  • Damage assessment and Damage index for RC members failed in flexure was investigated by using the nonlinear finite element analysis, included with nonlocal constitutive law, which is analyzed for the localization of the failure on the post-peak region. In the nonlcal constitutive law, The local strains obtained at gauss points were averaged over a particular length, i.e. characteristic length and it was used to evaluate the damage of RC column member. As the analysis results, The value of nonlocal strain shows less mesh sensibility. In the damage assessment, It was confirmed that evaluations of damage of RC member were able to use nonlocal compressive strain on a cover concrete and a core concrete of the member. Moreover it was confirmed that damage process for the statically indeterminate structure was able to evaluate the damage context of the component members of the structure.

  • There is legal relation between both parties after contract formation. The parties are liable for performing each duties but a party is not liable for a failure to perform the duties if party proves that the failure was due to the force majeure. The forec majeure has different concepts and legal principles such as change circumstance, hardship, frustration, impediment and so on. Therefore, it need to analyze a historical background and their presence in various domestic legal systems. Although the CISG describes Art. 79 impediment instead of using the force majeure, the impediment has several interpretative limitation. The CISG pursue to harmonize divergent legal concepts and principles from various national laws and legal systems but the harmonization of legal systems make the impediment more confused. The article goes on to analyzes about limitation of the impediment and reviews to examine the force majeure and hardship in PICC. Thus both parties of international contract insert hardship clause in order to prevent the problem of judgment in a court or a court of arbitration under impediment of CISG.

  • This paper presents the development of a decision model to examine the optimal repair action for a deteriorating system. In order to make a reasonable decision, it is necessary to perform an analysis of the uncertainties embedded in deterioration and to evaluate the repair actions based on the expected future cost. Focusing on the power law failure model, the uncertainties related to deterioration are analyzed based on the Bayesian approach. In addition, we develop a decision model for the optimal repair action by applying a repair cost function. A case study is given to illustrate a decision-making process by analyzing the loss incurred due to deterioration.

  • This Study analyzes the fact that whether or not, the applicant, by failing to object promptly to the facial discrepancies of the presented documents and to return those documents to the issuing bank, has waived his right to sue for breach of the Application agreement based on the recent Korea-US Case law. Some commentators claim that an applicant has a duty to notify the issuing bank within a reasonable time after receiving the documents that they do not comply with the letter of credit requirements and to return those documents to the issuing bank, and also suggest that a failure to do so result in a waiver of discrepancies that operates as a matter of law. But such decisions make little sense in letter of credit transaction. Unless otherwise agreed, Applicant agreement does not require that the applicant notify the issuing bank of any facial discrepancies of the documents or return those documents. Moreover there is no support in the body of law, i.e., UCP 500 or the Revised UCC Article 5, for an automatic waiver or preclusion arising from the applicant's failure to object promptly. In addition, beyond the lack of authority to support an automatic waiver arising from the applicant's failure to object and return the documents, in a letter of credit transaction the issuing bank is the only party charged with the duty of scrutinizing documents. Therefore, if there are discrepancies, it is the bank that should have to seek an express waiver from the applicant ; the issuing bank should not avoid responsibility for failing to notice discrepancies because the applicant was slow to scrutinize the documents closely or because the applicant failed to inform the issuing bank of such discrepancies. Requiring that applicants inspect documents independently defeats the purpose of retaining the issuing bank, erodes the bank's responsibility to perform its role diligently, and may result in the bank avoiding liability despite negligent payment. If the bank wants to require an applicant to report discrepancies promptly, he may include a provision in the Application agreement limiting the time limit within which the applicant must give notice of facial discrepancies and return the documents. This approach will ensure the continued wide-spread use of documentary credit as a reliable payment mechanism.

Strength failure behavior of granite containing two holes under Brazilian test

  • A series of Brazilian tests under diameter compression for disc specimens was carried out to investigate the strength and failure behavior by using acoustic emission (AE) and photography monitoring technique. On the basis of experimental results, load-displacement curves, AE counts, real-time crack evolution process, failure modes and strength property of granite specimens containing two pre-existing holes were analyzed in detail. Two typical types of load-displacement curves are identified, i.e., sudden instability (type I) and progressive failure (type II). In accordance with the two types of load-displacement curves, the AE events also have different responses. The present experiments on disc specimens containing two pre-existing holes under Brazilian test reveal four distinct failure modes, including diametrical splitting failure mode (mode I), one crack coalescence failure mode (mode II), two crack coalescences failure mode (mode III) and no crack coalescence failure mode (mode IV). Compared with intact granite specimen, the disc specimen containing two holes fails with lower strength, which is closely related to the bridge angle. The failure strength of pre-holed specimen first decreases and then increases with the bridge angle. Finally, a preliminary interpretation was proposed to explain the strength evolution law of granite specimen containing two holes based on the microscopic observation of fracture plane.

  • This study is to introduce the Chinese Contract Law against non-performance of the contract and to solve the wide range of problems involving to executing the trading contract. The parties' liability for the period of performance, the place of performance, the failure to deliver conforming goods together with it's nature of the lack of conformity, and the methods of compensation against damages and the force majeure clauses application. Those issues affect directly to commercial transactions in international business. The focus is more on the interrelationship of private individuals in its trade and on aiming to remove the legal obstacles from the Chinese Contract Law to freely flow of international trade. Reference may include foreign corrupt practices, Conventions on Contracts for the International Sale of Goods and Laws of England, France, and Japan. This study has brought the efforts of these issues in the full spectrum of performance and with concentrations on effectiveness to avoid the different viewpoints of the general principles of CISG and commercial practice founded pre-eminently. This study, in presenting the legal framework, will contribute to a better understanding of the purpose of rules of Chinese Contract -Law as they interact to the benefit of the parties involved in international trade transactions. The writer believes that a problem-oriented approach and the concentration as outlined above would offer a different perspective for law faculty teaching in this area and hope that this study can be sufficiently diverse to satisfy many of those views.

Bayesian Value of Information Analysis with Linear, Exponential, Power Law Failure Models for Aging Chronic Diseases

  • The effective management of uncertainty is one of the most fundamental problems in medical decision making. According to the literatures review, most medical decision models rely on point estimates for input parameters. However, it is natural that they should be interested in the relationship between changes in those values and subsequent changes in model output. Therefore, the purpose of this study is to identify the ranges of numerical values for which each option will be most efficient with respect to the input parameters. The Nonhomogeneous Poisson Process(NHPP) was used for describing the behavior of aging chronic diseases. Three kind of failure models (linear, exponential, and power law) were considered, and each of these failure models was studied under the assumptions of unknown scale factor and known aging rate, known scale factor and unknown aging rate, and unknown scale factor and unknown aging rate, respectively. In addition, this study illustrated developed method with an analysis of data from a trial of immunotherapy in the treatment of chronic Granulomatous disease. Finally, the proposed design of Bayesian value of information analysis facilitates the effective use of the computing capability of computers and provides a systematic way to integrate the expert's opinions and the sampling information which will furnish decision makers with valuable support for quality medical decision making.

Numerical Study of Detonation for AN based non-ideal explosives via an Eulerian multi-material method (Ammonium Nitrate 계열의 폭발물의 폭굉에 관한 연구)

  • The numerical simulation for detonation failure of ammonium nitrate (AN) based non-ideal explosives is carried out with an accurate and state-of-the-art Eulerian method. Detonation failure is readily observed in the rate stick experiments utilizing the AN mixture explosives and the inert confinements of varying thicknesses. The composition of non-ideal explosives and thickness of the confinements influence the characteristics of detonation failure. Calculated results are compared against the experimental data of both unconfined and confined rate stick problems and provide a reliable guideline to establish a fine-tuned chemical kinetic model for detonation failure.
