부당지급청구 사례로 본 청구보증 사용의 필요성에 관한 연구 (A Study on the Necessity of Using Demand Guarantee following Unfair Calling Cases)

  • It is quite true that the more Korean contractors receive overseas contracts, the more they need guarantees. The top market for them is the Middle East countries, consisting of more than the half of the total amount awarded last year and the trend is increasing as well. The problem, however, is that employers in these countries are reluctant to use international rules for guarantee such as URDG or ISP98 and easily make unfair callings. However, Korean contractors(applicants), especially small and medium sized enterprises(SMEs) tend to hurriedly enter a contract without looking into its contents as well as guarantees. They do not realize the importance of the guarantees until they receive callings from the employers(beneficiaries). Being independent from the underlying contracts, guarantee is the equivalent to cash in that it usually does not require any proof of demand when calling and the guarantor should make a payment within usually 5 business days after the request. It is often observed these days that several Korean SMEs go bankrupt due to liquidity risks after receiving unfair callings from employers in the Middle East countries. In retrospect, some cases could be obviated if contractors were a little more careful in checking the contents of a guarantee at the time of concluding a contract. For example, there is one case where the underlying contract includes a reduction clause in the Advance Payment bond and the guarantee does not have that clause. In the end, the Korean contractor had to take the whole burden of the bond amount though it had finished 81% of the project. Nobody could argue that contractors should take a full responsibility if they fail in their obligations. However, the employer's wrongful callings need to be prevented in the first place, if possible. As there shouldn't be a case where one party is at a disadvantage against the other like the case mentioned above, useful insight is being sought to minimize unfair calling risks for the benefit of the applicant. First, the applicant should carefully look into every detail of the potential guarantee before signing a contract, heeding especially that there is a reduction clause in the AP bond. Second, the governing principles for guarantee should be the ones that are internally used such as URDG758 that is objective in terms of callings given that, for example, it specifies that the requirement for a supporting statement when making a demand is a default rule. It is also recommended that the form of guarantees be the standard demand guarantee. Third, parties involved in issuing guarantees are advised to understand international rules for guarantee like URDG758 and ISP98 and to play a key role in guiding SME contractors in Korea so that they can protect themselves from possible wrongful callings, particularly from employers in the Middle East countries. I hope this study would give a wake-up call for Korean SMEs wishing to do business in the Middle East countries and remind them of the importance of guarantee itself and its governing principles.

  • 최근 주택시장의 경향을 반영하여 도시형 타운하우스의 개발이 지역에 따라 다양한 형태로 이루어지고 있는 실정이다. 그러나 생활주택으로서의 특성과 소비자들의 니즈를 잘못 판단하여 도시생활에 적합하지 않거나 무분별한 지역개발의 산물로 전락하는 등 많은 시행착오를 거듭하고 있다는 점은 매우 안타까운 일이 아닐 수 없다. 도시형 타운하우스의 장점은 사생활 침해나 가구 간 소음문제가 없으며, 개별정원과 주차공간의 확충, 접지성 확보, 개성 있는 내·외부 계획을 할 수 있다는 점이다. 또한 방범, 방재, 보안 등 공동관리 효율성, 출입문 분리를 통한 연속벽 건축, 중앙광장, 공원 등 공용공간 계획 등의 공동주택 측면의 장점도 갖추고 있어서 도시형 주거유형으로 발전할 수 있는 가능성은 매우 높다고 본다. 따라서, 본 연구에서는 도시 생활공간에 적합한 주택상품개발을 위한 기본 방향을 구축하여 도시형 타운하우스의 역할을 극대화하는데 그 목적이 있으며, 생활주택으로서의 공간적 요소와 기능적 요소 및 재료활용을 파악하여 소비자의 니즈에 부합하는 도시형 타운하우스의 주택상품개발을 위한 가이드라인을 제시하고자 한다.

밀 품질평가 현황과 검사제도 (Current Wheat Quality Criteria and Inspection Systems of Major Wheat Producing Countries)

  • On the purpose to suggest an advanced scheme in assessing the domestic wheat quality, this paper reviewed the inspection systems of wheat in major wheat producing countries as well as the quality criteria which are being used in wheat grading and classification. Most wheat producing countries are adopting both classifications of class and grade to provide an objective evaluation and an official certification to their wheat. There are two main purposes in the wheat classification. The first objectives of classification is to match the wheat with market requirements to maximize market opportunities and returns to growers. The second is to ensure that payments to glowers aye made on the basis of the quality and condition of the grain delivered. Wheat classes has been assigned based on the combination of cultivation area, seed-coat color, kernel and varietal characteristics that are distinctive. Most reputable wheat marketers also employ a similar approach, whereby varieties of a particular type are grouped together, designed by seed coat colour, grain hardness, physical dough properties, and sometimes more precise specification such as starch quality, all of which are genetically inherited characteristics. This classification in simplistic terms is the categorization of a wheat variety into a commercial type or style of wheat that is recognizable for its end use capabilities. All varieties registered in a class are required to have a similar end-use performance that the shipment be consistent in processing quality, cargo to cargo and year to year, Grain inspectors have historically determined wheat classes according to visual kernel characteristics associated with traditional wheat varieties. As well, any new wheat variety must not conflict with the visual distinguishability rule that is used to separate wheats of different classes. Some varieties may possess characteristics of two or more classes. Therefore, knowledge of distinct varietal characteristics is necessary in making class determinations. The grading system sets maximum tolerance levels for a range of characteristics that ensure functionality and freedom from deleterious factors. Tests for the grading of wheat include such factors as plumpness, soundness, cleanliness, purity of type and general condition. Plumpness is measured by test weight. Soundness is indicated by the absence or presence of musty, sour or commercially objectionable foreign odors and by the percentage of damaged kernels that ave present in the wheat. Cleanliness is measured by determining the presence of foreign material after dockage has been removed. Purity of class is measured by classification of wheats in the test sample and by limitation for admixtures of different classes of wheat. Moisture does not influence the numerical grade. However, it is determined on all shipments and reported on the official certificate. U.S. wheat is divided into eight classes based on color, kernel Hardness and varietal characteristics. The classes are Durum, Hard Red Spring, Hard Red Winter, Soft Red Winter, Hard White, soft White, Unclassed and Mixed. Among them, Hard Red Spring wheat, Durum wheat, and Soft White wheat are further divided into three subclasses, respectively. Each class or subclass is divided into five U.S. numerical grades and U.S. Sample grade. Special grades are provided to emphasize special qualities or conditions affecting the value of wheat and are added to and made a part of the grade designation. Canadian wheat is also divided into fourteen classes based on cultivation area, color, kernel hardness and varietal characteristics. The classes have 2-5 numerical grades, a feed grade and sample grades depending on class and grading tolerance. The Canadian grading system is based mainly on visual evaluation, and it works based on the kernel visual distinguishability concept. The Australian wheat is classified based on geographical and quality differentiation. The wheat grown in Australia is predominantly white grained. There are commonly up to 20 different segregations of wheat in a given season. Each variety grown is assigned a category and a growing areas. The state governments in Australia, in cooperation with the Australian Wheat Board(AWB), issue receival standards and dockage schedules annually that list grade specifications and tolerances for Australian wheat. AWB is managing "Golden Rewards" which is designed to provide pricing accuracy and market signals for Australia's grain growers. Continuous payment scales for protein content from 6 to 16% and screenings levels from 0 to 10% based on varietal classification are presented by the Golden Rewards, and the active payment scales and prices can change with market movements.movements.

전통시장 아케이드의 설치 및 관리 효율화 방안 연구 (A Study of Efficient Measures for Installing and Managing Traditional Market Arcades)

  • 전통시장 시설현대화사업이 본격적으로 시행된 이후 10년이 경과하였고, 전국 835개 이상의 시장이 이미 사업을 완료한 상황임에도 불구하고 공적 소유물인 다양한 시설에 대한 명확한 설치기준과 유지 및 관리에 대한 기준이 마련되어 있지 않은 실정이다. 이로 인해 실제 시설 설치에 따른 이해관계자들의 민원 발생으로 사업이 차질을 빚고 있거나 지방자치단체마다 각기 다른 시설 설치 기준을 확보하여 시행하고 있으며, 일부 지방자치단체의 경우 유지·관리를 위한 별도의 기준을 마련하지 못하고 있는 상황이다. 그 중 특히 아케이드 관련 사업은 2010년까지 전국 694개 시장에 아케이드 설치를 위한 사업비가 지원되었다. 지원 사업이 전개된 이후 짧은 기간 동안 급속하게 증가 된 전통시장 시설현대화사업의 대표적인 사례라고 할 수 있는데, 이처럼 많은 증가에도 불구하고 아케이드 설치 및 향후 유지와 관리에 대한 명확한 기준이 마련되어 있지 않다. 그리고 아케이드 시설의 경우 새롭게 조성된 환경에 대한 기초적 자료나 이용실태 조사 및 평가 없이, 그리고 공적(公的)환경을 정비하는 종합적인 접근 시각이 부족한 상태에서 단순히 비 또는 햇빛을 가리는 장치물로서 계획 및 설치되고 있는 실정이다. 또한 공공 시설물임에도 불구하고 유지·관리에 대한 명확한 주체와 가이드라인이 없어 초기에 아케이드가 설치된 시장의 경우 시설 보수, 유지 및 관리에 대하여 정부 및 지방자치단체에 사업비 지원 요청이 점차 증가되고 있다는 점을 감안할 때 보완이 필요하다. 이에 본 연구에서는 시설현대화사업에 의해서 설치된 전통시장의 시설물 중 아케이드를 중심으로 이용실태 및 유지·관리 실태를 조사하고 문제점 도출 및 해외사례를 통하여 효율적인 설치 및 유지·관리를 위한 방안을 제시하고자 한다.

벼 재배 품종과 환경의 상호작용 (Genotype $\times$ Environment Interaction of Rice Yield in Multi-location Trials)

  • 강원도 지역에 적응성이 있는 품종을 선정하기 위해서 5개 시험지에서 11개 품종으로 1997년부터 2000년 동안에 수행된 결과를 분석하였다. 품종이 가지고 있는 유전적 특성은 환경요인과의 상호작용을 거쳐 발현되므로 장려품종을 선정하기 위하여 수행하는 다지역검정에서 이 유전자-환경간 상호작용을 평가하는 것은 품종의 환경안정성과 지역적응성을 올바르게 파악하는 데 매우 중요하다. 이를 위해서 기존에 활용되어 온 회귀분석모델로서 안정성을 분석하였고 AMMI model로서 지역별 수량성 반응의 변화양상을 토대로 유전자-환경간간의 상호작용을 해석하면서 각 시험지별 적응성 품종과 지역적 특성을 검토하였다. 1. 각 시험지에 대한 수량안정성 평가를 위한 회귀분석 결과 오봉벼, 진미벼, 신운봉벼, 운봉벼 등이 안정성이 있는 품종이었다. 2. AMMI 분석에 의한 수량성에 대한 분산분석 결과 전 변이중 품종변이가 66%, 품종-환경간 상호작용변이가 21%, 지역간 변이가 13%였다. 21%의 품종-환경간 상호작용 변이는 주성분분석을 통하여 제1주성분치(IPCAl)와 제2주성분치 (IPCA2)에 의해서 거의(92%) 해석되었다. 3. 품종들의 지역간 수량성 변화패턴은 육성모지나 시험지 등에 영향을 받았고, 5개 시험지의 수량변화 양상은 철원과 정선, 춘천과 고성이 비슷하였고 강릉은 다르게 구분되었다. 품종-환경간 상호작용 양상이 축약된 주성분분석치와 시험지별 재배기간동안의 순별 평균 기상자료와의 상관분석 결과를 기준으로 품종과 환경간의 상호작용에 관여하는 주요 기상요인은 초상최저온도, 최소상대습도, 일조시수 강수량 등이었다. 4. 비교적 환경안정성이 있는 품종으로는 오대벼, 오봉벼, 진부벼 등이었다. 철원에 적응성이 있는 품종은 진부벼, 신운봉벼, 오대벼, 오봉벼 등에었고, 춘천에는 진미벼 상주벼, 오대벼, 오봉벼가 정선, 강릉, 고성에는 진부찰벼, 삼천벼, 둔내벼 , 운봉벼, 진부올벼가 적응성이 있었다. 0.57, Fe 0.414, p 94.68, fat 3.74, protein 3.08, lactose 4.68,4. In case of processed market cow′s milk ; Ca 134.72, K 142.74, Mg 10.33, Na 45.07, Zn 0.50, Fe 0.650, p 92.48, fat 3.72, protein 3.07, lactose 4.74. According to the group of market milk(milk, fortified market row′s milk, processed market cow′s milk), the mean concentration of Ca and Fe were significantly higher in fortified and processed milk than milk(p<0.05). There were no significant differences in macronutrient(fat, protein, lactose) and mineral contents between pasteurized milk and UHT(ultra high temperature) treated milk($\alpha$=0.05). The labeled "Nutritional Facts" of market milk were satisfied with "Labeling Standards for Livestock Products of Korea". The measured mean concentrations of Ca, Fe, Zn were generally higher than lower limit of labeled value(above 80% of labeled value). 인터넷 의료광고의 규제방향에 대한 법적 검토 (Legal Review of Regulatory Guidelines for Medical Advertisements Online)

  • The contemporary age is a period of PR for the self. Regardless of how good the quality of goods or services offered is, if it is not made known to the buyers, a sell is impossible. As a result, the contemporary man is flooded with advertisements and is living in a time of over-saturated information. This is not much different in the medical services sector, as it too is experiencing an overflow of information due to the expansion of advertisement approaches to include not only the previous positive-method, but also the negative-method. In tandem, recent advancements in electronics and information technology has made possible a rapid increase in then number of internet advertisements. However, outmoded medical law, which was created to regulate newspapers and billboards, is still being applied to regulate today's modem medical advertisements. At the same time, collateral ordinances such as "corrective statutes for signs and advertisements" are not sufficient in providing the necessary regulatory countermeasures. In the midst of all this, as IPTV is scheduled to be broadcast nationwide starting next year, and with the market for search advertisements and internet advertisements annually growing at a rapid pace, it has become evermore urgent to come up with an adequate regulatory measure. Consequently, it is necessary to look into the possibility of restricting the medium and content of internet medical advertisements as well as realistic schemes for its realization. In particular, regulatory measures that take into consideration the special characteristics of internet advertisements should be found, and the necessity of an prior deliberation procedure and the likelihood of introducing a certification system should be examined.

한국(韓國) 근대기(近代期) 내륙지방(內陸地方) 도시주택(都市住宅)의 유형(類型)과 변천(變遷)에 관한 연구(硏究) (A Study on the Types and Changes of the Urban Houses in the Korean Inland during the Period 1910-1945)

  • In the meantime, the study of traditional and contemporary house had been produced so many achievements in korea, but modern house is yet to be solved, Accordingly, It is necessary to develop and present the basic research data in order to build up an objective study for urban house in the modern age(1910-1945), Following to a study on the foreigner's house in grid-type settlement of Open Ports, in this research is to investigate and analyze modern houses of urban areas in korean inland, and then clarify types and changes of them. In the first year($1995{\sim}96$), the modern houses of Central Inland Districts(arrounding river Kumgang)-Kunsan kanggyong Puyo Kongju Pugang Chongju were investigated by the layout of room, the construction and materials, the design and style, etc. In the second year($1996{\sim}97$), the modern houses of Open Market(開市場)-Seoul Taegu Kwangju Taejon Chonju were conducted to investigate as above. The traditional house transformed by differentiation and addition of room(kan), the various types were respectively adopted for the korean reforming and western cultural house. In the layout of room, the types of plan were gradually concentrated from the single wings of korean traditional house. The korean traditional house was later improved through the introduction of entrance, corridor, and internal toilet/bathroom. But the korean under-floor heating system(andal) and a series of three rooms had been entirely maintained, composed of master bedroom/living room(daechung)/room. And the traditional town house with shop and storage, being built closely to each other and walled up both sides, it had taken gradually the extensive characteristics in itself. By the displacement of shop/dwelling/ storage. the various types were respectively adopted for the separated, multi-storied, and complex type. The type of them was gradually changed to the narrow and linear form. And so with the stockpile of fundamental datas about modern houses in korean urban areas, we expect these results contribute to the knowledge of the spatial characteristics of urban house at present which are required to the understanding of transition as well as types.

An outlook on livestock welfare conditions in African communities - A review

  • A significant proportion of the African continent is conducive for animal agricultural production, due to its historical experience and available resources to accommodate and nurture various indigenous and exotic animal species and breeds. With food security being a global challenge, animal products can play an important role as nutrient dense food sources in human diets, particularly in Africa. However, this does not seem to reach its full potential in practice, due to numerous reasons that have not been adequately addressed. Animal welfare reservations can be highlighted as one of the major contributing factors to the curbed progress. The consequences have been scientifically proven to affect product quality and market access. However, in the African community, the concept of animal welfare has not been fully embraced. While there are international animal welfare standards in the developed world, there are inherent factors that hinder adoption of such initiatives in most developing regions, particularly among communal farmers. These include cultural norms and practices, social ranking, socio-economic status, available resources, information dissemination and monitoring tools. Therefore, there is need to harmonize what is internationally required and what is feasible to accommodate global variability. The protocols followed to ensure and evaluate farm animal welfare require regular investigation, innovation and a sustainable approach to enhance animal productivity, efficiency and product quality. Additionally, investing in animal wellbeing and health, as well as empowering communities with significant knowledge, has a potential to improve African livelihoods and contribute to food security. This review seeks to highlight the concept of animal welfare in relation to livestock and food production in African conditions.

친환경 모바일 홈 사우나 디자인 개발에 관한 연구 (A Study on Design Development of Environment-friendly Mobile Home Sauna)

  • The appeal of sauna is caused by the fact that through that, one can feel Korea's unique temperament and culture; however, because of its being a public facility and flooding of businesses due to excessive supplies of various additional features such as washing, playing, eating, sleeping and health care functions, issues of social resources and environment come to the fore, so it has reached a situation of red ocean that it is difficult to enter the market anymore. Taking these into account, this study focused on developing a thermal technology and design of the housing of an environment-friendly mobile home sauna, making the most use of the sauna's fundamental purpose and settling it as a tourist product, analyzing the marketing research on the existing sauna and considering the recent housing trends and lifestyles for a new concept sauna. Thus, regarding its characteristics and utilization, it was designed smaller than $10m^2$ (3 pyeong) so that it would be easy to install in any space and convenient to move. It can be installed in separate buildings and rest spaces such as country houses, resorts, pensions, camping grounds as well as outdoor houses, custom produced for a measure of pyeong that customers want so as to match up with the Enforcement Ordinance of the Agricultural Land Act in a concept of the farmer's hut and kitchen, bathroom and bathroom can be installed inside according to an option. In addition, regarding its efficacy, in order to give environment-friendly healing effects, materials such as Hinoki Cypress, red clay and hardwood charcoal were used, a fixed indoor temperature of $70{\sim}100^{\circ}C$ was maintained by heating methods such as electromagnetic wave free, energy saving and low-power boiler, and it was made to have excellent effects on fatigue recovery, relieving stress, skin care and diet through far-infrared emission.

신뢰성 확보를 위한 u-헬스케어 소프트웨어 시험 방법 (The u-Health care Software Testing Method For a Reliability Secure)

  • 현재 u-Health 기술의 표준화 추진 및 국내 자체의 원천 기술 및 기능개발을 위한 노력이 지속적으로 이루어지는 시점이다. 이에 따라 u-Health 소프트웨어 분야의 기반 기술을 조사하고 u-Health 소프트웨어 시장 동향 및 표준을 조사하였으며, 신뢰성 있는 u-Health 소프트웨어의 평가모델을 개발하고자 한다. 이를 위해 본 연구에서는 u-Health 소프트웨어의 특성 및 서비스 유형을 조사하고 u-Health 기술 동향 및 표준을 분석하였으며, u-Health 소프트웨어 기술적, 기능적 요소를 분석하여 u-Health 소프트웨어를 국제표준 ISO/IEC 9126 에 입각하여 품질평가 항목을 개발하였다. 이를 기반으로 u-Health 소프트웨어에 대한 평가모델을 개발하였으며, 개발된 평가모델을 바탕으로 u-Health 소프트웨어 품질 시험평가를 하였다. 신뢰성 확보를 위한 u-Health 소프트웨어에 대한 평가모델 개발을 통해 고품질의 경쟁력을 갖춘 u-Health 제품의 개발을 지원할 수 있을 것으로 기대한다.
