Study on Shinyeojuryeom through Historical Documents and Scientific Analysis (문헌자료와 유물의 과학적 조사를 통한 신여주렴(神輿朱簾)의 연구)

  • Shinyeojuryeom is a set of bamboo blinds[Juryeom] enclosing the Korean litter for transporting a mortuary tablet of royal family[Shinyeo] in Joseon dynasty. The blinds were made up of twigs laid horizontally which were joined together by vertical threading, then they were lined and backed with silk fabric. A number of historical documents such as Gukjosangryebopyeon(1758), JeongjoGukjangdogameuigwe(1800) and Gukjangdogam- myeongseseo(1905) provide information on material and structure of the litter and blinds. How- ever, detailed dimensions or specific ingredients of some of the materials were not clearly explained. In order to complement these missing or unclear parts, a close examination and scientific analysis of the litter's material was undertaken. The result newly identified materials of the gold tip tassels and pigments used on twigs as well as partly confirmed information on historical records. This new information will help further understanding and future production of a replica.

  • Traditionally courts have been adopted over the years two standards of dealing with compliance of documents such as strict compliance and substantial compliance and the substantial compliance, which was somewhat less demanding than the strict compliance. However the new guidelines of ICC's international standard banking practice for the examination of documents under documentary credits set up how the UCP is to be applied in practice. The payment obligations of an issuing bank to a beneficiary are independence of the performance or the nonperformance of any contract underlying the letter of credit. However, strictly applying the principle of independence and abstraction could produce unfair results by operating unjustly enrich an unscrupulous beneficiary in case of fraud. Accordingly, when a beneficiary presents complying documents, the issuing bank is bound to honour the presentation unless the fraud rule applies on the facts of the case such as forged or material fraud. If it does, the issuing bank(issuer) needs not pay despite the complying presentation of documents by the beneficiary under the Uniform Commercial Code Article 5-109 and case law in America. However the fraud rule was not addressed in UCP 600. In conclusion, view in terms of legal principle and the court cases is variable and difficult to honour or dishonour the presentation in case of application of the independence principle and fraud rule such as the problems on burden of proof timely, possibility of granting injunction in order to protect against victim for bona fide applicant.

  • This article is focused on the review of the judgement standard for compliance of the documents in international standard banking practice. Since the establishment of Uniform Customs and Practice for Documentary Credits, The practices of the Credit transactions has been formed and developed with the rapidly changing progress of the international trade environment. but though the international standard banking practice have meaning to suggest a new examination standard, in practice, there are some problems on the judgement of the compliance of the documents. Therefore, for the useful judgement standard for compliance of the documents, the range of the standard should become concrete and simple so that all the related parties can forecast. and the opinions and interpretations published by ICC Banking Committee are recommended to be used, systematized and activated. and also with the change of the trade environment, the changed standard practice could be published annually for the useful use. and it will be necessary to consider to publish the publications in the form of the "White Book" Last, it is necessary to accept the changes by the needs of the times as the international standard banking practice promptly and analysis accurately its problems for the times of the electronic commerce, so that Credit systems should be settled and developed continuously as the useful means of the settlement of the proceeds conquering of the characteristics originated from the international transactions between the parties concerned.

  • With the start of the fourth industrial revolution era, technologies of various fields are merged and new types of technologies and products are being developed. In addition, the importance of the registration of intellectual property rights and patent registration to gain market dominance of them is increasing in oversea as well as in domestic. Accordingly, the number of patents to be processed per examiner is increasing every year, so time and cost for prior art research are increasing. Therefore, a number of researches have been carried out to reduce examination time and cost for patent-pending technology. This paper proposes a method to calculate the degree of similarity among patent documents of the same priority claim when a plurality of patent rights priority claims are filed and to provide them to the examiner and the patent applicant. To this end, we preprocessed the data of the existing irregular patent documents, used Word2vec to obtain similarity between patent documents, and then proposed recommendation model that recommends a similar patent document in descending order of score. This makes it possible to promptly refer to the examination history of patent documents judged to be similar at the time of examination by the examiner, thereby reducing the burden of work and enabling efficient search in the applicant's prior art research. We expect it will contribute greatly.

  • "承政院日記" is a journal written by the scribes belonging to the Royal Secretariat and consists of objective and detailed records about events, dialogs, and actions that happened in the presence of the king and also collections of all the documents output by the Royal Secretariat. The medicine-related records in "承政院日記" are mainly records of the medical examination and treatment of the king and the royal family and related documents of operation. Of the many different entries involved with clinical practices, this study focuses on the medical examination and treatment of the king. Through the case studies displayed in the clinical records of "承政院日記", trial and error of its time as well as clinical results can be verified. Sorting out of affirmative tradition that could not be handed down due to institutional interruption is also made possible through comparison of effective treatment methods of late Chosun dynasty including patterns or distinctive methods of treating specific diseases against their counterparts in Traditional Korean Medicine of today.

  • The updated International Standard Banking Practice(ISBP), International Chamber of Commerce Publication No. 681, was published to bring its contents in line with UCP 600. The ISBP 681 has dealt with 185 paragraphs from paragraphs 200 of ISBP 645 that are commonly arising in the credit transactions and also explains in detail some of the articles of UCP 600 with the proper interpretation. The updated version ISBP 681 involved aligning it with UCP 600, making certain technical adjustments in expression of words such as "in conflict" instead of "inconsistent", etc. Also descriptions of goods in commercial invoice to be altered the words into "services or performance" in addition to "goods". Despite the updated ISBP 681, there remains a question. Where the words "from" or "after" are used in regard to something other than a period of shipment or the maturity date of drafts, there is no guidance from the UCP as to its meaning. The party concerned in credit transactions is also required to have a full understanding of the paragraphs of ISBP 681 and the articles of UCP 600 in order to acquire the documents preparation and examination facilitating the parties to minimize discrepancies.

  • To work in the fashion industry which has entered the digital age, and in specialization and high-industrialization age, one needs to attain various skills required for the qualifications of a fashion specialist. For these, qualification certificate systems are enacted to nurture specialized technical personnel, and among these, a jacket pattern is selected from the practical examination of Western-style dress skill prepared for nurturing specialist who can design, cut, and sew women's clothing, to be compared and analyzed against the existing printed practical textbooks, technical books of making clothes which used as college textbooks, and local documents of theoretical study documents. The methodology of the research is to select 8 samples for the study, analyze the identity with the design, and then cut applying the identical dimensions and compare the measurements, and make the clothes using each cutting methods, and inspect to find the consistency with the design and made statistical analysis. As a result, we designed and made research patterns, and suggested a jacket pattern design to patterns simply that suits the design fast.

A Study on the Obligations of the Issuing Bank in Payment Refusal under UCP600 (신용장 개설은행의 지급거절시 의무사항에 대한 연구)

  • This study aims to derive precaution points for issuing banks in refusing payment under L/C through literature review and examination of court cases and official opinions of ICC Banking Commission with regard to the provisions of article 16 of UCP 600 that stipulates obligations of issuing banks in refusing payment. If the issuing bank fails to act in accordance with this article, it shall be precluded from claiming that the documents do not constitute a complying presentation. Therefore, it is crucial that issuing banks should be well informed of this article. When discrepant documents are presented, however, issuing banks seldom refuse payment because, in most cases, the applicants waive the discrepancies. For this reason, issuing banks have few chances to deal with payment refusal in practice and thus they occasionally end up failing to observe the provisions of the article. Such court cases include Kookmin Bank and Korean Exchange Bank (currently Hana Bank) that failed to indicate discrepancies in the refusal notice losing the lawsuits. It should be noted that if issuing banks disregard the provisions of article 16 of UCP 600 and thus fail to indicate discrepancies in the refusal notice, they may face fatal situations in which they must make payment against discrepant documents.

The Classification and Age Determination of Ballpoint Pen Inks in Questioned Documents

  • The aim of this study was to investigate questioned documents written with blue or black ballpoint pen on paper by nondestructive technique. In this work, 21 blue and 22 black ballpoint pen inks which were purchased on different brands were analyzed by using Microspectrophotometry (MSP). The reflectance spectra were obtained from these ink samples and their shapes and the wavelength of the maximum intensity were compared. In the blue and black ballpoint pen inks, the discriminating powers (DP) were 0.85 and 0.61, respectively. The changes of the reflectance intensity at their wavelength of maximum intensity and their shapes appeared according to the exposure time to sunshine in a laboratory, especially in the blue ballpoint pen inks. Therefore it is possible to distinguish ink entries on the same paper with the relative age in case of questioned letters written with blue ballpoint pen.

  • The publication International Standard Banking Practice for the Examination of Documents under Documentary Letters of Credit (ISBP) is the product by a task force of the ICC Banking Commission. The ISBP is a practical complement to UCP 500, ICC’s universally used rules on documentary credits. The ISBP does not amend the UCP. It explains, in explicit detail, how the rules are to be applied on a day-to-day basis. It fills a needed gap between the general principles announced in the rules and the daily work of the documentary credit practitioner. By using the ISBP, document checkers can bring their practices in line with those followed by their colleagues worldwide. The result should be a significant reduction in the number of documents refused for discrepancies on first presentation.
