  • The Chicago-Bermuda system has been charaterizing international aviation order sine 1940's. Bilateralism was established as 'the' way of nogotiation in exchange of traffic rights among nations thanks to the system. The system was stable until new phenomena came into the scene. The orderly development of international aviation began to be threatened by a series of technological and commercial breakthroughs in the late 60's and 70's. Also, in the field of international aviation, aspiration of the newemerging third world countries was hightened and the emergence of an unified Europe was added to it. These caused worries on bilateralism as an efficient means of negotiation. New waves of multilateral(reginal or international) approaches have been conducted. Its formal discussion is accelerated by vigorous talk on multilateral liberalization of international trade in commodities and services, i.e., the Urguay Round. In this paper, we examine historical development of bilateralism and multilateralism in a perspective of political economy; changes in the international aviation industry, merits and demerits of the two regimes on competitiveness of negotiating partners. The ways Korea can respond to new changes are presented and compared and a tentative stance she can take is proposed.

한국 전자선화증권 등록기관 지정제도에 관한 연구 (A Study on the Designation System of Registration Authority of Electronic Bill of Lading in Korea)

  • 선화증권의 위기문제를 해결하기 위한 UN과 CMI 노력의 발판으로 볼레로 선화증권이 도입된 지 상당한 시간이 흘렀지만 아직까지 전자선화증권이 실질적으로 도입되지 않고 있는데 이는 법률적, 제도적으로 해결하지 못한 과제가 남아있기 때문이다. 특히 볼레로 선화증권의 경우에는 도입초기에 개별국가의 전자무역사업자들과의 협업사업모델을 제시하지 못하여 제대로 이용되지 않고 있는 실정이다. 국제적으로 볼레로 선화증권의 운영이 제대로 이루어지 않고 있는 상황에서 한국 상법에서는 전자선화증권의 등록기관 지정제도를 도입하여 현재 KTNET이 법무부에 의해 등록기관으로 지정되어 있으며 전자선화증권 서비스를 개시하였다. 그러나 한국의 상법모델은 볼레로 선화증권보다 글로벌차원에서 많은 문제점을 안고 있다. 이러한 문제점은 또한 등록기관 지정제도상의 특징과도 연관되어 있다. 따라서 본 논문은 한국 전자선화증권 등록기관 지정제도를 살펴보고 지정제도 상의 특징을 도출하고 그 특징과 관련된 이슈와 문제점을 규명함으로써 한국에서 전자선화증권이 보다 활성화되는데 그 연구목적을 두고 있다.

A Study on Change of Logistics Environment in Northeast Asia and Logistics Hub Strategy of China

  • Purpose - The purpose of this study is to find out how shipping company recognizes making partnership with the third party logistics provider and to give implication. Research design, data and methodology - Personal interview and questionnaire by E-mail, Fax, Mail, and telephone were used. 700 copies of the questionnaires were distributed and 155 copied were returned. Among collected questionnaires, 20 copies were excluded because of insufficient content, and therefore 135 copies were used. Results - Korea should change into new paradigm from old one based on current economic and social systems which has stemmed from bureaucracy, inflexibility chauvinism and equalitarianism. Flexible policies, administration and systems will be needed for better business practices. The Domestic logistics corporation needs to preoccupy strategic logistics hub and network. Conclusions - To be a center of North East Logistics, Korea needs more reasonable business law, systems and policies. Social norms and orders should be established to accomplish political and social security. A paradigm of the policy ruling over development of capital city and satellite cities shall make change.

국제무역거래에서의 전자결제시스템 도입에 따른 과제 (Requisites for Adopting Electronic Payment Systems in International Trade Transactions)

  • 본 논문은 전자무역거래의 환경하에서 활용될 수 있는 전자결제시스템의 유형과 현재 제공되고 있는 국제전자결제시스템의 활용상의 문제점을 살펴 보고 전자무역을 활성화할 수 있는 전자결제시스템의 발전방안을 모색하는데 그 목적을 두었다. 현재 전자무역거래에서 활용될 수 있는 전자결제시스템은 전자화폐(electronic cash), 전자수표(electronic check), 전자자금이체(electronic fund transfer), 트레이드카드(tradecard) 및 스위프트 시스템에 의한 전자신용장(electronic L/C by SWIFT system) 등이 있다. 하지만 이들에 대한 전자결제시스템의 보안성, 안정성 및 연동성을 포함하는 제도와 인프라가 제대로 구축되고 있지 않아 사용하는데 한계성을 가지고 있다. 따라서 아직 정착되고 있지 못한 국제전자결제시스템의 발전을 위해서는 정보보안기술과 인증시스템의 구축이 필요하고, 걸제서류가 전자문서로 교환될 수 있도록 해야 한다. 또한 스위프트시스템의 네트워크를 스위프트넷에 의하여 모든 당사자간에 연동시켜 안정성 있게 운용되어야 하고 기업간 거래를 위한 전자신용장을 정착시켜야 한다. 이와 더불어 전자결제와 관련된 법적${\cdot}$제도적인 국내외 인프라를 구축하여 국제전자결제시스템의 통합적 지침을 제공할 수 있도록 해야 할 것이다.

  • 온라인 및 무선 통신은 콘텐츠 산업 시장을 획기적으로 변화시켰다. 유통 채널이 서점에서 스마트 플랫폼으로 이동함에 따라 거래가 즉각적으로 이루어져 제작자에게 새로운 크고 작은 기회가 제공되었다. 그러나 그러한 기회는 산업 생태계의 불균형을 초래한다. 창의적 중소기업의 성장이 중요한 콘텐츠 산업 특성상, 산업의 건전성과 다양성을 보장하기 위해서는 콘텐츠 저작권에 관한 공정거래 규칙이 필요하다. 하지만 산업의 몇몇 구조적 특성이 이러한 규칙의 시행을 어렵게 한다. 첫째, 콘텐츠 업계는 주요 출판사들처럼 다수의 중소 판매업자들로 이루어져 있다. 둘째, 구글과 같은 플랫폼 회사 등 최종 판매자들은 독점적 지위를 보유하고 있다. 셋째, 콘텐츠에 대한 경제적 가치 평가도 어렵다. 기업 인수의 측면에서 보면, 저작권 거래는 (1) 라이선스(권리위임) 모델, (2) 원시취득 모델, (3) 수요독점 모델로 분류가 가능하다. 이 연구는 출판업계에서의 주요 법령과 각 모델 별 적용 방식에 대해 알아본다. 한국과 미국의 법령, 판례분석, 공정거래위원회(FTC)의 심결들을 분석하여 저작권 거래의 공정성/불공정성 평가 기준을 제시한다. 나아가 이 연구는 콘텐츠 저작권의 공정한 거래를 제고하기 위하여 콘텐츠 산업의 일반적 관행을 개선하기 위한 가이드라인을 제시함으로써 출판산업 생태계가 발전하기를 기대하는 바이다.

자유무역지역 제도비교를 통한 마산항 발전방향 (The development of Masan Port through comparison of Free Trade Zones)

  • The purpose of this paper is to investigate CFZ(custom free zone) and FTZ(free trade zone) in Korean FTZ System and develop Masan Port in Korea Local Port. The main point of this discussion is to approach the efficient method ill developing Masan Port through comparison CFZ and FTZ. For this purpose, this paper is searched the present situation of logistics in Korea and Northeast Asia, also discussed the concept of FTZ in international status. Then CFZ accepted by Korean government started from the concept of FTZ and is the logistic-centered FTZ in the middle of three model, production-centerde model, production-logistic combination, and logistic-centered FTZ. But CFZ in centering logistic excepted the fundamental manufacture in Korean production. and is almost the same about other various sides, i. e. law and enforcement ordinance. etc This problem is decreasing the efficiency in Korean commercial system. Thus this paper indicate the view point and rightness of region economic through study of FTZ and CFZ in Masan Port. This paper says that FTZ is better then CFZ in Masan Port with comparing superior position about economic development direction, industrial structure, Foreign investment attraction, business fluctuation, national-local renovation. Therefore this paper concludes that the development of Masan Port needs the effort as follow : first, Masan Port must apply in enlarging FTA into Free Tree Area. Second, the government must develop the high-density and medium-small scale in Masan Port. Third, the local government must promote the amount of demand in Masan Port logistic. Forth, the government must actively propel great-sphere development in present Masan Port.

A Study on the Problems and Countermeasures Relative to Negotiation Clause under L/C Transactions in the UCP 600

  • Purpose - The UCP is recognized as the governing law for L/C transactions, but it covers only the general details of the transaction and does not cover all complex practices. In view of this limitation, this paper examines a negotiation transaction which is most actively utilized in L/C transactions via a thorough review of the UCP provisions, analyzes the problems of the negotiation clause in the UCP, and suggests appropriate countermeasures to deal with unnecessary litigation costs. By doing so, the parties involved in the negotiation transaction would be able to avoid financial costs such as having to pay for lawsuits. Design/methodology - The present study first differentiates the general types of L/Cs (e.g., sight payment L/C, deferred payment L/C, acceptance L/C, and negotiation L/C), explains and the Article 2 and Article 12(b) of the UCP 600 where the term 'negotiation' is used, digs into the drawbacks of 'negotiation' occurring under the UCP 600, and discusses solutions to the problems found by analyzing the drawbacks descriptively. Findings - After a review of the UCP provisions on negotiation in detail, several possible problems which may occur in practice were discovered. First, as the UCP stipulates, the negotiating bank will want to delay payment to the maximum extent possible and make payment on the banking day on which the issuing bank reimburses the amount. This may lead the beneficiary towards bankruptcy or put it in financial crisis. Second, when a fraudulent transaction occurs, the negotiating bank can neither request the issuing bank to reimburse nor can it exercise its recourse right against the beneficiary because it has obtained all the rights of the beneficiary by purchasing the documents. Third, there is a practice in which the beneficiary sells the documents to its transaction bank which is not the nominated bank if the nominated bank specified in the credit is located in a third country or the exporter has no relationship with the nominated bank in the credit. In this case, whether to accept this and reimburse the non-nominated negotiating bank entirely depends on the issuing bank's decision even though such practice frequently occurs in Korea. Originality/value - There has been little research effort pertaining to negotiation transactions in detail even though negotiation L/C transactions account for around 70% in world trade notwithstanding deferred payment L/Cs and acceptance L/Cs that are also negotiated in practice. Thus, if the negotiations clause under the UCP 600 provisions were reviewed and the drawbacks of the negotiation transactions most actively used in L/C transactions were identified and examined, specific countermeasures could ultimately help smoothen the operation of L/C transactions and prevent financial losses.

스팸규제에 관한 연구 (A Study on Spam Regulation)

  • 스팸으로 인하여 우리 사회가 지출해야 하는 경제적 부담은 정보의 자유로운 유통으로 누릴 수 있는 이익을 상회한다고 볼 수 있다. 그리고 현재 이메일, 휴대폰 SMS 등을 통한 영리목적의 광고성 정보전송 행위에 대한 규제가 정보통신부와 공정위원회로 이원화되어 있으므로 $\ulcorner$정보통신망 이용촉진 및 정보보호 등에 관한 법률$\lrcorner$상 스팸규정에서 일부 공정위 소관법률 적용대상자를 예외로 하거나 동일의무에 대해 중복규제하는 등 법률의 분리로 인한 국민 불편 및 형평성 문제가 발생하고 있다. 이에 스팸규제와 관련된 국외의 환경 및 동향 등에 대한 비교 분석과 함께 포털사이트나 이동통신 등 정보통신망제공 사업자의 자율재량에 맡긴 스팸방지활동은 한계가 있기 때문에 동 사업자의 스팸 방지에 대한 기술적 조치 및 서비스제한, 신원확인 등 법적 의무화에 대한 검토가 필요하기에 본 연구는 국내 최적의 광고성 정보 규제법규의 형식 및 내용을 도출하기 위하여 국내 타 관련 법률 및 산업 환경 전반을 고려하여 스팸규제 범위를 명확히 하고, 스팸 행위뿐만 아니라 영리목적의 광고행위 전반을 포괄하는 법률 제정방안 수립하며, 기타 현 정보통신망 이용촉진 및 정보보호 등에 관한 법률 개정 또는 광고성 정보전송 규제 단일법 제정시 필요사항을 도출함을 목적으로 한다.

The Buyer's Remedies for Lack of Conformity under the PELS

  • This article attempts to describe and analyze the rules on the buyer's remedies for lack of conformity under PELS. It shows that such remedies under the PELS operate in a two-tier remedial scheme which is alien to both domestic and international legal systems. That is, repair and replacement take the position of primary remedy, whereas termination, price reduction and damages are secondary remedies which are available only where the primary remedies cannot be invoked. Notwithstanding its superiority, the PELS have some drawbacks in several aspects. First, the PELS seems to place its focus on the factor of cost except the other factors, for instance, the significance of the lack of conformity, when one decides whether the first tier remedies cause the seller unreasonable effort or expense. It is argued that the factors can be considered by referring to art. 1:302 PECL. Second, the PELS does not expressively provide any exclusion of the seller's right to choose between repair or replacement on the basis of unreasonable uncertainty in reimbursing the expenses advanced by the buyer. It argues that if there is such uncertainty, it should be regarded as causing the buyer an unreasonable inconvenience under art. 4:204(1). Third, the PELS does not seem to properly reflect the consumer's interests in that most consumers prefer to have the absolute right of termination as against the commercial sellers who have a relatively stronger bargaining position. The reasons for that is that there is a big hurdle, i.e., a hierarchy of remedies, to be overcome by the consumer to battle with the commercial seller, and that unavoidable vagueness in defining a minor lack of conformity has been often used against the consumer, but in favour of the commercial seller with a strong bargaining position.

Research on Construction of the Logistics Legal System in CJK FTA

  • With CJK FTA as a starting point, this paper mainly studied the role of the logistics legal system in promoting marine industrial cooperation, facilitating investment trade, establishing international transport logistics, building marine economy international cooperation demonstration zone and deepening the economic and financial cooperation between China, Japan and Korea, and explored the way to establish an integrated logistics system between China, Japan and Korea to match the e-commerce certification system, online payment system and logistics distribution, thereby gradually promoting economic development and logistics integration in Northeast Asia, improving logistics efficiency, reducing logistics costs and establishing a unified logistics industry standardization system. This will accelerate logistics industry integration in Northeast Asia, build a unified logistics management center in Northeast Asia, and promote a new model of integrated logistics cooperation in Northeast Asia. Therefore, it has a practical and reference significance. In short, the improvement for the logistics legal system in CJK FTA is not the responsibility of a country or several countries. It concerns the development and prosperity for the logistics industry in the three countries and is an inevitable choice to promote the vigorous development of CJK FTA and economic take-off of each country.
