의 진정성 제고 및 보존의 당위성을 논의할 목적으로 시도된 연구결과는 다음과 같다. 첫째, 요월정원림은 정원주 김경우(金景遇)를 비롯한 당대 거유들이 교유한 시율풍류의 현장이었다. "조선환여승람 호남읍지(湖南邑誌) 장성읍지(長城邑誌)" 등 고문헌을 통해 사화(士禍)를 피해 머문 은신처로서의 성격과 함께 지역정체성을 형성한 교두보로서의 장소성이 확인되었다. 또한 "요월정원운(邀月亭原韻)"을 통해 누정원림 작정(作庭) 의도 및 조영 동기를 확인한 바, 요월정원림은 세속과 탈속 그리고 현실과 이상이 뒤섞여 길항(拮抗)한 공간으로 해석된다. 둘째, 당호 요월(邀月)은 누정에서 조망했을 때의 승경적 요인 및 자연현상과 관련된 명칭으로, 마주한 '월봉산에 뜨는 달을 맞이함'을 함의하는 어휘로, 이는 자연의 섭리이자 풍류로서 탈속의 이미지와 맞닿아 있다. 즉 요월정은 세속의 희비를 벗어나 자연의 섭리를 따르려한 조영 의도를 반영한 당호로 해석된다. 셋째, 요월정원림의 입지는 "영광속수여지승람(靈光續修輿地勝覽)"을 통해 조영자가 퇴관 후 휴식을 위해 마련한 처소였으며, 월봉산을 마주하여 황룡강(黃龍江)이 굽이쳐 흐르던 승경지였음을 고문헌과 다수의 시문을 통해 확인하였다. 특히, 수호인 인터뷰에 따르면 요월정원림에서 야경의 시지각 빈도(頻度)는 수호인 거처인 고직사에서 요월정을 향해 황룡강 방향인 동쪽을 숙시각(熟視角)으로 조망했을 때가 가장 높다고 한다. 또한 시지각 강도(强度)가 가장 높고 아름다운 풍경은 요월정 좌측 배후면에서 달이 부상하여 요월정 전면(前面)의 배롱나무동산을 가로질러 요월정과 마주한 월봉산 사이에 남중한 때로 증언한 바 있다. 현재 요월정원림의 좌향은 $SE\;141.2^{\circ}$로서 거의 남동향 하고 있는데, 이와 같은 요월정 좌향 설정은 지형조건뿐 아니라 달의 궤적을 유상(遊賞)하기에 최적화된 방향과 시계(視界)를 확보하기 위한 기도(企圖)가 담겼다고 판단된다. 나아가 전면의 황룡강 수면 위로 남중한 달빛이 투영됨으로써, 하늘의 달과 황룡강 강물에 투영된 달이 동시에 감지되게끔 고려된 것으로 추론된다. 넷째, 현재 요월정원림은 요월정과 광산김씨문숙공파종회각(光山金氏文肅公派宗會閣) 및 고직사(庫直舍)로 구성된 '내원 권역'과 진입부를 아우른 배롱나무동산 및 소나무 배후림이 포함된 '외원 권역'으로 구분된다. 나아가 '용소 및 수생식물원 권역' 및 최근 조성된 '황룡정과 공원 권역'으로 외연(外緣)이 확산되면서 교란되고 변용되었다. 다섯째, 조영 당시 요월정원림은 누정에서 조망한 풍경을 안아 들여 누정을 중심으로 지근거리의 일정한 자연을 점유한 방식인 '경계 없는 산수원림'이었으나, 현재 복합경관은 과거 원형경관과는 괴리된 '이질화 분절화 파편화된' 경관으로 파악된다. 마지막으로, 요월정원림이 문화재지정보호구역임을 감안할 때, 편액과 기문에 묘사된 완전한 원형경관으로의 복원은 아니더라도 최소한 원림권역에서의 경관적 악영향과 시각적 훼손을 최소화하기 위한 대책수립이 요망된다.

일본 '고증파(考證派)' 의학에 관한 연구 (A Study on The 'Kao Zheng Pai'(考證派) of The Traditional Medicine of Japan)

  • 1. The 'Kao Zheng Pai(考證派) comes from the 'Zhe Zhong Pai' and is a school that is influenced by the confucianism of the Qing dynasty. In Japan Inoue Kinga(井上金娥), Yoshida Koton(吉田篁墩) became central members, and the rise of the methodology of historical research(考證學) influenced the members of the 'Zhe Zhong Pai', and the trend of historical research changed from confucianism to medicine, making a school of medicine based on the study of texts and proving that the classics were right. 2. Based on the function of 'Nei Qu Li '(內驅力) the 'Kao Zheng Pai', in the spirit of 'use confucianism as the base', researched letters, meanings and historical origins. Because they were influenced by the methodology of historical research(考證學) of the Qing era, they valued the evidential research of classic texts, and there was even one branch that did only historical research, the 'Rue Xue Kao Zheng Pai'(儒學考證派). Also, the 'Yi Xue Kao Zheng Pai'(醫學考證派) appeared by the influence of Yoshida Kouton and Kariya Ekisai(狩谷掖齋). 3. In the 'Kao Zheng Pai(考證派)'s theories and views the 'Yi Xue Kao Zheng Pai' did not look at medical scriptures like the "Huang Di Nei Jing"("黃帝內經") and did not do research on 'medical' related areas like acupuncture, the meridian and medicinal herbs. Since they were doctors that used medicine, they naturally were based on 'formulas'(方劑) and since their thoughts were based on the historical ideologies, they valued the "Shang Han Ja Bing Lun" which was revered as the 'ancestor of all formulas'(衆方之祖). 4. The lives of the important doctors of the 'Kao Zheng Pai' Meguro Dotaku(目黑道琢) Yamada Seichin(山田正珍), Yamada Kyoko(山田業廣), Mori Ritsi(森立之) Kitamura Naohara(喜多村直寬) are as follows. 1) Meguro Dotaku(目黑道琢 1739${\sim}$1798) was born of lowly descent but, using his intelligence and knowledge, became a professor as a Shi Jing Yi(市井醫) and as a professor for 34 years at Ji Shou Guan mastered the "Huang Di Nei Jing" after giving over 300 lectures. Since his pupil, Isawara Ken taught the Lan Men Wu Zhe(蘭門五哲) and Shibue Chusai, Mori Ritsi(森立之), Okanishi Gentei(岡西玄亭), Kiyokawa Gendoh(淸川玄道) and Yamada Kyoko(山田業廣), Meguro Dotaku is considered the founder of the 'Yi Xue Kao Zheng Pai'. 2) The family of Yamada Seichin(山田正珍 1749${\sim}$1787) had been medical officials in the Makufu(幕府) and the many books that his ancestors had left were the base of his art. Seichin learned from Shan Ben Bei Shan(山本北山), a 'Zhe Zhong Pai' scholar, and put his efforts into learning, teaching and researching the "Shang Han Lun"("傷寒論"). Living in a time between 'Gu Fang Pai'(古方派) member Nakanishi Goretada(中西惟忠) and 'Kao Zheng Pai' member Taki Motohiro(多紀元簡), he wrote 11 books, 2 of which express his thoughts and research clearly, the "Shang Han Lun Ji Cheng"("傷寒論集成") and "Shang Han Kao"("傷寒考"). His comparison of the 'six meridians'(3 yin, 3 yang) between the "Shang Han Lun" and the "Su Wen Re Lun"("素問 熱論) and his acknowledgement of the need and rationality of the concept of Yin-Yang and Deficient-Replete distinguishes him from the other 'Gu Fang Pai'. Also, his dissertation of the need for the concept doesn't use the theories of latter schools but uses the theory of the "Shang Han Lun" itself. He also became the first owner of the Wen Zhi She(溫知社), whose main purpose was the revival of kampo, and launched the monthly magazine Wen Zi Yi Tan(溫知醫談). He also diagnosed and prescribed for the prince Ming Gong(明宮). He usually analyzed the 'symptoms' of diseases but the composition, measurement, processing and application of medicine were all in the spectrum of 'analystic research' and 'researching analysis'. 4) The ancestors of Mori Rits(森立之 1807${\sim}$ 1885) were warriors but he became a doctor by the will of his mother, and he learned from Shibue Chosai(澁江抽齋) and Isawaran Ken and later became a pupil of Shou Gu Yi Zhai, a historical research scholar. He then became a lecturer of medical herbs at the Yi Xue Guan, and later participated in the proofreading of "Yi Xin Fang"("醫心方") and with Chosai compiled the "Jing Ji Fang Gu Zhi"("神農本草經"). He visited the Chinese scholar Yang Shou Jing(楊守敬) in 1881 and exchanged books and ideas. Of his works, there are the collections(輯複本) of "Shen Nong Ben Cao Jing"(神農本草經) and "You Xiang Yi Hwa"("遊相醫話") and the records, notes, poems, and diaries such as "Zhi Yuan Man Lu"("枳園漫錄") and "Zhi Yuan Sui Bi"("枳園隨筆") that were not published. His thoughts were that in restoring the "Shen Nong Ben Cao Jing", "the herb to the doctor is like the "Shuo Wen Jie Zi"("說文解字") to the scholar", and he tried to restore the ancient herbal text using knowledge of medicine and investigation(考據). Also with Chosai he compiled the "Jing Ji Fang Gu Zhi"("經籍訪古志") using knowledge of ancient text. Ritzi left works on pure investigation, paid much attention to social problems, and through 12 years of poverty treated all people and animals in all branches of medicine, so he is called a 'half confucianist half doctor'(半儒半醫). 5) Kitamurana Ohira(喜多村直寬 1804${\sim}$1876) learned scriptures and ancient texts from confucian scholar Asaka Gonsai, and learned medicine from his father Huai Yaun(槐園). He became a teacher in the Yi Xue Guan in his middle ages, and to repay his country, he printed 266 volumes of "Yi Fang Lei Ju("醫方類聚") and 1000 volumes of "Tai Ping Yu Lan"("太平禦覽") and devoted it to his country to be spread. His works are about 40 volumes including "Jin Qui Yao Lue Shu Yi" and "Lao Yi Zhi Yan" but most of them are researches on the "Shang Han Za Bing Lun". In his "Shang Han Lun Shu Yi"("傷寒論疏義") he shows the concept of the six meridians through the Yin-Yang, Superficial or internal, cold or hot, deficient or replete state of diseases, but did not match the names with the six meridians of the meridian theory, and this has something in common with the research based on the confucianism of Song(宋儒). In clinical treatment he was positive toward old and new methods and also the experience of civilians, but was negative toward western medicine. 6) The ancestor of the Taki family Tanbano Yasuyori(丹波康賴 912-955) became a Yi Bo Shi(醫博士) by his medical skills and compiled the "Yi Xin Fang"("醫心方"). His first son Tanbano Shigeaki(丹波重明) inherited the Shi Yao Yuan(施藥院) and the third son Tanbano Masatada(丹波雅忠) inherited the Dian You Tou(典藥頭). Masatada's descendents succeeded him for 25 generations until the family name was changed to Jin Bao(金保) and five generations later it was changed again to Duo Ji(多紀). The research scholar Taki Motohiro was in the third generation after the last name was changed to Taki, and his family kept an important part in the line of medical officers in Japan. Taki Motohiro(多紀元簡 1755-1810) was a teacher in the Yi Xue Guan where his father was residing, and became the physician for the general Jia Qi(家齊). He had a short temper and was not good at getting on in the world, and went against the will of the king and was banished from Ao Yi Shi(奧醫師). His most famous works, the "Shang Han Lun Ji Yi" and "Jin Qui Yao Lue Ji Yi" are the work of 20 years of collecting the theories of many schools and discussing, and is one of the most famous books on the "Shang Han Lun" in Japan. "Yi Sheng" is a collection of essays on research. Also there are the "Su Wen Shi"("素問識"), "Ling Shu Shi"("靈樞識"), and the "Guan lu Fang Yao Bu"("觀聚方要補"). Taki Motohiro(多紀元簡)'s position was succeeded by his third son Yuan Yin(元胤 1789-1827), and his works include works of research such as "Nan Jing Shu Jeng"("難經疏證"), "Ti Ya"("體雅"), "Yao Ya"("藥雅"), "Ji Ya"("疾雅"), "Ming Yi Gong An"("名醫公案"), and "Yi Ji Kao"("醫籍考"). The "Yi Ji Kao" is 80 volumes in length and lists about 3000 books on medicine in China before the Qing Dao Guang(道光), and under each title are the origin, number of volumes, state of existence, and, if possible, the preface, Ba Yu(跋語) and biography of the author. The younger sibling of Yuan Yin(元胤 1789-1827), Yuan Jian(元堅 1795-1857) expounded ancient writings at the Yi Xue Guan only after he reached middle age, was chosen for the Ao Yi Shi(奧醫師) and later became a Fa Yan(法眼), Fa Yin(法印) and Yu Chi(樂匙). He left about 15 texts, including "Su Wen Shao Shi"("素間紹識"), "Yi Xin Fang"("醫心方"), published in school, "Za Bing Guang Yao"("雜病廣要"), "Shang Han Guang Yao"(傷寒廣要), and "Zhen Fu Yao Jue"("該腹要訣"). On the Taki family's founding and working of the Yi Xue Guan Yasuka Doumei(失數道明) said they were "the people who took the initiative in Edo era kampo medicine" and evaluated their deeds in the fields of 'research of ancient text', 'the founding of Ji Shou Guan and medical education', 'publication business', 'writing of medical text'. 5. The doctors of the 'Kao Zheng Pai ' based their operations on the Edo Yi Xue Guan, and made groups with people with similar ideas to them, making a relationship 'net'. For example the three families of Duo Ji(多紀), Tang Chuan(湯川) and Xi Duo Cun(喜多村) married and adopted with and from each other and made prefaces and epitaphs for each other. Thus, the Taki family, the state science of the Makufu, the tendency of thinking, one's own interests and glory, one's own knowledge, the need of the society all played a role in the development of kampo medicine in the 18th and 19th century.

  • 1.The 'Kao Zheng Pai'(考證派) comes from the 'Zhe Zhong Pai(折衷派)' and is a school that is influenced by the confucianism of the Qing dynasty. In Japan Inoue Kinga(井上金峨), Yoshida Koton(古田篁墩 $1745{\sim}1798$) became central members, and the rise of the methodology of historical research(考證學) influenced the members of the 'Zhe Zhong Pai', and the trend of historical research changed from confucianism to medicine, making a school of medicine based on the study of texts and proving that the classics were right. 2. Based on the function of 'Nei Qu Li'(內驅力) the 'Kao Zheng Pai', in the spirit of 'use confucianism as the base', researched letters, meanings and historical origins. Because they were influenced by the methodology of historical research(考證學) of the Qing era, they valued the evidential research of classic texts, and there was even one branch that did only historical research, the 'Rue Xue Kao Zheng Pai'(儒學考證派). Also, the 'Yi Xue Kao Zheng Pai'(醫學考證派) appeared by the influence of Yoshida Kouton and Kariya Ekisai(狩谷掖齋). 3. In the 'Kao Zheng Pai(考證派)'s theories and views the 'Yi Xue Kao Zheng Pai' did not look at medical scriptures like the "Huang Di Nei Jing"("黃帝內經") and did not do research on 'medical' related areas like acupuncture, the meridian and medicinal herbs. Since they were doctors that used medicine, they naturally were based on 'formulas'(方劑) and since their thoughts were based on the historical ideologies, they valued the "Shang Han Ja Bing Lun" which was revered as the 'ancestor of all formulas'(衆方之祖). 4. The lives of the important doctors of the 'Kao Zheng Pai' Meguro Dotaku(目黑道琢) Yamada Seichin(山田正珍), Yamada Kyoko(山田業廣), Mori Ritsi(森立之) Kitamura Naohara(喜多村直寬) are as follows. 1) Meguro Dotaku(目黑道琢 $1739{\sim}1798$) was born of lowly descent but, using his intelligence and knowledge, became a professor as a Shi Jing Yi(市井醫) and as a professor for 34 years at Ji Shou Guan(躋壽館) mastered the "Huang Di Nei Jing" after giving over 300 lectures. Since his pupil, Isawara Ken(伊澤蘭軒) taught the Lan Men Wu Zhe(蘭門五哲) and Shibue Chusai(澀江抽齋), Mori Ritsi(森立之), Okanishi Gentei(岡西玄亭), Kiyokawa Gendoh(淸川玄道) and Yamada Kyoko(山田業廣), Meguro Dotaku is considered the founder of the 'Yi Xue Kao Zheng Pai'. 2) The family of Yamada Seichin(山田正珍 $1749{\sim}1787$) had been medical officials in the Makufu(幕府) and the many books that his ancestors had left were the base of his art.   • 《해악전도첩(海嶽全圖帖)》은 금강산과 해금강, 관동팔경을 그린 60점의 실경산수화와 51편의 기문(記文)으로 이루어진 화첩으로 규모와 화풍에 있어 보기 드문 작품이다. 그림의 특징은 화면을 가득 채운 구성과 남종화풍을 따르면서도 거칠고 파격적인 화법, 산석(山石)의 기하학적이고 입체적인 표현 등이다. 1973년의 특별전, '한국미술이천년(韓國美術二千年)'을 처음으로 화첩의 일부만 공개되었던 작품은 2019년 국립중앙박물관 특별전 '우리 강산을 그리다: 화가의 시선, 조선시대 실경산수화'에서 그 전모가 공개되었다. 《해악전도첩》이 김응환(金應煥)(1742~1789)의 작품으로 알려진 것은 화첩의 마지막 장에 쓰여진 관지(款識)와 현재 행방이 묘연한 <칠보대>에 찍힌 '복헌'이라는 도장 때문이었다. 그러나 김응환을 지시하는 관지와 도장은 모두 후대에 더해졌을 가능성이 크다. 본 연구는 화첩을 둘러싼 여러 요소를 고찰하여 제작자를 재검토하는 것을 목적으로 한다. 《해악전도첩》 제작 배경을 이해하기 위해 먼저 18세기 금강산 기행사경도의 전통과 봉명사경을 살펴보았다. 정선(鄭敾)(1676~1759)의 《신묘년풍악도첩(辛卯年楓嶽圖)帖》(1711)을 비롯하여 심사정(沈師正)(1707~1769), 김윤겸(金允謙)(1711~1775), 최북(崔北)(1712~1786 이후), 강세황(姜世晃)(1713~1791) 등은 조선 후기 최고의 여행지였던 금강산을 유람하고 기행사경도를 제작하였다. 화가들은 이전의 전통을 계승하여 내금강의 명승명소를 주로 그렸고, 자신들이 경험한 장소를 새롭게 시각화하였다. 이러한 기행사경도는 여행을 기념하며 동행자나 후원자를 위해 여러 장면을 담을 수 있는 화첩 형식으로 제작되었다. 개별적인 금강산 기행사 경도의 제작이 증가하는 가운데 1788년에 정조(正祖)(재위 1776~1800)가 도화서 화원인 김응환과 김홍도(金弘道)(1745~1806 이후)에게 영동9군과 금강산의 명승(名勝)을 그려오도록 명한 일은 공적 업무였다. 정조는 이들의 관계 및 지방관으로서의 경력, 서로 다른 화풍 등을 고려해 봉명사경의 화원으로 선발하였다. 김응환과 김홍도는 영조(英祖)(재위 1724~1776)조부터 도화서 화원으로 활동하며 선후배이자 동료로서 친밀한 관계를 유지했다. 나아가 이들은 영남 지역의 찰방(察訪)으로서 지방관의 업무를 수행한 경험이 있었다. 두 화원의 화풍은 서로 달라 김홍도는 부드럽고도 섬세하게 필선을 운용한 반면, 김응환은 굳세면서도 울창한 풍치를 잘 표현했다. 두 명의 화원은 각자의 개성으로 봉명사경 기간 동안 100여 폭의 초본을 그렸고, 이를 선별하여 60~70여 폭의 화첩 혹은 두루마리를 완성하였다. 이들의 그림은 18세기 전중반에 내금강과 관동팔경 위주로 제작된 금강산 기행사경도의 전통을 더욱 풍부하게 했고 영동과 외금강의 명승명소를 새롭게 발견하며 소재를 확장시켰다. 현재 《해악전도첩》은 원(元), 형(亨), 이(利), 정(貞) 4책으로 이루어졌는데, 원(元), 형(亨)책은 내금강의 그림 29점이며 이(利)책은 외금강의 장면 17점, 정(貞)책은 해금강과 관동팔경 14점으로 구성되었다. 비단 위에 그려진 각 그림은 기하학적으로 산석을 표현했으며, 연백으로 금강산의 암봉을 흰색 혹은 회청색으로 표현했다. 《해악전도첩》의 구도와 화법은 정선, 강세황, 심사정, 정충엽(鄭忠燁)(1725~1800 이후), 김응환, 김홍도의 화법과 비교할 수 있어 18세기 후반의 시대 양식을 갖는다. 특히 화첩의 일부 그림은 김홍도의 《해동명산도첩(海東名山圖帖)》(1788)과 구성 및 회화적 모티프가 매우 유사하여 두 화첩간의 연관성을 보여준다. 반면에 <영랑호>, <해산정>, <월송정> 등은 김홍도의 그림과는 구별된다. 이를 통해 화가가 김홍도와 영향을 주고받으면서도 자신만의 개성적인 화첩을 제작했음을 추측해 볼 수 있다. 《해악전도첩》에는 다른 화첩에는 등장하지 않는 <자운담>, <백운대>, <안문점망비로봉>, <백정봉> 등이 포함되어 있으며 각 장면마다 경물의 특징을 구체적이고 참신하게 묘사하였다. 특히, 화가는 산석을 기하학적으로 표현하고 선과 면을 도드라지게 하여 입체감을 강조하였다. 그는 남종화풍을 바탕으로 자신만의 화법을 확립했고 이를 자유자재로 운용하면서 화면에 동적인 리듬감을 부여했다. 이처럼 60점의 그림은 거칠고 파격적으로 보이지만 나름의 질서 안에서 일관성을 견지하고 있다. 본고는 화법과 봉명사경의 정황을 종합해 《해악전도첩》의 제작자를 김응환으로 추론하였다. 나아가 김하종(金夏鍾)(1793~1878 이후)의 《풍악권(楓嶽卷)》(1865년 이후)과의 친연성은 《해악전도첩》의 화가를 김응환으로 추정한 또 하나의 이유였다. 《해악전도첩》은 김홍도의 《해산첩》과는 달리 후대에 미친 영향력이 미비한데 김하종의 《풍악권》만이 《해악전도첩》의 소재와 화법을 따르고 있다. 김하종은 《풍악권》에서 50년 전, 춘천부사 이광문(李光文)(1778~1838)을 위해 제작한 《해산도첩》(1816)과는 전혀 다른 화법을 구사했다. 그는 김응환의 《해악전도첩》과 유사한 구성과 회화적 요소, 화보식 인물표현을 따르면서 사의적인 분위기를 강조하였다. 개성김씨의 일원이자 김응환의 종손인 김하종은 가문에 전해지는 《해악전도첩》류의 그림을 감상했고 이를 새롭게 번안했다고 추측된다. 화첩에 포함된 51편의 기문은 그림 다음 장에서 그려진 장소를 설명하고 있어 각 그림을 이해하고 감상하는 데 도움을 준다. 기문은 그림과 밀접한 관계를 가지며 앞의 장소로부터의 이동 정보, 이름의 유래, 지형적 특징, 관련 정보 등이 서술되었다. 이와 같은 백과사전식 혹은 지리지와 같은 기문은 19세기 전반에 나타나기 시작했으며, 금강산 화첩류에 더해졌다. 《해악전도첩》의 백화암 기문에는 1845년의 암자에 대한 중건 내용이 기록되어, 기문의 연대를 추정하는 중요한 근거가 되었다. 김하종에게 《풍악권》을 주문한 이유원(李裕元)(1814~1888)도 각 그림에 글을 붙였는데 이 글들은 김응환의 화첩에 포함된 기문 51편과 내용 및 서술방식이 흡사하다. 이유원의 기문은 《해악전도첩》의 기문이나 그 초고(원본)와 관련성이 높지만 두 화첩의 기문 필사의 선후관계를 판정하는 데에는 좀더 면밀한 검토가 필요하다. 《해악전도첩》은 김홍도의 봉명사경 초본 및 김홍도의 영향으로 제작된 19세기의 금강산 화첩과는 구별된다. 이 화첩은 화원 김응환의 회화세계를 이해할 수 있는 지평을 넓히고 18세기 후반 실경산수화의 또 다른 층위를 보여주고 있어 중요한 의미를 갖는다.

산림보험(山林保險)에 관한 연구(硏究) (A Study on Forest Insurance)

  • 우리나라는 근래(近來) 고도경제성장(高度經濟成長)으로 인(因)하여 목재수요(木材需要)가 급증(急增)하고 있으나 국내생산재(國內生産材)가 공급율(供給率)은 수요량(需要量)의 20% 정도(程度)에 지나지 않아 많은 외재(外在)를 도입(導入)하고 있으므로 장래(將來)의 목재(木材) 수요공급(需要供給)의 균형(均衡)을 이룩하기 위하여 강력(强力)한 산림자원(山林資源) 조성사업(造成事業)의 추진(推進)이 요망(要望)된다. 산림자원(山林資源) 조성사업(造成事業)을 추진(推進)하는데 있어서 가장 중요(重要)한 것은 조림의욕(造林意慾)을 높이고 조림사업(造林事業)에 필요(必要)한 산업자본(産業資本)을 산림(山林)에 유치(誘致)하도록 하는 일인데, 이러한 역할(役割)을 할 수 있는 경제적시설(經濟的施設)의 하나가 산림보험제도(山林保險制度)의 실시(實施)인 것이다. 산림보험(山林保險)을 실시(實施)하면 산림재해(山林災害)가 보상(補償)되므로 자본가(資本家)는 안심(安心)하고 조림투자(造林投資)를 할 수 있을 뿐만 아니라 산림(山林)을 담보(擔保)로 한 금융(金融)의 길도 열리어 투자(投資)한 산림(山林)에 환금성(換金性)이 주어지므로 산업자본가(産業資本家)가 산림투자(山林投資)를 회피(回避)하지 않게 되어 산림자원(山林資源) 조성사업(造成事業)이 촉진(促進)될 수 있다. 이러한 관점(觀點)에서 외국(外國)에서는 19세기말(世紀末)부터 산림보험제도(山林保險制度)가 실시(實施)되기 시작(始作)하여 주요(主要) 임업선진국(林業先進國)에서는 모두 산림보험(山林保險)을 실시(實施)하고 있는 것이다. 산림보험(山林保險)을 실시(實施)하는데 있어서 가장 중요(重要)한 것은 장기간(長期間)에 걸친 산림재해(山林災害)의 통계자료(統計資料)를 정확(正確)히 조사(調査)하는 일과 그 나라의 여건(與件)에 맞는 산림보험제도(山林保險制度)를 창설(創設)하는 일이다. 과거(過去) 10년간(年間)(1961~1970)의 년평균(年平均) 산림재해상황(山林災害狀況)을 조사(調査)한 결과(結果)는 산림화재(山林火災)가 9,000여정보(餘町步), 곤충피해(昆蟲被害)가 570,000정보(町步), 병균피해(病菌被害)가 694정보(町步)로 나타났다. 특(特)히 그중 외국(外國)의 산림보험(山林保險)에서 재해보상(災害補償) 대상(對象)의 으뜸이 되고 있는 산림화재(山林火災) 피해상황(被害狀況)을 과거(過去) 18년간(年間)(1953~1970)에 걸쳐서 조사(調査)한 결과(結果)에 의하면 산화면적(山火面積) 위험율(危險率)이 $\frac{1.1853}{1,000}$였고 1960~1969년(年) 사이의 전국(全國) 산림화재면적(山林火災面積) 위험율(危險率)은 $\frac{1.3045}{1,000}$로서 유우럽에 비(比)하여 높았으나 일본(日本)에 비(比)하여 그리 높지 않았다. 또 과거(過去) 5년간(年間)(1966~1970)의 전국(全國)의 산화재적(山火材積) 위험율(危險率)은 $\frac{0.1991}{1,000}$로서 대단(大端)히 낮은데 이것은 우리나라 산림(山林)의 축적(蓄積)이 빈약(貧弱)한데서 온 결과(結果)였다. 이러한 산림재해상황(山林災害狀況)에 비추어 우리나라에서 산림보험(山林保險)을 실시(實施)하려면 어떠한 내용(內容)의 산림보험제도(山林保險制度)를 설립(設立)하는 것이 좋겠는가 하는 질문조사(質問調査)의 결과(結果)는 다음과 같았다. 1. 산림보험(山林保險)의 필요성(必要性) 산림보험(山林保險)은 산림담보(山林擔保)에 의(依)한 금융(金融)의 길을 열어주고(5.65%), 산림피해(山林被害)를 당(當)하였을 때 재조림비(再造林費)를 확보(確保)하게 하여(35.87%), 조림투자(造林投資)를 보증(保證)하는 수단(手段)(46.74%)으로 반드시 실시(實施)되어야 한다고 응답(應答)하였다. 2. 산림보험법(山林保險法) 산림(山林)의 특수성(特殊性)에 비추어 일반(一般) 손해보험(損害保險) 규정(規程)을 준용(準用)할 것이 아니라(8.35%), 산림보험(山林保險)을 위한 특별볍(特別法)을 제정(制定)하여야 한다고 응답(應答)하였다(88.26%). 3. 보험경영업체(保險經營業體)의 종류(種類) 일반(一般) 보험회사(保險會社)(17.42%)나 산림소유자(山林所有者) 상호조합(相互組合)(23.53%)에서 산림보험(山林保險)을 취급(取扱)할 수도 있겠으나, 산림보험(山林保險)의 특이성(特異性)에 비추어 국(國) 공영산림보험(公營山林保險)의 별도(別途)로 운영(運營)되어야 한다고 반응(反應)하였다(56.18%). 4. 보험사고(保險事故)의 종류(種類) 산림보험(山林保險) 사고(事故)를 산화(山火)에 국한(局限)시키거나(23.38%), 산화(山火) 및 기상해(氣象害)만을 포함(包含)시키면 된다는 의견(意見)도 있으나(14.32%), 산림보험(山林保險) 사고(事故)에 산화(山火), 기상해(氣象害), 병충해(病蟲害)까지 포함(包含)시켜야 한다는 의견(意見)이 가장 많았다(60.68%). 5. 보험사고(保險事故) 취급대상(取扱對象)의 종류(種類) 산림보험(山林보험) 취급대상(取扱對象) 수종(樹種)은 침엽수(針葉樹) 인공림(人工林)에 한정(限定)시키거나(13.47%), 침엽수(針葉樹)와 활엽수(濶葉樹)의 인공림(人工林)만을 포함(包含)시키기를 원(願)하는 반응자(反應者)도 있었으나(23.74%), 많은 반응자(反應者)가 수종(樹種), 임종(林種)(인공(人工), 천연(天然)) 구별(區別)없이 모두 포함(包含)시켜야 된다고 반응(反應)하였다(61.64%). 6. 보험사고(保險事故) 취급대상(取扱對象)의 범위(範圍) 산림보험(山林保險) 사고(事故) 취급대상(取扱對象) 범위(範圍)는 10년(年) 이하(以下)의 유령림(幼齡林)만 취급(取扱)하기를 원(願)하는 자(者)(15.23%), 20년(年) 이하(以下)의 임목(林木)만을 대상(對象)으로 하면 족(足)하다는 반응자(反應者)가 있었으나(32.95%), 많은 반응자(反應者)가 40년생(年生) 이하(以下)의 임목(林木)까지 포함(包含)하기를 바라고 있었다(46.37%). 7. 보험계약(保險契約) 기간(期間) 산림보험(山林保險) 계약기간(契約期間)은 1년(年) 단위(單位)가 좋다는 자(者)도 상당(相當)히 있었으나(31.74%), 과반수(過半數)가 5년(年) 단위(單位)로 계약(契約)하는 것을 바라고 있었다(58.68%). 8. 보험계약(保險契約)의 제한(制限) 5정보(町步) 미만(未滿)의 소면적(小面積)은 산림보험(山林保險) 대상(對象)에서 제외(除外)하고(20.78%), 단위(單位) 면적당(面積當) 일정(一定) 재적(材積) 또는 주수(株數)를 보유(保有)하고 있는 산림(山林)만을 계약대상(契約對象)으로 하는 것이 좋다고 반응(反應)하였다(63.77%). 9. 계약방법(契約方法) 산림보험(山林保險) 계약방법(契約方法)은 임의(任意)로 산림(山林)을 선택(選擇)하여 계약(契約)하기를 원(願)하는 자(者)(32.13%), 임의(任意)로 계약(契約)하되 소유산림(所有山林) 전체(全體)를 일괄(一括) 계약(契約)하도록 하는 방법(方法)을 택(擇)하여야 한다는 자(者)(33.48%), 특정임지(特定林地)(신식지(新植地), 보조조림지(補助造林地), 고가임지(高價林地))는 의무적(義務的)으로 계약(契約)하도록 하여야 한다는 반응자(反應者)(31.92%)로 나타나 비슷한 반응(反應)을 보였다. 10. 보험료율(保險料率) 산림보험(山林保險) 요율(料率)은 지역(地域)에 따르는 위험정도(危險程度)를 참작(參酌)하여 면적비례(面積比例)로 결정(決定)하여야 한다는 의견(意見)(31.59%)과 지역(地域) 위험율(危險率)을 참작(參酌)하여 보험가액(保險價額)에 따라 정(定)해야 한다는 의견(意見)이 있었으나(31.59%), 우리 나라에는 지역적(地域的) 위험율(危險率)에 큰 차이(差異)가 없을 것이므로 전국(全國) 일률적(一律的)인 보험료(保險料)를 보험가액(保險價額)에 따라 정(定)하기를 원(願)하는 경향(傾向)이 높았다(39.55%). 11. 보험료(保險料)의 납부(納付) 산림보험료(山林保險料)는 단기(短期)는 일시불(一時拂), 장기(長期)는 매년(每年) 납부(納付)하게 하는 의견(意見)도 있으나(13.80%), 단기(短期)는 고율(高率), 장기(長期)는 저율(低率)로 하되 단기(短期), 장기(長期)를 막론(莫論)하고 매년(每年) 납부(納付)하도록 하여야 한다고 반응(反應)하였다(86.71%). 12. 보험사무(保險事務) 취급기관(取扱機關) 산림보험(山林保險) 사무(事務)의 취급(取扱) 즉(即) 창구업무(窓口業務)의 취급(取扱)을 산림행정기관(山林行政機關)에 위탁(委託)하거나(18.75%), 일반(一般) 보험회사(保險會社)에 맡기기보다는(35.76%) 산림조합(山林組合)에 위탁(委託) 취급(取扱)하게 하고 보험료(保險料)의 일정율(一定率)을 환부(還付)해주는 것이 좋다고 반응(反應)하였다(44.22%). 13. 손해보상(損害補償)의 한도(限度) 산림보험(山林保險)의 손해보상(損害補償)은 유령림(幼齡林)이 피해(被害)를 입었을 때에는 재조림비(再造林費)를 한도(限度)로 하여 보상(補償)하는 것을 원칙(原則)으로 하고 성림(成林)의 경우(境遇)에는 손해액(損害額)의 80%정도(程度)를 한도(限度)로 하여 보상(補償)하기 보다는(29.70%) 실손(實損) 현재가액(現在價額)을 보상(補償)하거나(31.07%) 조림비(造林費)의 복리계산(複利計算) 합계액(合計額)을 보상(補償)하는 것을 바라고 있었다(36.99%). 14. 보험기금(保險基金)의 조성(造成) 산림보험(山林保險)의 기금조성(基金造成)은 손해(損害) 보상액(補償額)에서 일정액(一定額)을 공제(控除) 적립(積立)하여 조성(造成)하거나(15.65%), 임야세(林野稅)를 신설(新設)하여 기금(基金)을 확보(確保)하기 보다는(33.79%), 산림보험(山林保險) 무사고(無事故)로 인(因)한 잉여금(剩餘金)에서 일정액(一定額)씩을 적립(積立)하여 산림보험기금(山林保險基金)으로 하자는 의견(意見)에 많은 반응(反應)을 하였다(44.81%). 15. 산화(山火)의 원인(原因) 산림관계직(山林關係職)에 종사(從事)하고 있는 사람들의 과거(過去)의 경험(經驗)에 비추어 본 우리나라 산화(山火)의 주요원인(主要原因)은 실화(失火)(원인불명(原因不明), 32.39%), 담배불(28.89%), 화전(火田)(19.85%)에 의한 것으로 나타났는데 산림통계(山林統計)에 나타나 있는 산화(山火)의 주요원인(主要原因)과 일치(一致)하였다. 16. 산화경방(山火警防) 산림화재(山林火災) 경방조치(警防措置)로서 가장 중요(重要)하고 실효성(實効性)이 있으며 실천(實踐)할 수 있는 삼대대책(三大對策)으로는 (1) 방화선(防火線) 설치(設置)(23.84%), (2) 건조기(乾燥期)의 입산금지(入山禁止)(21.10%), (3) 메스콤에 의한 계몽교육(啓蒙敎育)(18.01%)이라고 반응(反應)하였다.
