Medical services aren't done by doctors only but by different medical personnels. If any medical accident takes place, to what extent doctors, nurses and other personnels should respectively be liable for that should be determined. And when an employed doctor does any illegal medical act, his or her employer also should be responsible for that as a user. If a medical accident occurs, the victim or patient usually claims against the employer of the doctor sho causes the accident for compensation. And those who assist medical treatment, including nurses, should be liable for their own acts, but in case their doctor doesn't give any appropriate directions, the doctor should shoulder the liability. This indicates that nurses are also professional medical personnels, and that they should share the liability as well. There are lots of different medical personnels, but doctors and nurses are the pivot of team treatment, and nurses should also take responsibility for their services. Doctors and nurses are equal, as they are in pursuit of the same, namely, helping patients recover their health. Only their roles are different. If they respect each other and see each other as being responsible for their own roles, they will be able to consult together. Medical information on patients and nursing information should be shared by both of them, and patients should be provided accurate treatment and nursing services. If those who offer nursing services are unaware of required information due to conflicts with doctors, it might result in threatening the safety of patients. And in case any important information isn't properly conveyed between them, it might trigger a medical accident. Sophisticated and complex medical science requires medical personnels to be professional, and nurses as well as doctors need to be an expert. The fact treatment-related accidents take place often indicates that treatment is basically attended with danger. Furthermore, patients respond to all sorts of investigation and medicine in a different manner. They should be professional and knowledgeable to predict how they might respond and prevent any possible hazardous situations, and they are expected to have more knowledge in the future. Nonetheless, there aren't yet enough studies on the legal liability of nurses, and this study is expected to pave the way for future research on nurse liability against medical accidents.
This study is to examine current child care support policies and their limitations and to make some suggestions by means of statistics and previous literature. Major findings are as follows: First, As the women have younger children, the effect is more negative. Second, a maternity leave of Korea is 90 days, which is below ILO standard. Moreover, it is not well supported by the companies they work for. Third, the increasing number of men has spent a paternity leave since the pertinent law was enforced in 2001. The rate of spending the leave, however, is not as high as expected, because it has not yet been decided whether the leave would be paid or not. Lastly, the number of the employer-supporting child care center is rather few due to the legal standard of the facility and the expense that a company should cover. Only 46.5% of the companies that has been appointed to obligatorily establish the center now operate the facility. Therefore, child care support policies should be reformed or improved to help reduce married women's child care burden obviously hindering women from being employed, and this will consequently promote their economic activities. It is also urgently required to expand the application of the parental leave in terms of both object and scope. It is important that employers and employees get ready to compromise each other on the wage issue during the leave. In addition, the flexibility in period and form of the parental leave and the connection of working places with local community for better child care service must be taken into consideration.

Normally there is a one-time relationship between stakeholders in the construction projects. Thus, project participants are easily exposed to opportunistic behavior. According to the theory of transaction costs, a contract effectively influence the behavior of counter-party. The important role of contracts in limiting opponent opportunistic behavior has been academically acknowledged and studied in inter-firm relationships. The purpose of this study is to reveal the mediating effect of the contract on the power of the contractor in the contractor's behavior. Power is divided into mediated and non-mediated power. We surveyed construction companies' employees who have conducted construction projects. Based on the questionnaire response, we examined the influence of the Employer's power on the behavior of the contractor. Both non-mediated power and mediated power were significant for in-role and out-role behaviors. Both non-mediated power and mediated power were found to have a significant effect on the control and coordination function of contracts. The results show that the control function of the contract is significant for the in-role behavior and the extra-role behavior. Finally, the mediating effect of the contract function was significant only in the control function.
In today's industrial society, one observes fierce competition aiming at profit generation among companies, and the utilization of complex machineries and cutting edge science and technology constitutes a constant threat to the life, body, and health of employees. In such a context, it is precisely the purpose of the Industrial Safety and Health Act that is in force to provide protection to the life and health of employees against hazardous and harmful environment and the role of enterprises becomes more and more important in the law. The Industrial Safety and Health Act places the responsibility for preventing industrial accidents on the shoulders of the business employer by providing safety and health information relating to current employees and creating an appropriate work environment. The employer must recognize the importance of prevention of industrial accident and must possess a business philosophy that places top priority on safety when it comes to company management. In light of such practical considerations, the present study approaches to find out the influence of safety and health management on business management from a statistical sample survey point of view. By doing this, the study hopes to show that a through safety management serves to protect the life and health of employees and raise profit for businesses. What is more, the study hopes to demonstrate that promoting a sound business culture can act as fertilizer that promotes the ushering in of a bright society.
The present study investigated the current child care practices of professional working mothers in Korea and their needs for substitute child care outside the home. Three hundred twenty-two professional working mothers who have children under 6 years of age in Seoul, Pusan, Taegu, and Taejon were surveyed with the use of a questionnaire. It was found that during their working hours, most of the professional working mothers put their children in the care of either the paternal or the maternal grandmothers. Others put the children in the care of a full-time housekeeper or a part-time housekeeper. While all the mothers had worked out a way to care for their children, almost all of them would use day care if facilities were available. Specifically, 42 per cent prefer child care at their work site, 21 per cent prefer family day care, and only 3 per cent indicated that they would not use any child care facilities. Most of the working mothers think that their employer should manage the day care program. Others prefer social agency or government management. Regarding costs, most prefer that costs should be split 50-50 between the employer and the family. In addition, professional working mothers wanted quality programs with educational components rather than mere custodial care. It was concluded that variety in types of quality child care programs should be available to provide working mothers the options of choosing what they want for their children. The main type of programs suggested by this study is work site based child care for children under 3 years of age. The existing law for the Saemaul Nursery School program should be implemented so as to include programs for children under 3.
The objective of this study is to examine relevant factors of the service level of aged care facilities. The sample used in this study consisted of 357 aged care facilities in Korea. Data were collected with self-administered questionnaire and 140 returned questionnaire were analyzed by SPSS Version 12.0. The major findings of the study are as follows: First, there was no significant mean difference in the service level by the facility characteristics, except the length of operation. Second, it was found that both administrative characteristics and employer characteristics were positively associated with the level of nursing and supportive services. Third, the study results revealed that the following three variables of employee education and training, community networks, and employer's philosophy and management principles had significant positive effects on the level of nursing services. Meanwhile, the following two variables of employee education and training, and community networks had significant positive effects on the level of supportive services. In conclusion, in order to improve their service level, the managers of aged care facilities in Korea should make efforts to provide more employee education and training, establish networks with the community stakeholders, for example, local clinics and hospitals. It is also recommended for the government to make a policy inducing more qualified private investors to enter the aged care market, as well as to strengthen the qualification of the managers of the public aged care facilities.
Purpose: This study were carried out to investigate the difference employment characteristics and job satisfactions by gender and to explore the influences of demographic status and employment characteristics on job satisfaction. Method: Social statistics survey data collected by Ministry of Statistics in 1998 were used for the secondary analysis in the study. Job satisfaction was measured by questionnaire which were consisted in 12 items such as task, promotion, placement, wage, benefits, future in the work, working environment, human relationship, working hours. Result: The results show that more than 50% of women were working as a part-time employees. Their education level were lower than men. Women workers were unmarried at higher percents than men. Men were showed more satisfaction significantly in their job than women. Men also had higher job satisfaction with work task, promotion, placement, and human relation. Women had shown higher job satisfaction with wage, working environment, and employer-employee relationship. Employment status had the most important factor on the job satisfaction. And, living status satisfaction, education, age, occupation, marital status, employment status and sex were significant for the job satisfaction. 33.34% of the variance in the job satisfaction were accounted for by these variables. Conclusion: The results of this study showed that there were difference of job satisfaction between gender and employment status was the most predictive factors on the job satisfaction. Women had more unstable employment status such as part-time, employment on probation, or family employer without wage than men. Stability of employment could be considered as a strategy for enhancing job satisfaction for women.

There have been many studies on the subject of risks in the Construction Industry and many useful results have been produced. However, risk studies on the conditions of contract, which is the most critical contract documents, has not been tried despite of its contractual function in the overseas projects. In this study, various contractual risks are identified for proper and reasonable evaluation of the contractual risks possibly encountered in the Tender and/or Contract stages of the Projects. For development of study, FIDIC Red Book 1999 Edition which is world widely recognised as a standard conditions of contract prepared for the projects designed by the Employer. Contractual risks are divided into three levels and applicable clauses are assigned to each appropriate risk factors. And table of major contractual risk factors are made using the classified levels of each factors with evaluation criteria as a result of this study. As this study is made only for the conditions of contract which is prepared for the construction contracts designed by the Employer, further studies for other types of contracts such as Design-Build (FIDIC Yellow Book), EPC/Turnkey (FIDIC Silver Book) and recently developed Design, Build and Operate type of contract (FIDIC Gold Book) are required to cover various types of projects executed in the world construction markets.

Background: Effective policy implementation is essential for a healthy workplace. The Ryan-Kossek 2008 model for work-life policy adoption suggests that supervisors as gatekeepers between employer and employee need to know how to support and communicate benefit regulations. This article describes a workplace intervention on a national employee benefit, Family and Medical Leave Act (FMLA), and evaluates the effectiveness of the intervention on supervisor knowledge, awareness, and experience with FMLA. Methods: The intervention consisted of computer-based training (CBT) and a survey measuring awareness and experience with FMLA. The training was administered to 793 county government supervisors in the state of Oregon, USA. Results: More than 35% of supervisors reported no previous training on FMLA and the training pre-test revealed a lack of knowledge regarding benefit coverage and employer responsibilities. The CBT achieved: (1) a significant learning effect and large effect size of d = 2.0, (2) a positive reaction to the training and its design, and (3) evidence of increased knowledge and awareness regarding FMLA. Conclusion: CBT is an effective strategy to increase supervisors' knowledge and awareness to support policy implementation. The lack of supervisor training and knowledge of an important but complex employee benefit exposes a serious impediment to effective policy implementation and may lead to negative outcomes for the organization and the employee, supporting the Ryan-Kossek model. The results further demonstrate that long-time employees need supplementary training on complex workplace policies such as FMLA.

Slips and falls are associated with many occupational injuries in Korea. It is also estimated that slipping are major contributors to slip, trip and fall injury burden. So "LOCAL RULE ON OCCUPATIONAL SAFETY AND HEALTH STANDAR D" must be improved, especially article 3(prevention of slip, trip and fall). The primary purpose of the present study is to determine if, and to what extent, the standard could be improved in present environment. In order to fulfill our objective, the another regulation in Korea and foreign countries were investigated and reviewed. Many kind of standard, mandatory documents and guideline were also reviewed. And then, regulations, standard, guideline etc. reviewed were compared with each others. The article 3 was revised as below. 1. The floors of the traffic route in workplace shall have no hole or slope, or be uneven or slippery so as, in each case, to expose employees to slip, trip and fall risk, except if adequate measures have been taken to prevent a employees falling. 2. The employer shall design, install and fix the drain for effective drainage if fluid contaminants were frequently occurred. So far as is reasonably practicable, An employer shall keep the workplace clean, sanitary, and dry so that employees won't have any risk to tripping or slipping at the workplace. 3. To facilitate cleaning, every floor, workplace, and passageway shall be, so far as is reasonably practicable, kept free from protruding objects, splinters, holes, etc. Also, some criteria was developed in this study. Standard and criteria developed in this study will help to prevent slip, trip, and fall injuries.
