A Proposal for Enhancing Dispute Resolution Functions and the Governance of Korea National Contact Point (NCP) to the OECD Guidelines for Multinational Enterprises (OECD 다국적기업 가이드라인 한국 국내연락사무소 (NCP)의 분쟁해결 기능과 지배구조 개선방안)

  • The OECD Guidelines for Multinational Enterprises (The Guidelines) was initially promulgated in 1976 as a form of annex to the OECD Declaration on International Investment and Multinational Enterprises. The Guidelines aims at accomplishing the implementation and dissemination of the Responsible Business Conduct. The latest version of The Guidelines, as revised in 2011, directed 47 adhering countries to The Guidelines to set up their respective National Contact Points (NCPs). NCPs are The Guidelines' dispute resolution mechanism for specific instances arising from breach by multinational enterprises of The Guidelines. Korea to date has its own NCP performing its role to offer good offices and facilitates settlement between the parties to the specific instances regarding The Guidelines. However, there has been strong criticism from NGOs and civil society that Korea NCP has not performed well due to lack of transparency and impartiality, especially in the context of the governance of Korea NCP. Under this circumstance, this paper ⅰ) examines current status and problems of Korea NCP, ⅱ) evaluates the core criteria for function and governance of NCPs through a comparative overseas cases study, and ⅲ) suggests improvement plans for Korea NCP.

Politics of Technoscience and Science and Technology Governance in Korea (한국의 과학기술정치와 거버넌스)

  • Recently, governance of science and technology emerged as one of most important social problems and as a result it is crucial to understand it in science and technology studies. This article discusses three most important realms in science and technology goverance - research and development, regulation, and social movement - in the concrete Korean contexts. First of all, the Korean state has driven research and development and promoted its commercialization unlike other developed countries. Consequently, this nationalistic view on science disseminated to Korean public and it generated uniformity in research style and organization. Second, science and technology regulations embraced developed countries' policies, leading to its glocalization. As a result, technocratic old governance and new governance including precautionary principle and participatory democracy coexist. Third, the civil society has challenged expertise and state-driven science and technology governance and fueled social movements related to environment, safety, and health issues. The politics of knowledge created by citizens' voluntary participation and collaborative experts made it clear that science and technology should be no longer tool for economic development. In conclusion, we discuss characteristics of science and technology governance in Korea, giving various implication on current research and policy.

Adopting Cloud Service in the National Spatial Data Infrastructure

  • In Korea, NSDI(National Spatial Data Infrastructure) was implemented for integrating and sharing the nationally generated spatial data. One of the main roles of implementing NSDI is providing spatial data to public agencies. And now, the establishment plan for NSDI with the technical advancement should be needed. This paper deals with the technical aspects of adopting cloud service in the NSDI. First, we propose the concept for target system, which shows the current and future NSDI. In the future NSDI model, GIS cloud and governance systems are included. Service functions for cloud system and infrastructure implementation design directions are derived. Finally, governance system implementation plan is described. This research will contribute to the implementation of NSDI cloud service system.

An Overview of the Developments of ICANN Internet Governance and Some Recommendations for Korea (ICANN의 진화과정 고찰을 통해 본 한국 인터넷주소 거버넌스의 개선방향)

  • Internet Corporation for Assigned Names and Numbers (ICANN) is the body which manages the allocation and registration of global Internet IP addresses and domain names. As a gesture to overcome the dependency on the U.S. government, ICANN and the U.S. Department of Commerce jointly made the Affirmation of Commitment in which they submitted the workings of ICANN to the supervision of a council of Internet experts. Accountability and Transparency Review Team (ATRT) is one of four teams created for this purpose. In December 2010, ATRT made 27 recommendations, which were subsequently approved by the ICANN Board. These reform efforts of ICANN provide significant implications for the future of Korean Internet governance. Korea should enhance the compatibility of its domestic decision making process related to Internet addresses with the private sector driven, bottom-up process of global Internet governance. In order to increase the involvement of private sector and civil society, it is recommended for Korea to formalize the mechanism for bottom-up process. Insertion of a new provision concerning a bottom-up process into the Internet Addresses Act should be considered.

  • The recent COVID-19 pandemic is threatening human life and well-being, causing pain that has not been experienced before. Human security was summoned again as a result of the COVID-19 pandemic. However, it is paradoxically a threat to human security due to its inherent limitations and authoritarian control model. This paper first raises the analytical rigor of the concept of human security, focusing on COVID-19. Based on this, the practical usefulness of human security is improved by constructing a practical model that reflects the human security issues raised in reality. In particular, we approach the COVID-19 pandemic not from a natural disaster, but from the perspective of an artificial catastrophe caused by immorality and division in the international community. At the same time, we propose a multilateralism governance model that reflects the perspective of emerging security in order to realize human rights, the fundamental value of human security, and quarantine, a practical task in a balanced way.

Civil Servant Commitment on Giving Cash Waqf: Does Trust Matter?

  • Purpose: This study analyzes civil servants' trust in cash waqf institution and their relationship with commitment. We use Key Mediating Variables (KMV) Theory with variables such as board benevolence, board integrity, board ability, board opportunism, communication, and accountability to predict the trust and commitment of civil servants in providing cash waqf. Research design, data and methodology: We used a quantitative research approach and an online questionnaire distributed to civil servants in Gorontalo Province; 410 respondents were obtained. Structural Equation Modeling (SEM) was used, utilizing the SEM-PLS software to analyze the data. Result: This study found that the variables board benevolence, board ability, board integrity, board opportunism, communication, and accountability affected trust. As for the variable of accountability, the hypothesis was rejected Conclusion: The communication variable of cash waqf institutions has a strong influence in increasing the confidence of civil servants in providing cash endowments. However, trust in waqf institutions may diminish due to low accountability and poor governance of cash waqf institutions. The trust of civil servants in cash waqf institutions in the future will increase their commitment to waqf.

  • For cope with the participating government promoted local decentralization of the present time, local governments are coming to aim at the realization of local governance. Local governance refers to a way of solving public problems of urban area through partnership which is a collaboration and participation based on 'relationship' among diverse interested parties such as executive authority of policy, private sectors. First of all, it is most important task to make transparency and responsibility of all people and networks by themselves through sharing information. With like this kind of a background, local assembly is an momentos body of local governance because it is a decision making organization at the same time as a representative organization of local residents, and it has a relationship of 'check and balance' with chiefs of local governments as an organization monitoring and supervising the administration of an executive authority. Not the less, information about local assembly does not open to the public or exist. Even some informations open to the public, they are not enough to be settled distrust and low-valuation by civil society. Now Local assembly is face to a point that improve over all of record management. This study is based like this critical mind, then, it examines throughly local assembly's realities by suggestion with reforming plan of record management. Record can embody true values when record management practices indefatigably through prudential system from production until preservation. Accordingly, this study suggests management of transaction unit without the omission of record. Also this study is satisfy the condition of Korean record management system with proposals of record management policy and establishment of record center. At the conclusion of study, it puts effects into shape that local assembly secure transparency and responsibility and organize local governance by record management.

  • Being dealt in Alfred Weber's Theory of the location of Industries, a lot of economic benefits can be obtained through aggregation and clustering of industrial facilities, which derived to the development of industrial complexes in Korea. However, with the IMF economic crisis as well as various institutional changes, the framework of aggregation and clustering of industries is broken, which led to individual developments that took place without any consideration of surrounding industries. For reformation of these condition of industrial complexes, national government-led regeneration projects are being carried out currently. However, national government-led projects mainly focus on profitable projects such as officetel and hotel that are irrelevant to exist composition of industrial complexes which is usually manufacturing base industries and are unable to solve the fundamental problems of industrial complexes. Thus, a necessity of industry clustering is deduced through case analysis of actual private-led manufacturing industry cluster with governance and analysis of benefits on financial, spatial and environmental aspects. In addition, implications on the necessity follow base on factorial analysis on the benefit of clustering development than individual development as well as analysis on the measures taken for successful clustering.

A Comparative Study on Marine Rescue Volunteer Organizations (해상 구조 봉사단체의 비교 연구)

  • Maritime safety management needs active public participations because the sea is too wide for a government to respond to all unexpected accidents with limited resources. Marine rescue volunteer organizations of US, UK, Japan and Korea were compared one another on the base of disaster management governance theory, and recommendations for the development of marine rescue volunteer organization of Korea were proposed. The advanced organizations commonly have tradition of marine rescue voluntaryism in the advanced maritime countries. They have nation-wide networks and self-governing structures. Their main activities include public maritime safety education and fundraising programs as well as marine rescue operations. They have cooperative relationships with government agencies in charge of national maritime safety management, which are usually guaranteed by legislations or institutional systems. Donations from the public are major source of their finances. Members mainly consist of civil volunteers, and get basic compensations for their expenses. For the advancement of marine rescue volunteer organization of Korea, efforts are needed to strengthen the membership of civil rescue fleet, to activate public education and fundraising programs, and to amend the related law for institutional support.

Mainstreaming of Health Equity in Infectious Disease Control Policy During the COVID-19 Pandemic Era

  • The Korean government's strategy to combat coronavirus disease 2019 (COVID-19) has focused on non-pharmaceutical interventions, such as social distancing and wearing masks, along with testing, tracing, and treatment; overall, its performance has been relatively good compared to that of many other countries heavily affected by COVID-19. However, little attention has been paid to health equity in measures to control the COVID-19 pandemic. The study aimed to examine the unequal impacts of COVID-19 across socioeconomic groups and to suggest potential solutions to tackle these inequalities. The pathways linking social determinants and health could be entry points to tackle the unequal consequences of this public health emergency. It is crucial for infectious disease policy to consider social determinants of health including poor housing, precarious working conditions, disrupted healthcare services, and suspension of social services. Moreover, the high levels of uncertainty and complexity inherent in this public health emergency, as well as the health and socioeconomic inequalities caused by the pandemic, underscore the need for good governance other than top-down measures by the government. We emphasize that a people-centered perspective is a key approach during the pandemic era. Mutual trust between the state and civil society, strong accountability of the government, and civic participation are essential components of cooperative disaster governance.
