  • The Supreme Court's en banc decision on December 12, 2022 (docket number 2016Do21314) presented a new standard for determining whether the use of diagnostic medical devices by Korean medical doctors constitutes oriental medical doctors constitutes unlicensed medical practice. Based on this standard, it was determined that the use of ultrasound by Korean medical doctors was not an unlicensed medical practice. Supreme Court's Decision 2016Du51405 on August 18, 2023, is the first case in which a new standard was applied to determine that an Korean medical doctor's use of electroencephalography to diagnose Parkinson's disease and dementia was not an unlicensed medical practice. The Supreme Court abolished the previous standard that Western medical knowledge and technology should not be required for Korean medical doctors to use medical devices. However, it was unclear whether Western medical diagnosis of Korean medical doctors using diagnostic medical devices would be viewed as an an auxiliary method of diagnosis. Parkinson's disease and dementia are Western medical diagnoses. The Supreme Court judged that the Western medical diagnosis of Korean medical doctors was not an unlicensed medical practice. This clearly explains what an auxiliary method of diagnosis means. In addition, the Supreme Court excluded the principles of development and production of electroencephalography from its judgment criteria. Automatic extraction and automatic reading of test results were also excluded. The criminal court's view that the meaning of oriental medical practice should be clearly and strictly interpreted from the perspective of an oriental doctor, and it was clarified that diagnostic medical devices were excluded from criminal punishment unless it was clear that they were not related to the principle of oriental medical practice. As a result, the Supreme Court made it clear that the use of diagnostic medical devices is excluded from criminal punishment unless it is clear that they are not related to the principles of Korean medicine.

Interference Analysis and Its Mitigation Policy Based on MAC Layer for Peaceful Co-Existence between Unlicensed Devices (비면허 기기 간 주파수 공동사용을 위한 MAC 계층 기반의 간섭 분석 및 간섭 완화 정책)

  • In order for unlicensed devices to co-exist on the same frequency band, the frequency interference mitigation policy is necessary. Because the effects of frequency interference between unlicensed devices may vary depending on the analysis layer, exact interference analysis must be proceeded before making any related spectrum policy. In this paper, a frequency interference between WLAN and WPAN systems that operate at 2.4 GHz ISM band were analyzed in the physical layer and MAC layer, respectively. From the results, we confirmed that the interference analysis in MAC layer is closer to the measured results. Based on these investigations, we suggest a new co-existence criterion for unlicensed devices in MAC layer.

  • Over the past several years both licensed and unlicensed services and devices have enjoyed extensive growth in the wireless marketplace. In some urban areas in the Kazakhstan, the penetration rate of licensed cellular and PCS services is more than 60%. Similarly, the use of unlicensed wireless local area network technologies has grown significantly as these systems have been deployed in homes, offices, and 'hot spots' in restaurants, hotels, public meeting areas, etc. As more services are wirelessly enabled and as technologies continue to evolve, the demand for new spectrum for commercial services will also continue to increase. Thus, the appropriate regulatory models for future spectrum allocations will continue to be debated throughout the wireless industry.

Requirements for 6 GHz Unlicensed Bands (6 GHz 비면허 대역 이용을 위한 기술기준)

  • Federal Communications Commissions (FCC) has adopted a new rule that can provide a 1,200 MHz unlicensed spectrum to maximize the public benefits in the 5.925 ~ 7.125 GHz(6 GHz) band by expanding unlicensed broadband into the 6 GHz band while also ensuring that licensed services that operate in the band continue to thrive. In Korea, the M/W band of 6 GHz has been reallocated to introduce unlicensed services in the 6 GHz band. Considering the national interests, the entire 1,200 MHz will be supplied for the indoor uses, but only the 500 MHz of the lower bandwidth (5925 ~ 6425 MHz) will for the outdoor uses under the limited power to protect the incumbent services. The introduction of unlicensed devices is being actively promoted through the reallocation of the 6 GHz M/W band, but since it is desperately necessary to prepare technical requirements to operate them in Korea. In this paper, the US 6 GHz unlicensed rules has been analyzed, these results will be utilized for establishing Korean technical standards with the unlicensed spectrum expansion.

  • Recently FCC has considered about the unlicensed device operation in licensed bands. However, this operation can give the harmful interference to the existent licensed system while unlicensed devices operate. Therefore, there should be strict requirements to protect licensed system. So in this paper we propose dynamic frequency selection method in the MAC layer, which is based on the cognitive radio technology. The proposed dynamic frequency selection method creates channel lists after sensing the licensed channels. And it helps the CR base station immediately to moves the current channels that are used by the unlicensed system to other available bands dynamically when a licensed system's signal is detected. This method can reduce interference that is caused by unlicensed devices. In addition, it can maximize channel utilization with enabling coexistence of unlicensed system and licensed system.

An Efficient Data Collection Method for Deep Learning-based Wireless Signal Identification in Unlicensed Spectrum (딥 러닝 기반의 이기종 무선 신호 구분을 위한 데이터 수집 효율화 기법)

  • Recently, there have been many research efforts based on data-based deep learning technologies to deal with the interference problem between heterogeneous wireless communication devices in unlicensed frequency bands. However, existing approaches are commonly based on the use of complex neural network models, which require high computational power, limiting their efficiency in resource-constrained network interfaces and Internet of Things (IoT) devices. In this study, we address the problem of classifying heterogeneous wireless technologies including Wi-Fi and ZigBee in unlicensed spectrum bands. We focus on a data-driven approach that employs a supervised-learning method that uses received signal strength indicator (RSSI) data to train Deep Convolutional Neural Networks (CNNs). We propose a simple measurement methodology for collecting RSSI training data which preserves temporal and spectral properties of the target signal. Real experimental results using an open-source 2.4 GHz wireless development platform Ubertooth show that the proposed sampling method maintains the same accuracy with only a 10% level of sampling data for the same neural network architecture.

Test-Bed Implementation for Real-Time Frequency Interference Analysis between Unlicensed Devices (비면허기기 간 실시간 주파수간섭 분석 테스트베드 구현)

  • In this paper, we suggested a real-time test-bed for analyzing frequency interference between 2.4 GHz unlicensed devices, such as WiFi, Zigbee, etc. Owing to versatile programming capability of Universal Software Radio Peripheral(USRP) and $Labview^{TM}$, frequency interference environments can be easily modeled. Therefore, performance degradation effects due to various parameters of interferer and victim receiver can be analyzed intuitively. For verification, we showed a frequency interference scenario, which consists of IEEE 802.15.4 as a victim and IEEE 802.11b as a interferer. Measured Bit Error Rate(BER) results showed good agreement with theory and simulation results.

Feasibility Study for Device-to-Device Communications Using Unlicensed Bands in a Cellular Network (셀룰러 네트워크에서 비면허 대역을 활용한 단말 간 직접통신 타당성 연구)

  • Device-to-Device communication(D2D) enables devices in proximity to communicate directly without going through the network infrastructure. In particular, D2D communications in a cellular network can improve the spectral efficiency by allowing the reuse of cellular resources. However, it is not easy to maintain the channel quality of the D2D links and to protect the cellular links from the D2D interferences, since the resource allocations for the cellular users will change with time due to the time-varying nature of the cellular channels. To mitigate the performance degradation of D2D links, we propose to exploit unlicensed bands as auxiliary resources when the D2D links share the uplink cellular resources. The effectiveness of the proposed scheme is verified through simulations.

  • LTE's extension for unlicensed spectrum called Licensed Assisted Access (LAA) is equipped with Listen-Before-Talk (LBT) designed similar with the backoff mechanism of Wi-Fi for coexistence. However, Wi-Fi's backoff mechanism has not evolved from its old design for compatibility with legacy devices, thus LAA's LBT is not efficient either in utilizing spectrum. If LAA operates with no Wi-Fi systems in proximity, it can run more efficient LBT. In this paper, we propose Narrowband Clear Channel Assessment (NCCA) for narrowband transmission. In NCCA, an LAA node performs LBT in either wide or each narrow bandwidth segment. This allows multiple LAA nodes to perform simultaneous transmissions in orthogonal bandwidth segments in the same time slot. We design four variants of NCCA implementation and model their performance using a mathematical model. The coexistence performance of NCCA with conventional wideband nodes and the accuracy of the model are shown via simulation.
