A Study on the coverage of e-commerce insurance (전자상거래 보험의 담보범위에 관한 고찰)

  • Todays, computers in business world are potent facilitators that most companies could not without them, while they are only tools. They offer extremely efficient means of communication, particularly when connected to Internet. What I stress in this article is the risks accompanied by e-commerce rather than the advantages of Internet or e-commerce. The management of e-commerce companies, therefore, should keep in mind that the benefit of e-commerce through the Internet are accompanied by enhanced and new risks, cyber risks or e-commerce risks. For example, companies are exposed to computer system breakdown and business interruption risks owing to traditional and physical risks such as theft and fire etc, computer programming errors and defect softwares and outsider's attack such as hacking and virus. E-commerce companies are also exposed to tort liabilities owing to defamation, the infringement of intellectual property such as copyright, trademark and patent right, negligent misrepresent and breach of confidential information or privacy infringement. In this article, I would like to suggest e-commerce insurance or cyber liability insurance as a means of risk management rather than some technical devices, because there is not technically perfect defence against cyber risks. But e-commerce insurance has some gaps between risks confronted by companies and coverage needed by them, because it is at most 6 or 7 years since it has been introduced to market. Nevertheless, in my opinion, e-commerce insurance has offered the most perfect defence against cyber risks to e-commerce companies up to now.

Consumer protection in e-commerce: the Safety Transaction Service in Korea (전자상거래에서 소비자 보호방안에 관한 연구)

  • To accommodate the rapid growth of e-commerce transactions, non-face-to-face transactions, businesses use a wide variety of payment methods. However, many of these payment mediums are not secure as shown by increases in fraudulent transactions. In this paper, we analyze a particular e-commerce transaction medium, the Safety Transaction Service (STS). This system protects consumers through a wide variety of safeguards: safety settlement systems (escrow), consumer damage compensation insurance, payment guarantee, and secure bank settlement. In contrast to the safeguards, we identify the limitations and concerns with the STS and potential legal and political improvements. The plethora of payment methods limits the consumers ability to distinguish between the secured and unsecured transaction services. Regulation and consumer based verification of transaction services are essential to root out dangerously fraudulent systems. We propose the development of specific standards to these systems, in particular the need for consumer confirmation and clear settlement documentation. Only through the active promotion of scrutiny and improvement to STS will consumers be protected in e-commerce.

  • The development of IT expanded the scale of e-commerce, and grew large Internet shopping malls. As having raised the consumers' interest in overseas direct purchase(ODP) recently, the number and purchasing amount of ODP are constantly increasing. However, consumers need to pay attention to the potential problems which might happen by consumer's damage and conflict, as increasing the consumption through ODP. Because consumer's damages on utilizing ODP happen to the reason such as the trust problem between business and consumer due to the way which traded non face to face, non-compliance of goods delivery, returns, and refunds, and information asymmetry of items, a large number of consumer's damages in a wide range are much more likely to occur nowadays. The purpose of this study is to analyze the current state of ODP, and propose consumer damage's reduction and policy of the government through pre or post scheme for consumer damage's relief and consumer protection. As the compensation for consumer damages is actually inadequate, this study proposed a feasible alternative to the adoption of e-commerce insurance for both aggressive compensation and protection for consumer's damages and risk transfer and sustainable development of e-commerce.

  • On payment of the insurance money the insurer is entitled to be subrogated to all right and remedies of the assured in respect of the interest insured in so far as he has indemnified the insured. The purpose of subrogation is to prevent the assured from recovering more than once for the same loss, e.g. where goods are lost owing to a collision, the assured cannot claim the insurance money from the insurer and then sue the owners of the ship that negligently caused the collision. Under the doctrine of subrogation the right to sue owners of the negligent ship passes from the assured to the insurer on payment of the insurance money. The insurer is subrogated to the assured 'rights against the carrier under the contract of carriage. To defeat the cargo underwriters' subrogation righters, the carriers inserted in their B/L a clause allowing the carriers to have the "benefit of the shipper's insurance. But, in the Hague Rules, Hamburg Rules, Rotterdam Rules, its makes void any clause that assigns a benefit of insurance of the goods in favour of the carrier. In practice the insurer asks the assured to sign a letter of subrogation and retains the documents in order to prosecute the rights subrogated to him.

A Study on the Outcome of International Trade Practice in Commitment of Electronic Trade (전자무역의 몰입이 무역업무성과에 미치는 영향에 관한 연구)

  • This study tried to analyzed the relationship outcome and commitment in order to suggest to a outcome for commitment decision-making of e-trade. 6 hypothesis were constructed for analysis based on previous literature review. The subject of this study is to analyse on electronic trade practice outcome on the international trade practice commitment. This paper investigates the outcome determinants of e-trade commitment. There are 250 sended samples and 188 returns, 168 of them are analyzed on commitment for a electronic trade outcome. The first, multiple regression result shows that the international trade practice outcome are positively affected by the "Overseas market research commitment", "e-L/C Practice commitment", "Clearance Practice commitment", "e-B/L or global logistic commitment", "Payment or e-Nego commitment". However, The "Commerce practice commitment" factors does not affect in the electronic trade practice outcome.

  • Korean Government has provided special support to Korean export industry during past 40 years. However, due to the agreement on UR and appearance of WTO, the Government can't provide most of the subsidies which were allowed before WTO era. Hence, export insurance system became more useful tool since it's one of the few allowed subsidies under WTO. This study tries to find the impacts of export insurance systems on the exports in Korea, the United States, and Japan. Firstly, this study surveyed the export insurance systems of Korea, the United States, and Japan. Then, using a regression analysis it analysed the effects of export insurance systems upon the exports in Korea, the United States, and Japan respectively. The period of data is from 1980 to 1999. The results of the regression analysis for export insurance showed significant and positive effects of both Korean and Japanese but the United States showed insignificant and positive upon the exports.

  • Recently, most online firms are trying to provide personalized services based on customer's data. However, customers are reluctant to give their information to online firm because of concerns about data breach. Online firms are seeking to increase their trust by ensuring the protection of personal information for customers through privacy seal (e.g. e-privacy) or data breach insurance. This research examines the effects of privacy assurance(i.e. privacy seal, data breach insurance) on consumer behavior in online environment. An experiment based on the hypothetical scenario was conducted using a between-subjects 2 (type of privacy assurance) + 1 (control) design. We found that both privacy seal and data breach insurance increased perceived privacy trust. In addition, privacy seal has a positive effect on the intention to provide personal information through perceived privacy trust. Finally, in the case of the group with a high (low) disposition to trust, higher perceived privacy trust is formed through privacy seal (data breach insurance). Theoretical and practical implications are discussed.

  • 전자무역거래는 궁극적으로 무역계약체결천의 마케팅과 인콰이어리는 물론 무역계약과 계약 이후의 운송, 보험, 결제 등을 네트워크를 통해 실현하고자 한다. 그러나 무역거래의 전 단계의 전자화 추진에 있어 가장 큰 걸림돌은 국제대금결제시스템을 전자화하는 것이며, 이러한 문제점의 해결은 궁극적으로 전자무역거래의 완성이라고 해도 과언이 아닐 정도로 전자무역 구현에 있어서 시급하고도 중요한 핵심과제가 되고 있다. 이에 본 고에서는 전자무역시대를 맞이하여, 전자무역거래에서 전자결제시스템으로 주목받고 있는 BOLERO, TradeCard, 그리고 BeXcom의 주요 내용과 특징을 살펴보고, 상호간 비교 분석을 통하여 전자결제시스템의 발전적 과제를 제시하고자 한다.

  • The Internet is also fragmenting containers of goods that could have been custom cleared on a single entry into dozens of individual shipments that each require separate customs documents and clearance procedures. The policies of Korean government could promote the e-business environment and market conditions in legal and infrastructure terms, but not much of business itself. The facilitation of trade procedures is seen by all major international business as vital for economic development. The purpose of the study is to develop the e-Trade application, limitation and activation. This article intends to derive which factors are significant at information strategic planning stage as well as its evaluation stage. The study include the technical explanations under the ubiquitous computing.
