A Comparative Study of Ship Collision Legislation in Korea and China (한국과 중국의 선박충돌법제의 비교법적 연구)

  • The increasing trade volume between Korea and China has rapidly expanded the maritime transport between the two countries. However, safety, particularly considering the ship collisions in the Yellow Sea and East Sea waters, has not been fully ensured. These collision accidents in that region endanger traffic safety and the marine environment, moreover, it has the potential to cause legal complexity because Korea and China haver domestic legislation, that are considerably different in some aspects. International conventions and domestic legislation in China provide detailed laws with respect to ship collisions, however, the theory of ship collision infringement still needs to be improved, enriched, and developed. Because these laws are not very clear on the resolution of disputes resulting from ship collisions, we focused on the final judgments by the Supreme Court of China (SPC), and the judicial judgments set by the Maritime Court of China. This study aimed to explore the domestic legislation applicable to disputes related to ship collisions in China, and comparatively investigate the legal provisions of Korea and China on the issue of ship collisions, particularly on the aspect of damage compensation, fault ration, and liability apportionment.

  • The role of container ports contributes greatly to international trade and national or regional economic development by supporting maritime transportation and occupies a central position in the supply chain connecting sea and land. The performance(traffic volume) of a port generally depends on geographic, economic, and operational factors etc. For the past several decades, container port volumes have grown with fluctuation. This study amis to analyze how global ports have undergone changes in terms of cargo volume by region, size and period. For the analysis, only the volumes of global top 100 ports were used. Shift-share analysis and BCG matrix analysis were employed as methodologies. According to the result of the analysis, the relative volatility of port traffic over the past 16 years as a whole was found to be limited. On the other hand, ports in China and Southeast and Southwest Asia, which are economically growing for the last decades, showed growing trends, while ports in Northeast Asia and Europe appeared to be in a stagnant or declining phase. It also shows that most of the global ports maintain limited changes in cargo volume because they are already positioned as central ports in the region. In addition, it can be seen that the global port volume has a close relationship with the change in the economic capability of the relevant region or country.

  • Unification means the change of the economic system from 'Planned Economy' of the North Korea to 'Market Economy' of the South Korea. Therefore, it may cause confusions and difficulties for North Koreans who have been under planned economy for ages. So, we need to take the perspective of behavioral economics for the effective education. First of all, it is about overall finance, which contains the record of financial transactions, effect of inflation, investors' bounded rationality, and choice difficulty of financial products. Second, it is about borrowings, which includes the credit management, interest rate of difference among financial institutions. Third, it is about investment on financial products, which includes the effect of cost on returns, difference between compound interest and simple interest, trade-off between expected return and risk, market and non-market risks, the importance of diversification, and passive & aggressive investments.

A Study on Primary Control Area for Information Security Management System (ISMS): Focusing on the Domestic Three Industries (정보보호 관리체계를 위한 주요 통제영역에 대한 연구: 국내 3개 산업을 중심으로)

  • Most industries have introduced and operate an information security management system (ISMS) or a personal information security management system (PIMS) to suitably protect and maintain customer's information and company trade secrets. This study starts with the premise that it is desirable for every industry considering information security to maintain an ISMS. ISMS can be of different types among various organizations, taking into consideration culture, practical work procedures, and guidelines for information security. This study intends to derive primary control areas of an ISMS for each industry based on organizational size and audit type by analyzing non-conformity trends and control factors according to certification audits for organizations introduced for international ISMS under ISO27001. This study analyzed improvement effects of ISMS through case analyses. It is meaningful as exploratory research, although it was difficult to acquire data for empirical study because few organizations maintain certification in major industrial sectors. The requirements presented the highest frequency of non-conformity for each type from the 2013-initiated ISO27001; the years 2013 to 2020 were extracted as the primary control area. The study found that for primary control areas of ISMS for each of three industries, organizational size and audit type had differences.

Molecular epidemiology of Aleutian mink disease virus causing outbreaks in mink farms from Southwestern Europe: a retrospective study from 2012 to 2019

  • Background: Aleutian mink disease virus (AMDV) causes major economic losses in fur-bearing animal production. The control of most AMDV outbreaks is complex due to the difficulties of establishing the source of infection based only on the available on-farm epidemiological data. In this sense, phylogenetic analysis of the strains present in a farm may help elucidate the origin of the infection and improve the control and biosecurity measures. Objectives: This study had the following aims: characterize the AMDV strains from most outbreaks produced at Spanish farms between 2012-2019 at the molecular level, and assess the utility of the combined use of molecular and epidemiological data to track the possible routes of infection. Methods: Thirty-seven strains from 17 farms were partially sequenced for the NS1 and VP2 genes and analyzed phylogenetically with other strains described worldwide. Results: Spanish AMDV strains are clustered in four major clades that generally show a good geographical correlation, confirming that most had been established in Spain a long time ago. The combined study of phylogenetic results and epidemiological information of each farm suggests that most of the AMDV outbreaks since 2012 had been produced by within-farm reservoirs, while a few of them may have been due to the introduction of the virus through international trade. Conclusions: The combination of phylogenetic inference, together with epidemiological data, helps assess the possible origin of AMDV infections in mink farms and improving the control and prevention of this disease.

  • Tug services are essential services to ensure port safety. However, due to the relatively low barrier to entry into the tug service market, the number of service companies has increased, which has led to growing concerns about excessive competition among companies and poor service quality. To solve these problems, it is necessary to prepare a service quality evaluation system, but full-fledged implementation remains far away. The purpose of this study is to develop a tug service quality evaluation model that can be practically applied. To this end, an evaluation model consisting of two major categories, eight middle categories, and 25 detailed evaluation indicators was developed through a literature review, case studies, and expert interviews. AHP analysis is also conducted to derive the relative importance of the evaluation items. As a result of the analysis, it was found that the weight of user satisfaction was higher than that of management evaluation. In addition, the weights for each detailed indicator of management evaluation were in descending order of facility management, company management, and financial soundness, and it was analyzed that the management of facilities directly used for services was important. User satisfaction is in descending order of safety, punctuality, service satisfaction convenience, and transparency. These results show that securing safety is a top priority, and that the inherent quality of services such as safety and punctuality is more urgent than those of the convenience and transparency of the process in terms of providing preliminary services.

A study on the relocation strategy of the control line considering the marine pollution risk index and control capacity (해양오염 위험지수와 방제능력을 고려한 방제선 재배치 전략에 관한 연구)

  • The numbers of occurrences and the amount of spills of marine oil pollution have increased, and accordingly, it is necessary to secure additional control capabilities. Therefore, it was intended to present an empirical basis for improving the overall idle capacity through the relocation of control ships existing in each region. First, the marine pollution index was derived and the control capability compared to the marine pollution index of each region was compared to examine the appropriateness of the deployment of control ships. The marine oil pollution risk index was derived by multiplying the nine items that cause marine pollution by the weight derived by experts. We checked the control capacity (A) compared to the marine pollution risk index (F) for each sea area. Mokpo (F:13.4, A:1.9), Busan (F:14.3, A:6.4), and Yeosu (F:21.5, A:16.6) are the areas that lack control capabilities compared to the marine pollution risk index. On the other hand, the areas that have room for control compared to the marine pollution risk index for each sea area are Masan (F: 5.9, A:13.3), Gunsan (F:1.7, A:8.3), and Jeju (F:2.7, A:6.9). Therefore, for improving the standardized control capacity proportional to the risk of marine pollution nationwide, it is suggested that the control ships of Masan, Gunsan, and Jeju should be relocated to Mokpo, Busan, and Yeosu, which lack control capacity.

A Study on the Difference in Consumer Demand of Leports Wear and Its Implication for Apparel Development by the Types of Motivation to Participate in Marine Leisure Sports

  • This study attempted to categorize the motivation for participation in leisure sports and analyze the difference in consumer demand for leisure sports wear according to the type. As a result of the analysis, the functionality of the preferred material consisted of movement, comfort, and body temperature maintenance. When purchasing, the factors to consider were extracted such as basic emphasis, emphasis on flaunting, and emphasis on practicality. The improvement requirement was composed of basic function improvement and various function additional factors, and the purchase satisfaction factor was composed of three factors: brand, practicality, design, and functionality. Motives for participation in marine leisure sports were grouped into mania, leisure, and health types. As for the functionality of the preferred material, the mania type and leisure type preferred movement, comfort, and body temperature maintenance functionality over the health type. As for the factors to consider when purchasing, the mania type and leisure type had higher consideration for the factors of basic emphasis, ostentation, and practicality than the health type. In the improvement requirements, both basic function improvement and various function additions had the highest mania type and the lowest health type. In terms of purchase satisfaction factors, practicality and brand were found to have a high leisure type, and functional factors were found to have a high mania type. For the enthusiastic group, it is thought that product development should focus on functionality and additional functions, and health types should be focused on design and utilization.

Sensitivity analysis of RPLS inventory model with price dependent demand linearly under order-size-dependent delay in payments in a two-stage supply chain (주문량에 따라 종속적으로 외상거래기간이 허용되는 상황 하에 선형수요함수를 고려한 RPLS 재고모형의 퇴화율에 따른 민감도분석)

  • Credit transactions are used as a means of price discrimination from competitors in order for suppliers to increase customer demand. In particular, in the case of a two-stage supply chain consisting of a supplier, a retailer, and a customer, the deferral of payment for goods allowed by the supplier is a means of reducing the inventory investment cost of the retailer. Retailers have the opportunity to discount the selling price while anticipating an increase in end-customer demand through the reduction of the inventory investment cost. In view of the fact that such trade credit is provided for the purpose of increasing demand as a means of discrimination from competitors, it may be more general that the credit transaction period is allowed flexibly according to the transaction volume. In particular, in the case of deteriorating products, the credit transaction period given according to the order volume is a factor that increases the order volume of the retailer, but product deterioration can be a limiting factor in the increase in the order volume. The deterioration rate actually plays an important role in determining the inventory policy of the retailer. Therefore, in this paper, the effect of such deterioration rate on the inventory policy of retailer is analyzed.

Impact of Oil Price Shocks on Stock Prices by Industry (국제유가 충격이 산업별 주가에 미치는 영향)

  • In this paper, we analyzed how oil price fluctuations affect stock price by industry using the non-parametric quantile causality test method. We used weekly data of WTI spot price, KOSPI index, and 22 industrial stock indices from January 1998 to April 2021. The empirical results show that the effect of changes in oil prices on the KOSPI index was not significant, which can be attributed to mixed responses of diverse stock prices in several industries included in the KOSPI index. Looking at the stock price response to oil price by industry, the 9 of 18 industries, including Cloth, Paper, and Medicine show a causality with oil prices, while 9 industries, including Food, Chemical, and Non-metal do not show a causal relationship. Four industries including Medicine and Communication (0.45~0.85), Cloth (0.15~0.45), and Construction (0.5~0.6) show causality with oil prices more than three quantiles consecutively. However, the quantiles in which causality appeared were different for each industry. From the result, we find that the effects of oil price on the stock prices differ significantly by industry, and even in one industry, and the response to oil price changes is different depending on the market situation. This suggests that the government's macroeconomic policies, such as industrial and employment policies, should be performed in consideration of the differences in the effects of oil price fluctuations by industry and market conditions. It also shows that investors have to rebalance their portfolio by industry when oil prices fluctuate.
