International Technology Licensing and Intellectual Property Rights:Empirical Evidence

  • 본 연구는 전 세계적으로 1990년에서 1999년 사이에 발생한 기술 라이센스 거래에 관한 자료를 바탕으로, 기업들이 속한 국가의 지적 재산권 보호정도를 포함한 국가별 고유 특성들이 기업들의 라이센스 거래 상대 선택에 어떻게 영향을 미치는 가를 살펴본다. 연구 결과, 기술 보유 기업들은 지적 재산권이 잘 보호되는 나라의 기업들에게 더 많은 라이센스를 주었다. 또한 경제적 자유가 많은 나라로의 기술 라이센스 이전이 보다 활발하다.

  • This paper is to explore the direction of international software protection laws, either copyright or patent right, by examining the current situations in the United States, European countries, Asia including Korea and the WTO/TRIPs Agreement. According to the comparative legal systems, each court and office gives both copyrightability and patentability of software by a stronger and appropriate intellectual property protection system.

  • LED 부품소재 분야에서 가장 높은 특허 분쟁율을 나타낸 신물질 형광체는 외부로부터 흡수된 에너지를 가시광선 영역의 빛 에너지로 변환시켜주는 무기 발광 물질로 LED에서 직접적으로 빛을 내는 역할을 하는 핵심소재로 LED 전체의 발광 특성(광 변환 효율, 휘도, 연색지수 등) 향상이 가능하므로, 고온에서도 발광강도의 안정성을 유지할 수 있는 형광체에 대한 기술이 유망할 것으로 판단된다.

  • WIPO international government committee will finish to develop toolkit for making documentation on discussions of intellectual property protection with TK, GR until the late 2003. As they construct DB of TK, GR, it becomes in a hurry to construct DB of TK information in Korea. We looked into application of copyright in force and a lot of problems in terms of analyzing medical books in the resent condition or protecting them in Korea. There are 29 kinds which have been lost, 12 kinds which could have read in parts, 136 kinds which have been existed of Korean medical books before 1900. There are also a lot of medical books which have been published after 1900 and still are unpublished. It would be 406 medical books from China totally, 111 kinds from Chosun Dynasty version, 134 kinds from Euybangeuchui, 225 kinds from Hyangyackjibsungbang, 78 kinds from Dongeuybogam. We consider to know whether Korean medical books could been applied to the copyright in force or not in accordance with discussions of WIPO on the period, subject(author), contents of protection. If it is applied to the copyright in force, it will be decided to revise according to discussions of WIPO. On the other hand, the problem which is occurred to protect Korean medical books is friction with China as importing their medical books, to find our medical books actively which has been unpublished. Finally, We have to revise administration and intellectual property standards or protect our medical books by making new administration laws.

지역특산물의 지식재산권 현황 및 브랜드화 발전 방향 (The Status of Intellectual Property Rights and Developmental Direction for Brands of Special Rural Products in Korea)

  • The purpose of this study was to analyze the status of intellectual property rights and developmental direction for brands of special rural products in Korea. The data was derived from 166 special rural products in Korea. The major results of this study were as follows: Enterprises having intellectual property rights above one were Traditional soybean sauce 18(56.2%), Hangwa 15(42.9%), Kimchi 18(43.9%), Traditional tea 20(80%) and Crafted products 10(31.3%), respectively. Enterprises acquiring designation and certification due to national and local autonomous entities over one were Traditional soybean sauce 17(56.7%), Hangwa 23(63.9%), Kimchi 33(80.4%), Traditional tea. 13(52%), and Crafted products 20 (62.5%), respectively. The trademark registration of special rural products was invested with total 62 cases(37.3%) as Traditional soybean sauce 14(43.7%), Hangwa 15(41.7%), Kimchi 17(41.5%), Traditional tea. 12(48%) and Crafted products 4(12.5%). And Patent registration 39 cases(23.5%), design registration 32 cases(14.5%), and utility model registration 5 cases (3.01%) were invested respectively. It was shown that, where the origin of brand names was a proper non 107 were things(53%), 39 were materials(19.3%), 17 were the production method(8.41 %) and 55 were a composite trademark(33.1%).

  • 동화상 압축 기술과 네트워크의 발달로 빠르게 보급된 디지털 콘텐츠는 불법복제와 인터넷을 통한 유포의 피해로 지적 재산권에 대한 보호의 필요성이 요구되었다. 이를 배경으로 지적재산권 보호를 위해 여러 표준화 단체들과 콘텐츠 공급자들이 DRM(Digital Rights Management) 시스템을 개발하였다. 그러나 서로 독자적인 DRM 시스템 개발로 인해, 이기종 DRM 시스템간의 상호운용성이 결여되는 문제점을 낳았다. 이런 문제를 해결하기 위해 MPEG(Moving Picture Experts Group)에서는 IPMP(Intellectual Property Management and Protection) 표준을 제안 하였으나 흡족한 기능을 제시 하지 못하여 이를 보완하는 DMP(Digital Media Project) 표준이 제시되었다. 이는 콘텐츠의 보호를 위해 툴(Tool)을 사용하고 이기종간의 상호 운용성과 콘텐츠의 지적재산권 보호를 제공한다. 본 논문에서는 오픈소스 멀티미디어 프레임워크인 Gstreamer를 이용하여 DMP 표준을 준수하는 DRM 시스템을 설계 및 구현하였다.

지적재산권 보호를 위한 전통의학 DB 구축에 관한 고찰 (Grope for a Summary Program about a Traditional Medical Database for Intellectual Property Protection in WIPO)

  • Objectives : In the WIPO conference about the protection of intellectual property for traditional knowledge (TK) and genetic resources (GR), there was a demand concerning the necessity of recognizing the invention of TK and GR and the foundation of a related database. Methods : In the standard of the foundation of a database, the content and resource identification standards, the technological standards and the security and transmission standards were discussed. In a decision on intellectual property, it means the protection and recognition as a technology precedent of the materials of the database. Results : Massive material on traditional medical care technology in Korea has existed in many areas. However, it is hard to make a database because it is difficult to organize and find the data. In addition, a database demanded by WIPO is not only the material of images or texts of simple technology information, but also the use of patent decisions about traditional knowledge technology and the public sharing of information in related areas. A traditional medical care database would consist of the core of a subject and the related areas. The core part is the medical herb resource and Oriental clinical technology. Conclusions : These are necessary to detail the kind of medicines and prescriptions, their use, and their processing. In the related areas, it needs to detail PIAS and clinical data in regarding the industrialization. These DB have to protect the TK and the GR of Korea.

중국의 약물자원 및 전통의약 지식재산권 보호 동향 분석 -「나고야의정서」 채택과 관련하여- (Analysis of China's Efforts to Protect Medicinal Resources and the Intellectual Property Rights of Traditional Chinese Medicine - in light of the adoption of the Nagoya Protocol -)

  • Objectives : In recent years, the Chinese Government has been providing full support aimed at promoting the excellence of Chinese culture, including Traditional Chinese Medicine (TCM), to the world after recognizing Chinese culture and medicine as elements that can generate national wealth. Methods : In investigating China's awareness of the issues surrounding the intellectual property rights of TCM, as well as its implementation of protective measures, this study analyzed the law and platform policies of the Chinese Government, as well as the designation status of China's intangible cultural heritages and the recent research trend in the TCM field. Results : First, China is taking various protective measures based on laws and institutional devices, including the Patent Act. Second, China is protecting the intellectual property rights of traditional Chinese medicines by registering them as Chinese intangible cultural heritages or UNESCO world heritages. Third, China is seeking to promote TCM throughout the wider world through various research and academic conferences, and by strengthening ties between nations. Conclusions : With the adoption of the international regimes of the WIPO and CBD, and particularly the Nagoya Protocol in 2010, China is seeking to implement measures aimed at maximizing the national interest based on the intellectual property rights of TCM. China began to implement a system of protection of medicinal resources and the related traditional knowledge after recognizing the potential crisis that could occur if Chinese medicine-related patents were taken over by foreign countries. As such, the system now takes various forms.
