보육시설 안전사고 예방과 보상에 대한 부모와 보육시설장의 인식 (Perceptions of Parents and Directors on Safety, Injury Prevention, and Compensation at Child-care Centers)

  • This research examined perceptions of parents and directors of child-care centers about safety, injury prevention, and range and level of compensation. Subjects were 285 parents and 297 directors of child-care centersin Kyunggi Province.Data were analyzed by t-test. Results showed differences between perceptions of parents and directors : parents considered the content and frequency of safety education to be more important; directors considered preparation for safety and safety management of equipment for injury prevention to be more important. Parents thought that range of compensation should include travel to and from the child-care center; directors thought that range of compensation should include sudden infant death. There was no difference between parents and directors regarding amount, subject, and process of compensation.

  • Purpose This study aims to develop a work-related injury and illness monitoring geographic information system that analyzes and visualizes the types of work-related injury and illness based on workers' compensation insurance big data. Design/methodology/approach Using the developed system, we explained the process of monitoring the areas of the applied workplace, medical care application, index, and medical care institution. We also showed examples of analyzing the index and medical care institution area. By applying the system, we can intuitively recognize the current status of workers' compensation insurance and confirm the basic information necessary for managing the current status of workers' compensation insurance. Findings We generated more helpful information by combining workers' compensation insurance data and designated medical care institution data. We were able to apply the severity score and the vulnerability index of work-related injury and illness to the system as a demonstration. To efficiently manage workers' compensation insurance, it was necessary to integrate workers' compensation insurance and designated medical care institution data, as well as the data from various sources.

북한법상 인신사고에 대한 손해액 산정기준 (Study on the North Korean Law in Estimating the Damages caused by Personal Injury)

  • 남북 간의 교류와 협력은 그 과정에서 불가피하게 여러 가지 법적 분쟁을 야기할 수 있는데, 그 중에 하나가 인신사고로 인한 손해배상 문제이다. 이 글의 목적은 인신사고로 인한 손해액 산정에 관한 북한법의 내용을 살펴보고 이를 남한법과 비교함으로써, 남북한 주민 간의 손해배상사건에 있어서 분쟁해결의 기준을 제시하는 데 있다. 향후 남북간의 교류와 협력이 확대될 것으로 예상됨에 따라, 북한의 손해배상법에 대한 이해는 매우 중요하고 시급한 과제이다. 남한 민법에는 인신사고로 인한 손해액 산정과 관련한 구체적인 규정을 두고 있지 않기 때문에, 손해액 산정에 관한 구체적인 기준은 법원의 판례를 통해서 정해지게 된다. 남한의 법원은 인신사고로 인한 손해를 적극적 재산상 손해, 소극적 재산상 손해, 정신적 손해로 나누어서 각각의 손해액을 산정한다. 반면, 북한 손해보상법은 인신사고를 1) 건강을 침해한 경우(제41조), 2) 건강을 침해하여 장애를 남긴 경우(제42조), 3) 인신 침해로 사망에 이르게 한 경우(제44조)로 나누어서 그에 따른 손해의 항목을 구체적으로 규정하고, 손해액 산정에 관한 규정(제43조, 제51조)을 두고 있다. 또한, 남한에서는 신체사고에 대한 정신적 손해배상을 넓게 인정하고 있으나, 북한에서는 정신적 손해배상을 원칙적으로 인정하고 있지 않다.

Occupational Injuries and Illnesses and Associated Costs in Thailand

  • Background: The purpose of this study was to enumerate the annual morbidity and mortality incidence and estimate the direct and indirect costs associated with occupational injuries and illnesses in Bangkok in 2008. In this study, data on workmen compensation claims and costs from the Thai Workmen Compensation Fund, Social Security Office of Ministry of Labor, were aggregated and analyzed. Methods: To assess costs, this study focuses on direct costs associated with the payment of workmen compensation claims for medical care and health services. Results: A total of 52,074 nonfatal cases of occupational injury were reported, with an overall incidence rate of 16.9 per 1,000. The incidence rate for male workers was four times higher than that for female workers. Out of a total direct cost of $13.87 million, $9.88 million were for medical services and related expenses and $3.98 million for compensable reimbursement. The estimated amount of noncompensated lost earnings was an additional $2.66 million. Conclusion: Occupational injuries and illnesses contributed to the total cost; it has been estimated that workers' compensation covers less than one-half to one-tenth of this cost.

집중 복합 물리치료 프로그램이 산재 외상성 어깨둘레근 손상 환자의 통증, 관절가동범위, 근력, 기능, 삶의 질과 우울증에 미치는 영향 -예비연구- (Effects of an Intensively Complex Physical Therapy Program on the Pain, Range of Motion, Muscle Strength, Function, Quality of Life, and Depression of Patients with Traumatic Rotator Cuff Injury caused by an Industrial Accident -A Pilot Study-)

  • Purpose: This study aimed to investigate the effect of an intensive rehabilitation program on the pain, range of motion (ROM), muscle strength, function, quality of life (QoL), and depression of patients with traumatic rotator cuff injury caused by an industrial accident. Methods: Seventeen patients with traumatic rotator cuff injury caused by an industrial accident participated in this study. The 12-week treatment included 30 min of manual therapy and 30 min of exercise therapy twice a day, five times a week. The outcomes were measured for evaluating the pain, ROM, muscle strength, function, QoL, and depression before the commencement of the program and after 4, 8, and 12 weeks. Results: According to the time of applying the intensive rehabilitation program, the pain (p<0.01), ROM (p<0.01), muscle strength (p<0.01), function (p<0.01), and depression (p<0.05) significantly improved with time. However, QoL was not statistically significant. Conclusion: This study confirmed the excellent effect of an intensive rehabilitation program on the pain, ROM, muscle strength, function, and depression of patients with traumatic rotator cuff injury caused by an industrial accident. However, this study was limited by the absence of a control group. This pilot study highlights the need for more extensive research with a larger sample.

산업재해 요통 근로자의 기능장애에 영향을 미치는 요인 (Factors Affecting the Compensated Low Back Pain Disability)

  • Purpose: To identify the factors which are related to compensated low back pain disability. These include individual. workplace. economic and injury factors. Method: Data collection was performed at 13 office of Korea Labor Welfare Corporation and 29 hospitals from 23th June to 4th August 2003. This study used 212 workers with compensated low back pain. Result: From the bivariate analysis, industry kind, type of employment, rest schedule, Job control, compensation, payment of company, diagnosis, cause of occupational injury, duration of compensated low back pain, pattern of pain, operation, other injury is related to low back pain disability. From the multiple regression analysis, rest schedule, compensation, diagnosis, pattern of pain, other injury have statistically significant effect on the low back pain disability. Conclusion: In order to reduce low back pain disability, occupational rehabilitation nursing intervention is necessary to workers with compensated low back pain.

산재보험 수준의 연구실안전보험 보장성강화 방안 - 장해보험금 연금형태 지급을 중심으로 - (A Study on the Improvement of the Safety Insurance for the Laboratory at the Korean Worker's Compensation Insurance - Focusing on Disability Benefit Pension Type Payment -)

  • Background: Due to the diversification and advancement of research, researchers have become to deal with a variety of chemical and biological harmful materials in the laboratories of universities and research institutes and the risk has increased as well. Therefore, it is necessary to strengthen the social safety net for laboratory accidents by strengthening the compensation to the level comparable to that of Korean Workers' Compensation & Welfare Service, when the researchers become physically disabled by laboratory accidents. The purpose of this study is to secure researchers' health rights and to create a research environment where researchers can work with confidence by strengthening the compensation to the level comparable to that of Korean Workers' Compensation & Welfare Service. Method: We analyzed the laboratory accidents by year, injury type, severity of accident and disability grade with the 6 year data from 2011 to 2016, provided by Laboratory Safety Insurance. Based on the analysis result, we predicted the financial impact on Laboratory Safety Insurance if we introduce a compensation annuity by disability grade which is similar to Injury-Disease Compensation Annuity of Korean Workers' Compensation & Welfare Service. Result :As of 2011, the insured number of Laboratory Safety Insurance was approximately 700,000. The Average premium per insured was KRW 3,339 and there were 158 claims. Total claim amount was KRW 130 million, whereas the premium was about KRW 2.3 billion. The loss ratio was very low at 5.75%. If we introduce a compensation annuity by disability grade similar to Injury-Disease Compensation Annuity of Korean Workers' Compensation & Welfare Service, the expected benefit amount for 1 case of disability grade 1 would be KRW 1.6 billion, assuming 2% of interest rate. Given current premium, the loss ratio, the ratio of premium income to claim payment, is expected 41.4% in 2017 and 151.6% in 2026. The increased loss ratio due to the introduce of the compensation annuity by disability grade is estimated to be 11.0% in 2017 and 40.4% in 2026. Conclusion: Currently, laboratories can purchase insurance companies' laboratory safety insurance that meets the standards prescribed by Act on the Establishment of Safe Laboratory Environment. However, if a compensation annuity is introduced, it would be difficult for insurance companies to operate the laboratory safety insurance due to financial losses from a large-scale accident. Therefore, it is desirable that one or designated entities operate laboratory safety insurance. We think that it is more desirable for laboratory safety insurance to be operated by a public entity rather than private entities.

Using Workers' Compensation Claims Data to Describe Nonfatal Injuries among Workers in Alaska

  • Background: To gain a better understanding of nonfatal injuries in Alaska, underutilized data sources such as workers' compensation claims must be analyzed. The purpose of the current study was to utilize workers' compensation claims data to estimate the risk of nonfatal, work-related injuries among occupations in Alaska, characterize injury patterns, and prioritize future research. Methods: A dataset with information on all submitted claims during 2014-2015 was provided for analysis. Claims were manually reviewed and coded. For inclusion in this study, claims had to represent incidents that resulted in a nonfatal acute traumatic injury, occurred in Alaska during 2014-2015, and were approved for compensation. Results: Construction workers had the highest number of injuries (2,220), but a rate lower than the overall rate (34 per 1,000 construction workers, compared to 40 per 1,000 workers overall). Fire fighters had the highest rate of injuries on the job, with 162 injuries per 1,000 workers, followed by law enforcement officers with 121 injuries per 1,000 workers. The most common types of injuries across all occupations were sprains/strains/tears, contusions, and lacerations. Conclusion: The successful use of Alaska workers' compensation data demonstrates that the information provided in the claims dataset is meaningful for epidemiologic research. The predominance of sprains, strains, and tears among all occupations in Alaska indicates that ergonomic interventions to prevent overexertion are needed. These findings will be used to promote and guide future injury prevention research and interventions.

Epidemiology and Control of Agriculture Related Injury

  • Objective: The purpose were understanding the epidemiological characteristics of work related injuries of the farmer and establishing injury prevention and control activity. Background: Agriculture is one of the most hazardous industry and job in Korea. Method: We reviewed previous reports regarding the agricultural injury, injury prevention and control. Results: In the agricultural total injury, there were 45,342 hospitalized injury to farmers, injury rate was 35.8/1,000 farmers/years. Of these injuries, 52.6 percent were classed as work related injury. The farm-related injury rate was 17.5/1,000 farmers/years by analysis of Safety Aid System of Farm Workers. There were 2.4 times as incidence rate for farmers compared to non-farmers. Conclusion: Several strategies are available for injury prevention and control. They are as follows; social concern, survey of farm related injury, injury prevention, injury surveillance system and injury compensation.

인도 임상시험 피해보상제도 분석 및 윤리적 고찰 (Analysis and Ethical Review of the Compensation System for Clinical Trial Injury in India)

  • In 2004, India began investing in the clinical trial industry; the country now boasts a 20% market share with the help of a valuable resource - the world's second largest population. The Contract Research Organization has been able to generate profits efficiently conducting clinical trials via a large pool of participants, skilled researchers, and reduced developmental costs. As the demand and sheer number of global clinical trials increased, the International Council of Harmonization-Good Clinical Practice was introduced, and the need for the Institutional Review Board increased. While the clinical trial industry in India boomed, it came at the expense of the participants' civil rights. The increased media attention regarding the ethical issues forced the Indian Supreme Court to take action. Consequently, India is the only country, by law, that specifically compensates participants suffering from injury directly resulting from participation in clinical trials. This research paper will describe and compare the relevant laws of India and Korea including compensation criteria. In addition, the ethical issues and aspects of indemnity in clinical trials will be discussed. While the clear advantage of the compensation is one of the protected rights of a clinical subject, the current system is not perfect. Furthermore, laws created to redeem ethical issues can have unintended, negative consequences.
