  • Information and communications technologies are affecting an economic and social transformation of all countries. Without exception international commercial dispute resolution systems are faced with change its mechanism to online technology. Dispute parties can seek redress through arbitration other than litigation or mediation. Traditional dispute resolutions do not match the cyber trade environment which is basically pursuit the speed and efficiency in cyberspace. Arbitration other than resolution methods have been considered to be match with the online environment which is including party autonomy, speed and internationally accepted and binding awards. Traditional arbitration, however is lack of time and different physical location relating all parties. So we now think cyberspace as for the resolving place which is online arbitration. Even the parties exist in different space and time they may meet in the same time and space without moving or trips. Nowadays there are many online arbitration service provider serving the resolution of dispute arising with online transaction. In this paper we study the tendency for online arbitration, the recognize uncertain matters and avoiding programs its matters when use the online arbitration between disputing parties under cyber trade environment.

A Geographical Study on Characteristics of Political Activities in Cyberspace and Interrelationship between Online and Offline: A case of South Korea's Presidential Election in 2012 (가상공간에서의 정치 활동의 특징과 오프라인 환경과의 연계성에 대한 지리적 고찰: 2012년 대통령 선거를 사례로)

  • The goal of this investigation is to examine the matter as to how various cyberpolitical activities such as on-line civic participation, cyber parties, development and movement of civil society networks are appeared in cyberspace; and how political activities in cyberspace are associated with offline environment. This research was based on in-depth and open-ended interviews centering around 20s (32 interviewees) and the major results are as in the following. First, in terms of on-line civic participation, searching political issues occur in places, where internet users can access information easily relatively, and creating or reconstructing political information is identified in places giving stability or affinity to the public society. Second, even though each party's homepage for the channel of cyber parties has enough capacity as bridgespace, which takes charge of supporting f lows of people, goods, capital, and ideas, most of them don't play a role to establish virtual or real networks. Exceptively, cyber parties contribute to make temporalized places, where nobody takes the responsibility, somewhat. Third, the development and movement of civil society networks is divided into several segments according to political interests and tendency in online; furthermore, such a cyberpolitical activity influences human networks and the decision of major places for political activities in offline.

Type and Settlement System of Disputes in Electronic Commerce (전자상거래 분쟁의 유형과 해결제도)

  • Like traditional commerce, disputes are bound to arise in the course of conducting an e-commerce transaction. At present of June 30, 2001, 259 cases of dispute on e-commerce have been applied for the mediation of Electronic Transaction Dispute Mediation Committee, types of them are 170 cases of delayed delivery of commodity, 21 cases of contract cancellation and refund, 16 cases of personal information protection, 16 cases of false and exaggerated advertisement, 14 cases of commodity defect. The settlement systems of e-commerce dispute are litigation and Alternative Dispute Resolution(ADR). ADR encompasses mediation, arbitration, and similar private tools for resolving disputes. ADR offers many perceived advantages. Speed of resolution and low cost are often cited as the primary benefits. Therfore e-commerce disputes may be settled more effectively by litigation. The settlement systems of e-commerce dispute by ADR are the mediation of Electronic Transaction Dispute Mediation Committee, the mediation of Consumer Dispute Mediation Commercial Arbitration Board, and the arbitration of Korean Commerical Arbitration Board. E-commerce sets up the probability that its merchants and customers will not exist in the same legal jurisdictions. The confusing application of laws and wide geographical dispersion of these parties will necessitate a faster and cheaper dispute resolution methodology. Therefore, online ADR may be effective for e-commerce dispute resolution. The examples of online ADR opetation are the cyber mediation of Electronic Transaction Dispute Resolution Committee, the cyber mediation of Korean Commercial Arbitration Board, the cyber mediation of Click N Settle, the online ADR of BBB online, and the cyber arbitration of virtual Magistrate.

Study on the Civil Legal Remedies against Cyber Defamation

  • Cyber defamation is the act of damaging the reputation of the other person on the Internet, and the act of attacking by the commenting the article through a word or blog. The reason why punishment is stronger than general contempt is that the nature of crime about defamation is worse than contempt. Also, punishment intensity is higher than defamation because the nature of cyber information spreads widely. Honor is not only a question of self-esteem or identity, but also a function that economically reduces the cost of seeking information or socially trustworthy. Through these two functions, it has been developed as a legal system to protect the honor as well as asking the legal sanction for defamation. However, although honor is used in various meanings in everyday life, the honor of legal level is understood in a more limited sense. It is because the law cannot actively lead and protect all honor feelings for one's feelings or mood occurred by hurt. However, if the social evaluation of a group or individual is undermined through a certain distortion of the truth, the law will actively intervene. However, due to the ambiguity of the legal sanctions standards and the identification of the parties involved in the defamation of cyberspace, it was difficult to solve the problems related to defamation in fact. Therefore, this paper will try to find out the problems of civil legal remedy due to the cyber defamation, and seek a solution for civil legal remedy.

Design and Implementation of web based cyber counseling system (웹기반 사이버 상담시스템의 설계 및 구현)

  • Many people including teachers and students' parents must assist each student who will be a hero of future to develop their potential abilities and acquire various skills. Counseling is a fundamental thing to achieve this goal. But, in reality, it is usually difficult to do counseling which makes it possible to establish desirable self-view and world view expertly and systema tically because of burdensome task of teachers, spatial and time limit and students' extracurri cular activities. Taking advantages of computer networking, this research was designed to solve various problematic situations we can usually face with in school and home, to reduce limitations among three parties: teachers, parents and students, and to keep record continuously on the process and contents of counseling. And, also, this research is focused to web-based counseling network that makes possible to build database system easily adapts to specialty of each schools. Web based counseling system will provide these advantages: 1. Through analyzing and editing which will be done by expert In of accumulated database, to realize more systematic and expert database will be possible. 2. Owing to the physical characteristic of cyber space, counseling will be done any time and anywhere the computer is. 3. Because it is possible to minimize social limitations on physical condition, communication channel and anonymity of cyber space, counseling will be relatively easy to perform. 4. The contents of counseling will be automatically recorded on the database.

An Improvement of Certification-based One-Round Tripartite Key Agreement Protocols

  • Key agreement protocols allow multi-parties exchanging public information to create a common secret key that is known only to those entities over an insecure network. Since Joux first published the pairing-based one round tripartite key agreement protocol, many authenticated protocols have been proposed. Unfortunately, many of them have been broken while others have been shown to be deficient in some desirable security attributes. In 2004, Cheng et al. presented two protocols aimed at strengthening Shim's certificate-based and Zhang et al.'s tripartite identity-based protocols. This paper reports that 1) In Cheng et al.'s identity-based protocol, an adversary can extract long-term private keys of all the parties involved; and 2) Cheng et al.'s certification-based protocol is weak against key integrity attacks. This paper suggests possible remedies for the security flaws in both protocols and then presents a modified Cheng et al.'s identity-based, one-round tripartite protocol that is more secure than the original protocol.

  • The issue "Exploring Social Media and Other Crucial Success Elements of Attitude towards Politics and Intention for Voting in Pakistan" is a huge study embracing more issues. The politics of Pakistan is basically the politics of semantic groups. Pakistan is a multilingual state more than six languages. There are 245 religious parties in Pakistan, as elaborated by the Daily Times research. The use of social media sites in Pakistan peaked to its maximum after announcement of election schedule by the Election Commission of Pakistan in March 22, 2013. Most of the political parties used it for the recent elections in Pakistan to promote their agenda and attract country's 80 million registered electors. This study was aiming to investigate the role of social media and other critical variables in the attitude towards politics and intention for voting.

  • Roadmap of cyber trade offers members the opportunity to interact electronically with like-mined individuals and to both create and buyer relevant to a topic of interest. Roadmap of cyber trade was conduct on the economic effect of electronic commerce according to the method of constructing the Internet. Firms using cyber trade have difficulty enjoying a uniformly identical effect. That is, since the improvement effect of the intrafirm business method, unnecessary repeated manual paperwork and the use effect of being able to maintain the close relationship with to the parties to trades in the process of prompt receipt and delivery of documents are long-term and indirect effects, they have some limitation in that they can not be measured as coefficients but only as scales. In terms of business management, the intensification of corporate competitiveness improved by $10.00\%$ in case of less than 10 times and by $11.53\%$ in case of 50 to less than 50 times. And it was found that the effect of profit increase as the number of inquiries was large. That is, it was found that the effect of profit increase was $10.88\%$ when the number of inquiries was less than 10 times but it increased to $14.00\%$ in case of 50$\∼$less than 100 times. Therefore, to revitalize cyber trade, it is thought that government, the academic community and the business world all need to make much research into and sustained investment in cyber trade.

  • Off-line ship chartering is done nearly through the brokers. Because of the international scale of chartering market, brokers spend too much times and costs on searching the most appropriate product which the consumers want. In this research, we propose the on-line Charter Product Categorization Model to search the products efficiently in the Cyber Chartering System. This Model will make concerned parties of the ship chartering to get unified product information efficiently, and the select the most appropriate product. In this research, we classified the ship chartering products into categories of cargo, ship type, and sea routes, and defined mutual relation of each products, and we verified that this classification is necessary to search the products through the product searching experiment.

  • The companies' management strategies of the electronic commerce market are different from those of the traditional market. The main difference between the electronic commerce market and the traditional market is an IT network system which is a companies' management strategies in the electronic commerce market. This study focuses on the examination and analysis of the companies' management strategies which are constituted through influence on the effectiveness of the IT network system in the electronic commerce market and Promoting Arbitration System in The Era of Digital Economy this study is to introduce several alternative policies of the Government and companies to such formated IT network system of the electronic commerce market in the future. It's also suggested that the Korean Commercial Arbitration Board (KCAB) fully cover consideration and arbitration, while KCAB for Electronic Commerce activates its proper role of consulting and ad hoc arbitration by using electronic information. E-commerce sets up the probability that its merchants and customers will not exist in the same legal jurisdictions. The confusing application of laws and wide geographical dispersion of these parties will necessitate a faster and cheaper dispute resolution methodology. Therefore, online ADR may be effective for e-commerce dispute resolution. Therefore, a role of arbitration proposed and emphasized. To protect the dispute in advance, it's suggested to revise rules timely following on technical changes, and emphasized that the dispute has to lead to arbitration settlement not for consuming unnecessary time and finance for enterprises and consumers.
