  • Currently, it is the general trend that the party's autonomy principle is applicable in determining the applicable law for the international private law and the international commercial arbitration. The purpose of this article is to make research on the party's autonomy principle for the international commercial arbitral awards. For this purpose ist to analyse regal issue the applicability of the lex mercatoria and the possibility of $d\acute{e}pe\c{c}age$ relating to the party autonomy. In this Article ist dealt with Art. 29 para. 1 of the Korean Arbitration Act in comparison with Art. 28 para. 1 UNCITRAL Model Law and Art. 1051 para. 1 of the German Code of Civil Procedure. The Art. 28 para. 1 UNCITRAL Model Law and Art. 1051 para. 1 of the German Code of Civil Procedure provides equally. "The arbitral tribunal shall decide the dispute in accordence with such 'rules of law' as chosen by the parties as applicable to the substance of the dispute. Any designation of the law or legal system of a given State shall be construed, unless otherwise expressed, as directly referring to the substantive law of that State and not to its conflict of laws rules." The term 'rule of law' used to describe the applicability of the lex mercatoria and the possibility $d\acute{e}pe\c{c}age$. Unlike Art. 28 para. 1 UNCITRAL Model Law and Art. 1051 para.1 of the German Code of Civil Procedure. Act, Art. 29(1) of the Korean Arbitration Act provides that the arbitral tribunal shall decide the dispute in accordence with the 'law' chosen by the parties as applicable to the substance of the dispute. However the majority view in Korea takes the position that the term 'law' should be interpreted broadly so as to encompass 'rules of law' at UNCITRAL Model Law and the German Code of Civil Procedure.

  • This paper explains about general considerations and project management for a State of the Art utility supervisory systems. [1] The implementation and management of a supervisory system design project requires both a dedication of resources and application of good communications in order to be suc-cessful. [2] Success is on time delivery of a system to a satisfied customer at the proposal cost, [3] The recent experience of a company plus the collected comments from a number of ex-perienced control center project management provide a guideline for the company who is considering such a project. The Comments reflect typical situations or decision points faced by the project Manage.[2] This paper also attempts to help engineers in the task of specifying buying, and instal-ling a supervisory system[1]

  • Semiactive control systems have received considerable attention for protecting structures against natural hazards such as strong earthquakes and high winds, because they not only offer the reliability of passive control systems but also maintain the versatility and adaptability of fully active control systems. Among the many semiactive control devices, magnetorheological (MR) fluid dampers comprise one particularly promising class. In the field of civil engineering, much research and development on MR fluid damper-based control systems has been conducted since B. F. Spencer first introduced this unique semiactive device to civil engineering applications in mid 1990s. In 2001, MR fluid dampers were applied to the full-scale in-service civil engineering structures for the first time. This state-of-the-art paper includes a detailed literature review of control algorithms considering the characteristics of fm fluid dampers. This review provides references to semiactive control systems using MR fluid dampers. The MR fluid damper-based semiactive control systems are shown to have the potential for mitigating the responses of full-scale civil engineering structures under natural hazards.

  • This paper provides a state-of-the-art review on advanced analysis models for investigating the load-displacement and ultimate load behaviour of steel and composite frames subjected to static gravity and lateral loads. Various inelastic analysis models for steel and composite members are reviewed. Composite beams under positive and negative moments are analysed using a moment-curvature relationship which captures the effects of concrete cracking and steel yielding along the members length. Beam-to-column connections are modeled using rotational spring. Building core walls are modeled using thin-walled element. Finally, the nonlinear behaviour of a complete multi-storey building frame consisting of a centre core-wall and the perimeter frames for lateral-load resistance is investigated. The performance of the total building system is evaluated in term of its serviceability and ultimate limit states.

  • We provide a fudamental set of information on technologies in the area of mechanical engineering to draw action plans for intermationalization of the National R&D activites. First, we design and use a modified Delphi method to evaluate levels of our technological capabilities and developed countries' as well. We investigate technology acquistion methodolgies, technology characteristcs and various aspects of international cooperation in terms of technology. Secondly, we analyze final responses of participants (i.e,. the third round results of Delphi method) tosee the correlation between various factors in developing mechanical engineering technologies through international cooperation. The technology classification used in this research is developed by STEPI (Science and Technology Policy Institute).

  • In this paper, we describe a novel method for document layout analysis that is based on a Fuzzy Energy Matrix (FEM). A FEM is a two-dimensional matrix that contains the likelihood of text and non-text and is generated through the use of Fuzzy theory. The key idea is to define an Energy map for the document to categorize text and non-text. The proposed mechanism is designed for execution with a low-resolution document image, and hence our method has a fast processing speed. The proposed method has been tested on public ICDAR 2009 datasets to conduct a comparison against other state-of-the-art methods, and it was also tested with Korean documents. The results of the experiment indicate that this scheme achieves superior segmentation accuracy, in terms of both precision and recall, and also requires less time for computation than other state-of-the-art document image analysis methods.

  • Seismic probabilistic risk assessment(RA) rather than deterministic assessment provides more valuable information and insight for resolving seismic safety issues in nuclear power plant design. In the course of seismic PRA seismic fragility analysis is the most significant and essential phase especially for structural or mechanical engineers. Lately the seismic fragility analysis is taken as a useful tool in general structural engineering as well. A systemized and synthesized procedure or technology related to seismic fragility analysis of critical industrial facilities reflecting the unique experiences and database in Korea is urgently required. This paper gives a state-of-the-art reviews of PRA and briefly summarizes the technologies related to PRA and seismic fragility analysis before developing an unique technology considering characteristics of Korean database. Some key items to be resolved theoretically or technically are extracted and presented for the future research.

  • Permanent magnet brushless DC (PMBLDC) motors are the latest choice of researchers due to their high efficiency, silent operation, compact size, high reliability and low maintenance requirements. These motors are preferred for numerous applications; however, most of them require sensorless control of these motors. The operation of PMBLDC motors requires rotor-position sensing for controlling the winding currents. The sensorless control would need estimation of rotor position from the voltage and current signals, which are easily sensed. This paper presents state of the art PMBLDC motor drives with an emphasis on sensorless control of these motors.

  • This paper reports on the state-of-the-art of the main non-destructive assay (NDA) techniques usually used for in-situ radiological characterization of nuclear facilities subject to a decommissioning programme. For the sake of clarity and coherence, they have been classified as environmental radiation monitoring, surface contamination measurements, gamma spectrometry, passive neutron counting and radiation cameras. Particular mention is also made here to the various challenges that each of these techniques must currently overcome, together with the formulation of some proposals for a potential evolution in the future.
