A Legal Study on liability for damages cause of the air carrier : With an emphasis upon liability of passenger (항공운송인의 손해배상책임 원인에 관한 법적 고찰 - 여객 손해배상책임을 중심으로 -)

  • Air transport today is a means of transport that is optimized for exchanges between nations. Around the world, has experienced an increase in operating and the number of airline route expansion that has entered into the international aviation agreements in order to take advantage of the air transport efficient, but the possibility of the occurrence of air transport accidents increased. When compared to the accident of other means of transport, development of air transport accidents, not high, but it leads to catastrophe aviation accident occurs. Air Transport accident many international transportation accident than domestic transportation accident, in the event of an accident, the analysis of the legal responsibility of the shipper or the like is necessary or passenger air carrier. Judgment of the legal order of discipline of air transport accident is a classification of the type of air transport agreement. Depending on the object, air transport agreements are classified into the contract of carriage of aviation of the air passenger transportation contract. For casualties occurs, air passenger transportation accident is a need more discussion of legal discipline for this particular. Korean Commercial Code, it is possible to reflect in accordance with the actual situation of South Korea the contents of the treaty, which is utilized worldwide in international air transport, even on the system, to control land, sea, air transport and welcoming to international standards. However, Korean Commercial Code, the problem of the Montreal Convention has occurred as it is primarily reflecting the Montreal Convention. A Study on the Daily Hassles and Health-Related Quality of Life of Middle-Aged Women: Focusing on the Mediation and Buffering Effects of Spiritual Well-Being and Coping Styles (중년 여성의 일상생활스트레스와 건강 관련 삶의 질에 관한 연구: 영적 안녕과 대처기제의 매개효과와 조절효과를 중심으로)

  • This study explored the impact of daily hassles and the mediated effect of spiritual well-being and the moderated effect of coping styles on health and depression of middle-aged women. Subjects for this study were 230 Christian midlife women attending in the 10 churches on the metropolitan area. The data was analyzed using path analysis and moderator effect model with the structural equation modeling. Daily hassles are found to act as causes that damage physical or mental health and also elevate the level of depression. Daily hassles have a direct impact on health and depression, and at the same time, they also produce a partial mediation effect on spiritual well-being as a mediation factor. In other words, daily hassles impede spiritual well-being, and the deteriorated spiritual well-being, although its connection to physical health is not clear, is shown to damage mental health and elevate the level of depression. Analysis of coping styles related to the relationship between daily hassles and health and depression showed that, of the 12 coping styles, three, namely, self-criticism, positive interpretation and self-control, produced significant buffering effects. This study hopes to reveal the mediation factors that can minimize negative impact in the relationship between middle-aged women's daily hassles and healthiness and provide the basic material for figuring out practical implications and policy measures regarding the issue.

Psychological burden for legal responsibility of 119 emergency personnels (119구급대원의 법적책임에 대한 심리적 부담감)

  • Purpose : To grasp the mental burden for legal responsibility that rescue members have in the performance of job. Method : Questionnaire was presented to rescue members serving in 2 direct control safety centers of fire station located in Seoul, Daejon, Incheon, Kwangju, Busan, Daegu and Ulsan. Results : 1. Questioned whether they have mental burden for legal responsibility while performing job on the site, the rescue members responded : very burdensome in 38.0%, burdensome in 56.0%, moderate in 4.5%, not burdensome in 1.0%, no burden at all in 0.5%. 2. Questioned on the first aid treat for which they have the most mental burden, the rescue members responded : intubation into trachea laryngeal mask airway(LMA) in 40.4%, automatic external defibrillator in 16.3%, securing vein providing sap(medicine) in 10.8%, basic cardiopulmonary resuscitation in 7.2%, eliminating foreign matters inserted into body in 5.4%, stanching external bleeding and treating injury in 5.4%, fixing extremities and spine by using splint in 1.8%, measuring the symptom of vitality in 1.2%, providing oxygen in 0.0%. 3. Questioned whether experiencing legal problem or firm petition(complaint) raised by patient while serving as rescue members, they responded : experiencing a complaint in 41.6%, experiencing no complaint in 58.4%. Asked to indicate the stress level in the scale of which they suffered when lawsuit or firm petition was raised, 0(weak)-10(strong), they answered 8.8 in average. 4. Questioned whether 119 rescue members put the legal responsibility in case that they cause damage to patients intentionally in performing, they responded to the inquiry 3.66 in average(of 5.00). It represented meaningful differences (F=2.874, p=.024) whether they had license or not. 5. In future, legal action will raise against the rescue member by 99% because of people's rights improvement(63.1%), high expectations for the rescue system(29.5%), non-licensed rescue members(5.1%). Conclusion : It was found that the rescue members had severe mental burden for advanced life support which was investigated to have low enforcement rate in the preceding research, for instance, intubation into trachea securing vein management by using automatic external defibrillator. To improve the qualitative level of rescue service in the fire fighting, it may be required to construct the environment that eliminates the mental burden of rescue members for legal responsibility.

  • Anomia, word finding difficulty, is one of the most common feature in aphasia. Previous studies support that the process of picture naming consists of three stages, in the order of the object recognition, semantic, and phonological output stages. Anomic patients have many symptoms and it means that anomia can be sub-divided into several symptom groups. Our anomia assessment battery consists of several parts: (1) picture naming set, (2) picture-word matching task, (3) lexical decision task for mental lexicon damage, (4) naming task for phonological lexicon damage, and (5) semantic decision task. Pictures and words were selected on the basis of usage frequency, semantic category, and word length. We administered this anomia evaluation battery to many anomic aphasics and we subdivided patients into several groups. We hope that our anomia evaluation set is useful and helpful for evaluation anomic aphasics

  • Korean Identification card or driver license is usually used to verify one's identity in Korea. These are also used as an adult certification. Since the form of these ID card is an analog and it needs to be checked with naked eyes, it might be used maliciously. Someone who's got someone else's ID card can do other things. Therefore, it must be reported rapidly when ID card is lost or stolen. The most serious problem might be occurred when they do not recognize and report the loss. They might suffer from pecuniary or mental damage such as opening a mobile phone service, providing loan or credit card, opening a personal checking account, etc. Thus, this study suggests and compares the ways of avoiding these problems. First, the most effective way is to send the authorization code via mobile phones in consideration of build-up period and cost. The person in charge of business processing department using ID card sends the authorization code via registered mobile phone. The owners submits it to the person and their identifications are confirmed. Next effective way is that the person in charge of business processing department using ID card sends text messages via registered mobile phone. Lastly, the most ineffective way is to introduce and implement the electronic ID card ultimately even though it is expensive and takes a long time to build up the system.

The application of "bone window technique" using piezoelectric saws and a CAD/CAM-guided surgical stent in endodontic microsurgery on a mandibular molar case

  • Apical surgery for a mandibular molar is still challenging for many reasons. This report describes the applications of computer-guided cortical 'bone-window technique' using piezoelectric saws that prevented any nerve damage in performing endodontic microsurgery of a mandibular molar. A 49-year-old woman presented with gumboil on tooth #36 (previously endodontically treated tooth) and was diagnosed with chronic apical abscess. Periapical lesions were confirmed using cone-beam computed tomography (CBCT). Endodontic microsurgery for the mesial and distal roots of tooth #36 was planned. Following the transfer of data of the CBCT images and the scanned cast to an implant surgical planning program, data from both devices were merged. A surgical stent was designed, on the superimposed three-dimensional model, to guide the preparation of a cortical window on the buccal side of tooth #36. Endodontic microsurgery was performed with a printed surgical template. Minimal osteotomy was required and preservation of the buccal cortical plate rendered this endodontic surgery less traumatic. No postoperative complications such as mental nerve damage were reported. Window technique guided by a computer-aided design/computer-aided manufacture based surgical template can be considerably useful in endodontic microsurgery in complicated cases.

  • Presently, abrasive processing is on eof several methods for cutting and grinding brittle materials, and high quality in dimensional accuracy and surface roughness are often required as a structural components, therefore most of them has to be ground. In manufacturing of tungsten-carbide components, grinding by diamond wheel is usually adopted in order to provide configurational and dimensional accuracy to the components. The present study proposes the experi- mental research of optimum condition to the high quality surface grinding of the WC-Co material using diamond abrasive wheel in order to minimize the damage on the ground surface and to pursue the precise dimension by conventional grinding machine. Brief investigation is carried out to decrease the dressing is constant, theoretical grinding effect such as machining precision is changed according to the speed of workpiece. Accordingly, normal and tangential grinding forces, which are Fn, Ft were analyzed for the machining processes of WC-Co material to obtain optimum grinding conditions, 3-point bending test is carried out to check machining damage on the ground surface layer, which is one of sintered brittle materials.

As a result, young people are feeling fear of delinquency. Fear of delinquency young people feel, a major impact on the personality development of the youth of the period of growth. In particular, the violent delinquency, to give a physical impact, damage youth receives is large. As well as physical damage to people in and around the juvenile victims, given the damage mental serious form, fear violent delinquency has been shown in many previous studies. Therefore, in this study you have the purpose to study the effects on the reaction of juvenile victims for fear of delinquency caused by the delinquency of violence. Set randomly on campus and external experience and damage directly or indirectly, are classified into action evasive action defensive reaction of fear by delinquency, factors that affect the risk caused by violent delinquency, Daegu after conducting a survey of high school students in general in the areas in which we tested the hypothesis.   • There has been an increase in head trauma due to rapid industralization and improvement in transportation. This poses difficulties in differentiating between neuropsychiatric disabilities resulting from real organic changes and those arising from compensation issues. It is the purpose of this study to seek out the differences between normal and abnormal finding group in the structural brain imaging studies via the results of the functional brain imaging studies and psychological tests. Out of 132 subjects, 62 comprised normal and 70 the abnormal finding group. EEG and SPECT were chosen for inspection of functional brain imaging. MMPI and K-WAIS were chosen for psychological test. The subjects were further divided into right hemispheric damage, left hemispheric damage, both hemispheric damage, diffuse damage group and negative group in order to find out whether any differences in the psychological lest results could be localized. The results are as follows : 1) The abnormal finding group, the EEG and SPECT were proven to be a good predictor of brain lesion. This implies that even in the functional brain studies, abnormalities are more easily detected if there are visible brain lesions. 2) The FSIQ of the abnormal finding group is lower than that of normal finding group. this difference is mainly due to low V1Q. The left hemispheric damage group lend to shaw low V1Q. This lowered in was the difference between left hemispheric damage group and negative group. Furthermore, there were no group differences in the PIQ. It is concluded that K-WAIS is effective as evaluator of VIQ mainly of those patients with left hemispheric damage and it is ineffective as a evaluator of PIQ. 3) In the MMPI profile, the both groups displayed high neurotic profiles. There was no difference in the psychotic profiles. The scores of the Depression and Hystery were high in abnormal finding group. This can be seen as one of the lypical findings of chronic head trauma patients. 4) The abnormal finding group tend to be diagnosed as organic mental disorder in the psychological tests more frequently.

  • It is very difficult to clearly define the damages caused by blasting-induced noise and vibration, because the damages depend on, besides the level of noise and vibration, the response of the object, environmental conditions, subjective feeling, and mental condition. Especially, it is more difficult when the fish is concerned, because that experimental approach is not easy and that we lack of the reasonable criterion for the acceptance level of noise and vibration. In Korea, the acceptance level for damage due to underwater noise is 140 dB re $1{\mu}Pa$, and the difference from the underwater background sound level is defined as more than 20 dB re $1{\mu}Pa$. It is however, appropriate for continuous noise not for transient sound. The authors compared the relationship between vibration velocity and underwater noise measured from the test blasting around Marphysa sanguinea farm. This paper presents the measurement results and suggestions the acceptance level for damage due to underwater noise from explosive blasting.
