The major legal issues of this case were governing law questions regarding the liability of the shipowner/employer to its employee. It is true that in the absence of the parties' choice of law, the arbitral tribunal may apply the substantive laws or rules of law which it deems appropriate. However, it does not mean that the arbitral tribunal has arbitrary discretion in choosing the appropriate law as the governing law of the case; rather, the arbitrators should carefully examine the conflict of law rules of the forum and the requirement of the law of the country where the upcoming arbitral award will be enforced. They must bear in mind the role of the "connecting factors" in determination of the governing law. Therefore, the application of an alien law, which has minimal connecting factor with the case, may lead to a conclusion that is hardly understood by the parties. On the same token, the arbitrators must pay attention to applying the mandatory rules of a country, the laws of which not being the governing law of the issue. It is said that the application of the mandatory rules is a necessary evil to secure the enforcement of the award in the country, which has national interest in applying its own law to the issue. Further, arbitrators must pay attention to the consistent application of the law and respect the integrity of a legal system to reach a fair conclusion. The place of service of a seafarer for a vessel navigating international sea ought to be its home port country rather than the country of the ship registry, and the party autonomy in choice of the law in a seafarer employment should be respected.
This study is to clarify regional structure and connection of international physical distribution through clearance depot of Cheongju customs of inland location. The trade of clearance depot of Cheongju customs industrial characteristics reflects of territorial hinterland. As origins and destinations of freight as exports and imports region, territories of Cheongju customs trade mainly with Japan, China, and USA. Origin and destination of freight of Cheongju customs territory are hinterland and foreland of Incheon International Airport and Busan port. In case of export, foreland of Busan port is board, and in case of import, the hinterlands of Incheon International Airport and Busan port are similar. Clearance depot of inland-located Cheongju is construct by the advantages of rapidness and inexpensive cost. And the kind of freight and system of physical distribution of each enterprise show different characteristics. For each export and import freight, each shipper corporation has its own physical distribution system, and structure of international distribution is classified into export pattern of bonded industry and bonded warehouse. Again the patterns of bonded warehouse are distinguished free on board price system with division of labor in base of production in overseas, free on board price system, and cost-insurance-freight with division of labor in base of production in overseas. These Phenomena are caused by transaction between headquarter and its overseas corporation, initiative freight handling of export corporation, choice of inexpensive cost, and international convention.
It might be true that both experimental and analytic techniques have been developed in the vibration analysis end engineering. It could not be said, however, that the experimental method has been also developed as much as analytic method, such as Finite Element Method One of the reason is that computation time becomes longer and that the solution often diverges depending on the choice of initial value in solving nonlinear equation. The equation in experimental modal analysis is usually composed of the nonlinear term of natural frequency and modal damping ratio, and the linear one of equivalent stiffness. In this study, the nonlinear terms were solved first, and then the linear term was obtained. The experimental modal parameters were estimated, applying the developed experimental modal analysis curve-fitting method to the super-structure model. In addition, the number of modes and modal damping ratio could be easily determined by the developed program with the application of graphical techniques and with easy handling button.
This study was conducted to evaluating the willingness to pay for marine leisure ships through a contingent valuation method that can estimate the value of non-market economy. The questionnaire adopted a double-bound dichotomous choice Model and the variables for evaluating the amount of willingness to pay consisted of demographic variables and respondent behavior variables, and related information verified through previous studies. As a result of collecting and analyzing a total of 309 questionnaires, the amount of willingness to pay for marine leisure ships was estimated to be 25,510 won. In addition, significant variables affecting the amount of willingness to pay were the experience of visiting the island, satisfaction with the introduction of new maritime transportation, and intention to revisit the island. Through this study, it can be used as a basis for evaluating the economic value of new maritime transportation by estimating the willingness to pay for marine leisure ships using the contingent valuation method.
A freight forwarder plays an important role in global trade and logistics by connecting worldwide nodes such as shippers, ports, and airports. Most freight forwarders in Korea are small and do not provide a sophisticated and professional service. This study aims to develop a strategy for Korean freight forwarders to the world-class 3PLs which they have to establish the strategy on how shippers select their freight forwarders. We conducted a higher-order factor analysis using the PLS-SEM techniques on the SmartPLS program to confirm the importance and significance of each factor, while considering relevant previous research. The findings suggested that shippers chose their freight forwarders for international logistics activities primarily by the reliability and forwarder service factors. Therefore, freight forwarders in Korea have to strengthen confidence and widen their service to shippers in order to become leading logistics companies.
Recently, there has been an increase in interest from the aspects of transshipment and connection between the means of transportation. Not only for passengers but also for freight transportation as the need for transportation efficiency is growing while the importance of logistic railway transportation is emerging. The domestic freight transportation is carried out by roads, railroads, ships, and port. However, as other means of transportation, except road, is impossible for Door to Door Service, multimodal transportation accompanied by road transportation is carried out. Here, even though 'transshipment' occurs, because of the lack of basic data regarding this, it is difficult to reflect it in the demand forecasting. With respect to the Korean freight O-D, it was very difficult to have equivalent comparison on the competitiveness and availability of transportation services between the point of departure and the final destination. Taking into account the study of implementation of logit model considering the time and cost of transshipment of multimodal transportation and the transshipment resistance value upon selecting means of freight transportation on multimodal transportation was comparatively insufficient. This study consisted of questionnaire targeting shippers, and based on this, transshipment resistance value was calculated by deriving utility function. By doing so, I intend to examine the effect 'transshipment' has on selecting the means of transportation occurring from freight transportation.
Video-assisted thoracoscopic surgery (VATS) has been established as the surgical approach of choice for lobectomy in patients with early-stage non-small cell lung cancer (NSCLC). Patients with clinical stage I NSCLC with no lymph node metastasis are considered candidates for VATS lobectomy. To rule out the presence of metastasis to lymph nodes or distant organs, patients should undergo meticulous clinical staging. Assessing patients' functional status is required to ensure that there are no medical contraindications, such as impaired pulmonary function or cardiac comorbidities. Although various combinations of the number, size, and location of ports are available, finding the best method of port placement for each surgeon is fundamental to maximize the efficiency of the surgical procedure. When conducting VATS lobectomy, it is always necessary to comply with the following oncological principles: (1) the vessels and bronchus of the target lobe should be individually divided, (2) systematic lymph node dissection is mandatory, and (3) touching the lymph node itself and rupturing the capsule of the lymph node should be minimized. Most surgeons conduct the procedure in the following sequence: (1) dissection along the hilar structure, (2) fissure division, (3) perivascular and peribronchial dissection, (4) individual division of the vessels and bronchus, (5) specimen retrieval, and (6) mediastinal lymph node dissection. Surgeons should obtain experience in enhancing the exposure of the dissection target and facilitating dissection. This review article provides the basic principles of the surgical techniques and practical maneuvers for performing VATS lobectomy easily, safely, and efficiently.

The Switched Bill of Lading(SBL) has been in frequent use in recent years as intermediary trade increases with the growing number of companies' overseas subsidiaries. Its frequent use, though, has brought about disputes regarding its illegal issue. Although there are several legal cases regarding this, studies on this issue are hard to find. Therefore, this study tries to provide countermeasures and precautions against unlawful issues of SBL through examining the legal cases resulting from illegal issuing practices of SBL. When the Switched Bill of Lading is issued, the shipper, consignee, port of loading and unloading, and shipping date of the original bill of lading are usually changed. Statements which may put the shipper at a disadvantageous position may also be deleted and/or the bill of lading may be either divided or integrated when it is issued. However, if the carrier issues the SBL 1)without withdrawing original BL, 2)indicating the shipping date, port of loading and port of discharge falsely, or 3)deleting the statements which may give him disadvantages, it may be regarded as an illegal issue. These unlawful issues of SBL may pose a huge threat to the shipper, banks and the parties relating to the trade. That is, the shipper may take a substantial loss when the goods can be delivered to a third party by SBL without his collecting the proceeds. The issuing bank and the negotiating bank may also have their security rights to the goods hampered by the illegal and improper issue of SBL. In most cases, the carrier has no choice but to issue the SBL without collecting the original BL for fear of hurting the relationship with the intermediary traders. This practice of issuing more than two sets of BL may pose a potential risk to the carrier.

When we consider to develop a new harbor, the most important factor, we think, is the lowest water depth of waterway and approaching channel for safe navigation of vesse. The existing harbors have been being dredged to meet the international trend of jumbo sized vessels by adopting the new design criteria. As the dredged materials over the expected at the design level were common and there are still lack of land based reclamation area, we have no choice to discharge the dredged materials in open sea area. In this study, we analysed the behavior of discharged materials at the dumping area of offshore open sea, which were collected from the dredging work at the waterway in Busan New Port. We measured the tidal currents and analyzed the waters of dumping site after the dumping work. these were used to evaluate the numerical models. Suspended Solids(SS) were introduced to the diffusion model. Because of the characteristics of the dumping site, the speed of initial diffusion and settle down of the discharged materials was so fast. Therefore, we believe that the dumped materials do not cause a significant impact to the marine environment.
