Effectiveness analysis about Readjustment of Fishery Permit (어업허가 일제정비제도 도입에 따른 효과분석)

  • The coastal and offshore fishery to manage from a fishery permit system in our country at present seems to be a sign of lots problem, which are illegal fishing, a permit rent, non fishing vessel the purpose of vessel reduction, fishery compensation, tax exemption oil, the excessive occurrence of administrative cost due to differences during a period of a fishery permit. All the readjustment system for the permit has suggested an effective solution for a fishery permit management, the maintenance of a fishery order(the prevention of illegal fishery), the prevention of unused fishery, the entrance of new vessel in coastal fishery and it's system has prevent this problems in ahead. This paper has estimated an prevention convenience for an illegal spill of the tax exemption oil, actual effects of vessel reduction, the conservation of fishery resource for the future value and carried out an economic analysis to estimate compliance cost for the system introduction. Also, this study have analyzed throughly the coastal fishery situation and catched lots of issues on the management for the permit system. Especially, the problems improving the readjustment introduction for the permit have estimated the social and economic effects quantitatively and qualitatively with a calculated technique to classify various scenarios. This paper has judged correctly the term of validity for the permit to shorten as a result of the estimation and it will be to take the net convenience cost 1,655thousand million won. The results of this study have expect to provide a basic data to introduce the readjustment system for the permit.

A study on the Institutional Characteristics of Artisanal Fisheries (입어관행과 관행어업의 제도적 성격에 관한 고찰)

  • This study is concerned with the identification of the concepts and characteristics of the traditional access of small scale fishery and traditional small scale fishery based on the classification of fisheries under Fisheries Law, As we called, these fisheries are the small scale of artisanal fisheries. These traditional small scale of artisanal fisheries have been developed throughout the most coastal fisheries but have never been included the institutional fishery system and policy since industrial fisheries have been exploited. By this reason there was no studies to understand and identify these fisheries as fisheries under category of institutional fishery system. Recently by the Fisheries Law, my Person who desires to operate these fisheries, shall report to the provincial governor and then these fisheries were incorporated into the category of fisheries to be reported. But this case of the administrative practices should be not consistent with the classification of fisheries under Fisheries Law. The traditional access of small scale fishery is a derivative concept of fishery categories under the institutional fakery system Because this fishery under institutional fishery system can not be establish the right of fishing by fishery right system technically but the right of fishing is supported by the fishing access system only. Therefore, It is a mistake for the provincial fishery governor to adopt such a policy that the fishing right of the traditional access of small scale fishery which is different from the fishing based right is restricted by the factors of fisheries to be reported. On the other hand the traditional small scale fishery is coincident with the traditional access of small scale fishery and the common fishery under the style of utilization of fishing gear and fishing gear and methods. But this fishery has never been included the fishery categories supported by the government subsidy policies and considerations and has been remained with indifference during the last few decades. Anyhow the fishing right of these fisheries have been assured under the institutional fishery system, any person who desires to operate this fishery should have a fishing right against the public or private uses of fishing ground such as land reclamations and other coastal zone development. A deprivation of the fishing right of this fishery by the conflicts of these public and private uses of fishing ground is not regarded as appropriate according to the social welfare policy. Also it is the administrative expediency to support the fishing right of this fishery under the fisheries lobe reported.

  • The Japanese fishery management system has been established on the basis of various experience accumulated over many years. The fishery management system in Japan, one of the oldest fishery management systems in the world, is aimed at ensuring comprehensive utilization of the water surface and developing fishery productivity, by giving protection of the breeding environment of aquatic animals and plants, enabling the appropriate use of fishery grounds, preventing and solving disputes over fishery grounds and making other fishery adjustments. Japanese Fishery Law has been changed largely into (1) The Feudal Era(to 1900), (2) The Oldest Fishey Law(1901~48), (3) Current Fishery Law(1949 to present). Japanese fishery legislation is designed as a single package combining coastal, offshore and distant-water fisheries. During the period of the old fishery law, numerous conflicts arose over the joint use of fishing grounds and fish stocks. Such conflicts occurred among users of the same gear as well as between users of different gears or of different sizes of fishing craft. Large scale conflict sometime occurred between neighbouring fishing communities due to a lack of fairness in principle and coordination in practice. Therefore, the new fishery law enacted in 1949. This law was designed primarily to realize the most effective and rational use of fishing grounds and fishery resources, the basic philosophy being that, through democratic organization by fishermen themselves, productivity would be stimulated and incomes and living standards eventually improved. Nowadays, Community Based Fisheries Management through democratic organization by fishermen themselves have to enforce at coastal fisheries. This Community Based Fisheries Management manage to fishery resources by fishermen themselves and harvest in collaboration with that resources. Therefore, this paper is intended to briefly to describe the entire system and the historical development of Japanese fishery legislation in order to assist in reform of our country fisheries management regime.

Reorganization of International Fisheries Regime in the East China Sea and the Yellow Sea (동중국해ㆍ황해에 있어서 국제적 어업재편과 과제)

  • This study discussed the international reorganization of fisheries in the East China Sea and the Yellow Sea, for the cases of Korea, China and Japan, through the fishery competition and the division of sea areas and resources. In these sea areas, each country has done mutual operation, which causes the fishery competition and controls fishery development. Besides, Exclusive Economic Zon(EEZ) established in 1996 resulted in the prominent changes of fishery development as well as fishery relationship among each country, demands reorganization of fisheries. New fishery order in these sea areas is controlled by BEZ system. The fishery reorganization according to EEZ is a common issue of each country and it also includes the importance of mutual fishery agreement. Resources of fisheries could be used continuously under reasonable management. Each country should consider the stability and existence of fisheries in the international viewpoint. At this point of time, those should be considered such as adjustment of interests according to the division of sea areas, establishment of resource management system and insurance of fishery management, for the subject of fishery reorganization.

A Study on the Evolution of the Holding and Utilizing System of Fisheries Resources in Korea (수산자원 소유.이용제도의 변천에 관한 연구)

  • This study deals with the evolutional history of the holding and utilization of fisheries resources in Korea. Fisheries resources have the basic characteristics of the density dependent self-regulating renewable and common property resources, Irrational utilization of fisheries resources is mainly due to the unlimited access to the resources. The holding and utilization of fisheries resources in Koryo era was opened to everyone. But it was nationalized in the early Yi Dynasty. The purpose of its nationalization was to provent the paticular powered-man with their monoplized holding and to levy fisheries tax. Eoeop-peop, the first modern fisheries law in Korea, was enacted as a part of the invasion policy of Japan in 1908. With the japanese annexation of Korea in 1910, the Japanese Government established a new institutional system of fisheries as a part of an overall reformation of the institutional for an implementation of the colonial policy. It was very the new enacted Fisheries Law (Gyogyorei). Also the Government enacted compulsorily another new Fisheries Law (Chosen Gyogyorei) with its adjunct laws and regulations revise the institutional system of fisheries on May 1, 1930. After Eoeop-peop enactment, the fisheries resources in Korea could be used only under the license, permission, and statement. After Korea was from Japan in 1945, Korea Government at last enacted the new fisheries law (Susaneop-peop) in 1953. The goal of Susaneop-peop was to achive the general usage and protection of the fisheries resources, and to attain the development and democratization of the fishery in Korea. This law was amended 13 times until 1990. The license fishery have a legal right on the fishery, called a fishery rigt. This right means a right of exclusive occupation and utilization of a unit of the inshore fishing grounds. The main evolutional issues of license fishery are as the following : 1) the foundation of the exclusive usable fishery right(1911, Gyogyorei), 2) the deletion of the settled U9space lift net and settled space sein net fishery, and the expansion of the cooperative fishery-No.1, 2, and 3 type cooperative fishery-(3rd amendment, 1963), 3) the deletion of the No.2 and 3 type cooperative fishery, and the separation of the culturing fishery in No.1 and 2 type culturing fishery (13th amendment, 1990). The effective period of the license fishery was amended as the following : 1) 1908(Eoeop-peop) : within 10 years, renovation system, 2) 1929(Chosen Gyogyorei) : within 10 years, unlimited extension system, 3) 1971. 7th amendment : 10 years, renovation system, 4) 1972. 8th amendment : 10 years, only 1 extension system, 5) 1975. 9th amendment : 5-10 years, only 1 extension system, 6) 1990.13th amendment : 10 years, within 10 years of total extensional years. The priority order of the fishery license was established in 1953 (Susaneop-peop).   • In this paper, we designed and built a system that is site manager can be monitored remotely to the growth of the fishery environment. To this end, modular distribution system and environmental monitoring of live fishery products. Simulation results, were building a purification system and the oxygen supply to the fishery living inside the container was to build a system that can be monitored in real time. As a result, it was able to raise the necessary environment for the storage and distribution of fisheries products. We constructed a monitoring system with database and communication environment and created the optimal environment suitable for growth with sensor. As a result, it was possible to monitor the environment for the storage and distribution of fishery products and to build a suitable fishery products management system.

Comparison of Production Structure of Purse Seine Fishery in Korea and Norway (우리나라와 노르웨이의 선망어업 현황 및 생산구조 비교)

  • In order to improve the competitiveness of Korean large purse seine fishery, the purpose of this study is to find out the problems and present the improvement of the production structure of Korean large purse seine fishery by comparing to the production structure of Norwegian purse seine fishery. Norwegian purse seine fishery has been operating labor and energy-saving systems through a single wire operation and avoiding fishing competition through the introduction of IVQ system with different types of fishing vessel and obtaining benefits from Leading fishery management integrated with fish pumps and cooling water systems. In contrast, our country has a large purse seine fishery issues such as high cost and low efficiency of production structures, the volatility of mackerel resources, the lack of leading fishery management after catching fishes, the reduction of fishing ground in accordance with the North East Asia EEZ system. To solve these problems, initiatives to improve the structure of our large purse seine fishery are as follows: First, Implementing the promotion of the effective immature fishes management and establishing Korea-China-Japan resource management system. Second, the promotion of reduction of fleet size, the review of possible single fishing operation, leading out to strengthen its competitiveness by switching to energy-efficient production systems through enhanced efforts at fisheries catches steps. Third, it is necessary to realize corporate through the diversification of business areas and the large-scale commercialization of production structure.

A Study on the Legal System of Compensation for Fishery Loss caused by Public Works (우리나라 어업손실 보상제도에 대한 정선방안 연구;-법제도를 중심으로-)

  • The objective of this study is to analize the system of legal compensation for the fishery loses caused by public works and to suggest alternatives on the current compensation system. Korea government has been performing reclamation activities in coastal region to conduct farm, urban and industrial area, and such activities are still going on in Yeongjongdo airport area, Saemangeum area and so on. Reclamation interrupts fishing activities in or around the reclaiming area, therefore, the compensation for fishery losses incurred by fishermen should be made. The system of legal compensation in Korea, however, is based on the land compensation, and the regulation of the compensation for fishery losses in the Fishery Act can not be applied for the compensation of public works because the procedure of the compensation in the Fishery Act is different from its cause of action. Therefore, this study is caried out to suggest a resonable compensation procedure and to provide a basis for establishing legal system.

A Study on Problems and Solutions for Trading System of Fishery Products Wholesale Market in Korea (수산물 도매시장 거래제도의 문제점과 개선방안)

  • The Act on Distribution and Price Stabilization of Agricultural and Fisheries Product, which specifies rules and regulations on the trading system of fishery products wholesales markets, has been revised several times, mainly in order to improve the trading system. However, there is still a huge gap between the reality and law when it comes to the trading system of the fishery products wholesale market. This study aims to analyze the problems of the trading system of the fishery products wholesale market and to suggest ways to make improvement. The main problem facing the trading system of the fishery products wholesale market is sales on consignment by intermediate wholesalers, and this paper suggests two alternatives to solve the problem. First, intermediate wholesaler can be converted to market wholesalers, but it also entails other problems. The market wholesaler system has never been successfully adopted in the agricultural and fishery products wholesale market, and it is not clear which system is better between the wholesale market corporation and the market wholesaler system. Second, sales on consignment by intermediate wholesalers can be adopted with a positive view toward it. Negotiation transaction can be carried out for sales on consignment as a transaction method under the current Act on Distribution and Price Stabilization of Agricultural and Fisheries Products. However, since the act cannot provide a solution for listing, it is necessary to introduce Japan's negotiated transaction in advance system as a negotiation transaction method.

A Comparative Study of the Co management of Fishery Right by Fisheries Cooperatives - Centered on the Management of Fishing Ground through Eochon-gye - (수산업협동조합의 어업권관리기능에 대한 비교 연구 -어촌계의 어장관리활동을 중심으로-)

  • The government is largely responsible for preventing “the tragedy of the common property”, but fisherman's effort fer an autonomous fishery control is equally required. Especially in these days of EEZ such self- regulated fishery management system should be developed and cared for as well. This study aimed to explore a proper management system for coastal fishing ground that now requires the responsible fisheries management by investigating and analysing more drastically the managerial functions of fishery right by Eochon-Gye(the smallest unit of fisheries cooperative based on a fishing village), a typical fishery producer's organization in Korea. This study also included such contents as (1) an understanding of fishery producer's organization, (2) the utilization and management system of coastal fishing ground, (3) the actual condition of fishing right distribution in Korea, (4) the fishery right management and activity of Eochon-Gye, (5) the operation and distinctive feature of fishery right in Japan, (6) the intervention and limit of fishery producer's organization for fishing ground management function, and (7) summary and proposal. We made all Eochon-Gye of the whole country an object of this study and carried out an investigation into Eochon-Gye through a questionnaire. We extracted 359 Eochon-Gye, 20% of the total 1,719 Eochon-Gye as a random sample and investigated these regions through a questionnaire by mail. The contents of the questions consist of 40 items, including six categories about the organization of eochon-gye, and fishing ground management and activities.
