고려초 복식기록에 관한 고찰 - 광종.경종.성종대를 중심으로 - (A Study on the Records of Costume of the Early Koryo Period - Focus on the Reign of King Gwangjong.King Gyeongjong.King Seongjong -)

  • The purpose of this study was to consider the kinds and features of costume and fabrics of the early Koryo period which are mentioned in the records of costume system, royal presents and diplomatic articles at that time ranging from the reigns of king Gwangjong to king Gyeongjong and to king Seongjong. Findings of the study can be summarized as follows. In the 11th year of king Gwangjong's reign, the official costume system was established, which reflected the royal will to independence as an imperial nation. That system also became the basis of the official wage system in king Gyeongjong's reign. In the reigns of king Gwangjong and king Gyeongjong, the monarch granted official uniforms to persons who passed the state examination, directly connecting with new bureaucrats and strengthening the royal authority. Those uniforms were usually worn at a banquet where the monarch and subjects participate together in the early Koryo period. In the reign of king Seongjong, costume and fabrics were positive means of realizing political Confucianism as they were used for bureaucrats who advanced to official position through the state examination. Records issued at that time explain that the monarch presented costume and fabrics in an effort to getting along with officials and civilians of different classes as the state and the royal authority stabilized. Found in the records released in the reigns of king Gwangjong to king Seongjong, the kinds of costume or fabrics at that time include jikseongeuio, gap, yongeui, seupeui, gyegeum baekcheop, geumeunseon gyegeumpoyok and po. The techniques of manufacturing armors in the early Koryo period were probably advanced since the item was a craftwork presented to the court in the reigns of kings Gwangjong and Gyeongjong. Presumedly, baekcheop was a kind of hemp and po. Koryo's native hemp cloth.

  • 국립중앙박물관 소장 <무라사키노 자일 놀이(紫野子日遊圖)·오이강 유람도 병풍(大井川遊覽圖屛風)>(이하 국박본으로 지칭)은 일본 교토 궁정의 화사(畫事)를 전담한 직책인 에도코로아즈카리(繪所預)였던 도사 미쓰요시(土佐光芳, 1700~1772)의 묵서와 인장을 지닌 김병풍(金屛風) 한 쌍이다. 이 병풍은 국립중앙박물관이 2018년 미국 뉴욕에서 구입한 것으로, 판매자에 따르면 20세기 초 어느 시점에 일본에서 미국으로 건너왔으나 그 자세한 시점은 불명이라고 한다. 여섯 면의 두 폭 한 쌍으로 이루어진 이 병풍은 오른쪽 병풍에 새해 정월 자일(子日)에 야외로 나가 어린 소나무 묘목을 채집하는 궁중 행사인 '자일 놀이(子日遊)'의 장면을, 왼쪽 병풍에 교토 오이강(大井川)에 한시(漢詩), 와카(和歌), 관현(管弦)을 의미하는 세 척의 배를 띄워 유람했다는 '세 척의 배(三船の才)' 고사 장면을 그렸다. 이 작품은 훗코야마토에(復古やまと繪) 장르를 대표하는 화가인 우키타 잇케이(浮田一蕙, 1795~1859)가 고메이 천황(孝明天皇, 1831~1867)의 명으로 제작한 교토 센뉴사(泉涌寺) 소장 <무라사키노 자일 놀이(紫野子日遊圖)·오이강 유람도 병풍(大井川遊覽圖屛風)>(이하 센뉴사본으로 지칭)과 화제와 도상이 일치한다. 단독 작품으로 제작된 사례는 다수 찾을 수 있는 '자일 놀이'와 '오이강 유람' 화제가 서로 짝을 이루어 한 작품으로 제작된 작례는 현재까지 국박본과 센뉴사본뿐이다. 부케덴소(武家傳奏) 히로하시 가네타네(廣橋兼胤, 1715~1781)의 일기인 『히로하시가네타네코부고요닛키(廣橋兼胤公武御用日記)』에 따르면 1760년, 미쓰요시는 1709년(보영도(寶永度))에 건축된 교토 고쇼(御所)의 전각인 쓰네고텐(常御殿) 내부의 낡은 후스마에(襖繪)를 새 것으로 교체하는 임무를 맡았다. 미쓰요시는 이때 국박본의 주제와 도상을 구상할 기본 자료를 얻었다고 생각된다. 당시 쓰네고텐 내부에는 가노파 화가가 그린 '봄날의 야외 행차(春日野行幸)'와 '오이강을 떠다니는 세 척의 배(大井川逍遙三艘)'라는 화제의 후스마에가 연속되어 배치되어 있었다. 미쓰요시는 1760년 쓰네고텐 후스마에 교체 작업을 통해 '오이강 유람' 화제의 도상을 학습하고 '자일 놀이'와 '오이강 유람' 화제를 서로 짝을 지어 한 쌍의 병풍으로 제작한다는 구상을 하게 된 것으로 보인다. 새해 정월 첫 자일에 어린 소나무를 채집하는 행위는 장수(長壽)를 기원하는 길상적인 의미를 가진다. 오이강에 각각 한시, 와카, 관현을 의미하는 세 척의 배를 띄워 유람했다는 '세 척의 배' 고사는 교토 궁정의 필수 교양인 한시, 와카, 관현의 삼재에 모두 능통한 인재를 뜻한다. 이처럼 길한 주제의 병풍이 소용되는 자리로는 천황의 즉위식을 제일 먼저 고려할 수 있다. 본 논문에서는 교토 궁정 관련 화사를 전담했던 도사 미쓰요시가 천황 즉위식이나 연중행사 등 궁정 의례에서 사용할 목적으로 국박본을 제작했을 가능성을 제시해보고자 한다.

  • 2018년 주요 판결 중에는 법리적으로 새로운 판결을 발견하기 어려운데, 이는 어느 정도 법리가 확립되었고, 손해배상이라는 틀 안에서 주로 사실관계에 대한 다툼에 집중하기 때문인 것으로 이해된다. 과실판단이 심급끼리 상반된 사례들은 그 사유와 법리를 이해하는데 도움이 되었으며 갈수록 의료소송에서 다툼이 치열해짐을 확인할 수 있었다. 책임제한을 하지 않은 판결들과 의무기록기재 관련 판결 등도 눈에 띄었는데, 특히 의무기록 기재 관련 판결들이 상당히 증가한 것으로 보인다. 이는 당사자들이 의무기록 관련 의문을 제기하는 사건들이 늘어나는 현상의 일환으로 생각되고 이번 기회에 몇 개판례를 분류하여 소개하였다. 장기입원환자의 퇴거 및 진료비 청구 사례는 의료과실로 인한 후유증 치료에 소요된 진료비는 환자에게 청구할 수 없다는 취지의 대법원의 판결 이후 퇴원 거부와 장기입원을 하는 환자들이 늘어가는 현실에서 법리적으로 관심이 가는 판결이어서 소개하였다.

조선시대 과두(裹肚)에 관한 연구 (A Study of Gwa-du (裹肚) in the Joseon Dynasty)

  • Gwa-du(裹肚), name of a garment, appears often from documentary records of Joseon Dynasty. It is assumed as one of the upper garments for men, and according to the record, it was worn as a set with Dan-ryung(團領), Dap-ho(搭胡), Chul-rik(帖裏), Han-sam(汗衫), pants and socks. After the Japanese Invasion of Korea in the 17th century, it changes to a shape of wrapping clothes with straps at four corners, and used to cover the stomach of a corpse like sash. From 16th-17th century, before the Japanese Invasion of Korea, the excavated costume shows a clothing which takes a role of Jegori, longer than Han-sam(汗衫) and shorter than Po(袍). In this study, this clothing is called Gwa-du(裹肚). This study examined the usage and shape of Kwa-du from some documentary records- "朝鮮王朝實錄-The Annals of the Joseon Dynasty", "禮書- Book of Manners", "宮中件記- Googjoonghalkee, recording court goods and commodities lists" and more with actual clothing. Kwa-du is presumed to have changed to men's Jegori So-chang-ui(小氅衣) after 17th century.

2020년 주요 의료판결 분석 (Review of 2020 Major Medical Decisions)

  • 2020년에 선고된 주요 판결들 중에는, 독감 및 코로나 백신 접종 부작용으로 시의성이 있는 아나필락시스와 관련하여 의료진의 과실을 인정한 사례와 부정한 사례가 있었고, 기존에도 판례를 통해 인정된 적은 있지만 드문 사례로서 수인한도를 넘어설 만큼 불성실하게 진료를 한 경우 그러한 과실을 별도의 불법행위로 인정하여 위자료 지급을 인정한 판결이 선고되었다. 또한, 손해배상 범위 산정과 관련하여, 맥브라이드를 기준으로 노동능력상실률을 산정해온 관행을 깨고 항소심에서 대한의학회 장애평가기준에 따라 장해율을 산정한 판결이 있었으며, 전화 진료를 비롯한 원격의료는 의료법상 허용되지 않는다는 대법원의 입장을 명확히 하였다는 점에서 의미 있는 판결이 있었다. 설명의무에 관하여는 확립된 법리 위에 개별 사건에서 설명의무 이행 여부를 판단하는 구체적 기준에 관한 세부적인 내용이 더해지는 과정으로 보이며, 진료기록 기재와 관련하여서는 사후기재의 의심이 강하게 들더라도 증명방해에 해당하지 않는다고 판단하였다. 그 외에도, 사실관계가 동일함에도 심급에 따라 과실 및 인과관계 판단이 달라진 판결들에서 원심판결과 대상판결의 차이점을 비교하였으며, 최근 의사의 업무상과실치사상에 대하여 실형이 선고되는 사례가 늘고 있는 상황에서 1심에서 실형을 선고하면서 구체적으로 그 이유에 관하여 설명한 판결을 다루었다.

공공영역의 2004년 대통령 탄핵사건 기록 (A Study on the Records of Presidential Impeachment in 2004 in the Public Domain)

  • 2004년도에 발생했던 대통령 탄핵사건의 의미는 다양한 맥락에서 해석될 수 있겠지만 그 명분에 해당하는 성격은 무엇보다도 국내의 탄핵제도에 의한 헌법재판 사건이었다. 본 논문은 이러한 "공적 활동으로서의 탄핵사건"이라는 성격을 중심으로 사건에 관한 이해와 관련된 기록들의 현황을 비교분석하는 내용을 담고 있다. 이러한 목적에 따라 먼저 공적활동으로서 탄핵사건을 이해하기 위한 탄핵사건 분석을 시도하였으며 그 결과를 바탕으로 공공영역에 존재하는 탄핵사건 기록현황을 직접방문, 전화면담, 정보공개청구의 방법으로 조사 분석한 내용을 기술하였다. 공적활동으로서 탄핵사건은 국내의 탄핵제도의 규범 아래 탄핵소추를 담당하는 국회와 탄핵심판을 담당하는 헌법재판소가 헌법 등에 명시된 고유한 권한을 중심으로 진행하는 활동으로 이해할 수 있다. 또한 피소추자인 대통령과 탄핵소추에 의해 생성된 대통령권한대행체제 그리고 탄핵의 결정적 사유를 제공한 중앙선거관리위원회 역시 공적 활동의 주요한 주체로서 식별되었다. 또한, 공공영역의 경우 법적인 요건에 해당하는 기록들이 잘 생산되어 현재 보존 관리되고 있음을 확인하였다. 하지만 탄핵사건 기록이 주로 표면적인 처리과정과 명시적 활동의 결과에 관한 것들이 주를 이룸으로써 업무와 관련되어 내용적으로 철저하게 생산되었다고 보기는 어려웠다고 평가하였다. 특히, 활동의 맥락을 보여주는 기록들의 부재를 확인할 수 있었다.

ANALYSIS OF THE LUNAR ECLIPSE RECORDS FROM THE GORYEOSA

  • In this paper, we study the lunar eclipse records in the Goryeosa (History of the Goryeo Dynasty), an official history book of the Goryeo dynasty (A.D. 918 - 1392). In the history book, a total of 228 lunar eclipse accounts are recorded, covering the period from 1009 to 1392. However, we find that two accounts are duplications and four accounts correspond to no known lunar eclipses around the dates. For the remaining lunar eclipses, we calculate the magnitude and the time of the eclipse at different phases using the DE406 ephemeris. Of the 222 lunar eclipse accounts, we find that the minimum penumbral magnitude was 0.5583. For eclipses which occurred after midnight, we find that some accounts were recorded on the day before the eclipse, like the astronomical records of the Joseonwangjosillok (Annals of the Joseon Dynasty), while others were on the day of the lunar eclipse. We also find that four accounts show a difference in the Julian dates between this study and that of Ahn et al., even though it is assumed that the Goryeo court did not change the dates in the accounts for lunar eclipses that occurred after midnight. With regard to the contents of the lunar eclipse accounts, we confirm that the accounts recorded as total eclipses are accurate, except for two accounts. However, both eclipses were very close to the total eclipse. We also confirm that all predicted lunar eclipses did occur, although one eclipse happened two days after the predicted date. In conclusion, we believe that this study is very helpful for investigating the lunar eclipse accounts of other periods in Korea, and furthermore, useful for verifying the calendar dates of the Goryeo dynasty.

Cultural Archetype Contents for the Traditional Wedding

  • This research aims to perform a contextual study of the wedding customs, wedding procedures, and wedding costumes included in Korean traditional wedding culture, making use of cultural contents which form cultural archetypes. The range of wedding customs studied are set limits from the Joseon dynasty to ancient times, and, for wedding procedures and costumes, to the Chosun dynasty, when a wedding ceremony became the norm. Only wedding ceremonies performed among ordinary classes are included as subjects for this research; wedding ceremonies and costumes for court are excluded. The cultural archetypes developed within these boundaries suggest prior cultural content, developed beforehand. The research methods are focused on document records inquiry and genre paintings during the Joseon era, using museum resources as visual materials. The following is the outcome of this research: Firstly, wedding customs and procedures observed among folk materials are presented in chronological order. Secondly, the brides' and grooms' wedding costumes are also presented chronologically, differentiated by class-characteristics.

장서각 소장 사찬발기를 통한 조선왕실의 사찬음식 연구 - 탄일, 출산, 가례, 상례를 중심으로 - (A Study on Joseon Royal Cuisine through Sachanbalgi of the Jangseogak Archives - Focusing on Royal Birthday, Child birth, Weddings and Funerals-)

  • This study investigated the Sachanbalgi, which record the royal feasts given by the royal family of the Joseon Dynasty of Korea. These records are contained within the Gungjung Balgi, which recorded the types and quantity of items used in royal court ceremonies. The Eumsikbalgi is the general name for the records of food found within this document. Using these Eumsikbalgi, and in particular the Sachanbalgi, this study investigated the food eaten and bestowed by the Joseon royal family. The Sachanbalgi describes four categories or occasions of feasts: royal birthdays, childbirth, royal weddings, and funerals. These records allow us to reconstruct who the attendees were and what the table settings and food were for instances not directly indicated in oral records, books, or other documents. The food at these Sachan (feasts) was diverse, being related to the specific event, and its contents varied based on the position of the person who was receiving the food. Usually, Bab (rice) was not found at a Sachanbalgi, and only on two occasions were meals with Bab observed. Specifically, it was served with Gwaktang (seaweed soup) at a childbirth feast. There were seven kinds of soups and stews that appeared in the Sachanbalgi: Gwaktang, Yeonpo (octopus soup), Japtang (mixed food stew), Chogyetang (chilled chicken soup), Sinseonro (royal hot pot), and Yukjang (beef and soybean paste). Nureumjeok (grilled brochette) and Saengchijeok (pheasant), and Ganjeonyueo (pan-fried cow liver fillet) and Saengseonjeonyueo (pan-fried fish fillet) were eaten. Yangjeonyueo, Haejeon, Tigakjeon (pan-fried kelp) and other dishes, known and unknown, were also recorded. Boiled meat slices appeared at high frequency (40 times) in the records; likewise, 22 kinds of rice cake and traditional sweets were frequently served at feasts. Five kinds of non-alcoholic beverages were provided. Seasonal fruits and nuts, such as fresh pear or fresh chestnut, are thought to have been served following the event. In addition, a variety of dishes including salted dry fish, boiled dish, kimchi, fruit preserved in honey, seasoned vegetables, mustard seeds, fish, porridge, fillet, steamed dishes, stir-fried dishes, vegetable wraps, fruit preserved in sugar, and jellied foods were given to guests, and noodles appear 16 times in the records. Courtiers were given Banhap, Tanghap, Myeonhap, wooden bowls, or lunchboxes. The types of food provided at royal events tracked the season. In addition, considering that for feasts food of the royal household was set out for receptions of guests, cooking instructions for the food in the lunchbox-type feasts followed the cooking instructions used in the royal kitchen at the given time. Previous studies on royal cuisine have dealt mostly with the Jineosang presented to the king, but in the Sachanbalgi, the food given by the royal family to its relatives, retainers, and attendants is recorded. The study of this document is important because it extends the knowledge regarding the food of the royal families of the Joseon Dynasty. The analysis of Sachanbalgi and the results of empirical research conducted to reconstruct the precise nature of that food will improve modern knowledge of royal cuisine.

Assessment of Legal Instruments and Applicability to the Use of Electronic Bills of Lading

  • Purpose - This study mainly investigates two potential legal regimes expected to govern the use of electronic bills of lading: the Rotterdam Rules (2009) and the UNCITRAL Model Law on Electronic Transferable Records (2017). Widespread use of electronic bills of lading has been unsuccessful partly due to the absence of a uniform legal regime and protracted uncertainties. This paper aims to carry out an assessment of the possibilities where either of two potential legal regimes could provide certainty to the effect and validity of the use of electronic bills of lading, and contribute to the facilitation of electronically transferring the rights to goods carried by sea. Design/methodology - This paper first introduces two legal instruments and the relevance to electronic bills of lading. Since neither of these legal instruments has yet entered into force, the following section looks into the ratification or enactment possibilities based on a literature review and track records of the past legal regimes of the same kind. Assessment of the different adoption possibilities further requires comparative work of the two legal instruments, which will be based on an analysis of relevant provisions and a literature review. The literature review on the Rotterdam Rules delves into various studies and data produced since the UNCITRAL's adoption in 2009. The literature review on the UNCITRAL Model Law on Electronic Transferable Records heavily relies on UNCITRAL working group documents from 2011 to 2017 together with the final explanatory note. Findings - The main findings can be summarized as follows. Application of the Rotterdam Rules would negate the role of the UNCITRAL Model Law on Electronic Transferable Records assisting in the implementation of the Rotterdam Rules due to some conflicting issues. Enactment of the UNCITRAL Model Law alone can sufficiently provide a higher level of certainty in the use and effect of electronic bills of lading so long as lawmakers and parties are aware of some issues with the application. What concerns potential users most is the extension of the status quo, where neither of the legal instruments have any effect. It is necessary to take a number of alternatives into consideration, such as promotion of standard clauses and confirmation by a court ruling. Originality/value - Existing studies focus either on the Rotterdam Rules or on the UNCITRAL Model Law, but not both. Not many papers have yet dealt with the Model Law, which was adopted by UNCITRAL only 2 years ago, particularly in the context of a potential legal regime for electronic bills of lading. This paper attempts to introduce the differences between the two legal instruments in regulating the use of electronic bills of lading while providing an assessment of the various possibilities for which parties involved in international trade can be better prepared for the changing legal environment.
