On the Japanese New Alternative Dispute Resolution System in the Financial Sector (일본의 금융분야 ADR 에 관한 검토)

  • In the past, ADR has not been used as frequently in Japan as it has in other parts of the industrialized world. However, though litigation is still the most utilized vehicle of dispute resolution by Japanese financial institutions, this will be changing. The New Financial ADR system, which was created by a June 2009 amendment to the Financial Instruments and Exchange Act, is meant to deal with every stage of financial-related disputes and, as such, strives to resolve disputes before they become significant and acts to ameliorate any post-ADR issues that may remain, thereby completing the FIEA's purpose to protect investors. Since the foundation of the New Financial ADR system applies to all related industries, new provisions were set out in 16 business related acts, such as the Banking Act, the Insurance Business Act, and FIEA itself. October 2010 will mark the formal introduction of a new system of financial ADR in Japan. New Financial ADR in Japan will be modeled on the Financial Ombudsman Service in the United Kingdom, but will not feature one comprehensive dispute resolution system in which one dispute resolution institution covers all disputes in the financial field. The New Financial ADR system is merely one step towards a foundation of comprehensive financial ADR such as FOS. It must be noted, however, that this all important first step was over seven years in the making, involving a great deal of discussion, debate, and compromise amongst many parts of Japanese government, business, and society. The New Financial ADR system grants participating parties the ability to stop the clock on any statute of limitations which may correspond to any future possible court cases related to the dispute,13 and further grants the ability to suspend related court proceedings while the parties are utilizing the New Financial ADR system. In addition, where financial institutions have not accepted dispute resolution proceedings or have not accepted a special conciliation proposal, the Ministry of Finance may issue an order compelling compliance if it is found that certain actions are necessary to ensure the appropriate operations of a financial institution's business. The Performances of Sediment Trap for Reducing Water Pollutants and Soil Loss from Rainfall Runoff in Cropland (농경지 토양유실 및 수질오염물질 유출에 대한 침사구 조성 효과)

  • BACKGROUND: An intensive farming system may be of the most important source for agricultural non-point source (NPS) pollution, which is a major concern for agricultural water management in South Korea. Various management practices have therefore been applied to reduce NPS loads from upland fields. This study presents performances of sediment trap for reducing NPS and soil loss from rainfall runoff in cropland. METHODS AND RESULTS: In 2018 and 2019, three sediment traps (L1.5 m × W1.0 m × D0.5 m = 0.75 ㎥) and their controls were established in the end of sloped (ca. 3%) upland field planted with maize crops. Over the seasons, runoff water was monitored, collected, and analyzed at every runoff. Soils deposited in sediment traps were collected and weighed at the season end. Sediment traps reduced runoff amount (p<0.05) and NPS concentrations, though the decreased NPS concentrations were not always statistically significant. In addition, sediment traps had a significant prevention effect on soil loss from rainfall runoff in a sloped cropland. CONCLUSION: The results suggest that the sediment trap could be a powerful and the best management practice to reduce NPS pollution and soil loss in a sloped upland field.

  • In this study, it investigates the highly controversial issue "low carbon car subsidy". Through the policy's intent, purpose, and necessity, it aims to present alternatives for automotive industry development. Introducing the low carbon car subsidy will bring a huge change to the vehicle purchase practices by changing vehicle purchase cost. It expects that this change will reduce greenhouse gas emission from vehicles. For successful settlement of the system, it shall set up the target sections for subsidy and levy appropriately in order to get the nation's consensus. Additionally, it has to conduct sufficient reviews the measures such as adjustment to the existing auto tax, divided payments of burden charge, etc before enforcing the system. In terms of the automobile industry, it must do their level best in technical development in order to meet the carbon dioxide emission level of imported cars until the enforcement. Also, the government has to strengthen its support to the industry.

Analysis of NPS Pollution reduction from No-till Field (무경운 밭에서의 비점오염물질 저감효과 분석)

  • Various Best Management Practices (BMPs) have been suggested to reduce soil erosion and non point source (NPS) pollutant loads from agricultural fields. However, very little research regarding water quality improvement with No-till (NT) has been performed in Korea. Thus, effects of NT were investigated in this study. The objective of the study was to investigate the effect of NT on the surface runoff and sediment discharge in a field. Eight experimental plots of $5{\times}30m$ in size and 3 % or 8 % in slope prepared on gravelly sandy loam soil were treated with Conventional-till (CT) and NT. Runoff and NPS pollution discharge were monitored and compared the treatments. The amounts of rainfall from 13 monitored events ranged from 28.7 mm to 503.5 mm. The runoff amount was reduced by 17.6~59.2 % in 3 % NT and 29.6~53.2 % in 8 % NT. The average NPS pollution loads of the 3 % NT plots and 8 % NT plot were reduced about 45.1~89.2 % and 47.7~98.0 % compared to those of the CT plots, respectively. This research revealed that NT can reduce the NPS pollution loads substantially as well as increase the crop yield. Runoff and NPS pollution loads reduction by NT method could be contribute to improve the water quality of streams in agricultural regions.

  • Biogas, combine with ever-increasing natural gas demand, has been on the center stage in South Korea for the early part of twenty first century in an effort to reduce the emission of global warming gases. With the passage of legal system of City Gas Business Law in 2014, the biogas has its place of production and distribution to consumers. However, it has a room for its technological improvements in terms of enrichment, by separating carbon dioxide and removing impurities efficiently. For these improvements, four different methane enrichment processes were tested in this study; membrane separation, water absorption, Chemical Absorption and Adsorption. A variety of operation scenarios were applied to the processes and the best practices were drawn out. The optimum process was selected based on case study results. Methane produced in this study showed 97% purity and 98% recovery rate, which meets the requirements of the City Gas quality standards.

Safety management for multi-swarm events did ministry of public safety and security, local government, police department, fire department etc. Activities of Safety management for multi-swarm events was checked the risk level, safety management, safety planning and training, safety management in accordance with the Manual. But, safety management of police had Manual maintenance is necessary for the police forces and take advantage of, it is necessary to clarify the mission, it is necessary to configure the risk of a step-by-step checklist for police safety tips in detail. This study for solve the problem proposed the United States, United Kingdom, Germany, France, Australia, the case of the Japanese.

Real-Time Pavement Damage Detection Based on Video Analysis and Notification Service (동영상 분석을 통한 실시간 포장 손상 탐지 및 알림 서비스)

  • In this paper, we propose a system to detect various damage automatically inflicted on road pavement by collecting and analyzing data from acceleration and camera sensors in real time. The proposed system sends the collected images, acceleration signals, and GPS coordinates to the road manager and the database in the remote server, shortly after detecting the damage to the road pavement. Our study makes three key contributions. The proposed system 1) enables road managers to maintain road conditions quickly, accurately, and conveniently; 2) allows road mangers to take care of various kinds of damage to the road pavement at the initial stage; and finally 3) even makes it possible to track the damage, which suggests that the integration of a high-level decision support function becomes affordable. We tested the sensitivity and precision of the proposed system against real-time data obtained from the vehicles driving on the highway at an average speed of 100 km/h. With ten iterations, the proposed system achieved an average sensitivity of 74% and an average precision of 84% in road pavement damage detection, which is comparable with the best competing schemes.

Class Language Model based on Word Embedding and POS Tagging (워드 임베딩과 품사 태깅을 이용한 클래스 언어모델 연구)

  • Recurrent neural network based language models (RNN LM) have shown improved results in language model researches. The RNN LMs are limited to post processing sessions, such as the N-best rescoring step of the wFST based speech recognition. However, it has considerable vocabulary problems that require large computing powers for the LM training. In this paper, we try to find the 1st pass N-gram model using word embedding, which is the simplified deep neural network. The class based language model (LM) can be a way to approach to this issue. We have built class based vocabulary through word embedding, by combining the class LM with word N-gram LM to evaluate the performance of LMs. In addition, we propose that part-of-speech (POS) tagging based LM shows an improvement of perplexity in all types of the LM tests.

  • Makerspace is growing rapidly with government support and attention. The purpose of this study is to discuss how to operate makerspaces to meet the direction of university development and to support university education. To the end, this study focuses on (1) explored the concept of makerspace, (2) assessed the best practices for constructing and operating makerspaces among Korean and North American, and finally, (3) suggested the detail methods and precautions for constructing and operating makerspaces in Korean academic library. The data were collected from literature review, on site field survey, in-depth interviews with targeting librarians and telephone interviews, email surveys.

A Study on the Relationship Between Nursing Organizational Culture and ICUs Team Effectiveness (중환자실의 간호조직문화와 팀효과성에 관한 연구)

  • Purpose: The purpose of this research is, by investigating organizational characteristics, types of nursing organizational culture and team effectiveness in ICU, to ascertain the type of nursing organizational culture and the organizational characteristic that can improve the team effectiveness. Method: The research targeted 427 nurses from 33 ICUs of 14 general hospitals which have more than 250 beds and the data were gathered by using self-report questionnaires from April 10, 2003 to April 24, 2003. For this research, the following tools were used; the tool for measuring organizational characteristics and organizational cultures and the tool for measuring team effectiveness. Result: The most significant nursing organizational characteristic in ICU is the centralization. The organizational culture in ICU is generally rank-oriented culture. There was a significant difference (p<.01) in four types of organizational cultures; relation-oriented, innovation-oriented, rank-oriented and task-oriented. Verifying influence power of organizational cultures upon team effectiveness of ICU, relation-oriented culture had 49.2% of an influence upon team effectiveness, innovation- oriented and relation-oriented culture had 60.4% of an influence, and rank-oriented, innovation-oriented and relation-oriented culture had 61.2% of an influence. The organizational culture profiles according to the types of nursing organizational cultures in 33 ICUs were found by a cluster analysis. They were classified into five culture profiles; strong balance culture profile, weak balance culture profile, innovation-oriented and task-oriened culture profile, strong relation culture profile and strong rank culture profile(p<0.5). According to me organizational culture profiles, a significant difference of team effectivenesses(coworker satisfaction, team performance perception, team satisfaction and team commitment) was found(p<.01). The strong balance culture profile had the best team effectivenesses. Conclusion: For nursing culture management, a nursing administrator should identify the relevant nursing organizational culture at first by utilizing an innovative team-leader. After identifying the organizational culture, the administrator should make strategic plans and practices that can distinguish good organizational cultures to be expanded from ones to be sublated so that a strong balance culture can be developed.
