A Study on Export Bond Insurance as a Security for Independent Bank Guarantee in International Transactions (국제거래에서 독립적 은행보증서에 대한 담보장치로서의 수출보증보험에 관한 연구)

  • An independent bank guarantee(aka an independent guarantee) is provided as an security on a principal obligor's performance of his obligation, and a guarantor should pay the guaranteed amount only upon a beneficiary's written demand. A standby letter of credit has been used in the United States, since it was construed that a bank should not issue a guarantee. There was wide misunderstanding that a standby letter of credit differs from an independent bank guarantee. However, a standby letter of credit is the same security as an independent bank guarantee, and in international business a standby letter of credit is not differentiated from a independent bank guarantee. An independent bank guarantee are independent from the underlying contract, unconditional, and irrevocable. And a guarantor should pay upon written demand without proving a principal obligor breaches the underlying contract. These features of an independent bank guarantee has been abused in international transactions. Thus it has been proposed that some exceptions to the features of an independent bank guarantee should be allowed. United Nations Convention on Independent Guarantees and Standby Letter of Credit(1995) stipulates some exceptions to payment obligation. Export bond insurance, a part of export insurances, operated by the Korea Export Insurance Corporation under the Export Insurance Act, is used as a security for unfair calling by a beneficiary under an independent bank guarantee. Most of the export subsides by the government are prohibited under WTO's Agreement on Subsidies and Countervailing Measures. However, as export insurance is allowed under the WTO, it operates a significant role in enhancing the export. In the event that export bond insurance is provided for a guarantor, an obligor who is subject to recourse by a guarantor, can be exempt from the recourse in case of unfair calling. The Korea Export Insurance Corporation, an insurer, bears unfair calling risk by a beneficiary. Generally it is understood that a demand shall be made before the expiry of an independent bank guarantee. However this is not absolutely true, it shall be decided by URDG, ISP98, the governing law.

  • Recently, with the development of IoT technology, there has been an increase in interest in the power consumption of the devices used by the internal devices. Especially, the standby power consumption during the main function of the devices is about 11% of the power energy and the problem of standby power interruption is suggested. However, there is a problem that the plug must be unplugged in order to substantially shut off standby power. Therefore, in this paper, we design and implement a standby power cutoff algorithm that can automatically control and manage users' participation in order to solve there problems. As a result of evaluating the implemented system, it was confirmed that the standby power interruption rate improved by about 5.89Wh on average compared to the existing system.

  • Since January 1, 1999, traders, bankers and their counsels worldwide have available for their use the first set of rules exclusively dealing with standby letters of credit:the International Standby Practices(ISP98). Numerous standbys have alreadby been issued in the United States and worldwide subject to the new ISP. The international banking community is anticipating an increasing demand from their customers to issue ISP-governed undertakings. Before the adoption of ISP, traders and bankers had only the choice of issuing their standby subject to the International Chamber of Commerce's(ICC) Uniform Customs and Practices for Documentary Credits(UCP) and, to a much lesser extent, to the ICC's Uniform Rules for Demand Guarantees(URDG). However, practice showed that UCP rules are not easily adapted to regulate transnational standbys. Indeed, UCP was conceived to govern documentary credits, which are intended to serve as a means of payment. By contrast, standbys are means of guaranty. The core of UCP cannot therefore be appropriate for standby practices and, as a consequence, a number of UCP's provisions have to be excluded in the standby's text. UCP's shortcomings indicated above fulfil the requirements of a key factor for the success of uniform rules. Indeed, to achieve success in the sense of meeting the market's acceptance, any such rules should fill a widely recognized need expressed by merchant community to which such rules are addressed. The ISP cleary has such a vocation. Nonetheless, the already largely encumbered regulatory environment of guarantee devices can hardly go unnoticed. The question therefore arises as to the proper place of ISP in such a context.

  • A Power Management System(PMS), which provides the functions of automatic detection and cutoff of home appliances' standby power without user intervention, is presented in this paper. A client in this system measures the power consumption of a home appliance plugged in it and transmits the information to a server in real-time over a wireless network. The server analyzes the features of the power consumption of home appliances and detects if any home appliance consumes standby power. The detected standby power information is used to create the information of the home appliance and to build a database, which will finally offer the automatic detection and cutoff of the standby power without any configuration through user intervention.

  • Recently, as the interest in power saving increases with the development of IoT technology, research on power saving of smart devices, which are being miniaturized, is being actively conducted. In particular, due to the diversification of IoT-based smart devices and the increase in personal penetration rate, the issue of standby power even when not in use is increasing. However, there is a drawback of physically unplugging the outlet or turning off the power in order to substantially reduce standby power. Since Zigbee is used instead of the existing IP, it is necessary to change to the IoT standard protocol based on the Internet network. Therefore, this paper designed and implemented the standby power saving system applying CoAP, the IoT standard protocol, to the existing Zigbee technology. Existing systems and evaluations confirmed that the average standby power of about 8.4Wh was reduced.

  • A study on electrical and electronic equipment will occur in the atmosphere, which is essential to cut the power to prevent the waste of power by power measurement technology development and to develop the technology to do this operation is the main core of standby power to detect and block it and return the configured for software and hardware, while the actual construction to ensure stability through field testing and debugging of problems improved accordingly, as well as ease of installation and so it could be done while the test. In addition, in terms of basic hardware switching of standby power when blocking, reducing stress and ensure stable operation and circuit design, power off and back to ensure stable operation even when a protection circuit is applied.

  • Recently, although the power consumption of the flyback converter at the light load and standby power load was minimized by the burst mode operation of PWM IC, flyback converter has still the low efficiency characteristics by the high magnetizing current flowing through magnetizing inductance of transformer. This paper proposes a novel flyback converter with an improved efficiency characteristics and the reduced magnetizing current at the light load and standby power load. Prototype of the 70W multi-output flyback converter for an auxiliary power module of 50 inch PDP TV is built and the experimental results are described.

  • This paper presents the self-oscillating flyback converter for reducing standby power without a control-IC. The proposed self-oscillating flyback converter includes a DC-Blocking capacitor for reducing constant power loss of initial switching path of a conventional self-oscillating flyback converter. it's possible to reduce the standby power to 1W and power efficiency. To confirm the validity of proposed system, comparison of conventional system, verification of experimental results is presented by realization of 35W power system.

  • This paper deals with the reliability and availability characteristics of three different series system configurations with warm standby components and a repairable service station. The failure time of the primary and warm standby are assumed to be exponentially distributed with parameters ${\lambda}$ and ${\alpha}$ respectively. The repair time distribution of each server is also exponentially distributed with parameter ${\mu}$. The breakdown time and the repair time of the service station are also assumed exponentially distributed with parameters ${\gamma}$ and ${\beta}$ respectively. We derive the reliability dependent on time, availability dependent on time, the mean time to failure, $MTTF_i$, and the steady-state availability $A_i$(${\infty}$) for three configurations and perform comparisons. Comparisons are made for specific values of distribution parameters and of the cost of the components. The three configurations are ranked based on: $MTTF_i$, $A_i$(${\infty}$), and $C_i/B_i$ where $B_i$ is either $MTTF_i$ or $A_i$(${\infty}$).
