  • Korean businesses engaging in transactions with U.S. entities are increasingly favoring arbitration clauses to address unexpected disputes. How best ought the parties' arbitration contractual terms be drafted to avoid lengthy, protracted and expensive legal disputes? Authors examine the public policy favoring arbitration through the U.S. Federal Arbitration Act. Korean litigants seeking a "Motion to Compel Arbitration" rely on arbitration clauses designed to address four factors U.S. courts use to evaluate the enforceability of arbitration contract clauses. What role does U.S. state court jurisdiction hinder or help Korean businesses contracting with U.S. business entities located within certain boundaries? What is the effect of an arbitration clause that designates the Korean Commercial Arbitration Board in Seoul to arbitrate? All cases analyzed entail Korean business entities. Eleven cases demonstrate the results of seeking motions to compel arbitration in U.S. courts. Three cases illustrate motions to compel arbitration drafted to use the Korean Commercial Arbitration Board in Seoul. The results provide Korean businesses and legal practitioners insight into addressing the specific goals of including contractual arbitration clauses to enhance their international commercial interests in the United States.

  • Free flap having been used for reconstruction of skin and soft tissue defect in various areas in a body is spreading up its application for not only functional reconstruction but also aesthetic reconstruction. Authors met with good results minimizing the demerits of anastomosis using suture through microvascular anastomotic device, hereupon, we intend to report this. We worked with 27 cases that used microvascular anastomotic device for venous anastomoses among patients who were processed free flap in our hospital. Age ranged from 12 to 63 (average 43.2), and there were 12 females and 15 males. As a result of a follow-up by 3 months - 5years (average 11.3 months), there was no particular complication in the anastomosed vein except 1 cases among 27 cases that sutured their veins through microvascular anastomotic device. Use of microvascular anastomotic device at free flap shortened the time required for vascular anastomoses to reduce ischemic time of tissue, and minimized the damage of intima during anastomoses and made easy anastomoses possible even in case the difference of diameters of blood vessels being sutured is wide. As well, even for survival rate of flap, satisfactory results were obtained compared with using suture. Consequently, it is concluded that use of microvascular anastomotic device in free flap is a useful way that can substitute existing anastomosis using suture.

  • The major concern of component users who develop applications using the existing components is to confirm whether a component is collaborating with the different components in accordance with the requirements. Therefore, interoperability testing whose role is to check whether components collaborate with each other within the new operating environment not within the component development content of each component is considered as an importance research topic. In this paper, we propose a test case generation technique for interoperability test of component based software. The proposed technique defines a test model for generating test cases. The proposed technique generates test models from the use case specification and thereafter from these models, test cases for Interoperability testing are derived. In addition, we describe a tool which Implements the procedures for generating test sequences from test models.

  • Before an IT product is used, there is a sequence of the process such as the components supply-demand of the product, their assembly and production, their logistics and delivery, and then finally, the product can be used by a user. During this sequence of the process, there can be many security exposures and risks. In this paper, we show, by examining security cases of various IT products, that there are many security exposures in the process of IT products from their production to their delivery to end users and in their use, and also show how critical the security exposures are. Even though there are various security theories, technologies and security controls, there is still weak link from the production of an IT product to its use, and this weak link can lead to security vulnerabilities and risks. This paper tries to call attention to the importance of the execution of the security control and the control components. We examine the practical cases to find out how the security control is paralyzed, and to show how it is compromised by asymmetric security resources. Lastly, from the cases, we examine and review the possible domestic security issues and their countermeasures.

  • Korea has shown a tremendous leap in economic development in a short span of time, and the world is watching Korea's economy with keen interest. Development of industries that are implementing information systems (IS) has played a role in leading economic growth in Korea. Because of the success of Korean firms, the creation of case studies for implementing IS in Korean firms was attempted. Despite the many case studies, analysis of the motivations and results, for implementing IS as a firm's strategic purpose, was rarely conducted. Therefore, this paper investigates some Korean firms' cases studies in order to show the best practice example of implementing and adopting IS strategically. Nine cases of Korean firms' strategic use of IS were analyzed in various industry fields. Each case consists of the following four categories: company overview, background implementing IS, adoption of IS for strategic purpose, and the results of implementing IS. In order to help various companies to take an action with their IS implementation and its strategic use, implications from the cases are summarized to show how Korean firms strategically introduced IS for solving particular problems that they had faced.

  • Over the past four decades after World War II a great deal of data and clinical experiences have been accumulated relating to the diagnosis and surgical treatment of cardiovascular diseases in Korea. Clinical data after the first open heart surgery by Professor Yung Kyoon Lee on August 7, 1959 up to 1984 revealed the total number of cardiovascular surgery in Korea as 13,100 cases performed in 22 institutes with overall hospital mortality of 7.7%[Cardiovascular Surgery in Korea 1985], Publishing committee of the Korean Thoracic and Cardiovascular Surgical Society collected the data of cardiovascular surgical cases in Korea again in between 1985 and 1990 from 38 institutes out of total 42 institutes of open heart centers in Korea. The results are: 1. The survey reply ratio was 90.5%[38 out of 42 institutes]. 2. Of the total 30,061 cases of cardiovascular surgery reported from 38 institutes 1,402 cases were failed as hospital mortality of 4.7%[4.5% of the 21,761 operations for congenital, and 5.2% of the 8,300 operations for acquired heart diseases]. Out of the total congenital cases, 17,303 cases were acyanotic group with a operative mortality as 2.0%, and 4,458 cases were cyanotic group with a hospital mortality as 14.le The incidence of corrective operations for complex congenital cardiac anomalies were increasing recently with decreasing age group. 3. During the year in 1990, 38 institutes performed 5,427 cardiovascular surgery with a hospital mortality of 3.4%. 4. Of the total cumulative 6,458 cases for cardiac valve surgery more than 90% cases were put to prosthetic valve replacement with hospital mortality as 4.8%. And the incidence of re-Do valve surgery was increasing recently as 13.1% in 1990. 5. Coronary artery bypass graft was increasing recently with 7.9% of hospital mortality in total 440 cases. Intracardiac operation for intractable arrhythmia was started since 1987 as 49 cases in total. Experiences on VAD and ECMO were also reported sporadically in recent year. 6. Home made oxygenator[OXYREX] is now in clinical use, and under animal experiment for clinical trial in near future.

  • This research aimed to investigate the current trends of rooftop greening techniques of frequent use within and without Korea. It is also expected that this research will help developing new rooftop greening techniques appropriate for Korean environment. Data for this study have been collected from patent applications for rooftop greening techniques; the web sites of the Korean Intellectual Property Office as well as patent offices in Germany and Japan, where active researches on rooftop greening techniques are in progress. 168 applications within a period from the year of 1984 to December of 2004 were examined, among which Japan excelled with its 81 applications followed by Germany(54), Korea(31)and USA(2). In case of Japan, where more patent applications were found than in any other countries, applications for Plant Base(38) excelled others - System(36), Management(4) and Plant(3) in the number of applications. As for Germany, 25 cases were on Plant Base, 25 cases on System, and 4 cases on Plant; in Korea, 15 cases were on Plant Base, 11 cases on System, 3 cases on Plant and 2 cases on Management; in USA, 1 cases were on System and 1 cases on Plant. Overall, the total number of patent applications in three countries reaches 168 cases; among which Plant Base topped in all four countries, followed by 73 cases on System. Applications concerning Plant and Management totalled to 11 and 6 for each. In conclusion, most patents were concentrated on Plant Base and System while researches on Plant and Management still do not get as much attention as they deserve. Research and development of various techniques on Plant must be a precondition for the formation of diverse Bio-tops suitable for the environments of specific areas. Concrete researches on rooftop greening techniques will contribute to the improvement of urban ecosystem by developing more convenient and easily applicable techniques during the time of actual construction.

  • Background and Objectives: Reliable and versatile free flap has become a mainstay in reconstruction of the head and neck. But until now pectoralis major myocutaneous flap (PMMCF) as workhorse is useful and has some advantages such as good viability, one-stage reconstruction and carotid protection. The objective of this study was to review the role and indication of PMMCF in this era of potent free flaps for head and neck reconstruction. Patients and Methods: Sixty one PMMCF and one hundred forty six free flaps used for head and neck reconstruction between 1991 and 2001 were reviewed retrospectively. We compared the applied sites of flap, the flap failure rate and complications. Results: Contrary to the free flap, use of PMMCF has gradually decreased after the middle of 1990s. PMMCF were mainly used for mucosal defect(33cases, 54.1%) and cervical skin defect(22cases, 36.1%) and free flap were mainly used for mucosal defect(129cases, 88.4%). In point of use of PMMCF according to years, from 1991 to 1997, 30cases(70%) are used to reconstruct mucosal defect and 12cases(29%) are used to reconstruct skin defect. But from 1998 to 2001, only 2cases(10.5%) are used to reconstruct mucosal defect and 13cases(68.4%) are used to reconstruct neck skin defect. In case of free flap, from 1991 to 1997, 41cases (87%) are used to reconstruct mucosal defect and from 1998 to 2001 88cases(89%) are used as same purpose. Three major necrosis (more than 50%) deveolped in 61 PMMCF (4.9%) and three major necrosis developed in 146 free flaps(2.1%). Conclusion: PMMCF is no longer flap of choice for primary reconstruction but it is a still one of a good tool in some head and neck reconstruction such as covering single wide defect of face or neck skin, back-up procedure of free flap, postoperative status, treatment of pharyngocutaneous fistula and covering vital structure.
