일본(日本)의 어업관리제도(漁業管理制度)에 관한 법적 고찰 (A Legal Study on the Fisheries Management System in Japan)

  • The Japanese fishery management system has been established on the basis of various experience accumulated over many years. The fishery management system in Japan, one of the oldest fishery management systems in the world, is aimed at ensuring comprehensive utilization of the water surface and developing fishery productivity, by giving protection of the breeding environment of aquatic animals and plants, enabling the appropriate use of fishery grounds, preventing and solving disputes over fishery grounds and making other fishery adjustments. Japanese Fishery Law has been changed largely into (1) The Feudal Era(to 1900), (2) The Oldest Fishey Law(1901~48), (3) Current Fishery Law(1949 to present). Japanese fishery legislation is designed as a single package combining coastal, offshore and distant-water fisheries. During the period of the old fishery law, numerous conflicts arose over the joint use of fishing grounds and fish stocks. Such conflicts occurred among users of the same gear as well as between users of different gears or of different sizes of fishing craft. Large scale conflict sometime occurred between neighbouring fishing communities due to a lack of fairness in principle and coordination in practice. Therefore, the new fishery law enacted in 1949. This law was designed primarily to realize the most effective and rational use of fishing grounds and fishery resources, the basic philosophy being that, through democratic organization by fishermen themselves, productivity would be stimulated and incomes and living standards eventually improved. Nowadays, Community Based Fisheries Management through democratic organization by fishermen themselves have to enforce at coastal fisheries. This Community Based Fisheries Management manage to fishery resources by fishermen themselves and harvest in collaboration with that resources. Therefore, this paper is intended to briefly to describe the entire system and the historical development of Japanese fishery legislation in order to assist in reform of our country fisheries management regime.

농어민의 정보격차와 소득수준에 대한 연구 (A Study on Digital Divide of Farmers and Fishermen)

  • 도시와 농촌이라는 지역적 차이는 여러 가지 다양한 차이를 빚어낸다. 도시와 농촌간에는 경제적 격차, 문화 격차 등등 다양한 차이를 경험하게 된다. 또한 정보에 접근하고 활용하는 데 있어서도 도시와 농촌지역을 차이를 보이고 있다. 본 연구는 정보소외계층 중에서도 특히 정보격차 수준이 다른 집단들에 비해 더 심각하다고 여겨지는 농어민그룹을 대상으로 정보격차와 소득격차간의 관계를 밝혀내고자 하였다. 즉, 농어민들의 정보격차현상이 소득격차에도 영향을 주고 있는가를 살펴보고자 하였다. 이를 위해 매년 정부에서 시행하고 있는 정보격차지수 및 실태조사결과를 바탕으로 농어민들의 정보화수준과 소득과의 관계를 분석하고자 하였다. 연구결과 농어민들의 정보화수준과 가구소득간에는 통계적으로 유의미한 양(+)의 관계가 있음을 밝혀냈다. 또한 그 회귀계수 추세가 양(+)으로 나타나 농어민들에 대한 정보화 수준을 높일 수 있는 정부의 다양한 정보화 정책이 필요함을 시사한다.

연안어업의 관리제도 개선방향 - 어선어업 을 중심으로 - (Directions for the Improvement of Coastal Fisheries Management)

  • Reduction of fishing grounds, which was caused by the recent fisheries agreements between Korea, Japan, and China, Is Increasing the important of coastal fisheries. Korea's coastal fisheries, however, need special management measures owing to the following problems. First, there are too many fishing fleets even though fisheries resources are continuously decreasing. Despite the fact that some of the fishing vessels have been scrapped, there still remain too many vessels and especially approximately 27,000 vessels increased during 1997-1998. Second, as the condition of fisheries resources changed radically, many fishermen are fishing by methods which they were not permitted to. These fishing methods cannot be legally supported and so there is a huge gap between the system and the reality, Third, two or three licenses are given to each coastal fishing vessel because a single license cannot give sufficient income, but some of these are formally acquired. So under such circumstances, efficient management of fisheries is impossible. Fourth, absence of demarcation among regions and industries is causing frequent conflicts and there are concerns about the decreasing fisheries resources due to competitive fishing practices. Therefore, considering the above mentioned problems Korea's coastal fisheries management should be developed as the following: First, new licenses should be limited while expanding the buy-back program. The government is currently planning to limit new licenses by introducing the fixed license number system in coastal fisheries but is somewhat passive about the buy-back program. Second, fisheries management which is based on self-regulation should be established. In order to increase the effect of fisheries management, the fishermen should decide by themselves the fish and fishing methods they would be exploiting and directly regulate them. Third, it is necessary to integrate the licenses of coastal fisheries. Since coastal fisheries management through the license system has distinct limitations, it is preferable to unify risking licenses and let the fishermen decide specific matters on their own. Finally, it is necessary to establish boundaries among the regions and industries. Joint fishing areas among regions(cities and provinces) should be established and fishing in other areas should be permitted on condition of paying the required fees. On the other hand, it is also necessary to permit coastal fishing only within certain distances.

어업관리 옵서버 제도의 효과에 대한 생물경제학적 분석 (Bioeconomic Analysis of Effectiveness of the Observe Program in Fisheries Management)

  • The observer program is being utilized In various fishing areas and fisheries internationally and nationally due to the its expected effectiveness in fisheries management and the collection of bioeconomic data necessary in fisheries management policy. The timely gathered data by observers play substantially a major role in decision-making fisheries policy such as the change in management measures, the application of season closure and area closure and etc. The expected effectiveness of the observer program In fisheries management, generally mentioned, is that it would lead to the increase in stock size from which the level of harvest would consequently increases. This study is aimed to analyze this tentatively expected effectiveness of the observer program in fisheries management. The changes in stock size and the level of harvest over time are analyzed under the observer program assuming the fishermen bear the cost of the observer program by investigating the change in fisherman's fishing activity under the observer program and by combining this changed activity with the biological model. The level of fishing efforts of fishermen was decreased from the results of the increase in fishing cost caused by the observer cost and the decrease in catchable stock size restricted by observers. This reduced level of fishing efforts enables stock size to increase over time and therefore, the expected level of harvest increases as time goes on. Another benefit under the observer program is to reduce management costs from the fact that fishermen are responsible for the cost of the observer program and the avoidance cost of fisherman responding to the fisheries regulation could be eliminated from the surveillance of observer. Therefore, it may possible to accomplish the cost-efficient fisheries management policy.

어선 종사자에 대한 안전교육 적정성에 관한 연구 (A Study on the Adequacy of Maritime Safety Training for Fisheries Seafarers)

  • In order to prevent the maritime accident, all seafarers who work on fishing vessels over G/T 20 tons are required to undergo the basic safety training by the Seafarer's Act. 45% of domestic crews have boarded on the fishing vessels. However, the fishermen have been trained in accordance with the STCW(International convention on standards of training certification and watch-keeping for seafarers) Convention. But safety training courses for seaman do not reflect on the safety equipment and the limitation of the fishing vessel in the training contents which is organized in accordance with the merchant ship by STCW convention and code. Most of the fishing vessels are small fishing boat of less than G/T 80 tons. Small fishing vessels are operating with only a minimum of safety equipment that has been defined by the fishing vessel safety equipment standard. Due to the safety training that does not fit the situation of the fishing boat, the level of satisfaction by the crews onboard is low for the training. Furthermore, there is a difficulty in achieving the goal of safety education. In order to carry out the safety training that is suitable for fishermen, it is required to provide appropriate standards for the safety education of workers of small fishing boat, by understanding the current state of the domestic fishing vessels. The purpose of this study is to define the aforementioned problems and to provide the standard for the safety education of fishermen. In order to complete the purpose, the research team has conducted a analyzation for registered domestic fishing vessel and safety equipment standard.

  • Korean fishery wage system has been evolved with the different titles. However, Since the law of fishing crew was enacted in 1984, the fishery wage system has been established as a rate system, which is a legal term. The present rate system in practice shows various contents and modalities, depending on fisheries and regions, but the fisheries of large trawl cooperative employ a rate system of fixed plus rate wage. However, such change did not transform basically the properties of pure rate scheme. As well known, fishing vessel owners face an awful lot of difficulty in managing and controlling effectively the production process because fishing activities are carried out in the seas remote from the land. Thus, it tend to be inevitable for vessel owners to employ a rate system to induce fishermen's positive motivation for promoting productivity and saving operating costs. However, the rate system has worked out as a driving force, which induce an increase in production more strongly under the expansion of vessel numbers and power and the keener competition of fishing activities. Even though the control mechanism of fishing instruments are well established, fishermen become naturally to have an incentive to increase their fishing effort for maximizing production since they are able to raise their shares by maximizing the quantity harvested. Thus, as far as the rate system exists, fisheries administration may have much difficulty in realizing its fishery management goals only through vessel reduction and fishing gear regulations. Also, under the rate system fishery management authority may be in face of a serious dilemma between the spontaneous rate system and vessel reduction policy. If the realistic aspect of the rate system is recognized and resource restoration and profit promotion are main policy goals, it is necessary to develop effective ways to control vessel owners' and fishermen's production-maximizing motives at an appropriate level. From this point of view, it seems reasonable to introduce TAC system by species or by fisheries into the existing fishery system. The research results suggest that if the fisheries administration could understand clearly the spontaneous fisheries wage system, it would know the norm of TAC and the basic reasons for illegal fishing activities and thus it would be able to develop and implement more realistic resource management policies.

  • 농어민 계층은 대표적인 정보소외계층으로 알려져 있다. 이러한 측면에서 농어민 계층들이 PC사용을 통하여 혜택을 받도록 하는 것은 국가정책의 하나가 되어 있다. 따라서 본 연구는 2017년 디지털정보격차 실태조사의 자료를 토대로 농어민 계층의 PC이용능력이 그들의 삶의 만족도에 어떠한 영향을 미치는지를 분석하고자 한다. 특히 인터넷서비스 이용의 매개역할을 검증한다. 경로모형을 토대로 분석한 결과, PC이용능력은 삶의 만족도에 유의한 긍정적 영향을 주는 것이 확인되었다. 또한 인터넷서비스 이용은 PC이용능력과 삶의 만족도와의 관계에서 부분적으로 매개효과를 가지고 있었다. 이를 통해 정부는 농어민의 PC이용능력 배양과 동시에 인터넷서비스 이용을 적극 권장하여 삶의 만족도가 향상될 수 있도록 할 필요가 있다. 향후 연구에서는 위계적 선형모형을 적용하여 지역별 차이를 고려한 세밀한 정책적 연구를 제안한다.

전남 지역의 패류 형망어선의 개량 (The improvement of the shellfish dredge vessel in Jeonnam province)

  • This study is aimed to develop an improved shellfish dredge vessel considering the increase of the fishing safety and welfare of fishermen in Jeonnam province. We visited five fishing village societies in Korea, and conducted field surveys and survey questions to investigate the current status. In order to solve the problems presented by the investigation, a general arrangement of the improvement vessel was written and adopted after meeting between the fishermen and research team, and calculated the initial stability in five loading conditions by using the Napa program. As a result of field surveys and survey questions, the existing vessel have buoyant materials under the bow and the warp pass through the wheel-house. In addition, most fishing equipment and nets are concentrated on a narrow stern, making it difficult to work efficiently. According to the survey, fishermen also responded that operation of casting and hauling is very inconvenient. The fishing equipment of the improvement vessel was rearranged, the size of the wheel-house and the crew room was increased, and we secured a basic welfare space. As a result of the initial stability test, the stability criteria of the fishing vessel were satisfied in all loading condition.

수산자원 소유.이용제도의 변천에 관한 연구 (A Study on the Evolution of the Holding and Utilizing System of Fisheries Resources in Korea)

  • This study deals with the evolutional history of the holding and utilization of fisheries resources in Korea. Fisheries resources have the basic characteristics of the density dependent self-regulating renewable and common property resources, Irrational utilization of fisheries resources is mainly due to the unlimited access to the resources. The holding and utilization of fisheries resources in Koryo era was opened to everyone. But it was nationalized in the early Yi Dynasty. The purpose of its nationalization was to provent the paticular powered-man with their monoplized holding and to levy fisheries tax. Eoeop-peop, the first modern fisheries law in Korea, was enacted as a part of the invasion policy of Japan in 1908. With the japanese annexation of Korea in 1910, the Japanese Government established a new institutional system of fisheries as a part of an overall reformation of the institutional for an implementation of the colonial policy. It was very the new enacted Fisheries Law (Gyogyorei). Also the Government enacted compulsorily another new Fisheries Law (Chosen Gyogyorei) with its adjunct laws and regulations revise the institutional system of fisheries on May 1, 1930. After Eoeop-peop enactment, the fisheries resources in Korea could be used only under the license, permission, and statement. After Korea was from Japan in 1945, Korea Government at last enacted the new fisheries law (Susaneop-peop) in 1953. The goal of Susaneop-peop was to achive the general usage and protection of the fisheries resources, and to attain the development and democratization of the fishery in Korea. This law was amended 13 times until 1990. The license fishery have a legal right on the fishery, called a fishery rigt. This right means a right of exclusive occupation and utilization of a unit of the inshore fishing grounds. The main evolutional issues of license fishery are as the following : 1) the foundation of the exclusive usable fishery right(1911, Gyogyorei), 2) the deletion of the settled U9space lift net and settled space sein net fishery, and the expansion of the cooperative fishery-No.1, 2, and 3 type cooperative fishery-(3rd amendment, 1963), 3) the deletion of the No.2 and 3 type cooperative fishery, and the separation of the culturing fishery in No.1 and 2 type culturing fishery (13th amendment, 1990). The effective period of the license fishery was amended as the following : 1) 1908(Eoeop-peop) : within 10 years, renovation system, 2) 1929(Chosen Gyogyorei) : within 10 years, unlimited extension system, 3) 1971. 7th amendment : 10 years, renovation system, 4) 1972. 8th amendment : 10 years, only 1 extension system, 5) 1975. 9th amendment : 5-10 years, only 1 extension system, 6) 1990.13th amendment : 10 years, within 10 years of total extensional years. The priority order of the fishery license was established in 1953 (Susaneop-peop). 어업용 유류의 안정적인 공급에 관한 연구 (A study on the Stable Supply of Fishery Oil in Korea)

  • The policy of suppling tax-exempt fishery oil in Korea has a history of almost 40 years, which was initiated by the National Federation of Fisheries Cooperatives in 1965. In 1999 the volume of fishery oil supplied to the earning fishermen and fishing entrepreneurs amounted to 8,390 thousand DM, 500 billion won in total. This paper analyzes the oil supplying system to fishermen in Korea and shows that the structural obstacles to the stable provision of fishery oil lies in the ineffective bargaining power (fixing price). Provided that the NFFC as a buyer, which is not equipped with the storage facilities for oil bids for a unit-price contract of fishery oil, there exists a possibility of collusion among 5 local oil refineries corporations to influence the oil price, making it difficult to reach a resonable price of oil. Though the international bids and direct imports following the liberalization of oil imports would help lower the unit price, purchasing and importing the oil out of season at a lower price would not be guaranteed without the oil storage facilities. Furthermore, the current supply system of oil is quite vulnerable to the extraneous factors and, say when the oil price soars unpredictably, it is almost impossible to supply low - priced fishery oil to fishermen. The National Federation of Fisheries Association of Japan(Zengyoren), for instance, possesses 10 oil storage facilities, which had been built across the country during the last 20 years (1964-1984). The storage capacity of these facilities reaches 0.6million DM(by kind, 0.56million DM for A heavy oil, 38thousand D/M kerosene, 5thousand D/M for diesel fuel oil). Allowing no intermediary of production associations(fisheries cooperatives) the NFFA's capacity for keeping oil in reserve rises much higher. As these storage facilities can keep the oil amounting to as much as of 70 days demand in reserve, a stable supply of fishery oil on favorable terms is secured. In contrast with Japan case, unequipped with the storage facilities for fishery oil, Korea does not have much bargaining power for bringing down the price of fishery oil. To make matters worse, the oil storing capacity of the member cooperatives is the volume of only 8 days demand. In case the oil price rises, it is almost impossible to supply the oil to the fishermen at a price lower than the price risen.
