A Study on Improvement Measures Related to District Unit Planning to Induce Landscape-Friendly Planning in Non-Urban Areas (비시가화지역의 경관친화적 계획 유도를 위한 지구단위계획 관련 제도 개선방안 연구)

  • In this study, in order to induce landscape-friendly various development plans established at the district level, the contents of landscape plans appearing in domestic laws and systems and related previous studies are reviewed and comparative analysis is performed to advance the district-level landscape plan. The main focus was to explore the institutional methodology for this. The summary of the research results is as follows. First of all, as a result of analysis of the landscape plan content prescribed in the National Territory Planning Act and the enforcement decree of the same Act, the landscape plan content for natural elements and the landscape plan content for artifacts appeared mixed. Next, looking at the analysis results of the landscape plan contents in the Landscape Act, the Enforcement Decree of the same Act, and the landscape plan establishment guidelines, it is analyzed that the content mainly intended to improve the artificial landscape in terms of aesthetics, such as color, lighting, and buildings. Became. As a result of analysis of the landscape plan contents in the district unit plan establishment guidelines, it was found that the contents of the landscape plan for the skyline, night view, color, advertisements, and viewpoints were presented. As a result of the analysis of the landscape plan contents in the preceding study, the plan contents for ecological, recreational, and micro-visual aspects were revealed, and all three aspects aim to establish a landscape plan within the range of minimizing damage to nature. there was. Appeared to be. The results of this study are considered to be able to induce more landscape and nature-friendly district unit plans being conducted at the district level.

  • The Korean government and industry have presented a roadmap for the commercialization of UAM services and are promoting it in earnest. In order to introduce full-scale UAM services, there are various issues to be solved, such as the development of high-performance aircraft, the design of network bases and corridors, the optimization of operation management, and the establishment of related laws and systems. In this study, in terms of optimizing operation management, we will examine research trends by field, focusing on Korea, and derive research topics that need to be solved in the future. Korean researchers have suggested that research is centered on UAM service usage fees, usage intentions and acceptance models, and vertiport location selection, but operational optimization studies such as service order acceptance, aircraft repositioning, and battery charging and maintenance scheduling are needed in the future.

  • Purpose: When designing plants and workplaces such as handling and using chemicals, a system that can automatically determine whether the design has been made in compliance with domestic safety management laws is established to shorten the review time and increase accuracy. Method: Safety design standards for chemical handling and use workplaces were investigated, and types and systems were derived that could automatically judge design errors by dividing the articles into semantic units. Result: An automatic design review method performed when designing a building was proposed, and a system that can review the safety design requirements required when designing a chemical handling business site through the development of a rule checker was proposed. After confirming whether the law is subject to application, the safety design rules are classified into semantic units through preprocessing. The classified results can be classified into four types, and the specifications, space, conditions, situations, and specific devices and facilities to reinforce safety were analyzed as representative types. It proposes a system that prepares a diagram for the safety design rule and allows it to be reviewed through the rule checker program.

Development of a Model for Managing Chemical Substances in Korea with Emphasis on Cleaning Solvents (우리나라의 화학물질 관리모델 개발: 세정용 유기용제를 중심으로)

  • Hazardous organic solvents management as prescribed by presidential decree in Korea is reviewed. The status of import, manufacture, and circulation of organic solvents was investigated. Problems inherent in the management of organic solvents in the electroplating, metal degreasing, and dry cleaning industries were discussed. The chemical substance management system in Korea was compared to those of foreign organizations. A walk-through check list was developed and then used to assess the actual conditions and potential hazards of chemical substances in these industries. The questionnaire could be used to develop a chemical management system and protect workers from hazardous substances. Based on the results of the site survey, MSDSs were not integrated appropriately into the workers education and were not readily accessible to employees. In the case of the dry cleaning industry, the new dry cleaning solvent used as a substitute includes a lot of potentially hazardous organic solvents. This research is preliminary. It is recommended that a national survey be performed to better identify the current situation. Because chemical substances are regulated by thirteen laws in seven executive branches, management systems often overlap, resulting in ineffective control. Using the above results, a model for managing chemical substances was developed. This will more efficiently provide MSDS information to workers covered by the presidential decree and allow the construction of a management system database for better cooperation with the executive branches in Korea.

Management Changes of Hazardous Air Pollutants Sources and Its Proposed Improvement in Korea (유해대기오염물질 배출원 관리의 변천과 개선방향)

  • Even a small amount of hazardous air pollutants could have a harmful influence upon human beings, animals and plants. Hazardous air pollutants have the properties of toxicity, canceration and organism accumulation. They include heavy metals, volatile organic compounds, polycyclic aromatic hydrocarbons, dioxin, etc. The Clean Air Conservation Act has defined specific hazardous air pollutants and designated 35 pollutants, distinguishing them from common air pollutants for special control. This study investigates the history of the controls of specific hazardous air pollutants with reference to some relevant laws and regulations in Korea. It investigates the regulations at the permission stage, such as the restrictions on installation of emission facilities, the permission and reporting of installation of emission facilities, and the regulations at the operation stage, such as maintaining permissible emission levels, installation of measuring devices, dues for emission, self-measurement and securing environmental engineers. The current regulatory management is not so satisfactory in regards to the serious effects of specific hazardous air pollutants upon the human body. An advanced new concept, like the maximum available control technology in US, the facilities management standards, which will soon take effect, will be able to lessen the emissions of fugitive hazardous air pollutants. In addition, this study discusses some possible stricter controls on the emission facilities of specific hazardous air pollutants and proposes some measures to maintain and supplement the current systems.

  • The natural environment restoration industry has been newly included in the environment area of engineering technology. Accordingly, the enactment of a standard of estimate for determining the 'Cost plus Fixed Fee' method has become necessary for the implementation and vitalization of natural environment restoration projects. The purpose of this study is to determine the standards for which the prices for engineering projects are calculated with respect to the enactment of an engineering project standard of estimate in the natural environment restoration field. These include the scope of the technological work, standard area, manpower requirements by technical grade that are necessary for carrying out the technological tasks. Relevant laws and regulations, systems and precedent case studies were investigated and analyzed to establish a price calculation standard. The overall results of the analysis were used and applied to questionnaires, public hearings, and expert delphi techniques. The study showed the following results: The scope of the technological work was categorized into 'Biotopes', 'Eco-corridors' and 'Ecological restoration'. The standard area was set up as $1,000m^2$ for 'Biotopes' and $5,000m^2$ for 'Eco-corridors' and 'Ecological restoration'. The manpower requirements by technical grade that are necessary for carrying out the technological tasks were determined. The suitability of the costs, standard area, manpower requirements by technical grade of ordered engineering projects that are determined by applying the standard of estimate for natural environment restoration that may be enacted pursuant to this study may be effectively investigated and analyzed. Moreover, further studies on the calculation of standard prices that can ensure the stability of natural environment restoration projects will be necessary.

  • UNIDROIT Principles of International Commercial Contracts(PICC) was published in 1994. PICC has been functioned as a guideline of international commercial contracts, an applicable law to govern a contract by the agreement of the parties to a contract, general principles of law and lex mercatoria. In addition, PICC has a role of interpreting or supplementing international uniform law instruments as well as domestic laws, and also has served as a model for national and international legislations. PICC has been accepted as a authoritative source of knowledge of international trade usages of international commercial contracts to the arbitral tribunal rather than domestic court because it excluded the characteristics of hard law at the drafting stage. This article dealt with the rule on gross disparity of validity which fall outside the scope of UN Convention on Contract for the International Sale of Goods(CISG), which has obtained a leading legal position of uniform law in international sales of good. In other words, PICC suggests a series of meaningful solutions to the issue of gross disparity of contract which is the most complicated among legal disputes occurring during the process of conclusion of contact and also extremely different and diverse between legal systems. This article covered the issue of gross disparity of contract at the conclusion of contact and suggested the legal basis of several rules related to the gross disparity by analysing gross disparity rule of PICC. Furthermore, this article suggested legal check points or implication as well as interpretation and evaluation on doctrine of laesio enormis and undue influence or unconscionability. This article also dealt with a comparative analysis with Principles of European Contract Law(PECL) and Common European Sales Law(CESL) which have important legal positions in the area of international commercial contract as well as in terms of close relationship to PICC by linking with recent court or arbitral tribunal rulings.

Problems of Government Crisis Management System and Its Improvements: Focusing on Park Geun-hye Administration (정부 위기관리시스템의 문제점과 개선방안 : 박근혜 정부를 중심으로)

  • This study is intended to comprehend the level of Crisis management through the review of the government Crisis management system, to draw its problems and improvement methods, and to present implications on the establishment of effective Crisis management systems for the future. For this, the condition of operating Crisis management system was analyzed based on legal system, organizations and networks through the major disaster cases during Park Geun-hye administration period. The result of the study showed that there was lack of the interconnectedness among laws in the legal system, manuals and disaster preparation training. The Crisis management organizations had such problems as inappropriate response to crisis, perfunctory re-organization and lack of organizations' functions. The problems in the networks were relations between central and local governments, lack of cooperation and association among each division, and operation methods. The presented improvements for the above problems were the comprehensive revision of legal system, securing responsiveness of Crisis management organizations and the establishment of organic network system.

Education and Training Measures on Multi-crew Pilot License(MPL) Application in Korea for Improving Air Navigation Safety (항행안전 증진을 위한 국내 부조종사자격증명(Multi-crew Pilot License; MPL)제도 도입 관련 교육·훈련방안)

  • Multi-crew pilot license (MPL) is a new pilot licensing concept introduced and operated by ICAO. Mostly, candidates for MPL are educated and drilled with competency-based trainings (CBTs). In this paper, to present education and training measures for the domestic MPL application, ICAO documents and Korea aviation laws for pilot licensing, domestic and foreign airlines' employee requirements, and status of operations related to MPL system are identified. Also feasibility of MPL application in Korea is reviewed by checking approved domestic aviation training institutions' capabilities, airlines' pilot demands, and concerns of airlines and trainees with MPL system. Finally, three education and training measures on MPL application in Korea for the air navigation safety are suggested.
