전자무역 활성화를 위한 글로벌 전자무역거래법의 요건과 역할기능의 이론적 기초 (Some Theoretical Foundations on the Necessities and Functions of Global Electronic Transactions Act)

  • The electronic technology development have occurred in the face of existing legal barriers to legal efficacy of computer information goods, and the liberating promise of electronic transactions cannot fully realized unless there is predictability in the legal rules that govern such transactions. This study analyzes some theoretical fundamentals of the Act. First, it proposes that the Act clarify and set forth uniform legal principles applicable to computer information transactions. Secondly, it suggests that if the individual is risk averse, the acceptance set for electronic transactions will be a convex set, and that the application of the Act will make the acceptance set more expanded by lowering the probability of conflicts and by downsizing the risk averness. Thirdly, it also suggest that through the mothod of contingent commodities analysis, the application of the Act by means of its restricted regulations will give more expected utility than the absence of the Act. Fourthly, it derives some implications that the degree of legitimate restriction will be affected by the objective risk inherent to the electronic transactions, and the individual's subjective risk-averseness. Finally, it concludes that harmonization of restriction and protection of individual's rights in electronic transaction process will be a necessary condition for more efficient body of law from the law-economic perspectives.

  • The purpose of this study is to propose a new mechanism for the global transmission of electronic trade documents and to promote them using it. Trade settlement methods are changed from L/C bases to non-L/C bases and in particular, the telegraphic transfer is dramatically increased since mid 1990. But the status of transmission of electronic trade documents still rely on the letter of credit and bill of lading. So it need to change the process of transmission of electronic trade documents utilizing non-negotiable sea waybill instead of bill of lading. In this study, I pointed out two problems as obstacle factors in global transmission of electronic trade documents. First is the system connection problem between domestic and foreign banks and second is the electronic right transfer problem in the bill of lading. Electronic bill of lading has already been made, but are not used and e-Nego has also not been activated under the above issues. Therefore, it should be solved previously the above problems for the global transmission of electronic trade documents under the letters of credit. However, in transactions of transfer, it does not need the inter-bank connection and also does not occur the electronic right transfer problem of bill of lading if using the non-negotiable seaway bill instead of bill of lading. In this paper, I recommend the global transmission strategies of e-trade documents using the non-negotiable sea waybill in transactions of transfer. Hopefully, I expect the activation of global transmission of e-trade documents through the utilization of electronic non-negotiable sea waybill as suggested by this study.

  • This study deals with controversial issues surrounding the today′s cyber-taxation and recommends feasible consumption tax system architecture titled Global Electronic Tax Invoice System (GETI). The GETI is an electronic consumption tax architecture to provide "all-in-one" tax and e-payment services through a trusted third party (TTP). GETI is designed to streamline the overall cyber-taxation process and provide simplified and transparent tax invoice services through an authorized np. To ensure information security, GETI incorporates public Key infrastructure (PKI) based digital certificates and other data encryption schemes when calculating, reporting, paying, and auditing tax in the electronic commerce environment. GETI is based on the OECD cyber-taxation agreement that was reached in January 2001, which established the taxation model for B2B and B2C electronic commerce transactions. For the value added tax systems, tax invoice is indispensable to commerce activities, since they provide documentations to prove the validity of commercial transactions. As paper-based tax invoice systems are gradually phased out and are replaced with electronic tax invoice systems, there is an increasing need to develop a reliable, efficient, transparent, and secured cyber-taxation architecture. To design such architecture, several desirable system attributes were considered -- reliability, efficiency, transparency, and security. GETI was developed with these system attributes in mind.

Technologies and Standards for the Coordinated Implementation of Global e-SCM

  • Global e-SCM (electronic Supply Chain Management) has become an important business strategy in a rapidly changing global competition environment. It encompasses both domestic business and overseas business. Overseas business, including B2B and B2G, involves the complex trade procedures across countries. So, the standardization of electronic documents (messages) and business processes is one of critical factors for the successful implementation of global e-SCM. Without standardized messages and streamlined business processes, the benefits of global e-SCM would not be guaranteed because of human intervention like re-keying business data, which may create errors, delay processes, cause additional data or procedures, etc. Thus, this paper is to review the implementation challenges of Global e-SCM, to address the needs for electronic information flows through the standardization in electronic documents and business processes for fast and accurate trade transactions in the global supply chain activities, and to assert the importance of adoption of international standards.

Because electronic transaction using electronic documents be carried without direct person to person meeting, there can be the possibility to use other's identity illegally without notice, and very hard to verify authenticity of transaction as well. In addition, it is very hard to find out that the electronic documents on the process of submitting is forged documents or not, and also have much difficulty in maintaining transmitting secret. Therefore, to solve such problems on electronic commerce transactions and electronic documents, the digital signature and certification system with cryptography skill is inevitably necessary. As the wide use of digital signature together with beginning of digital government and financial transaction, not only the issuance of electronic certification, but certification market came to gradually expand. In Korea, after enacting digital signature act in 1999, the act contents were expanded to the wide range of contents complying with global standards from the end of 2001 to April, 2002, including the new clause of certification problems. And the act was put into operation now. Therefore, in this paper, we'd like to suggest development scheme through the investigation on electronic certification related problems, such as, concepts, procedures, service conditions here and abroad.

  • Biometric discretization is a process of transforming continuous biometric features of an identity into a binary bit string. This paper mainly focuses on improving the global discretization method - a discretization method that does not base on information specific to each user in bitstring extraction, which appears to be important in applications that prioritize strong security provision and strong privacy protection. In particular, we demonstrate how the actual performance of a global discretization could further be improved by embedding a global discriminative feature selection method and a Linearly Separable Subcode-based encoding technique. In addition, we examine a number of discriminative feature selection measures that can reliably be used for such discretization. Lastly, encouraging empirical results vindicate the feasibility of our approach.

Effect of Nano/micro Silica on Electrical Property of Unsaturated Polyester Resin Composites

  • The addition of nano/micro silica into unsaturated polyester resin (UPR) results in the improvement of the electrical properties of Silica-UPR composites. The surface, volume resistivity, dielectric strength, dissipation factor and dry arc resistivity of nano silica-UPR composites were found to improve significantly. The effects of the nano and micro fillers in UPR have been evaluated. They are presented in this paper. To evaluate the electrical properties of the nano & micro composites, all the measurements were done as per the prescribed methods in ASTM. It was observed that the addition of nano silica improves the electrical properties as compared to micro silica. The better dispersion of silica particles in unsaturated polyester resin enhances the electrical properties of silica-UPR composites.

  • The digital revolution is happening much more quickly and Internet Commerce and Electronic Commerce is having a profound influence on the global trade and internal commerce, revolutionize the way of doing business, especially retail and direct marketing. Owing to Internet, an increasing share of business transactions occurs online. Electronic payment is essential for the smooth progress of the electronic commerce as electronic payment plays the important role in the electronic commerce, that is, the value transfer resulting from the electronic commerce. So far, there have not been a considerable emphasis on the risks residing in the electronic payment and money. So, this paper deals with the risks in the electronic payment and money, in particular technical risks and social risks, and the reliability-increasing schemes to prevent the risks in the electronic payment. The reliability-increasing schemes relate to the security of the electronic payment systems and certification authority and key management, transaction rules between the parties concerned in the electronic payment.
