A Long-term Replenishment Contract under (R, S) Policy ((R, S)정책하에서의 장기 보충계약)

  • By committing to a long-term replenishment contract, suppliers can mitigate the pressure to find new customers and afford to charge a discounted price to buyers seeking to lower their purchasing costs. In this paper, we develop an analytical model from buyer's perspective for the contracting process to investigate the buyer-supplier interactions. Based on the developed model, we propose an algorithm to derive optimal strategy for the contract. We consider a system with a single buyer and a supplier in a situation where the buyer's inventory is controlled by (R, S) policy under VMI setting. According to the contract, the supplier should replenish the buyer's inventory up to a fixed level every R times during a specified period. The buyer purchases any deficient amount from a spot market at a higher price. We show by computational experiment that our proposed algorithm finds the global optimum solution.

The buyer's obligation to pay the price includes taking such steps and such formalities under the contract. The remedial system of the rights of the seller is easier than that of the buyer, for the obligations of the former are less complicated. The seller has the right to avoid a contract provided two conditions are fulfilled : (a) the buyer must have committed a fundamental breach of contract, or (b) the additional period for performance set by the seller in the case of non-performance must have expired. A decision is more difficult to take in the case of a delay where there is no fixed-term contract, to clarify the situation the seller may set a Nachfrist. It is essential that the contracting parties in Korea should understand the provisions of CISG.

A Study on Customary Practices in Iron Ore and Steel Product Shipping Contract - Case of Long-term Shipping Contracts in Korea

  • Long-term shipping contracts represent the cooperative and coexisting relationships between the shipping and steel industries. Yet, differences between the contract forms for iron ore and steel products have emerged. Specifically, the large proportion of consecutive voyage charters (CVC) is being applied in the iron ore trade, whereas the contract of affreightment (COA) is proportionally higher for shipping steel products. The literature review and in-depth interviews in this study identified through the research model, the characteristics of the shipping and market structure in both markets have significantly contributed to the preference of different long-term contracts. It has been determined that the mutual oligopoly market structure and the characteristics of shipping such as, the small number of suitable vessels in the market, the single fixed load/discharge ports, the long-distance voyages, and the potential risks for fatal accidents because of cargo liquefaction, for the iron ore trade, provide higher contribution to the preference of CVC contracts. In contrast, the consignor oligopoly market structure and the shipping characteristics, such as the greater number of suitable vessels available in the market, the variation in ports, the cargo quantity per shipment, the various load/discharge ports, and the need for experienced carriers for steel product loading in the steel product trade has shown higher preference on the COA contracts as the consignors with superiority over the shipowners, resulting in favorable contract types and conditions for the consignors.

ATYPICAL EMPLOYMENT IN TAIWAN'S CONSTRUCTION INDUSTRY

  • Responding to the fierce market competition and trying to cut personnel costs, the construction industry in Taiwan is adopting atypical employment in human resource. To discover this trend, this study employed a questionnaire survey to investigate the current use of atypical employment by domestic contractors and its possible impacts on the industry. According to the 103 returned valid questionnaires, 40.8% of the respondent contractors have applied some atypical employment types in recent three years and most of them used fixed-term employment. The major reasons the contractors used atypical employees are to reduce personnel costs, to deal with business fluctuations and to streamline personnel. According to the respondents, there is no significant difference between the advantages and disadvantages of using a large number of atypical employees in the short term. However, in the long term, atypical employment is generally more disadvantageous than advantageous.

The Effect of Firm Characteristics on the Female Employment Ratio (기업특성이 여성고용비율에 미치는 영향)

  • This study examined the effects of the firm characteristics of the manufacturing industry on the female employment ratio. Three hypotheses regarding female employment ratio, were tested for 5,729 firms that could use financial data among the firms listed on the KOSPI from 2011 to 2019, in terms firm size, listing period, and foreign ownership. Follwing the analyses, three hypotheses were mostly adopted. It was found that as the size firm and foreign ownership ratio increased, the female employment ratio increased in the number of regular and permanent contract employees, fixed-term employees, and total employees. As for the listing period, the higher the value, the lower the female employment ratio in the number of regular and permanent contract employees, fixed-term employees, and total employees. These research results may be used as basic data for gender equal employment policies such as Affirmative Atcion for Gender Equal Employment.

  • Risk factors are the reason behind cost overruns and delays in long-term large-scale IT service projects. Major risks originate from the integration of complex IT system components, including software, hardware, and solutions; the competitive bidding process; the turnkey and firm-fixed price nature of contracts; and the project execution environment. We have identified several risk factors such as delay in acceptance, low quality of deliverables, delay in payment, adding and changing requirements and scope, unclear definition of roles and responsibilities of the buyer and supplier, and unclear procedures of change and quality management during the project execution phase. One needs to manage risks proactively before signing the contract. In order to weed out or lower the risk factors well in advance, we need to identify and remove risk factors contained in contract clauses and attached contract documents. We propose a checklist for assessing IT service project contracts. To validate the checklist's utility, we applied it to an IT service project in the finance industry. The results show that the checklist is effective in identifying and removing risk factors pertaining to IT service projects.

Training Effects on Wage and Employment Security by the Non-Standard Worker Types (비정규직 유형별 교육훈련의 임금 및 고용안정성 효과)

  • This paper analysed the training effects on wage and employment security by the non-standard worker types by using Economically Active Population Additional Survey data. Through propensity score matching method, we found that the regular workers' training effect on wage was 4.2%, that was very higher than 2.7% of fixed-term workers. Logistic regression analysis showed that the training participation itself did not affect on the regular workers' regular position continuance, but training duration affected. Just in fixed-term workers among non-standard workers, both of training participation and training duration affected the transition from non-standard position to regular position. The result that both training effects on wage and on employment were positive just in the fixed-term workers might be interpreted owing to the clear employment contract relation between employer and employees.

Soil-Tunnel Interaction and Isolation Effect during Earthquakes (지진시 지반-터널 상호작용 및 면진 효과)

  • Long term earthquake observations at different tunnel sites within a variety of alluvial soil deposits have demonstrated that a circular tunnel is liable to deform in such a way that its two diagonal diameters crossing each other expand and contract alternately. Based on this knowledge, the soil-tunnel interaction and isolation effect for this particular vibration mode is investigated. Interaction effect is considered with the condition of fixed tangential strain between the tunnel and the soil. Isolation effect embodied by covering up the tunnel with isolation materials is discussed as a possible measure for mitigating seismic damage to it. When Poisson`s ratio of isolation material decreases or the shear modulus ratios of the soil to isolation material become large, the isolation effect becomes bigger.

A study on the factors that affect the working conditions of the disabled for the duration of employment: Comparison between regular and temporary workers (장애인 직업 유지 기간이 근로조건에 영향을 미치는 요인에 관한 연구: 상용근로자와 일용근로자의 비교)

  • The study data used for the analysis of this study were obtained from the raw data during the 1st survey of the 2nd wave of the 2019 Panel Survey on the Employment of Persons with Disabilities conducted by the Korea Employment Agency for Persons with Disabilities. The results showed that, for regular workers, when there was a fixed term of employment contract, it was more likely that the job was retained for 12 months or longer. For the day laborers, workers without a fixed-term employment contract were more likely to retain their jobs for 12 months longer. This suggests that owing to the types of jobs that did not consider disabilities, people with disabilities were facing difficulties in terms of the options available in their job choices and their self-decisions. Therefore, the state would have to develop more job types and skills for these individuals to expand their career options. The growth in the employment of people with disabilities by small businesses that hire day laborers will depend on the diversification of the employment subsidy, which is again dependent on the size of the businesses.
