한국패션기업의 지적재산권 보호실태에 관한 연구 (Protection of Intellectual Properties Rights in Korean Fashion Industries)

  • The intellectual properties right are becoming very critical issues in domestic fashion industries and also international trade. Although it is true that intellectual properties rights are commonly infringed in fashion industry, none of researches has been done for this matter. The present study is to analyze the patterns of infringement by case analysis, which was limited to trademark and trade dress. As a result, in case of trademarks, counterfeiting was relatively clear case, but it is generally investigated by prosecutes whereas the judgement of similar trademark has been taken by legal lawsuit. In case of industrial design(trade dress) most of disputes were related to textile design and modified Korean tradition dress. Reflecting the short history of protection of intellectual properties rights many informations and legal regulations should be established by te government and by the association of fashion related industry.

국내 패션기업의 위조상품 관리실태 및 대응전략분석 (Analysis of Actual Condition of Counterfeits and Anti-Counterfeiting Strategies of Korean Fashion Firms)

  • The purpose of this study was to analyze anti-counterfeiting strategies of fashion firms in Korea. Data was collected by in-depth interviews for 25 fashion firms and 5 buying offices who had been victims of counterfeiting. The result showed that fashion firms recognized the counterfeiting, especially deceptive counterfeiting, as a serious problem in Korea and seek for stronger protection. Fashion firms adopted diverse strategies for the protection of trademark and for the protection of design; (1) Investigation and Surveillance, (2) Warning, (3) Prosecution, (4) Lawsuit, (5) Consumer education (6) High-tech tabooing, (7) Provide incentives, (8) Penalty, (9) Do nothing. Despite the diverse efforts, they proposed the most desirable strategies to deter the counterfeiting as the changes of consumer attitude and stronger legal protection.

  • VIAGRATM, an oral therapeutic agent for erectile dysfunction, is the citrate salt of sildenafil. VIAGRATM is formulated as blue, film-coated rounded-dia-mond-shaped tablets, equivalent to 25mg, 50mg and 100mg of sildenafil for oral administration. ViagraTM has been allowed to be sold at the drug store in Korea officially, but it is still increased to sell or use counterfeits or smuggled goods, because of its high price or strict restriction on both sale and purchase. Discrimination and analysis of 13 cases of VIAGRATM tablets for verification of genuineness or counterfeit were requested to our institute on the period, from January 1999 to July 2003. (omitted)

U.S. Consumers' Motivations for Purchasing and Not Purchasing Fashion Counterfeit Goods

  • This study explores U.S. consumers' perceptions about fashion counterfeit goods and counter feiting and motivations for purchasing and not purchasing those goods. A qualitative research technique utilizing self-administered essay questions was used to collect data. A convenience sample of female college students(N=128) drawn from classes at Midwestern and Southern universities in the U.S. participated in this study. This study found that a majority of consumers tended to perceive that fashion counterfeit goods are merely imitations of the legitimate goods and that counterfeiting is producing and selling fake goods, but a small number of consumers associated those goods with illegally produced goods and illegal practices or violations of intellectual property rights. The major motivations for purchasing counterfeit fashion goods were found to be price/value consciousness, appearance of counterfeit goods, status consumption, availability of the goods, desire for souvenirs, and social(family and peer) influences. In addition, the major deterrents to purchasing these goods were identified as integrity/ethical judgment, poor quality of counterfeit goods, self-image/status, and unavailability of the goods. This study provides policy makers and anti-counterfeit coalitions with information to develop effective educational programs or campaigns to influence consumers' counterfeit fashion purchasing behavior.

특수섬유를 이용한 보안용지의 개발 (Use of New Fibers for the Development of Security Paper)

  • Use of security papers for monetary papers, gift certificates, and lottery tickets increases every year. As the use of security papers increase, there are more possibility of counterfeits. In this study, we used unique fibers from the sea to increase the difficulties against counterfeiting. The red algae fibers give opacity as much as calcium carbonates, and have unique shape in length ($500{\sim}900\;{\mu}m$) and width ($1{\sim}4\;{\mu}m$) to be discerned from other natural fibers such as wood and cotton fibers. We mixed red algae fibers to wood fibers in a series of fixed ratios to make single and multiply papers for making security papers. Paper with dyed red algae fibers were also used. Paper made without fillers gave enough opacity for printing when red algae fibers were used more than 20% of the fiber furnish. Those properties may allow red algae fibers to be a potential candidate for fiber raw materials of security paper.

  • RFID 시스템은 최근 다양한 분야로 적용되면서 개발이 급증하고 있다. 특히 RFID 시스템은 공급 업체의 물류분야에서 공급 사슬 관리 시스템의 중추적인 기술로 사용된다. 물류분야에서는 신속하고 정확하게 제품을 파악해야 하는데 제품의 이동으로 인하여 제품의 재고관리를 실시간으로 처리하는데 문제점이 있다. 본 논문에서는 이러한 문제점을 해결하기 위하여 RFID 네트워크의 구조적 기준이 되는 EPC-IS 네트워크를 이용하여 제품의 재고 상태를 실시간으로 파악한다. 또한 위조품이나 도난품을 파악하는 정품인증 서비스를 실시간으로 제공한다. 따라서 본 논문을 통하여 제품의 관리를 실시간으로 처리할 수 있음을 보인다.

RFID기반수산물이력제의 성공요인에 대한 탐색적 연구 -소비자 및 공급자 관점을 중심으로- (Critical Success Factors of REID-based Fisheries Traceability Systems: From the Perspectives of Consumers and Suppliers)

  • Recently, fisheries safety has been a matter of primary concern among consumers and suppliers. This phenomenon made them require the introduction of fisheries traceability systems. For traceability systems to be effective, automatic identification means play an important role. Therefore, RFID-based fisheries traceability systems are more required than barcode-based fisheries traceability systems. Unlikely EU and Japan, Korea did not accept mandatory traceability regulations. But Many countries began to accept mandatory traceability regulations to diminish food risks. So Korea is expected to adopt them in the near future. The purpose of this study is to find what benefits are generated from the adoption of RFID-based fisheries traceability systems and are related to their success. To do these, this study investigated primary benefits of RFID-based fisheries traceability systems from the perspectives of consumers and suppliers. Consumers' benefits were derived from the perceived risk dimensions. And suppliers' benefits were derived from operational benefits of RFID systems. To purify the benefits from RFID-based fisheries traceability systems, reliability and factor analysis were used. And the refined benefits of RFID-based fisheries traceability systems were additionally analyzed to find which benefits were significantly related to fisheries traceability systems' success. According to the analysis results, all risk dimensions except social risk were significantly related to their success. But in the benefits of suppliers, only "recalls and counterfeits" factor was significantly related to their success. These results implied that fisheries traceability systems should be based RFID technology instead of barcode and fisheries traceability systems were related to almost food risk dimensions. It's because these significant factors are related all food risks except social risk and the benefits of suppliers can be derived from only RFID technology.

중국 온라인 시장에서 위조품에 관한 정보 제시 여부가 구매의도에 미치는 영향 (Effects of China Online Market Counterfeit Products Message on Purchase Intention)

  • 위조품은 사전적으로 '거짓으로 속여서 진짜처럼 만든 제품'을 의미하며 불법 복제품이라고도 할 수 있다. 본 연구는 이런 불법적인 위조품의 범람이 온라인 쇼핑 소비자에게 어떤 영향을 미치는지를 연구하고자 한다. 또한 온라인에서 다양한 제품의 리뷰의 접근성이 높아지고 있으며 제품 리뷰를 긍정적 또한 부정적인 리뷰로 구분하여 소비자가 기존에 가지고 있는 정보에 영향을 미치며, 제품 관여도에 따라서 정보의 수용성이 달라 구매의도에 미치는 영향을 연구하였다. 이에 본 연구의 초점은 위조품에 관한 정보 제시 여부가 소비자의 구매의도에 미치는지와 리뷰방향성(긍정적/부정적), 관여도(높은/낮음)가 위조품에 관한 정보의 조절역할을 살펴보았다. 따라서 본 연구는 이를 통해 중국시장의 온라인 소비자에게 위조품에 관한 정보 많이 노출된 상황에서 온라인 기업과 가게에서 판매할 제품과 그 제품의 구매의도를 증가할 수 있는 마케팅 전략 방안을 제공했다는 점에서 중요한 시사점을 갖는다.

단일입자재현법(單一粒子再現法)을 활용한 고고유물의 진위판별 연구 (Authentication Test of Archaeological Materials using Single Grain Regenerative Dose Method)

  • 이 연구에서는 고고학 유물의 진위여부를 판단하기 위하여 미세시료채취법을 적용하여 시료를 채취한 후 화학적으로 분리된 세립 석영 입자의 고고선량을 산출하였다. 진위판별 연구에 앞서 미세시료채취법의 타당성은 백제무령왕릉 출토 전(塼)에서 산출된 고고선량 값들로부터 입증되었다. 이를 바탕으로 고구려 시대에 제작되었다고 주장되는 4점의 고고학 유물에 미세시료채취법을 적용하여 극소량의 시료를 채취한 후 단일입자재현법으로 고고선량을 산출하였다. 모든 유물에 대하여 고고선량 값은 0.2Gy 이하로 매우 낮았으며 단일시료재현법으로 산출된 값과 비교한 결과 매우 신뢰도가 높음을 알 수 있었다. 그러므로 유물의 고고학적 상황과 국내에서 고고선량은 평균적으로 1,000년 당 약 3.5Gy 내외의 값을 가진다는 점으로 미루어 판단하건데, 이 유물들은 고구려 시대에 제작된 유물이 아닐 가능성이 매우 높았다.

목통(木通).천목통(川木通).관목통(關木通)의 감별기준(鑑別基準) (Criteria for Identifying Akebiae, Clematidis, Aristolochiae Caulis)

  • Objectives : Due to morphological similarity, many substitutes and counterfeits have been used as Moktong for thousands of years. This study was designed to determine discriminative criteria for identifying medicinal herbs used as Moktong. Methods : Akebia quinata, A. trifoliata, Clematis armandii, and Aristolochia manshuriensis were collected in various regions. Samples were authenticated and examined by observation and microscopy with paraffin embedding and triple staining using the modified Ju staining method. Results : Three different types of features to establish discriminative criteria for four kinds of Moktong were identified. Botanical features include differences in phyllotaxy, leaf shape, and caulescent. External morphological features were arrangement and size of fine holes(xylem), and overall shape of the section. Internal morphological features include the number of medullary rays, shape of the pitch, type of tissues rounding pitch, appearance of annual rings, shape and amount of crystals(calcium-oxalate), and the appearance of cork cambium. Further details(e.g. identification keys) are in the article. Conclusions : These criteria could provide an effective method for identifying numerous kinds of Moktong distributed in markets throughout northeast Asian nations.
