Study on the Development of Disaster Safety Judicial Police System (재난안전사법경찰제도의 발전 방안 연구)

  • This study examined the current situation of the problem and to suggest an improvement plan for the general public officers who are currently working as the Special Judicial Police for Disaster Safety in Gyeonggi-do and Kangwon-do provinces. The disaster safety special judicial police have the expertise of the investigative environment and human factors. The present situation of the operation was analyzed, and the problems, improvement plan, and activation plan of the system were derived. To cope with crime prevention, which is complicated and diversified progressively, this paper proposed the direction of reestablishing disaster safety special judicial police personnel for disaster safety.

Substantial Fairness in the Administrative and Judicial Process of Medicine Price Cut in Korea (약가 인하 효력 발생 시점 차이에 따른 문제점과 그 해결방안)

  • This study analyzed the problem of the time difference of medicine price cut in Korea according to the administrative and judicial process and sought to present the amendment in the related law to achieve substantial fairness. We considered unfairness of medicine price cut caused by the administrative and judicial process in three situations, the approval-patent linkage system, realistic differences in the practice of administration and suspension of price cut execution. Based on it, we reasoned out the solution to get substantial fairness in the administrative and judicial process of medicine price cut in Korea. Although each step of the administrative and judicial process is lawful and reasonable, the time difference of medicine price cut according to the administrative and judicial process can result in damages or windfall to both of pharmaceutical company and National Health Insurance Service. In the present legal system of Korea, it is unable to be correct. Thus, we present the amendment to correct the damages and windfall when it happens.

Legal System Reasearch Relating to Retaliatory Crime (보복범죄 관련 법제연구)

  • Social unrest from retaliatory crimes is increasingly becoming problematic. Recently, there was an accident involving a suspect who went to a hospital and committed acts of retaliatory violence 11 times. This person's reasoning was that he was imprisoned due to the hospital's reporting to the police. He was consequently arrested in Boeun Choongbook on December 27th 2014. Accidents like this one take place frequently around our surroundings. There are regulations and systems in place. Nevertheless, similar cases that continue to take place makes us wonder if criminal judicial systems work well. Lukewarm responses to retaliatory crimes is not only threatening social security, but also placing fears in the minds of ordinary citizens. If retaliatory crimes take place, most citizens become apprehensive about criminal judicial activities of the police and mistrust for criminal judicial system. This at times discourages people from reporting incidents and could eventually increase crime rate and cause various social problems. Even though there are legal and systemic control measures, retaliatory crime is an increasing trend. This study is going to examine tendencies of internal retaliatory crimes and discuss legal-systemical responses.

A Study of Internet Content Regulation in South Korea (국내 통신심의 제도 개선에 관한 연구)

  • The recent Internet environment demands a new approach to Internet content regulation. The need for regulation on the Internet has been recognized due to the rise of digital sex crimes, illegal information such as drugs and suicide, fake news, hate speech, false consumer reviews, and harmful content for young people. This article attempts to analyze the legislative, judicial, and administrative aspects of Internet content regulation in Korea. It covers the current status and characteristics of the Internet content regulation law, the judicial judgment on KCSC's communications deliberation and regulation, and the process and characteristics of KCSC's communications deliberation. Problems in Korea's communications deliberation system were addressed through legislative, judicial, and administrative approaches. This article concludes with policy suggestions for improving Internet content regulation in Korea.

Comparison and Suggestions of Mediation System between AAA and KCAB (AAA와 KCAB 조정제도의 비교와 시사점)

  • Mediation, which is part of ADR, is a method used to settle disputes amicably by employing a third party who is in a neutral position. Utilization and attention on meditation are increasing in place of litigation and arbitration owing to its effectiveness in terms of time, cost, and effectiveness in achieving an amicable settlement. As to Korea, mediation at the civil level was employed by the KCAB in July 2012 but its utilization was in ABC stage compared to mediation at the governmental and judicial levels. Based on this situation, this study reviewed the guideline and system of the KCAB through a comparison of the management system between the KCAB and AAA where mediation was in good use. This study further suggests solutions as to the development of an international commercial mediation system First, the KCAB rule is needed to create a mediation language, mediation place, mediator internationalization, and so on. Second, a system backup is necessary to ensure the enforceability and effectiveness of mediation. Third, a unified mediation law in Korea is desirable for the harmonization of mediations at civil, governmental, and judicial levels. The unified mediation law, if it is made, may lead to an international base where this requirement exists. Fourth, advertising the merits of mediation to the public is necessary. Fifth, securing specialized mediators and relevant training are essential. If the above requirements are implemented, Korea would advance in international commercial disputes.

A Study on the Unlawful Fishery Control System (불법어업 단속제도에 관한 연구)

  • The fisheries resource in waters under the jurisdiction of Korea is being endangered by unlawful fishery. The Korean government exerted great efforts to establish the public order of water, but the number of the exposed unlawful fishing violations has increased for last 10 years. The system to guide fisheries regulatory noncompliance of Korea is limited to the use of fishing guidance patrol boats. For strength of monitoring and surveillance systems, the government needs to phase in Vessel Monitoring System. But there are some studies for that. The defects of present monitoring practice can be drawn from the facts described above. The qualification of the fishery control official one of most important element of fishing control system, is defined as any officer who is charging on fishing. For clear law enforcement the qualification should require considerable experience and knowledge. Korean coast guards have problems on guiding unlawful fishing violations because of the absence of administrative authority by comparison with the fisheries guiding officer, who has both authorities on administration and jurisdiction. To draw some judicial problems this research presents a analysis on the fishing control system. The research suggests the improvements to compensate the defects.

A Study on the System of Litigation and Ideal Dispute Resolution (소송제도와 이상적인 분쟁해결제도에 관한 연구 - 대법원의 상고법원 설치안을 중심으로 -)

  • The number of final appeal(the rate of final appeal: 43%) has been on the increase every year over the past ten years in Korea. The number of final appeal cases given to a justice of the Korean Supreme Court amounts to nearly one everyday, which makes it vulnerable to faulty decisions. Reversal rate of final appeal is as low as 10% with most of the cases being dismissed and hence the percentage of people having trust in the judiciary is merely 27%. In this context, the Korean judiciary has announced its plan to set up a final appellate court in the Supreme Court. The establishment of final appellate court, however, is not only against the Constitution but also hardly seen in other nations. It would only overexpand the Supreme Court. Furthermore, the final appellate court would end up deteriorating into the court of fourth instance and impose extra burden on the government as well as on the disputing parties. Therefore, it is necessary to upgrade the quality of the court by increasing the number of judges in the lower court and let them focus on the fact finding process. Facilitating the ADR(Alternative Dispute Resolution) process such as arbitration would help improve the structure of the judiciary. The incompatibility among the four values of the dispute resolution process(equitability, truth, quickness and efficiency) calls for building comprehensive judicial system in which disputes are settled by choosing either jurisprudence or utility.

Enforcement of South Korean Arbitral Awards in Mainland China

  • This article reviews some recent decisions of the Supreme People's Court (SPC) of the People's Republic of China (PRC) on the recognition and enforcement of several South Korean arbitral awards. It explains the implementation of the New York Convention in the PRC and in particular the so-called Report System under the current Mainland Chinese law and judicial practice. It identifies some deficiencies in the People's Courts' approaches to the application and interpretation of the New York Convention and argues that the Mainland Chinese courts should adopt the pro-enforcement principle in the determination of the relevant issues under the New York Convention. It proposes further enhancement of the Report System and that the current categorization of 'domestic, foreign-related and foreign' in the context of arbitration agreements and arbitral awards needs to be further reviewed and clarified by the SPC. Last but not the least, it recommends some steps that South Korean parties should take to enhance the enforceability of South Korean Arbitral Awards in Mainland China.

Harmonization between Environment and Trade under the WTO system (WTO체제하의 환경과 자유무역간의 조화)

  • This paper finds out that the WTO's member countries' environmental measures have sometimes reflected the interests from their domestic industrial fields under the name of environmental protection. For the harmonious linkage between the trade and environments under the WTO mechanism, it is required for the concerned parties to reach the consensus for the measures to be imposed domestically and internationally, as well as the WTO's judicial efforts to make more scientific approach. Such coordination and consensus among the concerned parties to the domestic and international environments would be the efficient way to solve the conflicts between the trade and the environments, together with the WTO's more scientific approach in interpreting and applying the environmental provisions.
