A Study on Problems Arising from Application of the Retterdam Rules under International Multimodal Transport Contracts (국제복합운송계약에서 로테르담 규칙의 적용상 문제점에 관한 연구)

  • The continuing advance of multimodal transport with the importance for efficient and effective logistics management emphasizes the need for uniform legal approach to international multimodal transport. However, the current fragmented instrument regulating such transport is being an obstacle to development of multimodal transport as it aggravates confusion and uncertainty. The Rotterdam rules, which was adopted in December 2008 by UNCITRAL, expands its scope of application to door-to-door transport. However, the new rules has some problems in its application to multimodal transport operation as it has been conceived not to regulate general multimodal carriage but to regulate contract of carriage by sea that extends its services to the transport by other modes. This article examines conflict of conventions in the Rotterdam Rules. The applicability of the Rotterdam Rules in international multimodal transport contract and possibility of potential conflict with other transport conventions are analyzed with some hypothetical cases. Furthermore, problems arising from application of the Rotterdam Rules under international multimodal transport Contracts are indicated in the chapter IV.

  • The purpose of this paper is to introduce the limitation of liabilities of multimodal transport operators(MTO) in Korea. Also, this paper reviews the revised draft of Korean Commercial Code in 2015. This paper analyzes Korean multimodal transport systemand the limitation of liabilities of MTO by analyzing articles, regulations and practices of Korean Commercial Code and it's the draft in 2015. The paper, also, studies multimodal transport rules by comparing specifically international treaty, rules, or practices. In Korea, Article 816 of Commercial Code treats multimodal transportation adopting the network liability regime. The Article describes only the case of the multimodal transportation where the maritime carriage is engaged. Korea proposed the draft of multimodal transport regulation of Commercial Code in 2015 because present law could not apply for the multimodal transportation involved in the air or land carriage. This paper support the draft of Korean Commercial Code in 2015 because it is necessary to make a predictable legal system of multimodal transport and the limitation of liability reflecting practices or customs.

  • The transport a administration in Korea is meeting demands of developing international multimodal transport system. In the past, as Korea transport policy has been emphasizing on the passenger traffic, the physical distribution sector is far behind international trend. Regarding the urging necessities of reducting costs in transport in order to upgrade the competitive edge of industries, Korea has to develop the most efficient transport system so called international multimodal transport system. The existing transport system is inefficient because each transport mode is separate, so this system is aiming at reducing cost and time and developing freight transport. The scope and scheme of this thesis should be as following. Chapter 2.   • The Purpose of this Article is to analyze the examination criteria on the compliance of multimodal transport document in the ISBP. When the goods are taken in charge by the multimodal transport operator, he shall issue a multimodal transport document which, at the option of the consignor, shall be in either negotiable or non-negotiable form. The multimodal transport document shall be signed by the multimodal transport operator or by a person having authority from him. When the multimodal transport document is presented by the beneficiary to the bank in the letter of credit operations, the bank should examinate the bill of exchange and/or shipping documents, including multimodal transport document. There are two rules in connection with examination of the documents in the letter of credit operations. One is the "Uniform Customs and Practice for Documentary Credits(UCP 500)" approved by the Banking Commission in March 10, 1993, the other is the "International Standard Banking Practice for the Examination of Documents under Documentary Letters of Credits(ISBP)" approved by the ICC Banking Commission in October 2002. Therefore, this Article has studied the multimodal transport document presented under documentary credits on the basis of the UCP 500 and the ISBP it reflects.

  • As the interest about smooth logistics increases lately, the importance of multimodal transport, which performs the key role of logistics emerges, Through there are many issues respecting multimodal transport, the issue of the efficiency of multimodal transport seems to be the most importance. This paper examine as to the problems & systems of the multimodal transport including transportation document and customs clearance for door to door services. I wish our country will use total logistics automation systems for encouraging multimodal transport chance and make a partial amendment of commercial code including the customs clearance regulation. This study will assist in the development of logistic and the enlargement of multimodal transport transaction.

  • The international trade is basically founded on the contract of international sale of goods and backed up by the contract of international carriage of goods and the contract of insurance in the goods carried. For the efficient development of international trade, it is essential to incorporate the above three fields closely together. Economic growth has developed international trade which has accelerated the development of international carriage of goods. As a result of rapid expansion of international carriage of goods, rationalization of transport was required, which has brought about the International Multimodal Transport System(herein after referred to as 'IMT') through containerization. International multimodal transport system has affected international trade a lot, especially the field of insurance a great deal. The aim of this paper is to analyze contents of Multimodal Transport Operator's(MTO's) liability system in the UN Convention on International Multimodal Transport of Goods, 1980 and FIATA Bill of Lading(FBL) as one of current Multimodal Transport Documents. The analysis of MTO's liability system will be a good introductory concept for the further study of insurance problems for the development of IMT.

  • International Trade has led to the increase of the demand of international transport, and also the development of international transport not only incurs claims concerning transportation but also establishes various international rules to settle the claims between the shippers and carriers incurred in the course of transport. With a view to settling the claims successfully, the men who are concerned in the transport have to know the principle and scopes of carrier's liability. In this paper, I would like to find out the scopes of liability of multimodal carriers based on the principles of liability. In order to perform the purpose of this study, I classify the liability principle of the international carrier under the UNs Convention on International Multimodal Transport of Good(1980) and UNCTDAD/ICC Rules(1991) in three system-Network Liability System, Uniform Liability System and Modified Liability System. And that I show the results-the scopes of multimodal carriers' liability based on the UN's Multimodal Convention(1980) and the ICC/UNCTAD Rules(1991), and transport vehicles.

  • Increasing of the multinational corporation brought into the international multimodal Increasing of the multinational corporation brought into the international multimodal transport on the logistics environment. In case of Europe which have a great infrastructure, they are tried to develope a second of the silk road constantly. This paper emphasized the importance of international multimodal transport and proposed the model for northeast multimodal transport. For this research, we analyzed the multimodal transport system in Europe and north corridor of TAR. We are expecting economic effect of the route is including republic of korea and developed a model for connecting with sea, air and road. Actually, this research can not be enough data of numerical value for proving this effectiveness. but we developed and proposed a specific route of multimodal transport that was never suggested. Consequently, we established basic ground for comparing each transport route in the future research.

  • The Korean Government decided to reduce 30% of carbon emissions as of 2020, tightening regulations to reduce greenhouse gas in the international society. Therefore it will burden Korean logistics industry that overland trucking freight covers 70~80% of all, to lower emissions. As known, rail and coast(feeder) transport systems can be substituted for road transport but there are many problems to solve in Korean multimodal (intermodal) transport system such as time, cost, etc. Because of this, multimodal transport system should be improved systematically. For the reason, it aims to study a conceptual model with Thinking Process of TOC(theory of constraints) and System Dynamics to help improve the existing multimodal transport system for green logistics.

  • The purpose of this paper is to suggest a plan on promoting use of multimodal transport logistics terms in Incoterms, 2010. This study deals with the terms of three promotion factors which are a user's subjective factors, a trade transport logistics environment factors, and a term content factors. According to analysis results of the factors, a user's subjective factors(3.87 score) are scored the most ones of promotion factors of using multimodal transport logistics terms in Incoterms, 2010, to be compared with a trade transport logistics environment factors(3.60 score). with a term content factors(3.74 score). Therefore, first of all, it is important to promoting use of multimodal transport logistics terms in Incoterms, 2010 through as follows, a user's subjective factors : (1) to understand correlation of door to door multimodal transport and terms of Incoterms, 2010, (2) to promote use of multimodal transport logistics terms in Incoterms, 2010 in door to door multimodal transport, (3) to restrain customary use of FOB, CFR, CIF terms. And, the next, we have to promote use of multimodal transport logistics terms in Incoterms, 2010 through considering a trade transport logistics environment factors and a term content factors.
