The Impact of ICT Costs on Innovation Activity of Digital Hubs in Regions of Kazakhstan: Universities, SMEs and R&D

  • Purpose: the study aims to examine the impact of ICT on the formation of digital hubs in regions of Kazakhstan, specifically the influence of ICT costs on the level of innovation activity of enterprises, the number of its actors as legal entities by size and region, small and medium enterprises, universities and research and development organisations. Research design, data and methodology: the research methodology is based on the collection of secondary data from the official statistical yearbooks of the Bureau of National Statistics of the Republic of Kazakhstan and the use of quantitative methods, in particular, correlation analysis and multiple regression. Five indicators related to the formation of digital hubs in the regions of the country were selected. Results: the study revealed that ICT spending has an impact on the formation of digital hubs in regions, in particular on the development of the number of legitimate enterprises, SMEs and R&D organisations as actors in digital hubs. A positive dynamic in the growth of the number of actors is visible. However, the hypotheses on the impact of ICT costs on the number of universities and the level of innovation activity were not supported. Conclusions: based on the results of the study, recommendations such as government proposals on strategy development, funding projects of innovation and digital hubs, and business proposals on engaging local entities in digital transformation for the formation of digital hubs in the country's regions have been developed.

An Exploratory Study for the Introduction of Standard Electronic Documents for Bonded Logistics Warehouse in Port Hinterland (항만배후단지 보세물류창고 표준전자문서 도입을 위한 탐색적 연구)

  • After being kept in bonded areas and bonded logistics warehouses, the level of information sharing and progress confirmation on the process until the cargo is released is insufficient, resulting in disputes and legal disputes related to unauthorized and illegal delivery of cargo. This study attempted to present the introduction of standard electronic documents as a way to solve problems such as delivery practices raised in the delivery of existing imported cargo and legal disputes related to unauthorized illegal delivery among import-related entities. The service provider who manages the bonded warehouse/logistics center in the hinterland of Busan New Port and the shipper service user who use the service were classified into two groups, and a survey was conducted to analyze the difference in perception between the two groups. As a result of the analysis, both groups judged that the introduction of standard electronic documents was necessary, and showed high expected effects in preventing and reducing erroneous shipments and preventing and improving unauthorized and illegal shipments. Discussions between related organizations, related parties, and subjects are needed first to introduce standard electronic documents of the entry and warehouse management system, and the actual participation of related entities such as service providers and service users will play a very important role in establishing the system.

  • As the 'hyper-connected society' has emerged through the 'Fourth Industrial Revolution, public interests as well as social dangers have increased. Above all, the risk of infringement of information, including confidential personal information, is dramatically increasing. As the hyper-connected society has been realized, even if only one of the internet devices is hacked, there would be a danger that the ripple effect of such a hacking spreads to the whole network. Therefore, the necessity and importance of information security, including cybersecurity, has been increasing. In other words, the stability of cyberspace and internet space is becoming more important. As a result, the Korean government is seeking to build a legal system related to information security, which would be able to cope with the information infringement problem in the hyper-connected society. However, it seems that the government is still struggling with the direction of building such a legal system. In this context, a comparative review examining the legal systems of advanced foreign countries will provide meaningful implications as to what kinds of legal policies we should devise and implement for information security. In particular, the U.S. legislative act that actively responds to the cybersecurity violations is worthy of reference. For this reason, this article systematically analyzes the current status of the U.S. cybersecurity laws. Especially, this article focuses on the "Cybersecurity Information Sharing Act of 2015"(hereinafter "CISA"), that was recently enacted by the U.S. congress. The CISA prescribes the systemic and detailed information-sharing between national and private entities. The CISA, that actively promotes information-sharing, is full of suggestions for us, in that information-sharing is an effective way to properly realize information security in today's hyper-connected society.

Development of System Requirement Management Database System from User-centered Scenario (사용자 편의를 고려한 시스템 요구사항 관리 데이터베이스 구축)

  • In this paper, a new system requirement management tool and its application on the Urban Transit Maglev Project were introduced. In most R&D projects on complexity system such as transportation system, Systems Engineering(SE) activities are included on each project, and SE teams are using commercial computer-based tools to perform the SE activities. Even though SE tools help to manage huge data and documents on engineering efficiently, but well-designed functions of SE tools which support SE activities are not sufficiently used on the whole process of system engineering. In order to computer-based SE tools are to be effectively used on project management, most engineers who takes engineering and coordination roles, at least sub-project managers should be familiar to the tool and could be easily use it, but usability of commercial SE tools are very difficult for normal engineers with no experience on SE activities and SE tools. To overcome this difficulty, we developed a new system requirement management tool considering each user's scenario on using engineering tools. The developed tool could not cover whole SE processes, but designed to perform requirement engineering such as system requirements(SRs) management, specification management, traceability management, SRs' verification activity management and so on. All the entities on SR database are inter-connected by pre-recognized traceabilities, so even non-specialists on SE can easily browse the database and find entities concern, and linked information such as interacted entities, legal or engineering constraints, coordination documents, status of development and verification and so on. Also functions for SR verification tools, TPM(Technical Performance Measure) tools, DB searching tools with traceability, and report generation tools are included on the system.

  • The Urban Regeneration can improve physical, environment, economy, life and culture of retarded urban area to recover vitality and to recreate residing environment having competitiveness. This study constructed buildings database to investigate deterioration of buildings of each dong that was minimum administrative region classified for administrative convenience, and spatial structure analysis for Urban Regeneration in Busan. Legal standards have not been established yet. Therefore, the study conducted quantitative analysis based on the Law of Urban and Dwelling Environment Improvement as well as the Special Law of Promotion of Urban Reorganization to find out problems of existing legal systems and to make use of investigation results as basic material of Urban Regeneration project in the future. And, the study investigated physical deterioration of buildings, and characteristics and types of the variables such as population, welfare, business entities at each dong, that is to say, basic administration unit of the government through Factor-Analysis.

Legal Relation of Parties on Transactions in UCITA (UCITA상의 전자정보거래 당사자 간의 법률관계)

  • Uniform Computer Information Transactions Act (UCITA) is the first legislative attempt in the world that deals with transaction of digital information. This however gave rise to endless controversies and as of February 10, 2003, its life as the uniform law has expired. There are four kinds of relationships that UCITA regulates for the entities involved in information trading namely, 1) Relationship between licenser and licensee 2) The triangle relationship between dealers, end-user and publisher 3) Relationship between information right transferor and transferee 4) Relationship between financier, licenser and licensee. Amongst these, the most significant one is the triangle relationship amongst the publisher, commonly known as the licenser in the mass market, end-user and dealer. At the essence of the relationship is that the dealers is liable to refund the payment for the information regarding the end user if he/she does not agree with the publisher on the license of the common market. Looking at the relationship between license transferor and transferee, the transfer of license may be prohibited but the special contract must be conspicuously carried out. The relationship financier, licenser and licensee is unique to the United States and is rather unfamiliar to us. UCITA has been criticized for preferentially protecting the benefits of licensers especially when it comes to the specific regulations for the relationship. Therefore, it is not advisable to blindly accept UCITA regulations. However, UCITA does have components that we can utilize in formulating our own digital information trade regulations, save its proprietary nature as an American law and its preferential treatment for licensers.

Strategies for MSMEs to Achieve Sustainable Competitive Advantage: The SWOT Analysis Method

  • The essential purpose of this study is to propose strategies for developing micro-, small-, and medium-sized enterprises (MSMEs) to realize sustainable competitive advantage by applying the SWOT analysis method. Thus, the main problems investigated in this study are: a) around 60-70% of MSMEs in Kulonprogo regency do not yet have access or financing from banks; b) lack of knowledge of production technology; c) in general, MSMEs business actors are still incorporated legal entities; d) MSMEs do not have a good financial administration and management system; e) coordination between MSMEs stakeholders has not been integrated; f) limited facilities and infrastructure of MSMEs, primarily related to technological tools; and g) limited access to raw materials so that MSMEs often get low-quality raw materials. This study employed a survey method with questionnaires and interviews. By using the Slovin tools sampling technique, the number of samples was 39 MSMEs in Kulonprogo Regency, Yogyakarta, Indonesia. The results of this study confirmed that the Kulonprogo MSMEs should pay attention to seven aspects of business management to achieve sustainable competitive advantage. The seven aspects are: 1) business strategy; 2) human resources; 3) information technology; 4) products; 5) promotion; 6) cooperation; and 7) corporate social responsibility (CSR).

Distribution of the Tax Burden across Companies in Vietnam: The Issue of Corporate Tax Avoidance

  • Purpose: This paper considers the issue of corporate tax avoidance (CTA) in the distribution of the tax burden across companies in Vietnam because the high level of CTA leads to unfairness in taxation. In particular, we aim for discussing the way to measure the extent of CTA and explore the determinants of CTA that reflect the features of high-tax risk-taking companies. Research design, data and methodology: The study investigates factors influencing the CTA behavior of legal entities listed on the Vietnam stock market between 2012 and 2018 to fill the empirical research vacuum in the country. we employ the dynamic GMM estimate method. Interestingly, CTA is considered through three approaches, including two effective-tax-rate-based methods and especially accrual earnings Results: The results highlight tax - accounting book disparities have significant effects on CTA. In addition, firm size, net asset value, debt leverage, and tax-accounting books are related to CTA. Conclusions: Tax avoidance is shown to have a positive correlation with financial distress in this case. The higher a company's capital adequacy ratio, the fewer tax avoidance opportunities it has. The paper draws some recommendations to deal with tax avoidance that improves the fairness in the distribution of the tax burden among corporations.

Clarification of Safety Measure Implementation Entities through the Development of a Stakeholder Model for Special Types of Workers (특수형태근로종사자의 이해관계자 모형 개발을 통한 안전조치 이행주체 명확화)

  • Since the recently established obligation to implement safety and health measures for specialized workers as outlined in the Occupational Safety and Health Act (OSHA) for nine occupations in January 2020 and five occupations in November 2021, there is a need to verify and inspect the on-site operation of related systems. After a comprehensive fact-finding survey and risk factor analysis, it is necessary to examine the responsibility for on-site safety and preventive measures, along with the roles and responsibilities of specialized workers. Stakeholder analysis is essential to identify the fundamental problems related to the responsibility stipulated in the purpose of OSHA and to explore the entity responsible for implementing safety measures. Therefore, in this paper, we discuss the topic of implementation based on legal standards for on-site safety and preventive measures. Additionally, we develop a role model for appropriate safety measures, outlining the dynamic relationship between those who provide labor and those who provide labor in the context of specialized workers.

Legal Aspects of Insurance Regarding Space Activities and the Situation in China: an Analysis Based on the New Development of Space Commercialization (空間活動保險法律問題及中國狀況:基於空間商業化最新發展的分析)

  • Insurances of space activities are divided into satellite insurance, astronaut insurance and third party liability insurance. Against the background of the rapid development of space commercialization, especially the increasing participation of private entities in space affairs, the present international and domestic mechanisms of space insurance are challenged. As a space-faring state which is in the process of developing space businesses, the regulations of space insurance in China are deserved to be discussed. Satellites insurance is at present well-developed, the "pre-launch", "launch" and "in-orbit" phases of satellites are all possible to be insured by related companies. China created the CAIA in 1997 to provide insurance for Chinese satellites. However, with more private entities start to involve in space as well as satellite industry, the regime established under the framework of CAIA is necessary to be modified, and the mechanism relating to space insurance brokers should be promoted. The astronauts are recognized as the envoy of humankind, and relevant international regulations are made to provide assistance to them in emergency circumstances. From the domestic perspective, astronauts will be fully insured. China creates a particular type of insurance for astronauts. However, once space tourism becomes a business, the insurance of the tourist will be demanded to be created. In order to promote China's space tourism, it is recommended to take the "Astronaut Group Insurance" as an optional model to space tourists, if the tourists are customers of a governmental-owned space company. Once private involvement of providing orbital/suborbital tourism service becomes a reality, new rules are required. Getting a third party liability insurance is deemed as an indispensable precondition for an applicant to get a launch permission. Domestic space laws will include provisions for the third party liability insurance. China's "Interim Measures" of 2002 realizes the importance of third party liability insurance and requires the permit holder to get it before entering the launching site. This regulation is different from the practices of other states. Concerning that China is the sponsor of APSCO, for the purpose of promoting commercial space cooperation, a harmonized approach to domestic law is recommended to be found.
