A Study on Resolution Methods of Overseas Direct Purchase Dispute by ODR (ODR을 통한 해외직구 분쟁해결방안)

  • As the Internet rapidly emerges as a speedy and cost-effective way of purchasing goods from overseas websites, the number of disputes arising out of overseas direct purchases also increases. In such situations, a disgruntled consumer might be left without an effective remedy. Providing an alternative approach to redress such grievances might assist in resolving such disputes and in increasing consumer confidence in e-commerce. Online Dispute Resolution (ODR) will allow consumers to solve their disputes without going to court, in a quick, low-cost, and simple way. It also helps to eliminate complex jurisdictional and choice-of-law problems. On the other hand, it has many problems such as having inadequate confidentiality and security, not being able to meet the "writing" requirement for arbitration of disputes, having difficulty in enforcing online arbitration agreements, having difficulties in enforcing online decisions and so on. This article investigates relationship online disputes and ODR and suggests ways that ODR can work best in resolving disputes arising out of overseas direct purchases. To expand the ODR system in online disputes, it is very important for domestic consumers to recognize the concept and usefulness of the Alternative Dispute Resolution (ADR) and ODR systems. The Korean government must also help consumers recognize the ADR mechanisms of dispute resolution by public campaign advertisement of ADR systems. Further education of dispute resolution in higher educational institutions is also required as well as assisting the KCAB with funds and the establishment of ADR Law.

Enforcement of South Korean Arbitral Awards in Mainland China

  • This article reviews some recent decisions of the Supreme People's Court (SPC) of the People's Republic of China (PRC) on the recognition and enforcement of several South Korean arbitral awards. It explains the implementation of the New York Convention in the PRC and in particular the so-called Report System under the current Mainland Chinese law and judicial practice. It identifies some deficiencies in the People's Courts' approaches to the application and interpretation of the New York Convention and argues that the Mainland Chinese courts should adopt the pro-enforcement principle in the determination of the relevant issues under the New York Convention. It proposes further enhancement of the Report System and that the current categorization of 'domestic, foreign-related and foreign' in the context of arbitration agreements and arbitral awards needs to be further reviewed and clarified by the SPC. Last but not the least, it recommends some steps that South Korean parties should take to enhance the enforceability of South Korean Arbitral Awards in Mainland China.

  • Since its introduction to the dentistry, the CAD/CAM technology has been used over fifteen years. The application of CAD/CAM started from coping fabrication, expanded to the posterior full crown, and anterior restoration manufacture has also become widespread recently. While the development of machine was rapid, the advance of zirconia block was the fastest. Although some differences exist among individuals, the various natural tooth color can be expressed through the zirconia coloring itself without porcelain build up. And the texture characteristics can be reproduced just by CAD design. In this article, the development history of digital dentistry was summarized.

  • Random walk hypothesis is a hypothesis that explains theoretically the difficulty in forecasting in financial market. Various tests for the hypothesis have been developed so far but it is known that those tests suffer from low power and size distortion. In this article, a sign test based on slopes are suggested to overcome these difficulties. A simulation study is conducted to compare this test to the often used Dickey and Fuller (1979) test.

  • The soil contamination by heavy metals in playgrounds of kindergartens in Vilnius city is analysed in this article. The aim of this research is to investigate and evaluate soil contamination by heavy metals in playgrounds of kindergartens in different territories of Vilnius city. Concentrations of heavy metals were measured using Thermo Fisher Scientific Niton$^{(R)}$ XL2 X-ray fluorescence spectrometer. Maximum allowable and background concentrations that are given in Lithuanian hygiene standard and Lithuania geochemical atlas are used to compare and evaluate concentrations of heavy metals. Concentrations of heavy metals and their spatial distribution were analysed in order to exclude the most contaminated areas relating with different functional areas of the city. Geo-statistical analysis and maps of spatial distribution were developed using IDW interpolator in ArcMap software. Detail soil surveys helps to assess the extent of anthropogenic impact in different parts of the city which can be harmful to the soil ecosystem and human health. Such researches can help to change or select different function for city areas in territorial planning process.

  • This article introduces the characterization of spin coated ZnO transparent conducting oxide on the flexible substrates. As a II-IV compound semiconductor, ZnO has a wide band gap of 3.37 eV with transparent properties. Due to this transparent properties, ZnO materials can be also employed as the transparent conducting electrode materials. Therefore, strong demands have been required for the transparent electrodes with low temperature processing and cheap cost. So, We will investigate the electrical property and optical transmittance of ZnO transparent conducting oxide through the 4-point probe resistivity meter, and ultraviolet-vis spectrometer Lamda 35, respectively.

Survival of Colorectal Cancer Patients in the Presence of Competing-Risk

  • Background: Colorectal cancer (CRC) is considered to be a main cause of malignancy-related death in the world, being commonly diagnosed in both men and women. It is the third leading cause of cancer dependent death in the world and there are one million new cases diagnosed per year. In Iran the incidence of colorectal cancer has increased during the last 25 years and it is the fifth cause of cancer in men and the third in women. Materials and Methods: In this article we analyzed the survival of 475 colorectal patients of Taleghani hospital in Tehran with the semi-parametric competing-risks model. Results: There were 55% male cases and at the time of the diagnosis most of the patients were between 48 and 67years old. The probability of a patient death from colorectal cancer with survival of more than 25 years was about 0.4. Body mass index, height, tumour site and gender had no influence. Conclusions: According to these data and by using semi-parametric competing-risks method, we found out that only age at diagnosis has a significant effect on these patient survival time.

Nonparametric Inference for the Recurrent Event Data with Incomplete Observation Gaps

  • Recurrent event data can be easily found in longitudinal studies such as clinical trials, reliability fields, and the social sciences; however, there are a few observations that disappear temporarily in sight during the follow-up and then suddenly reappear without notice like the Young Traffic Offenders Program(YTOP) data collected by Farmer et al. (2000). In this article we focused on inference for a cumulative mean function of the recurrent event data with these incomplete observation gaps. Defining a corresponding risk set would be easily accomplished if we know the exact intervals where the observation gaps occur. However, when they are incomplete (if their starting times are known but their terminating times are unknown) we need to estimate a distribution function for the terminating times of the observation gaps. To accomplish this, we treated them as interval-censored and then estimated their distribution using the EM algorithm proposed by Turnbull (1976). We proposed a nonparametric estimator for the cumulative mean function and also a nonparametric test to compare the cumulative mean functions of two groups. Through simulation we investigated the finite-sample performance of the proposed estimator and proposed test. Finally, we applied the proposed methods to YTOP data.

  • The car insurance market in Korea has already entered (or is in the process of entry) a mature market that is characterized by increased competition by market participants. Participants are expected to compete more intensively in order to survive. Together with a slowdown in market growth the goal of non-life insurers' marketing strategies is to enhance existing customer loyalty because it is easier to raise their loyalty via customer satisfaction than to attract new customers in a stagnant market. In this article, we investigate what factors affect customer loyalty, and suggest some specific ways to establish and implement marketing strategies. We use a generalized additive partial linear model in order to find some significant factors.

Study on the Waterproofing Performance of FGD Gypsum Building Products from Inorganic-Organic Composite Additives

  • In this article, poly methyl triethoxy silane was compounded with an inorganic waterproof admixture at a certain ratio to improve the performance of gypsum products; a new type of high-efficiency compound water-proofing additive was also investigated. Furthermore, the waterproof mechanism and the various properties on the hardened gypsum plaster were investigated in detail by XRD and SEM. The results show that the intenerate coefficient of gypsum plaster increased to more than 0.9; the water absorbing rate decreased to less than 10 %. Both the bending strength and the compressive strength of gypsum plaster increased by various degrees. The intenerate coefficient reached a maximum value of 0.73 and the strength of the samples showed almost no change when 5% cement alone was added. In this new type of the high-efficiency compound with waterproof additive, the optimal technological parameters for formulas were obtained to be: 5% cement, 18 % mineral powder, and 0.8% poly methyl triethoxy silane, to compound gypsum plaster. Meanwhile, the production of high performance gypsum as a building material has become possible.
