지적재산의 취득과 실시에 관한 경쟁정책 : 기술혁신 시장 이론

  • Because global innovation-based competition is increasing and the amount of R&D expenditures becomes severely large, it is more likely that mergers and collaborative ventures tend to affect adversely to R&D competition Against this trend, enforcing agency of advanced countries including U.S.A are reassessing certain aspects of competition policy toward mergers and acquisition to ensure that procompetitive, efficiency-enhancing transactions are permitted. The role of competition policy is developing and appropriating new technology and protects the risks involved in the licensing contract of technologies. The role of intellectual property rights is also contrived to promote technological innovation and to increase consumer welfare. That is to say, dynamic efficiency of intellectual property rights includes (l) increase in social welfare and (2) promotion of growth by improvement of quality through invention and commercialization of new product as well as enhanced productive efficiency thorough appropriating new process. Because intellectual property rights are licensed to make use of complementary inputs, the rule of reason approach seems proper when applying antitrust law. To analyze the "Antitrust Guidelines for the Licensing and Acquisition of Intellectual Property"by DOJ and FTC in U.S.A, the author surveyed pros and cons on innovation market approach. This approach will only be used in a narrow range of situations when the evidence is solid, concentration numbers are extremely high, and the agencies can predict with a high degree of certainty that the merger will likely lead either to a slowing in the pace of innovation or the loss of an alternative research track that is likely to lead to a product beneficial to consumers. The author introduces the studies on licensing contract of intellectual property rights and competition polices on behalf of potential inquirers. Also the author invites the interdisciplinary researchers to analyze further with a model on the aspects of the "Notice 1995-10 for Types and Criteria on Unfair Transaction Behavior in International Contracts" by Fair Trade Committee of Korea.

  • This paper aims to develop methodology and indicators to review effective competition in Korean mobile telecommunication market. After examining strengths and weaknesses of other countries' experiences, we proposed several indicators for the assessment of competition. Developed from criteria such as transparency, regulation cost, policy objectives, proposed indicators comprise market structure, behaviour of sellers and consumers, and consumer benefits. These indicators are applied to the Korean mobile market. During the period 2001-2004, 'the competition assessment index' increased steadily, meaning the state of competition was aggravated during this period.

Fair Competition: The Concept of Regulation in the Sharing Economy

  • A free-market economic system supported by the progress of the Industrial Revolution 4.0 has given birth to a sharing economy with a disruptive business model. In many ways, this business model is more effective, efficient, and makes it easy for businesses and consumers. However, because disruptive innovation is not asymmetrical with the conventional business that sustains innovation, several regulatory issues arise because it is fundamentally very different and cannot be regulated by standard law. Disruptive innovation may create chaos if it is regulated by norms that are used to regulate conventional business. This research was conducted with a normative method, which examines various theories, principles, laws and regulations to get justification for how the law should govern. The findings of this study are: competition law must be designed pragmatically so that it can keep pace with changes in business models that are rapidly changing. For this reason, it is necessary to shift regulatory authority from the Government to business people to make self-regulation, as a rule, that was born from the agreement of the business actors themselves. Self-regulation is considered more effective in maintaining fair competition, so that the market will be more dynamic, and consumers will be more prosperous.

Competition, Collaboration and Innovation Networks in Regional Economic Development: The Case of Chonbuk (지역경제발전에서의 경쟁, 헙력 및 혁신 네트워크: 전북의 경우)

  • This paper examines the implication of competition and collaboration in the innovation process for regional economic development in an increasingly knowledge-based economy. While competition is an important force in securing the competitive advantage of firms, collaboration between firms and organizations should be necessary for promoting the innovative capacity of a region. This study shows that collaboration relations based on trust and stability is important for the long-term development of learning and innovation in competitive environment, and the way how spatial proximity plays an important role in interactive learning processes. It also discusses the reason why the innovative networks facilitating the exchange of tacit knowledge should be embedded in region. Finally, the paper examines the possibility of the networks based on collaboration relationship in less-favored regions such as Chonbuk, and suggests the policy implication of the result for achieving regional innovation systems in the region successfully.

The Influence of Actual and Potential Competition on Firms' R&D Investments: The Moderating Effects of Performance Relative to Aspiration Level (실질적 경쟁과 잠재적 경쟁이 기업의 R&D 투자에 미치는 영향: 목표대비 성과 수준의 조절 효과를 중심으로)

  • Growing competition is forcing firms to unceasingly achieve innovation for survival. In a response to increased competition, firms invest in R&D. In this vein, this study focuses on the relation between competition and R&D investments of firms. To this end, we decompose competition into actual and potential competition first and then empirically examine effects of each competition on firms' R&D investments. Further, this study also focuses on moderating roles of firms' performance relative to their aspiration level on these relations. By using Compustat data, we found that actual competition hinders firms' R&D investments, but potential competition enhances R&D investments. In addition, the effects of actual and potential competition were moderated by firms' performance relative to their aspiration level. Specifically, negative performance strengthens the negative effect of actual competition on R&D investments, but attenuates the positive effect of potential competition. Moreover, positive performance moderates the effects of each competition in the same direction, but its moderating effects are stronger than negative performance. As such, this research seeks to identify the relations between actual and potential competition and R&D investments of firms and the moderating role of performance relative to aspiration level.

  • Purpose: This study seeks to bridge between the research by Lawrence (1999) and Retegan (1992), where the focus of TQM on his studies rests on customer satisfaction. Whereas in this study trying to recompile TQM by involving the variables Innovation and competitive advantage to stimulate managerial performance improvement where performance measurements include various measurements such as financial performance, marketing performance, and production performance in the property industry. Research design, data, and methodology: Total sample are 105 respondents coming from middle to top level of management in the property sector in Indonesia. To empirically prove the results of this study using multiply regression analysis as a test tool for analysis. Results and Findings: The results of this study confirm that TQM has a positive effect on market competition, innovation, and company performance indirectly. However, it does not have a significant impact if it is directly related to TQM on company performance. In this case, TQM for property companies in Indonesia would not have been possible without the role of innovation and market competition. So that the managerial implications of this study also confirm that TQM is essential and feels obligatory to be implemented optimally.

Factors of Successful Policy Implementation in National Projects for Technology Innovation (과학기술혁신을 위한 National Project의 성공적 정책집행의 요인)

  • This research began by recognizing the development of telecommunication skill in a short period of time as one achievement of launching the national research and development (R&D) project for the diversification of telephone service and for the solution of telephone holdup rate. Under this concern, this research is focusing on searching the influential elements on successful outcome by analyzing the case of Time Division Exchange R&D Project carried out by Korea. Those variables for analyzing the case is limited to 7 definite variables, which are "willingness of policy making organization", "participation of manufacturers and buyers", "support from research and development group", "economy of operating methods and selection of machinery", "rate of technology transfer", "support from Fixer", and "quality management". Summarizing the result of analysis, in order to bring about technological innovation, knowledge creation activity leading to upward efficiency through competition and cooperation making a harmony should be done in one mechanism. I.e., launching an innovative policy should be done in an arena of competition and cooperation, where stability of implementing system is achieved, the entity of "Fixer" is an adequate operator, and competition and cooperation is efficiently managed, among where agreement on purpose and professional opinions are reflected.

  • Networks, services and industries have been converging with the advent of digital convergence by technology advancements of digitalization, broadband and interactivity in the areas of information-communication and broadcasting technologies. Especially, this convergence of technology and market has been blurring the boundary of telecommunication and broadcasting sectors, and the severe competition seems to be inevitable due to the lack of the differentiation in broadcasting media and contents. In this study, we regard the competition phenomenon in the digital convergence between telecommunication and broadcasting as the platform competition in two-sided markets which have been actively studied since 2000, and analyzed it using modified Hotelling's location model. According to the analysis of platform competition on the effects of the differentiation of platform (t) , killer component $(\mu)$ and component compatibility $(\theta)$ , it is shown that two differentiated platforms are simultaneously used in case of the decrease of substitution effects, and the profit of platform with killer contents is increased, but the profit of platforms with higher compatibility is decreased. The policy implication is that it is especially necessary to modify the policy and regulation on media contents considering the growing competition in media. On the other hand, differentiated and reasonable policy is required to make fair competition and active market environment.

Adopting a National Innovation Approach for Agro-Sustainability : A Case Study

  • Nowadays, agro-firms are confronted with competition from global suppliers in both domestic and export markets. Such competition in sustainable agro-operations is expected to intensify. The survival of these firms in developing countries urgently requires a significant transformation to be competitive. This paper discusses the rationale of adopting a national innovation (NI) approach from an industry-wide perspective. In order to attain sustainable agro-operations in developing countries, the approach stresses appropriate scientific and technological applications and effective linkages of technology transfer via the network between public and private institutions, universities and other research institutions. Central to this approach is the development of the agro-industrial sector whereby agri-chains are formed. An illustrated case of the NI approach is presented with respect to a small island developing state, the Republic of Trinidad and Tobago.

Technological status of Biocluster in Daedeok Innopolis: With the focused on the patent analysis (대덕 바이오클러스터의 기술현황: 특허 분석을 중심으로)

  • KIPRIS patent database was analyzed for identifying the technological status of Daedeok Innopolis Biocluster. It was found that the pattern of activities among various technological areas in Daedeok Biocluster is similar to that of an advanced country rather than those of other cities in Korea. The technological growth in Daedeok Innopolis Biocluster is in the progressive stage, which may be due to the innovative activities rather than the rise in the number of new firms or institutes. The concentration of technology in Daedeok Innopolis Biocluster is a favorable condition for the innovation activities. The trend for the technological concentration was remarkably consistent with the growth curve that a population increases according to the logistic equation. The logistic growth may be represented by the result of competition due to the limited resource allocation and then innovation cluster is corresponding to the ecosystem composed by biological individuals. There is strong competition in Daedeok Innopolis Biocluster in around 2009, so the government might make a policy to encourage the technological diversity for healthy knowledge ecosystem.
