Artificial Intelligence and the Virtual Multi-Door ODR Platform for Small Value Cross-Border e-Commerce Disputes

  • In recent times, the volume of cross-border e-commerce has witnessed an upward trend and has been accompanied by increased disputes, with cross-border e-commerce being characterized mainly by low value and large volume issues. For this reason, Online Dispute Resolution (ODR) was formed to carry out dispute resolutions in cross-border e-commerce. A virtual multi-door ODR platform for small value, cross-border disputes in e-commerce is then proposed in this paper. For a couple of decades, researchers have tried to employ Artificial Intelligence (AI) to Law. However, it turns out that they were faced with a couple of obstacles to integrate AI to Law since it is highly difficult to program AI to process the common sense of a human being. For example, AI cannot assimilate the affective side of a human being, and it is problematic to integrate a human being's common sense into the AI system. Considering this situation, this study puts forward an ODR model for cross-border e-commerce in the evolutionary perspective.

  • A motive and aim of enactment of UN Convention on the Use of Electronic Communication in Int'l Contracts is based on need to eliminate legal obstacles that might arise under existing int'l trade law instruments and promote int'l electronic commercial transaction. But when it is used with related articles, 14, 15, 16, 17 for offer under CISG, one of the most successful conventions which produces substantive law for the unification of int'l trade, questions of practical importance, for example possibilities of withdrawal, revocation, rejection of offer, the extent of its criteria arise from therewith. In conclusion, a effective electronic offer has to assure easily access and confirmation of trade terms besides criteria of offer under CISG. An offer can be withdrawal, if electronic message of withdrawal has entered the offeree's server before or at the same time when the offer has reached the offeree but agreement expressly or impliedly, between the parties about type, format, email address is a prerequisited. Implied consent could be presumed through prior conduct or trade usages between the parties under CISG articles 8, 9. The term "have reached" correspond to the time which is able to retrieve the electronic message of withdrawal. But without express or implied agreement between them about electronic communication of type, format, email address, an offer can be withdrawal before or at the same time when it has entered offeree's other e-mail address and confirmed by his retrieval. In case of the revocation, electronic message of the revocation is effective before the offeree's dispatching an acceptance. A prerequisite for the revocation by electronic communication is came as the above mentioned withdrawal except for concept of a time difference for reach. In case of a rejection of offer, when a rejection by electronic communication has entered the offeror's server, an offer is ended. But a prerequisite for the rejection by electronic message is same as the above mentioned withdrawal and revocation.

A Study on the Market Integration of Major Import Fishery Products in South Korea Utilizing STAR Model (STAR 모형을 이용한 국내 주요 수입수산물 시장의 통합 여부에 관한 연구)

  • I explore that South Korea's major import fishery product markets-frozen hairtail, frozen mackerel, frozen pollock and frozen squid-are integrated by testing whether there is favorable evidence of the law of one price (LOP). Unlike previous studies on the LOP for fishery product markets, I assume non-zero import costs and include them in a trade model. To explore whether LOP holds for major import fishery product markets in South Korea with non-zero import costs, I utilize a non-linear time-series model, Smooth Transition Autoregressive (STAR) model with the sample periods from January in 2002 to December in 2019. I find that the behaviors of home-foreign price (i.e., import price) differentials of all four major import fishery products are non-linear depending on whether trade occurs and favorable evidence of LOP for each import market in South Korea. These findings indicate that each of South Korea's major import fishery product markets is integrated. They imply that the supply of each major import fishery product-frozen hairtail, frozen pollock, frozen mackerel and frozen squid, and their prices are stable even if there is an economic shock on each market. When it comes to trade policy implications, the Korean trade policy including tariffs or quotas against their import countries for the four major import fishery products may not have influences on their price in the markets.

A Study on e-B/L Korea Service and its Facilitation Strategies (한국형 전자선하증권 활성화 전략에 관한 연구)

  • Korea has accomplished the establishment of the National Single Window for Paperless Trade. Since 1991, it has developed Trade Automation Service System based on EDI technology. In 2003, Korean government and private sectors jointly began to set up National Paperless Trade Service( e-Trade Service) as one of the e-government projects. In 2008, they commenced the uTradeHub Service which was equipped with Internet based e-B/L and e-Nego service systems for the first time in the world To facilitate the service Korea amended its e-Trade facilitation Act and Law by 2007. At the end of 2011, Korea historically recorded its trade volume of 1 trillion US dollars and joined '$1 trillion trade club' as the 9the member country since the country had started international trade less than five decades ago. A rolling out of the e-B/L and e-Nego service will 'ally reduce the transaction costs of trading businesses and accelerate the activation e-trade services. The purposes of the study are to examine 'e-B/L Korea' service and its facilitation strategies as well as identify obstacles to utilize the 'e-B/L Korea' service. The paper reviewed and analyzed Korea's Paperless trade system and distinctive characteristics of the 'e-B/L Korea Service. Parts of the fOWld distinctive characteristics of the Korea's e-B/L service are as follows; It is well equiped with IT and legal system. It also has more that 30,000 potential users who are already uTradeHub service users. The paper indicated several weaknesses of the current system such as global KPI issues, circulation of the electronic documents not only in the domestic market but also among economies, development of the electronic Bill of Exchange. As resolution measures, the paper recommended the introduction of mutual recognition system of PKI among trade partner counties, setting up e-trade solution for small and medium companies, and special attention to raise users' awareness of the e-B/L service.

A Study on the Research Trends in International Trade using Social Network Analysis (사회연결망 분석을 활용한 무역 분야 연구동향 분석)

  • This study used social network analysis to analyze trends and the knowledge structure of research in international trade. To this end, 4,840 keywords were extracted and analyzed from 1,797 papers contained in the Journal of Int'l Trade and Industry Studies, the Korea Trade Review, and the Journal of Korea Trade from 2003 to 2019. The results reveal that the distribution of keywords in the trade studies, as with other intellectual networks, followed a power-law distribution. Some differences were observed in the top 20 keywords across journals, with total factor productivity, economic growth, and Korea-US FTA ranking high only in the Journal of Int'l Trade and Industry Studies. Global value chain and trust emerged as a topic that attracted new researchers' attention in the 2011-2019 period. Interest in E-Trade, WTO, and internationalization has declined in recent years. The conventional international trade research trend analyses have predominantly featured qualitative analysis by descriptive method in general, but this study is meaningful in that it employs quantitative analysis using social network analysis techniques.

Space-Stretch Tradeoff Optimization for Routing in Internet-Like Graphs

  • Compact routing intends to achieve good tradeoff between the routing path length and the memory overhead, and is recently considered as a main alternative to overcome the fundamental scaling problems of the Internet routing system. Plenty of studies have been conducted on compact routing, and quite a few universal compact routing schemes have been designed for arbitrary network topologies. However, it is generally believed that specialized compact routing schemes for peculiar network topologies can have better performance than universal ones. Studies on complex networks have uncovered that most real-world networks exhibit power-law degree distributions, i.e., a few nodes have very high degrees while many other nodes have low degrees. High-degree nodes play the crucial role of hubs in communication and inter-networking. Based on this fact, we propose two highest-degree landmark based compact routing schemes, namely HDLR and $HDLR^+$. Theoretical analysis on random power-law graphs shows that the two schemes can achieve better space-stretch trade-offs than previous compact routing schemes. Simulations conducted on random power-law graphs and real-world AS-level Internet graph validate the effectiveness of our schemes.

  • The purpose of this paper is to analysis the legal aspects of e-commerce, particularly those relate to electronic contract, in China On 23 November 2005, the United Nations General Assembly adopted a Convention on the Use of Electronic Communications in International Contracts, known popularly as the Electronic Communications Convention. China signed it but the convention is not binding yet as it still requires the ratification by three states. On the other hand, China adopted a new act legalizing the electronic signature in 2004. This new act provides electronic signatures with the same legal status as handwritten signatures. But the efficiencies that business hopes to achieve through electronic commerce are not completely reflected in the legal processes necessary to support those hopes.

  • China has recently (28 August 2004) adopted a new act legalizing the electronic signature. This new act provides electronic signatures with the same legal status as handwritten signatures, and states that on-line certification providers will have to be created in order to ensure the security of on-line operations made using said signatures. This new act is intended to increase Chinese electronic business, and thus to raise the revenue China can expect from said business. And the law grants electronic signatures the same legal effect as handwritten signatures and seals in business transactions, and sets up the market access system for online certification providers to ensure the security of e-commerce. As Internet trade requires a reliable third party to identify the signers, the credibility of online certifying organizations is significant for the transaction security. So, considering the weakness of China's social credibility system, the law regulates that the online signatures certification providers should be approved and administered by governments.

  • Crowdfunding is growing up SNS spread, raising funds from numerous people which are offering necessary funding of private and enterprise using the internet-based platforms. The function of crowdfunding uses innovative financing in being business and start-ups having difficulty in financing. Crowdfunding in our domestic is concentrated on culture and arts in the early adoption phase, and is numerous projects with public features. However, the investment case of crowdfundig in e-commerce trade start-ups is rarely in spite of a increased attention for crowdfunding.. The purpose of this study examined the factors to be considered when using successfully crowdfunding on e-commerce trade start-ups. This study is understanding the legal and policy of crowdfunding market status and other countries, and suggests the activation of the direction of government policy, legal system, and participation of financing suppliers and investors as activating the law and policy system related the crowdfunding on a domestic in terms of e-commerce trade start-ups investment.

Meta Analysis of International Commerce and Information Review (통상정보연구 메타분석)

  • This study is a meta-analysis of the articles published over the last 18 years from the first edition of the "International Commerce and Information Review" to December 2016. 1047 papers were published in "International Commerce and Information Review" until 2016. Many articles appeared in the order of electronic trade field, product and service innovation field, regional trade information field, trade law system field, and trade negotiation field. There are more than 15 major fields of authors who have published more than 20 papers."International Commerce and Information Review" is a multi-disciplinary journal by scholars in various major fields. Most of the authors belong to universities and the proportion of papers that receive research grants is 19.7%. 46 authors have published more than 5 papers in "International Commerce and Information Review", and their H-index is 5.6. Influence Index (IF) of the "International Commerce and Information Review" in 2016 is 1.02. The main keywords of the papers published in "International Commerce and Information Review" are e-commerce, Internet, service trade, China, e-trade, Korean Wave, FTA, SME and foreign direct investment.
