말레이시아 주택의 구분소유권에 관한 탐색연구 (An Exploratory Study of Strata Residential Properties Problems in Peninsular Malaysia and How They are Resolved)

  • This study identifies the common problems faced by the owners of strata titles, the Management Corporation, the Joint Management Body, the Commissioner of Building (COB) as well as the Managing Agent being the stakeholders in managing strata properties. The methods employed are qualitative in nature. Analysis is done based on reports published by the relevant authorities dealing with strata residential properties as well as the case law as reported in the two leading journals in Malaysia such as the Malayan Law Journal and the Current Law Journal. The types and nature of problems are derived from the annual reports. The extent of the problems is determined based on the figures and supported by observation and interviews with the COB, being the agency directly involved in overseeing and monitoring strata properties management. The findings show that a substantial number of problems exist in the management of strata properties despite a law that allows the owners to self-managed their own properties. Having stated the status quo concerning the problems, the study also looks at the various means of resolving disputes as exist under the Malaysian housing system. The study proposes that alternative dispute resolution (ADR) modes are more appropriate in ensuring the sustainability of strata living and management.

한국불교 전통사찰의 건축물공부(建築物公簿)에 관한 연구 -범어사 건축물대장을 중심으로- (A Study on the Official Building Register of Korean Traditional Temple - Focused on the Official Building Register of Beomeo-sa -)

  • This thesis is to analyze the origin and transformation of the official building registers of Korean traditional temples, and also to suggest the amendment of their wrong archives. Especially, this study is to examine these subjects focused on Beomeo-sa which has maintained fine registers. The results are as follow; 1. In Chosun Dynasty, the Ip-an had been used, and in the period of Daehan-Empire, the Ga-gei had been used as each official registers for the common buildings. The other hand, the lists of properties and the legal registers had been used as official registers for the temple buildings between 1911 and 1962. 2. The current official building registers have been firstly recorded under in 1962. At that time, the current official registers have been also recorded for the Buddhist temple buildings. 3. Most of the official building registers of Buddhist temples are incomplete. Especially, these have usually the indistinct building names and wrong building areas. These were mainly caused by direct copying of the old registers recorded in 1956, the period of Buddhist confusion. Furthermore, the registers have been poorly operated by monks and offices. 4. Therefore, the registers has to be corrected as follow; The omitted buildings have to be added and the duplicated buildings have to be removed in the summary heading registers. The indistinct building names recorded in 1956 have to be correct into actual proper building names. The wrong building areas recorded in 1956 have to be correct into actual measurement building areas.

주상복합건물의 감리제도 개선방안과 기대효과 (Improvement and Expected Effect of Construction Supervision System for Mix-Use Residential Building)

  • 최근 건축물이 사용성, 효율성, 규모 측면에서 다양하게 변화함에 따라 건설공사의 품질은 더욱 중요하게 인식되고 있다. 1962년에 도입된 감리제도는 공공부문에서는 발주자의 위임을 받은 공사감리자에 의해 공사단계에서 확인 또는 지시로 목표품질을 확보하고자 정부는 1994년에 건설기술관리법 개정을 통해 책임감리제도를 도입하였고, 민간부문 중 공동주택의 부실공사를 방지하고자 주택건설촉진법을 개정하여 공사감리제도를 강화하는 등 공사관리의 효율성과 품질의 향상을 가져왔다. 도심기능의 재정비를 위한 차원에서 재개발 사업의 한가지 유형으로 고층화된 주상복합건물이 도입되면서 여러 형태적 사회적 요구에 따른 제도적 변화가 지속되어 왔다. 정부는 주택시장 안정을 위해 300세대 이상의 주택을 건설하는 경우 해당 주상복합건물에 대해 주택법을 적용하도록 관련 법령을 개정하였다. 그러나 이러한 관련법령의 개정사항은 건축법에 의한 감리대상 건축물 중 일부에 한정되어 왔다. 따라서 현행 감리관련 법령 및 제도는 고층화 추세에 따라 다양하고 복잡한 주상복합건물의 공사진행 과정을 효과적으로 감리하기에는 미흡하다고 할 수 있다. 이에 본 연구는 기존 감리제도에 관한 연구와 공사참여자 및 입주자의 설문조사를 바탕으로 주상복합건물의 감리제도의 개선방안을 제안하고 그에 따른 기대효과를 제시하였다.

  • Apartment building, which has been accompanied by economic growth in Korea, is a home of life and has the value overlapping as housing and assets. The improvement of consumer's eye level and development of related technology and related service development have positive function that enriches society and creates economic wealth. On the other hand, the clash and conflict between stakeholders increase social unrest and waste our competitiveness by economic loss. The term of warranty liability of apartment building is an important issue of defect lawsuits and is only a few quantitative standards. However, in this study, we examined the revision history of the law and ordinances for the reinforced concrete construction. As a result, establishing and revising the relevant standard, there is no definite basis system to support it. To improve this, the efforts to provide the standard for term of warranty liability and quantitative and objective basis to support it should be accompanied continuously.

공동주택 하자보증금 청구소송에 의한 하자담보책임기간 연구 (A Study on the Term of Warranty Liability by the Law-suit Requesting of the Guarantee against Defects in the Apartment Building)

  • The purpose of this study is to contribute to solution of the defect dispute in apartment house in advance. We want to propose the improved devices in defect problems by investigating the money that exacted from the practical business of the inspection company and the money that a judge gave a decision in a civil court in 50 cases of the lawsuit to requesting the guarantee against defects and the improved schemes of the applied rate by analyzing the diagnosis money of each applied years about the term of warranty liability in 40 cases of the lawsuit separately from that. As the result, we have to reflect the defect of non construction and error construction on apartment building defects, which recognizes very important factor when we compute the defect repair warranty money and it needs to be rearranged the applied ratio in guarantee peried of housing law practically.

  • Green building information used by the AEC industry is diverse and extensive), causing difficulties for personnel regarding the collection and utilization of information in the form of inaccurate searches about related laws, inefficient management of searched information and overlapping works. Therefore, this research aims to propose a law search system utilizing metadata for more accurate and efficient searches of green building information. The proposed system is expected to contribute to improve productivity of construction projects by reinforcing the accuracy and efficiency of searches for the collection and utilization of green building information.

PV 시스템이 설치된 대학건물의 전력 생산에 따른 신재생에너지 공급비율 분석 (The analysis of the renewable energy supply ratio for the school building applied PV system)

  • Recently the renewable energy has been used widely and the importance of renewable sources is bigger than before. And the government enforced a law to the public buildings to install the renewable energy facilities. The capacity of facilities was 5% of total construction cost until April 13, 2011. Since then, the government changed the law from 5% of total construction cost to 10% of predicted energy usage for the resonable use of the renewable energy facilities. In this study, the comparative analysis is conducted according to the law to the building installed PV system through the Energy Plus simulation. And the method for improving renewable energy supply ratio was analyzed using existing PV array. Adjusting the PV array angle is the best way to generate more electric power without additional fee. When applying the month optimum angle, 3,600kWh of electric power are more generated compared to the existing angle.

Present State of Membrane Structures in Japan

  • Formerly, it was called a tent and now, it is called membrane structure. If saying a tent, it imagines the tent of Bedouin, Mongolia and North American Indian. It became clear from the excavated wall painting that have been covered with the retractable roof of the canvas on the auditorium at the amphitheater in Pompeii and became a topic. These tents were made of the animal skins or fabric woven with the flax plants, and these tents are still used. However, if saying membrane material at present, it says the one to have applied a coating resin to the textile. Because the base fabric of membrane material is a woven fabric, the relation between the stress and the strain is different to the direction of the weaving thread. Moreover, the tensile force must always occur in the membrane surface. From these reasons, because the membrane structure corresponds to the particular building material and the construction method about the Building Standard Law, it must be examined specially that the membrane structural building have the same or any more safety as the provisions which was set to the Building Standard Law. Therefore, the technical standards about the membrane structural building became indispensable. In the paper, the kinds of the membrane materials, which are used for the membrane structural buildings, and technical standards process of the creating for the membrane structure buildings are introduced. Lastly, some of the soccer stadiums for 2002 FIFA World Cup KOREA/JAPAN which be covered with the roof of the membrane structures are presented.

우리나라 피난방화규정의 제.개정시기별 화재안전성능 평가 - 호텔건물을 중심으로 - (A Study on Evaluating the Fire Safety of the Regulation of Escape and Fire-Prevention from Enacting to Now - Focusing on the Hotel Building -)

  • 우리나라의 피난방화규정은 1962년 건축법 제정 이후 현재에 이르기까지 많은 변화를 겪어 왔다. 그러나, 과거에 비해 화재안전성능이 어느 정도 개선되었는지, 그리고 현재의 규정은 어느 정도의 화재안전성능을 확보하고 있는지에 대한 정량적인 평가가 이루어지지 않고 있다. 이 연구에서는 과거 화재사례로 비추어 화재발생시 인명피해가 높을 것으로 예상되는 숙박시설 중 호텔건물을 모델로 하여 피난방화규정의 제/개정 시기별 화재안전성능을 평가해 보았다. 그 결과 과거에 비해 화재안전성능이 개선되고는 있으나, 특히 저층부분에서의 거실 및 층피난안전성에서 취약함을 확인할 수 있었다. 숙박시설의 경우 재실자의 화재 인지가 늦어 피난시간이 상대적으로 지연되는 문제점이 있기 때문에, 내부마감재료와 방화문 그리고, 방화구획(면적별/층별) 등의 규정을 보완하여 연기층하강시간을 지연시킬 수 있는 현실적인 방안을 마련 할 필요가 있다.
