국제복합일관수송체제에 관한 고찰 (A Study on the Development of International Multimodal Transport System in Korea in Terms of Systems Approach)

  • The transport a administration in Korea is meeting demands of developing international multimodal transport system. In the past, as Korea transport policy has been emphasizing on the passenger traffic, the physical distribution sector is far behind international trend. Regarding the urging necessities of reducting costs in transport in order to upgrade the competitive edge of industries, Korea has to develop the most efficient transport system so called international multimodal transport system. The existing transport system is inefficient because each transport mode is separate, so this system is aiming at reducing cost and time and developing freight transport. The scope and scheme of this thesis should be as following. Chapter 2. Systems Approach of International multimodal transport 1. general systems theory 2. definition of International multimodal transport system 3. MTO (multimodal transport operator) Chapter 3. Current Situation and Problems of this System. 1. international law and practice 2.current situation A. Europe B. U.S. C. Japan D. Korea Chapter 4. 복합운송인의 책임제한 방식과 한도액 (A Review on Limit of Liabilities of Multimodal Transport Operator in Korea)

  • The purpose of this paper is to introduce the limitation of liabilities of multimodal transport operators(MTO) in Korea. Also, this paper reviews the revised draft of Korean Commercial Code in 2015. This paper analyzes Korean multimodal transport systemand the limitation of liabilities of MTO by analyzing articles, regulations and practices of Korean Commercial Code and it's the draft in 2015. The paper, also, studies multimodal transport rules by comparing specifically international treaty, rules, or practices. In Korea, Article 816 of Commercial Code treats multimodal transportation adopting the network liability regime. The Article describes only the case of the multimodal transportation where the maritime carriage is engaged. Korea proposed the draft of multimodal transport regulation of Commercial Code in 2015 because present law could not apply for the multimodal transportation involved in the air or land carriage. This paper support the draft of Korean Commercial Code in 2015 because it is necessary to make a predictable legal system of multimodal transport and the limitation of liability reflecting practices or customs.

  • The international trade is basically founded on the contract of international sale of goods and backed up by the contract of international carriage of goods and the contract of insurance in the goods carried. For the efficient development of international trade, it is essential to incorporate the above three fields closely together. Economic growth has developed international trade which has accelerated the development of international carriage of goods. As a result of rapid expansion of international carriage of goods, rationalization of transport was required, which has brought about the International Multimodal Transport System(herein after referred to as 'IMT') through containerization. International multimodal transport system has affected international trade a lot, especially the field of insurance a great deal. The aim of this paper is to analyze contents of Multimodal Transport Operator's(MTO's) liability system in the UN Convention on International Multimodal Transport of Goods, 1980 and FIATA Bill of Lading(FBL) as one of current Multimodal Transport Documents. The analysis of MTO's liability system will be a good introductory concept for the further study of insurance problems for the development of IMT.

  • The Korean Government decided to reduce 30% of carbon emissions as of 2020, tightening regulations to reduce greenhouse gas in the international society. Therefore it will burden Korean logistics industry that overland trucking freight covers 70~80% of all, to lower emissions. As known, rail and coast(feeder) transport systems can be substituted for road transport but there are many problems to solve in Korean multimodal (intermodal) transport system such as time, cost, etc. Because of this, multimodal transport system should be improved systematically. For the reason, it aims to study a conceptual model with Thinking Process of TOC(theory of constraints) and System Dynamics to help improve the existing multimodal transport system for green logistics.

  • International Trade has led to the increase of the demand of international transport, and also the development of international transport not only incurs claims concerning transportation but also establishes various international rules to settle the claims between the shippers and carriers incurred in the course of transport. With a view to settling the claims successfully, the men who are concerned in the transport have to know the principle and scopes of carrier's liability. In this paper, I would like to find out the scopes of liability of multimodal carriers based on the principles of liability. In order to perform the purpose of this study, I classify the liability principle of the international carrier under the UNs Convention on International Multimodal Transport of Good(1980) and UNCTDAD/ICC Rules(1991) in three system-Network Liability System, Uniform Liability System and Modified Liability System. And that I show the results-the scopes of multimodal carriers' liability based on the UN's Multimodal Convention(1980) and the ICC/UNCTAD Rules(1991), and transport vehicles.

국제복합운송계약에서 로테르담 규칙의 적용상 문제점에 관한 연구 (A Study on Problems Arising from Application of the Retterdam Rules under International Multimodal Transport Contracts)

  • The continuing advance of multimodal transport with the importance for efficient and effective logistics management emphasizes the need for uniform legal approach to international multimodal transport. However, the current fragmented instrument regulating such transport is being an obstacle to development of multimodal transport as it aggravates confusion and uncertainty. The Rotterdam rules, which was adopted in December 2008 by UNCITRAL, expands its scope of application to door-to-door transport. However, the new rules has some problems in its application to multimodal transport operation as it has been conceived not to regulate general multimodal carriage but to regulate contract of carriage by sea that extends its services to the transport by other modes. This article examines conflict of conventions in the Rotterdam Rules. The applicability of the Rotterdam Rules in international multimodal transport contract and possibility of potential conflict with other transport conventions are analyzed with some hypothetical cases. Furthermore, problems arising from application of the Rotterdam Rules under international multimodal transport Contracts are indicated in the chapter IV.

  • 전 세계적으로 생산과 판매, 유통이 펼쳐져 세계경제는 글로벌화 되고 국제운송체계는 신속성과 부가가치 서비스를 중요시하는 운송체계로 변화함에 따라 국제운송체계는 해상운송, 항공운송 그리고 철도운송을 시스템적으로 연계하는 국제복합운송 중심체계로 전환되고 있다. 이러한 변화에 따라 생산과 판매, 유통이 적시에 제공되고, 글로벌 네트워크상의 소비자에게 다차원적인 물류서비스를 제공할 수 있는 국제복합운송경로가 필요하지만 국제운송을 위한 정보 연계 및 운송수단 간의 연계 시스템이 미비하여 활성화되지 못하고 있다. 특히 국내에서는 3자 물류업체, 운송업체 둥의 선정기준은 제시되고 있으나, 운송을 계획하고 수행하는 물류전문업체들이 국제복합운송경로를 선정하는데 있어 체계적인 평가기준이 제시되지 못하고 있다. 이에 본 연구에서는 복합운송경로선정에 대한 주요 문헌연구를 정리하고, 업체 담당자들의 인터뷰를 통해 복합운송경로 선정을 위한 평가기준을 도출하고, 이를 계층분석기법(AHP)을 이용하여 측정하여 복합운송경로 선정을 위한 평가기준을 제시하는데 목적이 있다.

  • 다국적기업의 증가는 물류환경을 국제복합운송체계로 이끌고 있다. 기반시설이 잘 갖추어진 유럽의 경우에는 제2의 실크로드를 개발하기위한 노력이 끊임없이 행해지고 있다. 본 논문에서는 국제복합운송의 중요성에 대해 설명하고, 유럽 복합운송 체계에 대한 분석을 통해 국내 및 동북아 복합운송체계를 제안한다. 이를 위해 유럽 복합운송 사례를 분석하고 TAR의 북부 노선을 통해 한반도 남단을 기점으로 하는 노선의 경제적 효과와 이를 철도와 항만 및 공항으로 연결하는 복합운송 모델을 개발한다. 실질적으로 본 연구의 실효성을 증명할 수치적 근거가 부족하나, 본 논문에서는 기존에 제시되지 않았던 구체적인 복합운송 모델을 개발 및 제안함으로써, ESCAP에서 수행하게 될 시범 컨테이너 전용열차 운행 프로젝트를 통해 노선별 거리, 시간, 비용, 세금, 통관절차, 환적시설 등의 정보를 차후 경제성평가 연구에 활용할 수 있을 것으로 기대한다.

  • The world economy is becoming increasingly globalized. The globalization has resulted in far reaching agreements to deepen trade liberalization and enlarge its scope to cover new areas in addition to strengthening its supporting institutional base. Economic growth has developed international trade which has accelerated the development of international carriage of goods in 21st century. The international trade is basically founded on the contract of international sale of goods and backed up by the contract of international carriage of goods and the insurance on the goods carried. It is essential to incorporate each other sections for the efficient development of international trade. As a result of rapid expansion of international carriage of goods, rationalization of transport was required, which has brought about the International Multimodal Transport System through containerization. The approach to liability system will be a right way to solve the insurance problems for the development and enlargement of world trade volume. International multimodal transport system has affected international trade a lot, especially the field of insurance a grate deal. This paper is to analyze contents of liability system on Multimodal Transport with in the UN Convention on International Multimodal Transport of goods.
