Purpose - The study attempted to analyze how the U.S.-China trade dispute affects a highly trade-dependent South Korea. Currently, major domestic and international institutions have issued a number of conflicting predictions that the trade dispute between China and the United States will have a positive and negative impact on South Korea. Accordingly, the present study attempted to analyze using actual data. Design/methodology/approach - The analysis was conducted using actual import and export data from the United States and China and actual import and export data from the United States and China from South Korea. The analysis measured the number and amount of imports and exports by year and month, and the rate of increase and decrease. We also looked at trade dispute days, import and export outcomes and what the impact was. In addition, as a result of the US-China trade dispute, the amount of change in Korea's imports and exports was analyzed. Findings - Empirical analysis shows that South Korea's exports to the United States and China have increased. The analysis results are as follows. First, exports to the United States increased by 5.65% in 2018 and 6.45% in 2019 compared to 2017. Second, exports to China surged 12.34% in 2018 compared to 2017. This increase in South Korea's exports to the United States and its mass exports to the United States shows that South Korea has benefited from the trade dispute between the United States and China. Research implications or Originality - South Korea, which is highly trade-dependent, has been heavily affected by the U.S.-China trade dispute. Various predictions are made about this. The analysis showed that South Korea's export volume has increased. In the end, the effect of the trade transition to the 3rd country did not occur. Rather, the U.S.-China trade dispute appears to have helped South Korea.
미국과 중국의 무역분쟁은 코로나 전부터 시작하고 범유행(pandemic) 속에 새로운 변화를 가져와 이때 완화되고 있는데 중국 제조업 산업 발전으로 미중 무역 간 상호의존도가 높아졌다. 하지만 글로벌 전체 무역량이 팬더믹 전보다 적다. 코로나19 팬더믹 이후 미국과 중국 공급망의 변화에 대한 분석한 다음에 그 상황에 대한 한국의 대응 방안에 대한 구체적으로 제시하고자 한다. 하지만, 요즘 새로운 변화가 다시 일어나고 있다. 2022년 하반기에 중국 상하이에서 코로나19가 발생하면서 중국 산업사슬에 새로운 변화가 일어날 것으로 보인다. 중국 정부가 코로나19 방역수치를 엄격하게 작성하면서 업계 중 상당수 공장과 기업들이 당분간 문을 닫을 수밖에 없는 상황이지만 2023년에 현재 전 세계적으로 나라들이 코로나 상황이 좋아지고 있다. 그 변화하는 상황 속에서 중국은 핵심 과학기술의 연구개발 역도를 강화하고, 국제와 국내의 이중 사이클을 통해 혁신 생태계의 활력을 북돋아 글로벌 공급사슬의 상류로 이동시켜야 한다. 이럴 때 한국은 미국과 좋은 무역동반자 관계를 최대한 유지하면서 공급망에서 장점을 발휘하여 자신의 위치가 확고해야 한다.
Do international economic factors affect the result of gubernatorial elections? This research aims to explain the reasons that local elections are not influenced by international economic factors such as US-China trade dispute. Although previous studies show the mixed results about the relationship between economic factors and gubernatorial electoral outcome, this research argues at least three explanations can be identified. First, there is a perceived gap between the candidates and local voters on the effect of trade disputes. Local voters do not consider the trade dispute as immediate threats, and candidates only use the trade dispute for attacking rivals. Where the functional responsibilities are unclear among elected officials between federal and local government, voters tend to cast votes based on their party identification. In the case of trade policy, functional responsibility is murky between the president and governor; voters may not judge the governor incumbent or candidates on state economic condition.
Global trade protectionism has increased further and U.S. priorities and protectionism have strengthened since Trump took office in 2017. Trump administration is actively implementing tariff measures based on U.S. domestic trade laws rather than the WTO rules and regulations. In particular, the American government has recently been imposing high tariffs due to national security and imposing economic sanctions on other countries' imports. According to the U.S. Trade Expansion Act Section 232, the American government imposed additional tariffs on steel and aluminum imports to WTO member countries such as China, India, and EU etc. on march 15, 2018. Thus, this study aims to investigate whether the U.S. Trade Expansion Act Section 232 is consistent with GATT/WTO rules by comparing the legal basis of US / China / WTO regulations related to Section 232 of the U.S. Trade Expansion Act, and gives some suggestions for responding to the Section 232 measure. As the Section 232 measure exceeded the scope of GATT's Security Exceptions regulation and is very likely to be understood as a safeguard measure. If so, the American government is deemed to be in breach of WTO's regulations, such as the most-favored-nation treatment obligations and the duty reduction obligations. In addition, American government is deemed to be failed to meet the conditions of initiation of safeguard measure and violated the procedural requirements such as notification and consultation. In order to respond to these U.S. protection trade measures, all affected countries should actively use the WTO multilateral system to prevent unfair measures. Also, it is necessary to revise the standard jurisdiction of the dispute settlement body and to explore the balance of the WTO Exception clause so that it can be applied strictly. Finally, it would be necessary for Chinese exporters to take a counter-strategy under such trade pressure.
Over the past 20 years, labor standards have been widely used in free trade agreements. The U.S., the European Union and China have all aggressively signed free trade agreements with their trading partners, developing different styles on labor standards. According to the study, the implementation of the KOREa-EU FREE trade agreement has been hampered by ongoing disputes over the terms of the FREE trade agreement and the ILO since the korea-EU free trade agreement was signed. Because in order to break this deadlock, relevant scholars have done a lot of research, but mainly focused on the economic and trade field. Therefore, this paper for the first time systematically studies the substantive focus of disputes over FTA and ILO clauses, and carefully analyzes the domestic law amended by South Korea, and provides suggestions and inspirations for China by drawing lessons from the revision model of South Korea's domestic law. This is from a newperspective: the essence of the korea-EU FTA and ILO disputes is the conflict between international law and domestic law, and the conflict between free trade agreements and human rights protection. It holds that the essence of disputes should be sorted out from the perspective of legal principles and human rights protection, and the free trade and human rights protection should be actively coordinated. In order to make China more actively integrate into the international economy, China should adopt a positive attitude to revise and perfect its own laws, so as to realize the purpose of common development of international trade and human rights protection.
미·중 무역 분쟁이 시작된 이래로 전 세계의 관심은 물론이고 각 국의 무역에도 영향을 미치게 되었다. 하지만 미·중 무역전쟁은 전통산업의 경쟁에만 국한되지 않았으며 5G 산업의 경쟁도 갈수록 치열해지고 있다. 본 연구는 문헌연구를 중심으로 미국이 중국의 화웨이 회사에게 제재를 가하게 된 심층적인 원인을 분석하였다. 또한 이에 대한 문제점을 파악하고 해결방안을 제시하고자 한다. 미·중 무역 전쟁이 끊임없이 확대되고 빠르게 성장하고 있는 중국 산업은 미국의 산업에 영향을 줄 수 있으며 미국의 제재는 더 강화될 수 있다. 미국의 제재에도 불구하고 중국 5G의 빠른 속도와 효율적인 비용은 중국의 경쟁력을 더욱 높여 주고 있다. 하지만 앞으로 미국의 경제제재 하에서 중국의 5G 산업은 어떻게 생존하고 더욱 발전 할 것인가에 대한 심도 있는 연구가 이루어져야 한다.
This study reports on the Arbitration system in the China International Economic and Trade Arbitration commission (CIETAC) and the International Arbitration problems of Korea and China. The Chines laws including Arbitration laws are influenced by the civil Code system Particulary the German system. China is contracting state of the U N Convention on the Recognition and Enforcement of Foreign Arbitral Awards (1958 New York Convention), which became effective in the China April 22, 1987. International Commercial Arbitration is popular in China. CIETAC is the sole International Commercial Arbitration body in China. CIETAC has two sub-commissions, on is shen zhem S E Z and the other in shanghai. The CIETAC rules, are similar to the rules in effect in Countries using a civil Code system. Both an agreement to submit an existing dispute to Arbitration and an Arbitration clause in a contract relating to future disputes are recognizeal as valiad Arbitration agreements. CIETAC has the power to make a decision on disputes concering the validity of the Arbitration agreements, or jurisdiction over a specicific case.
It is well recognized that the availability of prompt, effective and economical means of dispute resolution is an important element in the orderly growth and encouragement of international trade and investment. Increasingly, arbitration, instead of litigation in national courts, has become the preferred means of resolving private international commercial disputes. Under the situation, it will be important thing for arbitral institutions to reach an agreement to promote the dispute settlement of the commercial disputes, for which efforts have been made between the Korean Commercial Arbitral Board(KCAB) and principal arbitration institutions of the foreign countries. Since 1973, the KCAB has entered into many arbitration agreements with well-known foreign institutions of arbitration. If the place of arbitration is not so designated by the parties, it, as a general rule, shall be the country of the respondent(s) under the Korea-Japanese Arbitration Agreement. On the other hand, the U.S.-Korean Commercial Arbitration Agreement maintains 'Joint Arbitration Committee which finally decide the place of arbitration. In 1996, the Korea-Austria Agreement of Cooperation was concluded for the prompt and equitable settlement on an amicable basis of commercial disputes. Under this Agreement, arbitral institutions between Korea and Austria agreed to act as an appointing authority in accordance with the UNCITRAL Arbitration Rules. It is also very important for Korea and China including North Korea to cooperate each other for the settlement of the commercial disputes within the Pan Yellow Sea Economic Bloc(PYSEB). The PYSEB is quickly becoming a distinctive and crucial region in the world sharing geographical proximity, many common historical experiences, and similar cultural norms and values although they have disparities in stages of development, trade and economic policies, and financial and legal frameworks. Finally, it should be considered to establish a central common system for settlement promotion of the commercial disputes within the PYSEB through the arbitration agreement. Such a dispute resolution system was already introduced and established within the area of the NAFTA, and it is called the Commercial Arbitration and Mediation Center for the Americas(CAMCA).
The scale of global FDI has been decreasing since 2016 due to the ongoing US-China trade dispute, the strengthening of FDI inflow screening regulations with concern over strategic technology leaks, and the spread of reshoring trends due to the reinforcement of national preferences. Eventually, the competition to attract FDI between countries is expected to become more intense. Therefore, in order to attract high-quality FDI for Korea that will contribute to the development of the national economy, it is pressing to evaluate and improve the domestic FDI attraction environment. This study aims to analyze which areas of Korea's economic and non-economic environments need improvement for gaining advantage amid the fierce competition to attract FDI between countries, by the relative comparison between Korea and the U.S., and based on the ranking indicated in key FDI attractiveness indices. As a result, improvement is needed in the following areas. First, according to IMD's "World Competitiveness Ranking 2020," Korea was inferior to the US in terms of business efficiency, productivity, finance and business legislation in terms of government efficiency. Second, according to INSEAD's "Global Talent Competitiveness Index 2020," Korea was inferior to the US in terms of internal openness, external openness, employability, lifelong learning, access to growth opportunity, and business and labor landscapes. Third, according to WEF's "Global Competitiveness Index 2019", Korea was inferior to the US in terms of product market, labor market, business dynamism and workforce skills.
The development of core technologies in the 4th Industrial Revolution, such as artificial intelligence, big data, and the intelligent Internet of Things, promote digital transformation and intelligence of the manufacturing industry. To realize them, there is an increasing demand for materials, components, and equipment needed for final goods. In particular, the expansion of global value chain instability due to changes in the external environment, such as the U.S.-China trade dispute, Japan's export regulations, and Covid-19 pandemic, increases the importance of strengthening the materials, components, and equipment industry in the global market. Thus, this study presents a strategic direction for securing global industrial competitiveness of materials, components, and equipment using Michael Porter's diamond model approach.
