Generally, the liability for breach is defined as the civil liability that arises from the conduct of violation of a contract. There are two notable principles governing liability for breach that have fundamental impacts on the unified Contract Law of the People's Republic of China (hereinafter Chinese Contract Law) in the remedies. In China, during the drafting of the Contract Law, there was a great debate as to whether damages for breach of contract ought to follow the fault principle or to follow the strict liability principle. Ultimately the Chinese Contract Law follows the model of the CISG on this point, namely, it follows the strict liability principle (article 107) with an exemption cause of force majeure. Under Chinese Contract Law, it is interpreted as strict liability in principle. Strict Liability is a notion introduced into Chinese Contract Law from the Anglo-Saxon Law. The strict liability or no fault doctrine, on the contrary, allows a party to claim damages if the other party fails to fulfill his contractual obligations regardless of the fault of the failing party. Pursuant to the strict liability doctrine, if the performance of a contract is due, any non-performance will constitute a breach and the fault on the party in breach is irrelevant. This paper reviews problems of legal character or legal ground of contractual liability in Chinese contract law. Specifically, focusing on the interpretation of Chinese contract law sections and analysis of three cases related contractual liability in freight agency, the paper proposes some implications of structural features of Chinese contract law and international commercial transactions.
This short report introduces the general background why Brazil conference is being prepared and what topics would be undertaken and what goals are being taken into account. It overviews what differences from traditional telecommunication governance, internet governance has had in its historical development and how such differences had been formed from its technological differences and the regulatory policy shift from common carrier regulation to privatization. Moreover, the fact that open, voluntary, bottom-up, diverse stakeholder's participation had evolved throughout the historical development of the internet, had established the present multistakeholder governance model from technological standardization to addressing scheme policies. ICANN, which has governed internet addressing schemes since the earlier 2000s, had developed address policies including IANA function from Jon Postel and technical community's legacy management system into contract based formation between ICANN and gTLD, ccTLD registries. And it made dispute resolution policies responding to trademark disputes and resolved gTLD monopoly issue by introducing new TLD generation and the separation of registry and registar. However, there had been challenges on the legitimacy of ICANN due to its dependency on the Federal Government of the U.S. particularly in its oversight role over ICANN and IANA contract. WSIS raised up internet governance issues including addressing governance, and set up IGF as a discussion platform for multistakeholders to discuss and share all views on other internet related public policies. IGF's loose and non-binding discussion once frustrated governments and other stakeholders, but more focused discussion and visible outcomes have consolidated its unique role for internet governance discourses. Particularly, IGF addressed many emerging internet related issues like cybersecurity, privacy, net neuratlity, development related issues. WTPF of 2013, after WCIT debate on whether traditional telecommunication regulation could be applied to internet infrastructure, suggested other governance issues such as the transition to ipv6, IXP coordination etc. How to make sure the legitimacy of internet addressing governance and how and where other internet related public policies could be undertaken are fundamental tasks for internet governance. Brazil conference, which has been motivated by the breakdown of trust in internet governance from NSA mass surveillance revealed by Snowden, faces these questions and try to make consensus on principles, institutions and roadmap for internet governance in multistakeholder participation way.
In this study, a model curriculum for the Library and Information Science programs in Junior Colleges is presented by comparing those curricula of the Republic of Korea, the United States of America, England and Japan. In Korea, 80 credits are required for graduate of Junior College and 60 credits of that total credits are for major courses. At Toshokan Danki Daikagu in Japan, 73 credits are opened for the Department of Library Science and 87 credits for the Department of Library and Information Science respectively. In the United States of America, 30 credits for major courses out of 90 total credits are opened at Lansing Community College and 24 credits for major courses out of 60-64 credits at Mesa Community College distinctively. On the basis of the various analyses, the following principles are applied in designning the model curriculum; (1) Possibly 3 credits per subject are assigned, (2) Major credits for graduate are 60-64 credits including possible optional subjects, (3) 20 percents of those 60-64 credits shall be applied for electives, so that 72-78 credits are assigned for major, (4) In order to combine theory and practice, and to select practice areas as required major, the ratio between required and elective must be adjusted, (5) In order to avoid duplication of subject, adequate individuality must be provided, (6) The Information Science areas must be dealt with in Library Science since computer systems are being rapidly adopted in libraries and the education for resources of materials and foreign languages are also important for successful fulfillment of mediator's roles between materials and users. Therefore the following model curriculum is suggested; 31 credits in 11 subjects for required major, 46 credits in 18 subjects for electives in major, total 77 credits for 29 subjects are established, and it includes such areas as material organization, foreign languages, resources of materials, library management, information science, fundamental studies, services and practice.
Korea-Japan Fisheries Agreement concluded in 1965 made a contribution to the stable development of fisheries relationship for both countries until the year of 1980. From the time on thereafter a series of respectable fishery disputes occurred throughout the period of fisheries self-regulation in accordance with alteration of home and abroad conditions. And both countries marched into a cooperation era by enforcement of the new fisheries agreement from the 23 January 1999, because the Fisheries Agreement system of 1965 had many limitations to settle the fundamental fisheries problems. In this paper, the author carried out the legal interpretation, arrangement of historical facts and evaluation of actual results of the Korea-Japan Fisheries Agreement of 1965. The key contents of the Fisheries Agreement were the establishment of 12-nautical mile exclusive fishery zone and the joint-control fishery zone under the principles of maintenance of MSY for fishery resources, freedom of high seas and mutual cooperation. The legal foundation of the conclusion of the Fisheries Agreement were the San Francisco Peace Treaty of 1952 and the four International Conventions on the Law of the Sea of 1958. During the 33 years, the fisheries power of Korea made a rapid stride, on the other hand that of Japan was almost stagnated. And in the meantime, there were very important development on the international law of the sea, for instant, the settlement of 12-nautical mile territorial sea regime and the establishment of 200-nautical mile exclusive economic zone regime. Annual meetings of the Joint Fisheries Committee were not successful to fill the role for conservation of fishery resources. The Fisheries Self-Regulation Agreement concluded in 1980 was also insufficient to accept the new international regime on the law of the sea, for that reason it was terminated on 23 January 1999. But it is true that the Fisheries Agreement of 1965 made a contribution to normalization of fisheries relationship between both countries and fisheries development of Korea.
It is the most important thing at present for physicians to posses the qualification of medical professionalism. A lot of medical schools have made all-out efforts to develop leaders of medicine, who will be able to meet the needs of medical professionalism in this complex medical environment. The purpose of this study is to review the cognitive base of medical professionalism leading the curriculum development of medical professionalism. The discussion of medical professionalism started in the 20th century. During the 1960s, there were attempts to reshape the concepts and attributes of medical professionalism. The government began to intervene in the autonomy of physician and the self regulation policy of medical society in 1970s. Physician may be asked to play as a healer and professional (what?) during their medical practice. The fundamental role of healer such as care, compassion, honesty, integrity, confidentiality, ethical behaviors, and respect with patients were nothing fresh to tell even though the age was changed. The attributes of professional which are physician's autonomy, self regulation, teamwork, and responsibility to society has been changed dramatically over the past five decades. In general, medical educators agreed that professionalism is demonstrated through a foundation of clinical competence, communication skills, and ethical and legal understanding, upon which is built application of the principles of professionalism: excellence, accountability, altruism, and humanism. If physicians fail to show professionalism in society, they will confront the crisis which can be under the government control. The only way to keep their autonomy is to practice medical professionalism. So far today, medical schools have laid more stress on competence than value standards in educational systems and it was restricted for medical students to learn the value standards for medical practice. To understand and practice the medical professionalism, it is the most realistic way to solve the complicated medical problems.
Nanotechnology has penetrated into the various branches of research and development and it is particularly of benefit to the particle size engineering. It has been widely known that the particle size of an active pharmaceutical ingredient (API) is critical in determining the bioavailability and processability of pharmaceutical formulation. However, the window of appropriate particle size has been limited mainly due to related processing difficulties. The windows have been widened by the recent development of nanotechnologies, resulting in diversified drug delivery systems. The impact of this development is far more fundamental than what can be expected from conventional particle size engineering. It is the case that the preparation and use of nanoparticles will soon be a common task in the particle engineering step of pharmaceutical unit operations. In this chapter, the basic principles of variouspreparation techniques will be discussed in detail. Regardless of processing details, the preparation methods of pharmaceutical nanoparticles mainly concern how to deal with the extra energy related with particle size. Depending on the ways of treating the e103 energy, preparation methods can be classified into two major classes, i.e.. thermodynamic and kinetic approaches. The recent progresses have shown the possibilities of much more complex combinations of different approaches and the use of new types of energy and nanostructures.

Background: The International Commission on Radiological Protection (ICRP) recommendations and the Federal Guidance Report (FGR) published by the U.S. Environmental Protection Agency (EPA) have been widely applied worldwide in the fields of radiation protection and dose assessment. The dose conversion coefficients of the ICRP and FGR are widely used for assessing exposure doses. However, before the coefficients are used, the user must thoroughly understand the derivation process of the coefficients to ensure that they are used appropriately in the evaluation. Materials and Methods: The ICRP provides recommendations to regulatory and advisory agencies, mainly in the form of guidance on the fundamental principles on which appropriate radiological protection can be based. The FGR provides federal and state agencies with technical information to assist their implementation of radiation protection programs for the U.S. population. The system of radiation dose assessment and dose conversion coefficients in the ICRP and FGR is reviewed in this study. Results and Discussion: A thorough understanding of their background is essential for the proper use of dose conversion coefficients. The FGR dose assessment system was strongly influenced by the ICRP and the U.S. National Council on Radiation Protection and Measurements (NCRP), and is hence consistent with those recommendations. Moreover, the ICRP and FGR both used the scientific data reported by Biological Effects of Ionizing Radiation (BEIR) and United Nations Scientific Committee on the Effects of Atomic Radiation (UNSCEAR) as their primary source of information. The difference between the ICRP and FGR lies in the fact that the ICRP utilized information regarding a population of diverse races, whereas the FGR utilized data on the American population, as its goal was to provide guidelines for radiological protection in the US. Conclusion: The contents of this study are expected to be utilized as basic research material in the areas of radiation protection and dose assessment.
Purpose: To examine the effect of the solution-focused group counseling program on the nursing students' problem-solving capacity. Methods: The research design was one-group pretest-posttest design in quasi-experimental research. The subjects were 16 sophomore nursing students being in K university located in D city, Korea. The period of this research was from January 9 to February 20, 2002, from January 10 to February 21, 2003. The group counseling program that was developed by Kim, Hyeon Mi (2001) on the basis of the fundamental principles of solution-focused therapy of de Shazer, et al. (1986) and the solution-focused group counseling process proposed by Selekman (1991), LaFountain, et al. (1996) and Metcalf (1998) was used after being modified and complemented for the nursing students. The group counseling was carried out six times for 120 minutes per week. The instruments used for this study were the Problem Solving Inventory developed by Heppner and Petersen (1982) and Scaling question. Collected data were analyzed by paired t-test with SPSS program. Results: 1) Problem solving capacity increased after solution-focused group counseling program, but a significant difference was not revealed(t=0.835, p=0.057). 2) The scores of self-confidence with the problem-solving were significantly increased when it was compared with the 1st and the 6th(t=3.587, p=0.001). Conclusion: It seems that the solution-focused group counseling program should be considered as an effective nursing intervention program for the nursing students by improving self-confidence with the problem-solving. As a results, this study suggests that the specific techniques used in the solution focused therapy should be applied actively in areas of counseling and communication training for the nursing students and nurses.
Finite element method (FEM) is an effective quantitative method to solve complex engineering problems. The basic idea of FEM for a complex problem is to be able to find a solution by reducing the problem made simple. If mathematical tools are inadequate to obtain precise result, even approximate result, FEM is the only method that can be used for structural analyses. In FEM, the domain is divided into a large number of simple, small and interconnected sub-regions called finite elements. FEM has been used commonly for linear and nonlinear analyses of different types of structures to give us accurate results of plane stress and plane strain problems in civil engineering area. In this paper, FEM is used to investigate stress analysis of a shear wall which is subjected to concentrated loads and fundamental principles of stress analysis of the shear wall are presented by using matrix displacement method in this paper. This study is consisting of two parts. In the first part, the shear wall is discretized with constant strain triangular finite elements and stiffness matrix and load vector which is attained from external effects are calculated for each of finite elements using matrix displacement method. As to second part of the study, finite element analysis of the shear wall is made by ANSYS software program. Results obtained in the second part are presented with tables and graphics, also results of each part is compared with each other, so the performance of the matrix displacement method is demonstrated. The solutions obtained by using the proposed method show excellent agreements with the results of ANSYS. The results show that this method is effective and preferable for the stress analysis of shell structures. Further studies should be carried out to be able to prove the efficiency of the matrix displacement method on the solution of plane stress problems using different types of structures.
