최근 선진국에서는 미래의 시장을 선점하기 위하여 유망 신기술에 대하여 조기에 지적재산권을 확보하려는 노력을 기울이고 있다. 본 연구는 세계 특허시장 중에서 가장 경쟁이 치열한 미국 특허시장을 중심으로 IT 유망기술을 도출하고 그 시사점을 살펴보는 데 목적이 있다. 본 연구에서는 이러한 목적을 효과적으로 달성하기 위하여 IT기반 유망기술에 대한 조작적 정의를 내리고, 이 정의를 토대로 2001년부터 2008년까지의 미국 공개특허 데이터베이스를 이용하여 유망기술을 도출하였다. 연구결과에 의하면 IPC main-group 수준에서 총 803개에 이르는 IT기술 중 69개 분야가 유망기술로 나타났다.

Advances in science and technology are driving us to the better life but also forcing us to make more investment at the same time. Therefore, the government has provided the investment to carry on the promising futuristic technology successfully. Indeed, a lot of resources from the government have supported into the science and technology R&D projects for several decades. However, the performance of the public investments remains unclear in many ways, so thus it is required that planning and evaluation about the new investment should be on data driven decision with fact based evidence. In this regard, the government wanted to know the trend and issue of the science and technology with evidences, and has accumulated an amount of database about the science and technology such as research papers, patents, project reports, and R&D information. Nowadays, the database is supporting to various activities such as planning policy, budget allocation, and investment evaluation for the science and technology but the information quality is not reached to the expectation because of limitations of text mining to drill out the information from the unstructured data like the reports and papers. To solve the problem, this study proposes a practical text mining methodology for the science and technology trend analysis, in case of aerospace technology, and conduct text mining methods such as ontology development, topic analysis, network analysis and their visualization.
Technological forecasting for microprocessor market can provide timely insight into the prospects for significant technological changes in computer hardware as well as software. In this paper, we use bibliometrics to forecast R&D trend on microprocessor technology. Cumulative numbers of US Patents on several generations of microprocessor technology (pipeline, superpipeline, supersclar and VLIW) approved since 1980 are applied to fit diffusion models. Our study results provide both the maximum market potential and the maturity time for each generation of microprocessor technology. Such information is expected to make contribution on making better decisions with regard to strategic corporate planning, R&D management, product development and investment in new technology of microprocessor.
This paper explores multi-technology capabilities between Korea and Taiwan by analyzing the pattern of inventive activities concerning technology fusion by using patent bibliometrics. Although two countries exhibit a similar level of invention activities and high degree of specialization in emerging technologies measured by the number and technological fields of their US patents, innovation systems in two countries differ. MTCs (multi-technology corporations) are stronger in Korea national innovation system while small innovative firms play important roles in Taiwan national innovation system. Technology fusion has been an important source of technological innovation and it suggests possible advantage for the Korean innovation system because it is a common belief that global size firms - most of them are multi-technology corporations - can perform better in multi-technology fusion and scientific research. The result of patent bibliometrics suggests rather complex answers to the belief Even though Korea shows slight advantage, it may not be ascribed to the large MTCs.
글로벌 경쟁의 가속화와 연구개발 투자의 위험성 증가에 따라 글로벌 개방형혁신에 대한 필요성이 제기되고 있는 가운데, 국제공동연구의 성과라고 할 수 있는 공동 출원 특허에 대한 품질평가를 통해 국제공동연구가 과연 효과적인지를 실증 분석하였다. 최근 들어 국제공동연구에 의한 공동출원 특허의 양은 더욱 가파르게 증가하고 있다. 1990년부터 2010년까지 21년간의 미국특허정보를 분석한 결과, 국제공동연구(international cooperative R&D)는 국내공동연구(domestic cooperative R&D)에 비해 피인용 수, 특허 패밀리 수, 청구항 수 등의 품질지표에서 모두 우수하다는 분석결과를 보여주었다. 국제공동연구에 의해 공동출원된 특허 가운데 가장 높은 품질을 보이는 산업은 IT산업으로 분석되었으며, 바이오산업, 자동차산업 등, 첨단산업 분야에서의 성과가 상대적으로 우수하다는 결과가 도출되었다. 미국특허 데이터베이스를 토대로 국제공동연구의 네트워크 분석을 수행한 결과 매개 중심성이 가장 높은 국가는 미국으로 나타났고, 독일, 영국, 캐나다, 프랑스가 그 뒤를 이었다.
사물인터넷은 오늘날 기술 주기에서 가장 널리 논의되고 있고 있는 기술적 개념이다. 이러한 기술은 우리가 어떻게 일을 하는지 뿐만 아니라 어떻게 사는지에 대한 급진적 변화를 예측할 수 있다. IoT의 개념은 기본적으로 데이터 네트워크를 통해 컨트롤 할 수 있는 연결된 장치의 웹을 의미한다. 이와 같은 장치들을 컨트롤하기 위해 요구되는 기술 비용과 스마트폰을 통한 인터넷의 연결의 증가로 IoT는 향후 10년 안에 모든 퍼베이시브 기술이 될 것으로 예상된다. 본 논문에서는 지식재산권(특허)의 관점에서 빠르게 성장하는 기술 도메인의 기술적 요소들을 살펴본다. IoT 기술의 특허 분포에서 전체 특허들의 5%가 상위 특허 출원인이고 나머지는 다수의 출원인이 차지하고 있다. 특히, 미국지역에 가장 많이 출원하고 있고, 이것은 한국과 일본의 큰 아시안 시장과 밀접한 관계가 있다.
인공지능 기술의 발전과 더불어 세계 각국의 인공지능 기술 특허를 둘러싼 경쟁도 치열해지고 있다. 2000년~2021년간 미국 특허청의 인공지능 기술 특허출원은 꾸준히 증가하고 있는 가운데 2010년대 들어 보다 가파른 성장세를 기록하고 있다. 특허지표를 통해 한국의 인공지능 기술경쟁력을 분석한 결과, 청각지능, 시각지능 등의 세부 분야에서 특허활동성, 영향력, 시장성 등이 우위에 있는 것으로 평가된다. 그러나, 주요국과 비교하여 한국의 인공지능 기술 특허는 양적 활동성, 시장성 확보 측면에서는 상대적으로 우수하나 기술 파급력은 다소 열위에 있는 것으로 나타난다. 최근 인공지능 기술 토픽으로 노이즈 캔슬링, 음성인식 등은 감소한 반면 모델학습 최적화, 스마트센서, 자율주행 등이 활성화되면서 성장이 기대되고 있다. 한국의 경우 사기탐지/보안, 의료 비전러닝 등의 분야에서 특허출원 성과가 다소 부족하여 분발이 요구된다.
(Background) Recent biotechnological breakthroughs are shedding new lights on various ethical and legal issues about human biological material. Since Rudolph Virchow, a German pathologist, had founded the medical discipline of cellular pathology, issues centering around human biological materials began to draw attention. The issues involving human biological materials were revisited with more attention along with series concerns when the human genome map was finally completed. Recently, with researches on human genes and bioengineering reaping enormous commercial values in the form of material patent, such changes require a society to reassess the present and future status of human tissue within the legal system. This in turn gave rise to a heated debate over how to protect the rights of material donors: property rule vs. no property rule. (Debate and Cases) Property rule recognizes the donors' property rights on human biological materials. Thus, donors can claim real action if there were any bleach of informed consent or a donation contract. Donors can also claim damages to the responsible party when there is an infringement of property rights. Some even uphold the concept of material patents overtaking. From the viewpoint of no property rule, human biological materials are objects separated from donors. Thus, a recipient or a third party will be held liable if there were any infringement of donor's human rights. Human biological materials should not be commercially traded and a patent based on a human biological materials research does not belong to the donor of the tissues used during the course of research. In the US, two courts, Moore v. Regents of the University of California, and Greenberg v. Miami Children's Hospital Research Institute, Inc., have already decided that research participants retain no ownership of the biological specimens they contribute to medical research. Significantly, both Moore and Greenberg cases found that the researcher had parted with all ownership rights in the tissue samples when they donated them to the institutions, even though there was no provision in the informed consent forms stating either that the participants donated their tissue or waived their rights to ownership of the tissue. These rulings were led to huge controversy over property rights on human tissues. This research supports no property rule on the ground that it can protect the human dignity and prevent humans from objectification and commercialization. Human biological materials are already parted from human bodies and should be treated differently from the engineering and researches of those materials. Donors do not retain any ownership. (Suggestions) No property rule requires a legal breakthrough in the US in terms of donors' rights protection due to the absence of punitive damages provisions. The Donor rights issue on human biological material can be addressed through prospective legislation or tax policies, price control over patent products, and wider coverage of medical insurance. (Conclusions) Amid growing awareness over commercial values of human biological materials, no property rule should be adopted in order to protect human dignity but not without revamping legal provisions. The donors' rights issue in material patents requires prospective legislation based on current uncertainties. Also should be sought are solutions in the social context and all these discussions should be based on sound medical ethics of both medical staffs and researchers.
우리가 살고 있는 세계에는 다양한 네트워크들이 발견된다. 특히, 기술 및 학문과 밀접하게 관련 있는 지식 네트워크는 지식이 생산되는 방식을 이해하는데 도움을 주기 때문에 큰 의미를 갖는다. 이러한 중요성을 바탕으로 지금까지 지식 네트워크를 대상으로 한 많은 네트워크 분석들이 이루어져 오고 있다. 그 중에서 동종성 계수는 네트워크 내의 노드들이 비슷한 성향을 가진 노드들과 연결을 맺으려는 경향 수치로 나타낸다. 동종성 계수가 가지는 이러한 특성은 지식 네트워크로 간주 될 수 있는 키워드기반 특허 네트워크에서 기술이 어떻게 진화하는지 확인 하는데 도움을 줄 수 있다. 왜냐하면 지식 내트워크내 노드로 표현되는 키워드들 간의 관계들이 기술이 만들어지는 구조를 나타내기 때문이다. 본 연구에서는 키워드 네트워크에는 핵심 노드가 존재한다는 기존 연구 결과를 기반으로 두 가지 가설을 세우고 이에 대한 검증으로 동종성 분석을 수행 하였다. 첫 번째 가설은 키워드 기반 특허 네트워크는 시간 흐름에 따라 비동종성을 띌 것으로 예측 하며, 동종성 분석을 통해 특허 네트워크가 진화함에 따라 비동종성을 보이는 것을 확인 하였다. 다음으로, 키워드 기반 특허 네트워크가 비동종성을 보일수록 클러스터링 계수 또한 낮아 질 것으로 예측하는 두 번째 가설에 대한 동종성 분석 결과, 네트워크의 동종성 계수가 낮아질수록 클러스터링 계수 또한 낮아진다는 사실을 확인 할 수 있었다. 또한, 두 번째 가설의 검증과정에서 확인 한 흥미로웠던 결과로써, 동종성 계수가 감소함에 따라 클러스터링 계수가 낮아지는 정도는 네트워크가 동종성을 보일 때 보다 비동종성을 보일 때가 훨씬 높았다.
이 글은 BRCA1과 BRCA2 두 인간유전자에 관련된 특허들에 대한 최근의 소송에서 제기된 인간유전자 특허의 여러 경제적, 법률적, 그리고 윤리적 쟁점들을 분석한다. 기존의 인간유전자 특허관련 연구들이 이의 법률적 논리와 윤리적 정당성에 대한 규범적인(normative) 분석에 초점을 두었다면, 이 글은 BRCA 관련 특허소송에의 기저에는 반공유재의 비극(the tragedy of the anticommons)이라 불리는 지적재산권과 경제혁신, 공공의 이익의 관계에 대한 새로운 이해가 존재하고 있음을 보일 것이다. 첫 부분에서는 2001년 미 특허청의 인간유전자 특허에 대한 정책의 형성과정에 대한 역사적인 분석을, 다음으로는 생명과학에서 지적재산권의 확대를 가져온 여러 경제적 가정들과 제도적 변화, 그리고 법적 판결들에 대한 비판적 논의를 소개할 것이다. 지적재산권의 한계와 생명의 사유화에 대한 비판을 통해서 BRCA 소송은 지적재산권의 정의와 그 범주, 그리고 이의 소유권을 둘러싼 논쟁이 공공의 이익, 과학과 의학 공동체의 창조적 지적활동과 환자들의 인권과 윤리의 문제가 복잡다단하게 얽혀있음을 보여주고 있다.
